SECOND WIND

Any vessel of at least five net tons which engages in the fisheries on the navigable waters of the United States or in the Exclusive Economic Zone, or coastwise trade, unless exempt under § 67.9(c), must have a Certificate of Documentation (COD) bearing a valid endorsement appropriate for the activity in which engaged. Vessel did not have a current COD. COD on board was expired in March 2025. 46CFR67.7 701c

The owner, charterer, master or managing operator shall instruct each crew member, upon first being employed and prior to getting underway for the first time on a particular vessel and at least once every three months, as to the duties that the crew member is expected to perform in an emergency including, but not limited to, the emergency instructions listed on the emergency instruction placard required by § 185.510 of this part and, when applicable, the duties listed in the station bill required by § 185.514 of this part. MI observed a lack of crew knowledge for the vessel type (Parasail). Vessel must have a qualified captain and crew for the vessel type prior to carrying passengers. 46CFR185.420

A vessel must comply with the applicable requirements for any radio and Electronic Position Indicating Radiobeacon (EPIRB) installations, including the requirements for a station license and installation certificates to be issued by the Federal Communications Commission, as set forth in 47 CFR part 80. Vessel did not have Safety Radiotelephony Certificate. Vessel restricted to 1000 ft from shore. 46CFR184.502

An exposed hazard, such as gears or rotating machinery, must be properly protected by a cover, guard, or rail. MI observed an uncovered rotating shaft in the engine machinery space. Vessel must submit a proposal to rectify within 7 days. 46CFR177.960

Each child size life jacket must be stowed in a location that is appropriately marked and separated from adult life jackets so the child size life jackets are not mistaken for adult life jackets. Vessel must rectify within 7 days. 46CFR180.78(a)(5)

Remote fuel shutoff stations must be marked in clearly legible letters at least 25 millimeters (1 inch) high indicating purpose of the valve and direction of operation. Vessel did not have the direction of operation clearly marked. Vessel must rectify within 7 days. 46CFR185.608

Owner/Operator of vessel must conduct new to zone inspection prior to carrying passengers.
