Pursuant to 33 U.S.C. §§ 1251-1376 (c), 33 U.S.C. §§ 1251-1376 (e)(1)(B), 33 C.F.R. § 1.01-80, and 40 C.F.R. 300.130(d), it was determined that the deck barge equipped with a tracked excavator located in Shoal Creek near the city of Killen, Alabama presented an imminent and substantial threat to public health or welfare of the environment because of an actual and/or threatened discharge of oil. Areas of potential water pollution consisted of oil saturated wood planks (railroad ties), oil saturated absorbent granules, oil residue throughout the excavator and two plastic containment pools retaining an oily water mixture. Additionally, the owner/operator attested that the excavator leaks oil (e.g., grease, machine oil, hydraulic fluid, etc.) while in use/operation.
