The company and the ship shall comply with the requirements of the International Ship Management Code. For the purpose of this regulation the requirement of the code shall be treated as mandatory. The company should establish procedures to ensure that the ship is maintained in accordance with the provisions of the relevant rules and regulations established by the company. The technical and/or operational nature of the deficiencies noted below provide objective evidence of a serious failure of the implementation of the ISM Code. An external ISM audit report, satisfactory to the Coast Guard, must be submitted prior to clearance of this deficiency and departure.

PSCO's observed oil-soaked lagging and missing lagging from high temperature pipes throughout the engine room specifically in the oil-purifier room and in the vicinity of the main engine.

Oil filtering equipment referred to in this regulation shall be such as will ensure that any oily mixture discharged into the sea after passing through the system has an oil content not exceeding 15 ppm. During the operational test, PSCO's observed a leak emanating from the oil filtering equipment rendering it inoperable. Leak has been present for 14 days.

Drills shall, as far as practicable, be conducted as if there were an actual emergency. The crew demonstrated a lack of competency during the fire drill when a fire party team member entered the affected area with a malfunctioning SCBA.

Resolution: Following the failed fire drill the malfunctioning SCBA was taken out of service and replaced. PSCO's had the crew test three additional SCBAs and the fire drill was conducted again with no issues.
