The company and the ship shall comply with the requirements of the International Safety Management code. The Company should establish procedures to ensure that the ship is maintained in conformity with the provisions of the relevant rules and regulations and with any additional requirements which may be established by the company. The company should periodically verify whether all those undertaking delegated ISM-related tasks are acting in conformity with the company's responsibilities under the Code. The company should periodically evaluate the effectiveness of the safety management system in accordance with procedures established by the company. The audits and possible corrective actions should be carried out in accordance with documented procedures. The technical and/or operational nature of deficiencies 02, 03, 04, and 5 provide objective evidence of a serious failure, or lack of effectiveness, of the implementation of the ISM Code. An external safety management audit, and external Document of Compliance audit with a corresponding report of findings satisfactory to the Coast Guard is required. 74 SOLAS (20) IX/3.1 ISM Code/10.1 20bc

Every ship when in a port of another Contracting Government is subject to control by officers duly authorized by such Government in so far as this control is directed towards verifying that the certificates issued under regulation 12 or 13 are valid. During external safety management audit PSCO observed Horizon Bureau of Shipping issued a new Cargo Ship Safety Construction Certificate which had a validity of 7 years. 74 SOLAS (20) I/19 (a) 20bc

When a nominated surveyor or recognized organization determines that the condition of the ship or its equipment does not correspond substantially with the particulars of the certificate... such surveyor or organization shall immediately ensure that corrective action is taken and shall in due course notify the Administration. PSCO observed that the Interim Cargo Ship Safety Construction Certificate did not have the most recent drydock date listed. 74 SOLAS (20)1/6.C 20bc

An Interim Safety Management Certificate should be issued for a period not exceeding six months by the Administration or an organization recognized by the Administration. PSCO observed back-to-back issued Interim Safety Management Certificates and the vessel has been operating under an Interim Safety Management Certificate since 14 Feb 2024. 74 SOLAS (20) IX/3.1 ISM Part B/14.2 20bc

An Interim Safety Management Certificate should be issued for a period not exceeding six months by the Administration or an organization recognized by the Administration. PSCO observed Interim Safety Management Certificate was issued 14 FEB 2024 till 13 FEB 2025 (12 months) and subsequent current Interim Safety Management Certificate was issued for six months. 74 SOLAS (20) IX/3.1 ISM Part B/14.2 30bc

An external safety management audit, with a corresponding report of findings satisfactory to the OCMI must be submitted prior to clearance of this deficiency and release from detention. 74 SOLAS(2020) IX/3.1: ISM code/10.1

All electrical apparatus shall be so constructed and so installed that danger of injury in ordinary handling shall not exist. PSCO observed residential air conditioning units located in the crew cabins with exposed and in-proper electrical wiring installation posing serious electrical and fire safety hazard. 74 SOLAS II-1/27.(a)(i)(l)

The international load line certificate shall not be delivered to the ship until the officer acting under the provisions of Article 13 of the present convention has certified that the marks are correctly indicated on the ships sides. PSCO observed the vessels starboard load line does not match the load line listed on the ILLC.

After any survey of the ship under Regulation 10 of this Chapter has been completed, no change shall be made in the structural arrangements, machinery, equipment, etc. covered by the survey, without the sanction of the Administration. PSCO observed unapproved modifications, by way of cut-outs, to the doors of the crew cabins leading out into the main passageway. Cut-out were fitted with residential air conditioning units. 74 SOLAS (20) I/11

Ships shall be provided with means of making effective distress signals by day and by night, including at least twelve parachute signals. PSCO observed that all 12 rocket parachute flares on board were expired. 74 SOLAS III/24

Life buoys shall be fitted with beckets securely seized. PSCO observed that 05 life buoys had dry rotted beckets attached. 74 SOLAS III/21.D

Cold fresh water and hot fresh water available in all wash spaces. PSCO observed that the vessel does not have hot fresh water available onboard. PWSA 33 USC 1223(b) ILO 147 pg 37 21.c

After any survey of the ship under Regulations 7, 8, 9, or 10 of this chapter has been completed, no change shall be made in the structural arrangements, machinery, equipment, etc. covered by the survey, without the sanction of the administration. PSCO observed that a rescue boat is not required under 74 SOLAS III. However, the vessel's work boat is incorrectly listed on the interim Cargo Ship Safety Equipment Certificate as a rescue boat. 74 SOLAS (20) 1/11

Oil filtering equipment referred to in paragraph 1 of this regulation shall be of a design approved by the Administration and shall be such as will ensure that any oily mixture discharged into the sea after passing through the system has an oil content not exceeding 15 ppm. PSCO observed that the vessel had removed the OCM for repairs and put the OWS out of service without notifying Flag/Class. MARPOL I/14.6 17c

Efficient Guard rails or bulwarks shall be fitted to all exposed parts of the freeboard and superstructure decks. PSCO observed 04 sections of heavily corroded railing. ICLL 25.2 16c

The International Load Line Certificate (1966) shall not be delivered to the ship until the officer acting under the provisions of article 13 of the present convention has certified that the marks are correctly indicated on the ship's sides. The vessel's load line does not match the ILLC load line. ICLL9 16c

Before the ship leaves port and at all times during the voyage, all lifesaving appliances shall be in working order and ready for immediate use. PSCO observed 03 lifebuoys in poor condition, 01 lifebuoy without reflective tape, and 01 lifebuoy without an operable light. 74 SOLAS III / 4.19.2 16c

The rings, lines and letters shall be painted in white or yellow on a dark ground or in black on a light ground. They shall also be permanently marked on the sides of the ships to the satisfaction of the Administration. PSCO observed deteriorated condition of the load line markings. Load line markingswere not in contrasting colors to the hull and did not matched the markings in the Load Line Cert.
