The marine employer must have a sufficient number of alcohol testing devices readily accessible on board the vessel to determine the presence of alcohol in the system of each individual who was directly involved in the SMI. Vessel representative could not provide testing devices on board the vessel. Obtain sufficient number of alcohol testing devices to satisfaction of Marine Inspector prior to carrying passengers. 46CFR185.212 46CFR4.06-15(a)

No marine employer shall engage or employ any individual to serve as a crewmember unless the individual passes a chemical test for dangerous drugs for that employer... Marine employers shall establish programs for the chemical testing for dangerous drugs on a random basis of crewmembers on inspected vessels. Vessel's mate could not produce evidence of pre-employment drug testing or proof of enrollment into consortium or employer based drug testing program. Provide evidence of Mate's enrollment into random drug testing consortium or employer based program to satisfaction of Marine Inspector prior to engaging in employment on the vessel. 46CFR16.210(a) 46CFR16.230(a)

A vessel must undergo an Annual Inspection within the 3 months before or after each anniversary date. Vessel was due for COI annual inspection on 04AUG2024 and has yet to contact the cognizant OCMI to schedule an inspection. Vessel shall not operate with passengers until inspection is conducted and COI is amended. 46 CFR 176.500(b)(1); 701c

A vessel that is exposed to salt water more than three months in any 12 month period since the last examination must undergo a drydock examination and an internal structural at least once every two years. Vessel was due for drydock examination on 31JUL24 and has yet to receive a drydock exam. 46CFR176.600(c)(1)

Except as noted in paragraph (c) of this section, stations in the maritime service must be licensed by the FCC either individually or by fleet. MI observed the vessel was unable to provide proof of a valid station license. Vessel is limited to operations within 1000 feet of shore. 47 CFR 80.13(a)

A vessel to which this subchapter applies may not be operated without having on board a valid U.S. Coast Guard Certificate of Inspection. Vessel was due for an annual inspection between 04May23-04Nov23 and has yet to receive a annual inspection. 46 CFR 176.100

The construction and arrangement of a vessel must allow the safe operation of the vessel in accordance with the terms of its Certificate of Inspection. Each pontoon compartment shall be fitted with hull inspection ports easily accessible from the deck. The inspector found six of the twelve inspection covers inaccessible due to the construction and arrangement of the vessels fixed seating. 46 CFR 177.100 MPS-WI-SECSP(spi)-21

The number and identification of the life jackets stowed inside, and their sizes, must be marked in clearly legible letters and numbers on each container for life jackets. Inspector found the lifejackets stored in an unmarked location. 46 CFR 185.604 (f)

Every vessel must be fitted with a suitable magnetic compass designed for marine use, to be mounted at the primary operating station. Inspector found the magnetic missing from the operating station. 46 CFR 184.402 (a)

Portable fire extinguishers must be located so that they are clearly visible and readily accessible from the space being protected. The installation and location must be to the satisfaction of the Officer in Charge, Marine Inspection. Inspector found the fire extinguisher location not labeled and the bracket missing inside the operators seat storage area. 46 CFR 181.520

In addition to adult life jackets a number of child size life jackets equal to at least 10% of the number of persons permitted on board must be provided, or such greater number as necessary to provide a life jacket for each person being carried that is smaller than the lower size limit of the adult life jackets provided to meet this section. Inspector found two child size life jackets on board. Three child size life jackets are required. 46 CFR 180.71 (b)

Overcurrent protection must be provided for each ungrounded conductor for the purpose of opening the electric circuit if the current reaches a value that causes an excessive or dangerous temperature in the conductor or conductor insulation. Inspector found no overcurrent protection for the stereo. Wiring did not match MSC approved drawing. 46 CFR 183.380

Conductors in power and lighting circuits must be No. 14 American Wire Gauge (AWG) or larger. Inspector found unapproved wire between the buss and fuse for the Garmin navigation equipment and VHF radio. Wiring did not match MSC approved drawing. 46 CFR 183.340(c)
