The purpose of this regulation is to contain a fire in the space of origin. The ship shall be subdivided by thermal and structural boundaries. PSCOS discovered a hole in the overhead fire boundary in the HVAC room. 74 Solas (04) II-2/9.1.1

Manholes and flush scuttles... shall be closed by substantial covers capable of being made watertight. The scape hatch from the welding shop is leaking rain water into the space due to missing nuts. Deficiency rectified on the spot. ICCL (88) 18(1)

Doors fitted in boundary bulkheads of machinery spaces of category "A" shall be reasonably gas tight and self-closing... the starboard, forward lower-engineroom escape door and the door leading to the air conditioning room was unable to close. 74 SOLAS (97) II-2/47.1

A special alarm operated from the navigation bridge or fire control station shall be fitted to summon the crew... no audible alarm sounded on emergency generator deck. 74 SOLAS (97) II-2/40.4

The company should establish procedures to ensure that the ship is maintained in conformity with the provisions of the relevant rules and regulations and with any additional requirements which may be established by the company. Due to the objective evidence in the above deficiencies, the vessel is not in substantial compliance with relevant conventions, calling into question the adequacy and implementation of the vessel’s SMS under the ISM code. Despite completing an ISM audit on 03/11/2021, PSCOs collected objective evidence that the vessel is submitting requests to the company for maintenance and repair support, but could not find evidence of the company taking actions to support the these requests. Requested repairs include CO2 lines and cargo fixed securing devices on deck. In all cases, the vessel could not produce evidence that the vessel or company notified their Recognized Organization or Flag Administration of the serious safety deficiencies. An external audit conducted by the Flag or RO is required within 30 days to determine whether the ship is operating in accordance with the ISM Code. Provide a copy of the completed audit report to USCG prior to departure from port. 74SOLAS (14) IX/3.1 ISM Code Part A/10.1

The piping for the distribution of fire-extinguishing medium shall be arranged and discharge nozzles so positioned that a uniform distribution of medium is obtained. PSCOs identified holes in the CO2 line leading to cargo hold 3 and excessive wastage of the CO2 line leading to cargo hold 2. 74SOLAS (97) II-2/5.1.3

Cargo and cargo units carried on or under deck shall be loaded, stowed and secured as to prevent as far as is practicable, throughout the voyage, damage or hazard to the ship and the persons on board, and loss of cargo overboard… PSCOs observed excessive wastage of multiple fixed cargo securing devices (lashing plates) on deck and multiple devices were cracked and bent. 74SOLAS (97) VI/5.1

All hatchways in position 1 and 2 shall be fitted with hatch covers of steel or other equivalent material…such covers shall be weathertight and fitted with gaskets and clamping devices. The means for securing and maintaining weathertightness shall be to the satisfaction of the Administration… During the deck walk PSCOs identified multiple areas of excessive corrosion and wastage that caused holes on the cargo hatch covers and on the sides of the cargo holds; compromising their structural strength and weathertight integrity. PSCOs observed light through the hatch covers in every cargo hold. ICLL 88 Reg. 16(1)

Openings in freeboard decks other than hatchways, machinery space openings, manholes and flush scuttles shall be protected by an enclosed superstructure, or by a deckhouse or companionway of equivalent strength and weathertightness… PSCOs observed wasted edge and gasket on the watertight door for the paint locker leading below the freeboard deck. After further inspection, PSCOs observed excess light through the watertight door while in the closed position. ICLL 88 Reg. 18(2)

Except as provided in paragraph (3), ventilator openings shall be provided with watertight closing appliances of steel or other equivalent material. In ships of not more than 100 m in length the closing appliances shall be permanently attached; where not so provided in other ships, they shall be conveniently stowed near the ventilators to which they are to be fitted… PSCOs observed excessive corrosion and wastage on the cargo hold ventilators rendering them inoperable. Ventilators requiring portable covers were missing completely. ICLL 88 Reg. 19(4)

Where frames or beams pass through a watertight deck or bulkhead, such deck or bulkhead shall be made structurally watertight without the use of wood or cement… PSCOs observed significant damage in the hull, frames, and deck plating on the starboard quarter in the air conditioning system space. PSCOs observed separation between the sideshell and deck plating with an ineffective and unapproved temporary concrete repair. 74 SOLAS (97) II-1/14.2.2

A forepeak or collision bulkhead shall be fitted which shall be watertight up to the bulkhead deck… PSCOs observed open forepeak tank cover and missing fixed securing bolts; eliminating the watertight integrity of the compartment. 74 SOLAS (97) II-1/10.1

The condition of the ship and its equipment shall be maintained to conform with the provisions of the present regulations to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or persons on board… PSCOs observed numerous cracks and holes in the starboard side hull rub rails resulting in excessive corrosion along the side of the vessel. 74 SOLAS (97) I/11(a)

In a ship in which oil fuel is used, the arrangements for the storage, distribution, and utilization of the oil fuel shall be such as to ensure the safety of the ship and persons on board…PSCOs observed excessive fuel oil leak originating from fuel transfer pump into a fixed containment, the pump housing accumulated approximately an inch of fuel, creating a fire risk. 74 SOLAS (97) II-2/15.2

On all ships, within the machinery spaces, emergency escape breathing devices shall be situated ready for use at easily visible places… The vessel is required six EEBD’s. PSCOs found two EEBDs completely exhausted and two expired EEBDs. 74 SOLAS (14) II-2/13.4.3.1

Every lifebuoy shall be fitted with a grabline not less than 9.5 mm in diameter and not less than four times the outside diameter of the body of the buoy in length. The grabline shall be secured at four equidistant points around the circumference of the buoy to form four equal loops… PSCOs observed multiple lifebouys with improper and dry rotted grablines. 74 SOLAS (97) III/31.1.8

Such certificate shall be issued or endorsed as appropriate either by the Administration for by any persons or organization duly authorized by it. The IOPP Supplement lists the incorrect Oil Content Meter (OCM). The onboard OCM complies with MEPC.60 but is listed as complying with MEPC.107 on the IOPP Supplement. MARPOL 17 1/7.2

Cylinders must always be secured and, when not in use, they must be stored in a rack in an upright position, with the valve protection cap in place… PSCOs observed 10 oxygen and acetylene bottles stored together on the main deck. 46 CFR 147.60(b)

All Ships 3,000 gross tonnage and upward shall in addition to meeting the requirements have ... a 3 GHxz radar or... a second 9 GHz radar...which are functionally independent. The X-Band Radar is non operational Solas Cons 2014 V 19.2.7.1 15ac

The construction and means for securing the weather tightness of cargo and other hatchways. Shall be at least equivalent to. the requirements of regulations 15 and 16 of this annex. PSCO observed 03 quarter sized holes in the steel of the cargo hatch cover. These holes allow for the passage of water into the hold below. ICLL 66 ANNEX I/14(1). 16A

The I.L.L.C shall not be delivered to the ship until the officer or surveyor...has certified that the marks are correctly and permanently indicated on the ships sides. The Load line affixed to the hull does not match the issued certificate. ICLL 66 Annex I/9 16a

Nautical charts...shall be adequate and up to date. Chart was improperly corrected and is unusable for Lake Worth area 74 SOLAS (14CONS) CH.V/REG 27 16A

OBJECTIVE EVIDENCE DISCOVERED DURING AN EXPANDED ISM EXAM REVEALED THE FOLLOWING NON-CONFORMITIES: THE VESSEL FAILED TO FULLY IMPLEMENT THE REQUIREMENTS OF THE ISM CODE THROUGH THEIR SMS PROCEDURES AS EVIDENT BY THE FOLLOWING DEFICIENCIES INDICATING THAT THE SHIP AND/OR COMPANY ARE NOT MEETING THE SMS REQUIREMENTS. RECOMMEND AN EXTERNAL AUDIT. 1) THE COMPANY SHOULD IDENTIFY EQUIPMENT AND TECHNICAL SYSTEMS THE SUDDEN OPERATIONAL FAILURE OF WHICH MAY RESULT IN HAZARDOUS SITUATIONS. THE SAFETY MANAGEMENT SYSTEM SHOULD PROVIDE FOR SPECIFIC MEASURES AIMED AT PROMOTING THE RELIABILITY OF SUCH SYSTEMS OR EQUIPMENT. DURING ROUTINE MAINTENANCE, FIRE MAIN VALVE WHICH SUPPLIES WATER TO SUPERSTRUCTURE HYDRANTS WAS SECURED. REST OF CREW WAS NOT INFORMED OF NON-AVAILABILITY OF FIREFIGHTING WATER DURING THIS TIME. PERFORMANCE OF MAINTENANCE OF VALVE PREVENTS "TECHNICAL PREPAREDNESS OF SHIP FOR POSSIBLE EMERGENCY SITUATIONS, EFFECTIVE DAMAGE CONTROL AND RENDERING ASSISTANCE TO PEOPLE AND SHIPS IN DISTRESS AT SEA", PER VESSEL'S SMS PROCEDURE. 74 SOLAS (14 CONS) IX/3.1 ISM CODE PART A 10.3 30AC, REDUCED TO 16AC

FIRE EXTINGUISHING APPLIANCES SHALL BE KEPT IN GOOD ORDER AND BE AVAILABLE FOR IMMEDIATE USE. DURING TESTING OF MAIN AND EMERGENCY FIRE PUMPS, SECOND OFFICER WAS UNABLE TO UTILIZE FIRE HOSES/HYDRANTS IN THE SUPERSTRUCTURE DUE TO CLOSED VALVES. SHIP'S CREW AS UNABLE TO IDENTIFY AND RECTIFY CAUSE FOR AN HOUR. 74 SOLAS (97) II-2/21 30AC,REDUCED TO 10C

0810-Personal Equipment-Four sets of full protective clothing resistant to chemical attack shall be provided. Vessel carried only three sets of chemical resistant clothing. 74 SOLAS (97 Cons) II-2/54.2.6.1

2500-ISM-Objective evidence discovered during an expanded ISM exam revealed numerous non-conformaties. Detailed description is contained in narrative. 74 SOLAS (14 Cons)IX/3.1 ISM Code Part A

The fire control plan shall show clearly for each deck the control stations, the various fire sections enclosed by class A divisions. Multiple class A fire doors would not close properly and class A fire door on poop deck was missing, thus compromising fire boundary integrity. 74SOLAS(1997 cons.)II-2/20.1

Every liferaft shall be stowed with its painter permanently attached to the ship in a float free arrangement. Port side liferaft not secured to weak link, liferaft not in a float free arrangement. 74SOLAS(1997 cons.)III/29

The ships identification number shall be permanently marked in a visible place. Vessel's IMO number is painted and not permanently marked. 74SOLAS(2014 cons.)XI-1/3

1410 - The condition of the ship and its equipment shall be maintained to conform with the provisions of the present regulations to ensure that the ship in all respects will remain fit to sea without danger to the ship or persons on board. The turbocharger on the main engine suffered a casualty resulting in a reduction of propulsion. 74SOLAS(14) CH.I/Reg.11a

Means shall be provided whereby normal operation of propulsion machinery can be sustained or restored even though one of the essential auxialiaries becomes inoperable.

"B'" Class divisions..shall be so constructed as to be capable of preventing the passage of flame to the end of the first half hour of the fire standard test.. STBD side door near lifeboat has cargo hole and does not provide proper fire protection. SOLAS 74(97) II-2 Reg 4.1

"A" class divisions shall be suitably stiffened. Galley door does not close properly. SOLAS 74(97) II-2/Reg 33.2

The condition of the ship and its equipment shall be maintained to ensure that the ship in all respects will remain fot to proceed at sea. Starboard setting tank containment has waistage not supplying appropriate containment. SOLAS 74 (09 Cons) Ch. I/ Reg 11

Fire extinguishers and semi portable extinguishers do not meet the service date. Certain fire extinguishers also were not full. See TRIANGLE FIRE, INC inspection report for full details.

Some portable CO2 extinguishers were empty.

Several EEBDs were empty as indicated by the TRIANGLE FIRE, INC inspection report.

Vessel unable to provide evidence of equipment tests and inspections required by 33 Code of Federal regulations 156.170 (c)(1)-(c)(5). Vessel has thirty (30) days from the date of this inspection to provide evidence of the requirement noted above to the cognizant OCMI. This evidence will be attested to by the master of the vessel.
