Monthly inspections required by NFPA 10 may be conducted by the owner, operator, person-in-charge, or a designated member of the crew. Vessel did not have a monthly inspection log for each individual portable fire extinguisher on board. 46 CFR 176.810(b)(1)(ii)

A vessel of more than 7.9 meters (26 feet) in length, but not more than 19.8 meters (65 feet), must carry a minimum of one life buoy of not less than 610 millimeters (24 inches) in diameter. The vessel's life ring buoy was only 20 inches in diameter and did not contain SOLAS approved retro reflective tape. 46 CFR 180.70(a)(2)

The master and crew of a vessel will be familiar with the content of and have mounted at the operating station, emergency instructions containing the actions to be taken in the event of fire, heavy weather, or man overboard conditions. MI's observed the vessel's emergency instructions were not applicable to the vessel's operating procedures. 46 CFR 185.510(a)

The master shall conduct sufficient drills and give sufficient instructions to make sure that all crew members are familiar with their duties during emergencies that necessitate abandoning ship or the recovery of persons who have fallen overboard. MI's observed training drill logs did not include participation from all crew members assigned to the vessel. 46 CFR 185.520(a)

A vessel must carry either a first-aid kit that meets the requirements in 46 CFR 199.175(b)(10) or a kit with equivalent contents and instructions. MI's observed missing contents from the first-aid kit onboard. 46 CFR 1847.710

Except as provided in paragraph (b) of this section, each vessel must have a stability letter issued by the Coast Guard before the vessel is placed into service. This letter sets forth conditions of operation. Minimum free board marking indicted on stability letter is missing.

Sidelights mean a green light on the starboard side and a red light on the port side each showing an unbroken light over an arc of the horizon of 112.5 degrees and so fixed as to show the light from right ahead to 22.5 degrees abaft the beam on its respective side. Port side light is blue.

As appropriate for the intended voyage, a vessel must carry adequate and up-to-date:(1) Charts of large enough scale to make safe navigation possible;(2) U.S. Coast Pilot or similar publication;(3) CG Light List;(4) Tide tables. Vessel missing Light List and Coast Pilot.

Each ring life buoy must be marked with Type II retroreflective material approved in accordance with 46 CFR 164.018 or other standard specified by the Commandant. Ring life buoy missing retroreflective material.

A vessel must carry either a first-aid kit that meets the requirements in 46 CFR 199.175(b)(10) or a kit with equivalent contents and instructions. - Each first-aid kit must meet the requirements in ISO 18813:2006(E) paragraph 4.12. First aid kits on vessel are not equivalent to ISO 18813.

Each child size life jacket must be stowed in a location that is appropriately marked and separated from adult life jackets so the child size life jackets are not mistaken for adult life jackets. Child life jacket stowage not marked.

The number and identification of the items stowed inside, and their sizes, must be marked in clearly legible letters and numbers on each container for life jackets and immersion suits. The size of life jackets is not marked on adult life jacket container and number of child life jackets missing.

The discharge ends of fuel tank vent pipes must terminate on the hull exterior as high above the waterline as practicable and remote from any hull openings. Fuel tank vent terminates in fuel fill.

Cable and wire for power and lighting circuits must: (1) Meet Section 310-13 of NFPA 70 except that asbestos insulated cable and dry location cables may not be used;(2) Be listed by Underwriters Laboratories (UL), as UL Boat or UL Marine cable; or (3) Meet § 111.60-1 in subchapter J of this chapter for cable, and § 111.60-11 in subchapter J of this chapter for wire. Two negative battery cables have no markings indicating they meet the above requirements.

Collection of an individual's saliva or breath to comply with § 4.06-3(a) must be taken only by personnel trained to operate the alcohol-testing device in use and must be conducted according to this subpart. No evidence was provided showing a trained person for conducting alcohol testing.

At least one ring life buoy must be fitted with a lifeline. If more than one ring life buoy is carried, at least one must not have a lifeline attached. The lifeline attached does not meet the regulation.

Each ring life buoy with a floating waterlight must have a lanyard of at least 910 millimeters (3 feet) in length, but not more than 1,830 millimeters (6 feet), securing the waterlight around the body of the ring life buoy. The lanyard onboard did not meet the regulation.

A vessel must carry one floating waterlight. The batteries were expired and wasted.

A vessel not required to have a power driven fire pump by §181.300 must have at least three 9.5 liter (21/2 gallon) buckets, with an attached lanyard satisfactory to the cognizant OCMI, placed so as to be easily available during an emergency. The words “FIRE BUCKET” must be stenciled in a contrasting color on each bucket. No fire buckets were on board the vessel.

An adult life jacket must be provided for each person carried on board a vessel. Multiple lifejackets are no longer serviceable found mold and saturated. Replace all lifejackets that don't meet the standard.

The owner, charterer, master or managing operator shall instruct each crew member, upon first being employed and prior to getting underway for the first time on a particular vessel and at least once every three months, as to the duties that the crew member is expected to perform in an emergency including, but not limited to, the emergency instructions listed on the emergency instruction placard required by §185.510 of this part and, when applicable, the duties listed in the station bill required by §185.514 of this part. Crew had no records of previous drills.

As appropriate for the intended voyage, a vessel must carry adequate and up-to-date: (1) Charts of large enough scale to make safe navigation possible; (2) U.S. Coast Pilot or similar publication; (3) Coast Guard Light List; (4) Tide tables; and (5) Current tables, or a river current publication issued by the U.S. Army Corps of Engineers or a river authority. (b) Extracts from the publications listed above for the areas to be transited may be provided instead of the complete publication No charts or publications were on board.

The operator of each self-propelled vessel 12 meters or more in length shall carry, on board and maintain for ready reference, a copy of these Rules. No Nav rules on board.

The Certificate of Inspection and any SOLAS Certificates must be posted under glass or other suitable transparent material, such that all pages are visible, in a conspicuous place on the vessel where observation by passengers is likely. If posting is impracticable, such as in an open boat, the certificates must be kept on board in a weathertight container readily available for use by the crew and display to passengers and others on request. The COI was wet, weathered and not legible.

When, in accordance with §178.210 of this chapter, a vessel must be provided with a stability letter, the stability letter must be posted under glass or other suitable transparent material, such that all pages are visible, at the operating station of the vessel. If posting is impracticable, the stability letter must be kept on board in a weathertight container readily available for use by the crew and display to passengers and others on request. The Stabilty letter was weathered, wet and not legible.

Flexible hose used for alcohol-gasoline blend fuels must meet the permeability requirements specified in 33 CFR part 183, subpart J; and (v) For the purpose of flexibility only, flexible hose installed in lengths of not more than 760 millimeters (30 inches) and subject to pressures of not more than 35 kPa (5 psig), may meet the following requirements: (A) Suitable compression type connection fittings may be accepted; (B) Flexible hose designed for use with hose clamps may be installed with two clamps, at both ends of the hose, which: (1) Do not rely on the spring tension of the clamp for compressive force; and (2) Are installed beyond the bead or flare or over the serrations of the mating spud, pipe, or hose fitting; and (C) USCG Type A1, A2, B1, or B2 flexible hose may be accepted in accordance with 33 CFR part 183, subpart J. Replace all worn and UV damaged fuel lines.

When operating a vessel on a body of water where the discharge of untreated sewage is prohibited by the Environmental Protection Agency under 40 CFR 140.3, the operator must secure each Type III device in a manner which prevents discharge of sewage. Acceptable methods of securing the device include— (1) Closing each valve leading to an overboard discharge and removing the handle; (2) Padlocking each valve leading to an overboard discharge in the closed position; or (3) Using a non-releasable wire-tie to hold each valve leading to an overboard discharge in the closed position.

An EAP training program must be conducted for the employer's crewmembers and supervisory personnel. The training program must include at least the following elements: the effects and consequences of drug and alcohol use on personal health, safety, and work environment; the manifestations and behavioral cues that may indicate drug and alcohol use and abuse; and documentation of training given to crewmembers and the employer's supervisory personnel. Supervisory personnel must receive at least 60 minutes of training. No training was provided.

Shutoff valves, installed so as to close against the fuel flow, must be fitted in the fuel supply lines. The valves were found frozen and needed maintenance to operate. Corrected on the spot.

Demonstrate operation of both engines prior to carrying passengers.

Demonstrate operation of navigation lights prior to operation after sunset.
