Subject to regulation 3 of this Annex, in an emission control area designated for Tier III NOx control under paragraph 6 of this regulation, the operator of a marine diesel engine that is installed on a ship: is prohibited except when the emission of the nitrogen oxides from the engine is within the following limits: 3.4 g/kWh when n is less than 130 rpm. Vessel has reported an inoperative main engine Exhaust Gas Recirculation unit; due to this fault, vessel's main engine is unable to operate in Tier III mode or meet Tier III NOx limits as required for the North American ECA.
