Ships shall be designed, constructed and maintained in compliance with the structural, mechanical and electrical requirements of a classification society. PSCO observed oil leaking from 2 steering gear valves and steering gear oil tank. 2004 SOLAS II-1/3-1

Oil filtering equipment referred to in paragraph 1 of this regulation shall be of a design approved by the administration. PSCO observed pin hole leak in overboard pipe after 3-way valve. MARPOL I/14.6 16AC

The company should establish procedures, plans, and instructions, including checklists as appropriate, for key shipboard operations concerning the safety of the personnel. PSCO observed multiple machinery equipment that was not safely secured from use by the crew on switchboard. No SMS procedures were found for securing switchboard. 74SOLAS(20) IX/3.1 ISM code 7 50AC

Means shall be provided to control leaks of flammable liquids. PSCO observed active F/O leak from #2 cylinder on A/E #1. 74SOLAS(04)II-2/4.1.1 40AC

After any survey of the ship under regulation 7, 8, 9, or 10 has been completed, no change shall be made in the structural arrangements. PSCO observed modified grease trap piping from galley passing through paint locker. 74SOLAS(20)I/11(a) 40AC

Structural fire protection systems shall be kept in good order so as to ensure their required performance if a fire occurs. PSCO observed stairwell fire doors on 2nd, 3rd, and 5th deck that do not properly latch. 74SOLAS(20)II-2/14.2.1.1.1 40AC

Electrical installations shall be such that the safety of crew and ship from electrical hazards will be ensured. PSCO observed dryer connected to an unauthorized extension cord. 74SOLAS(01)II-1/40.1.3 40AC

Penetrations in these divisions shall be kept in good order so as to ensure their required performance if a fire occurs. PSCO observed improper fire block for A-0 boundary penetration in electrical panel room on 1st deck. 74SOLAS(20)II-2/14.2.1.1.1 40AC

Each operation described in paragraph 2 of this regulation shall be fully recorded without delay in the Oil Record Book Pt. 1 so that all entries in the book appropriate to that operation are completed. PSCO observed entries in the ORB that did not correspond to oil transfers made on multiple dates. MARPOL I/17.4 10C

The condition of the ship and it's equipment shall be maintained to conform with the provisions of the present regulations to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or persons on board. PSCO observed the use of fabricated plastic drip trays to catch excess oil coming from NR1 and NR2 generators. A hose was fitted to the generator leading into plastic buckets due to an inoperable and blocked pipe. See attached pictures. 74SOLAS(20)I/11(a)

The company should establish procedures to ensure that the ship is maintained in conformity with the provisions of the relevant rules and regulations and with additional requirements which may be established by the company. Due to the objective evidence in the deficiencies noted below, the vessel is not being maintained and not in substantial compliance with relevant conventions, calling into question the adequacy and implementation of the vessel's SMS under the ISM code. An external audit conducted by the Flag or RO is required before the ship will be released from its detention to determine whether the ship is operating in accordance with the ISM Code. Provide a copy of the completed audit report to USCG prior to departure from port.(74 SOLAS 20 XI-1 Regulation 4.1 ISM Code 10.2)

Firefighting systems and appliances shall be kept in good working order and readily available for immediate use. PSCO observed fault on the cargo space sample extraction smoke detection system for smoke detector lines 7 through 11 rendering the system inoperable. (74 SOLAS 20 II-2 Regulation 14.2.1.2)

The condition of the ship and its equipment shall be maintained to conform with the provisions of the present regulations to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or persons on board. PSCO observed all alarm towers throughout the machinery spaces were in a constant state of alarm and were unable to be reset. (74 SOLAS 20 I Regulation 11(a))

A main electric lighting system which shall provide illumination throughout those parts of the ship normally accessible to crew shall be supplied from the main source of electrical power. PSCO observed numerous general and emergency lights throughout the machinery spaces were inoperable presenting a work and escape hazard to the crew. (74 SOLAS 04 II-1 Regulation 40.2.1)

Main and emergency switchboards shall be so arranged as to give easy access as may be needed to apparatus and equipment, without danger to personnel. PSCO observed upper panels of the main electrical switchboard located in the engine control room removed exposing high voltage electrical connections. (74 SOLAS 04 II-1 Regulation 45.2)

Machinery spaces of category A shall be adequately ventilated so as to ensure an adequate supply of air is maintained to the spaces for the safety and comfort of personnel and the operation of machinery. PSCO observed upper panels of the main electrical switchboard located in the engine control room removed. When the crew was questioned it was noted that the panels were removed due to an overheating condition with the panel. (74 SOLAS II-1 Regulation 35)

The condition of the ship and its equipment shall be maintained to conform with the provisions of the present regulations to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or persons on board. PSCO observed the electrical panel for the #2 fuel oil purifying system was found improperly mounted due to damage to the enclosure. (74 SOLAS 20 I Regulation 11(a))

All electrical apparatus shall be so constructed and so installed as to not cause injury when handled or touched in the normal manner. PSCO observed the main engine programmable logic control enclosure to be in disrepair and presenting a electrical hazard to the crew as well as jeopardizing electrical components vital to the safe operation of the main engines. (74 SOLAS 04 II-1 Regulation 45.1.3)

Before the ship leaves port and at all times during the voyage, all life-saving appliances shall be in working order and ready for immediate use. Lifeboart engine would only start with one battery. 74SOLAS(20)III/20.2

Ships shall be designed, constructed and maintained in compliance with elextrical requirements of a classification society. PSCO oberserved mast and stern light were not properly functioning. 74SOLAS(20)II-1/3-1

Whenever there is a hazardous condition either onboard a vessel or caused by a vessel or its operation, the owner, agent, master , operator, or person in charge must notify the nearest Coast Guard Sector. Vessel failed to notify Sector Mobile of inoperable navigation lights. 33CFR160.216

IF THE VESSEL'S RADAR STOPS OPERATING PROPERLY, THE PERSON DIRECTING THE MOVEMENT OF THE VESSEL MUST REPORT OR CAUSE TO BE REPORTED THAT IT IS NOT OPERATING PROPERLY TO THE NEAREST CAPTAIN OF THE PORT AS SOON AS POSSIBLE.

04 2500 74 SOLAS (14) IX/ 3.1 17A ISM CODE 10.1 THE COMPANY AND SHIP SHALL COMPLY WITH THE REQUIREMENTS OF THE INTERNATIONAL SAFETY MANAGEMENT CODE. FOR THE PURPOSES OF THIS REGULATION, THE REQUIREMENTS SHALL BE TREATED AS MANDATORY. THE COMPANY SHOULD ESTABLISH PROCEDURES TO ENSURE THAT THE SHIP IS MAINTAINED IN COMFORMITY WITH THE PROVISIONS OF THE RELEVANT RULES AND REGULATIONS. VERIFY ISM COMPLIANCE WITH REGARDS TO FIRE DETECTION AND ALARM SYSTEM MAINTENANCEAND REPAIRS. RECOMMEND FULL ISM AUDIT.
