Subject to regulation 3o of this annex, in the ECA designated for TIER III noxx control, the operation of the marine diesel engine that is installed on the ship must operate within the emissions limits of nitrogen oxides delineated in MARPOL ANNEX VI/13.5.1.1 when that ship is constructed on or after 01 January 2016 & Operating in the ECA.
Vessel can not meet ECA Tier III Nox emission requirements for their main engine due to a fault with the main engine's fuel injection system.

Subject to regulation 3 of MARPOL Annex VI, in an emission control area designated for Tier III NOx control under paragraph 6 of MARPOL Annex VI/13, the operation of a marine diesel engine that is installed on a ship is prohibited except when the emission of nitrogen oxides from the engine is within the limits listed in MARPOL Annex VI/13.5.1.1.1.1-.3 when that ship is constructed on or after 01 January 2016 and is operating in the North American Emission Control Area (ECA).
Improper function of main engine water injection and emulsification system renders main engine system from operation in Tier III mode inoperable. Vessel is only capable of maintaining the main engine in Tier II mode in regard to NOx emissions while operating in the North American ECA. Vessel is awaiting parts from manufacturer.
