The master, owner, operator, agent, or person in charge of a vessel equipped with ballast tanks that operates in the waters of the United States must employ one of the following ballast water management methods listed in 33 CFR 2025(a). Vessel's ballast water management system is inoperable. Vessel has been granted an extraordinary circumstance to employ the ballast water management method listed in 33 CFR 151.2025(a)(3) to conduct cargo operations while in the Sector New Orleans COTP Zone. In accordance with 33 CFR 151.2040(b)(3), the vessel must discharge only that amount of ballast water operationally necessary to ensure the safety and stability of the vessel for cargo operations.
