An exposed hazard such as gears and rotating machinery, must be protected by a cover, guard or rail. Provide guards over rotating engine parts as you enter the E/R space. May be a cover over the rotating parts, or rails to prevent sliding into rotating parts.

The owner, managing operator, or master must ensure that all persons on board a towing vessel comply with the Health & Safety Plan. Plan on board needs to be updated with specifics for company. [updated 1/14/2025]

Each towing vessel must have a reliable means to provide notification when an emergency condition exists. Alarms must be visible and audible at each operating station. The alarm at the operating station may be a summary alarm, the specific alarm condition must then be indicated at the machinery or bilge location. Vessel has a panel for alarms on the bridge and in machinery location, but could not test it properly. Ensure proper operation of alarm panel and be able to test in front of marine inspectors. Provide proof of enrollment in vessel owner's drug and alcohol program that includes random testing. Vessel Personnel are in a DAPI program, but information is not shared with marine employer. Provide proof marine employer has DAPI program, and employees are enrolled or crew share agreements are provided. [updated 1/14/2025]

Each lifejacket must be marked with the vessels name. Lifejackets on board display the old name of the vessel, strike thru and mark with current vessel name.

Complete Drug and Alcohol Program Audit. Will include items on the audit form. Some of the items include: list of covered employees on the vessel, at least one last random and one pre-employment test result, EAP details, and confirmation of supervisor training. This may be completed at the office location.

Survival craft must be stowed in accordance with the requirements of § 199.130 of this chapter, as far as is practicable on existing towing vessels. MI observed the hydrostatic release on the survival craft is expired.

A towing vessel must carry a combination of day and night visual distress signals indicated in Table 141.370 of § 141.370 for specified areas where the vessel operates. MI observed that the distress signals were expired.

Lifebuoys must have the following attachments and fittings: At least one lifebuoy must have a lifeline, secured around the body of the lifebuoy; Each lifebuoy with a floating electric water light must have a lanyard of at least 910 millimeters (3 feet) in length, but not more than 1,830 millimeters (6 feet). MI observed that both float lights were attached to the lifebuoy by lines more than 6 feet in length and one lifebuoy did not have a lifeline of sufficient length attached.

Except as provided in §§ 80.177 and 80.179, operation of transmitters of any ship station must be performed by a person holding a commercial radio operator license or permit of the class required below. The operator is responsible for the proper operation of the station. MI observed that the operator did not have a radio operators permit issued by the FCC. 47 CFR 80.155

The marine employer must have a sufficient number of alcohol testing devices readily accessible on board the vessel to determine the presence of alcohol in the system of each individual who was directly involved in the SMI.MI oberserved the alcohol test strips are expired.

Rails or equivalent protection must be installed near the periphery of all decks accessible to crew. Equivalent protection may include lifelines, wire rope, chains, and bulwarks that provide strength and support equivalent to fixed rails. MI observed severe corrosion on aft handrail on forward bulkhead, located under the vessel name. Deficiency is to be corrected prior to next Credit Hull Exam.

Each towing vessel operating on oceans, coastwise, limited coastwise, or beyond 3 nautical miles from shore upon the Great Lakes must carry a Category 1, 406 MHz satellite Emergency Position Indicating Radio Beacon (EPIRB). EPIRB currently has an expired battery installed (expired MAY2022). Vessel route is limited to 3 NM from shore until battery is replaced.

The Bridge-to-Bridge Act and the regulations of this part apply to the following vessels in the navigable waters of the United States: Every towing vessel of 7.8 meters (26 feet) or over in length, measured from end to end over the deck excluding sheer, while navigating. Vessel does not have a valid FCC Bridge-to-Bridge Certificate.

Each towing vessel operating on oceans, coastwise, limited coastwise, or beyond 3 nautical miles from shore upon the Great Lakes must carry a Category 1, 406 MHz satellite Emergency Position Indicating Radio Beacon (EPIRB). When the towing vessel is underway, the EPIRB must be stowed in its float-free bracket with the controls set for automatic activation and be mounted in a manner so that it will float free if the towing vessel sinks. The owner or managing operator must maintain valid proof of registration. The registration sticker and hydrostatic release unit for the EPIRB were expired. Provide proof that the registration is valid and replace hydrostatic release unit. Vessel is limited to 3 miles from shore until rectified to the satisfaction of the attending marine inspector.

Survival craft must be stowed in accordance with the requirements of § 199.130, which states: "Each liferaft or group of liferafts must be arranged for float-free launching." The vessel's liferaft was not arraged for float-free launching. Operator fixed the arrangement in presence of Marine Inspector.
