Each child size life jacket must be stowed in a location that is appropriately marked and separated from adult life jackets so the child size life jackets are not mistaken for adult life jackets. Provide label for child life jackets. 46 CFR 180.78(a)(5)

Each vessel must meet the applicable requirements in Subchapter S of this chapter. Each hatch cover must be attached to the hatch frame or coaming by hinges, captive chains, or other devices to prevent its loss. Provide device to prevent loss of lazaratte hatch cover. 46 CFR 177.13-1 OLD T 46 CFR 174.220(b)(2)

A vessel to which this subchapter applies may not be operated without having on board a valid U.S. Coast Guard Certificate of Inspection. You must submit your written application for renewal of a Certificate of Inspection to the OCMI at least 30 days prior to the expiration date of the Certificate of Inspection, as required in § 176.105 of this part. Vessel's COI expires on 05JAN2026. Vessel is restricted from operating with passengers on 06JAN2026. 46 CFR 176.404(b)

At each initial and subsequent inspection for certification, the owner or managing operator must be prepared to conduct tests and have the vessel ready for inspection of its fire protection equipment, including the following: fixed gas fire extinguishing system to check for excessive corrosion and general condition. MI observed pre-engineered fixed gas fire extinguisher for machinery space out of inspection. Inspection was due in June 2025. 46 CFR 176.810 (a) (1)

Each flare carried to meet this section must be stowed in one of the following: A portable watertight container marked as required by § 185.614 of this chapter, carried at the operating station. MI observed vessel did not have suitable container to hold all 12 distress flares. Replace container within 5 days. 46 CFR 180.68

The master and crew of a vessel will be familiar with the content of and have mounted at the operating station, emergency instructions containing the actions to be taken in the event of fire, heavy weather, or man overboard conditions. MI observed emergency instructions not posted onboard vessel. Post instructions within 5 days. 46 CFR 185.512

Each ship transporting more than six passengers for hire equipped with a radiotelephone station in accordance with Part III of Title III of the Communications Act must carry a radio operator who meets the following requirements: (1) Where the station power does not exceed 250 watts carrier power or 1500 watts peak envelope power, the radio operator must hold a marine radio operator permit or higher class license. (2) Where the station power exceeds 250 watts carrier power or 1500 watts peak envelope power, the radio operator must hold a general radiotelephone operator license or higher class license. MI observed master without proof of current marine radio operator permit. Vessel restricted to operation within 1,000 feet from shore. 47 CFR 80.159 (e)

Each ring life buoy with a floating waterlight must have a lanyard of at least 910 millimeters (3 feet) in length, but not more than 1,830 millimeters (6 feet), securing the waterlight around the body of the ring life buoy. MI observed lanyard too short and not wrapped around body of ring life buoy. Repair within 5 days. 46 CFR 180.70 (d) (2)

All vessels must have navigation lights that are in compliance with the applicable sections of the International and Inland Navigation Rules. MI observed loose housing for port navigation light and unsuitable wire routing of starboard navigation light. Vessel restricted to daylight, fair weather operations only with a minimum of 1 nautical mile of visibility. 46 CFR 183.420

Each life float must be fitted with a lifeline, pendants, two paddles, a painter, and a light. MI observed light holding bracket on port side aft life float mounted upside down so light is always on even when not in use. Repair within 5 days. 46 CFR 180.175 (d)

Vessels operated beyond the 20 nautical mile limitation specified in paragraph (a)(1) of this section, but not more than 100 nautical miles from the nearest land, must be equipped with a MF-DSC frequency transmitter meeting the requirements of § 80.1101(c)(3) and capable of transmitting J3E emission and a receiver capable of reception of J3E emission within the band 1710 to 2850 kHz. MI observed vessel was not able to complete an operational test of MF radio. 47 CFR 80.905(a)(2)

On a vessel of at least 26 feet in length, a visual and audible alarm must be provided at the operating station to indicate a high water level in a space with a through-hull fitting below the deepest load waterline, a machinery space bilge, bilge well, shaft alley bilge, or other spaces subject to flooding from sea water piping within the space, and a space with a non-watertight closure. MI observed no visual indication of bilge high water level alarm in MSD space. 46 CFR 182.530(a)

The required EPIRB test shall be logged. MI observed EPIRB tests were not being conducted monthly. 46 CFR 185.728(c)

The required fire and man overboard drills shall be logged. MI observed that fire and MOB drills were not being performed. 46 CFR 185.520(f)

Each officer employed on any vessel subject to this subchapter must have his or her license or merchant mariner credential onboard and available for examination at all times when the vessel is operating. MI observed master without radar observer endorsement on MMC despite having radar onboard. 46 CFR 185.402 46 CFR 11.480 (b)

Each item of lifesaving equipment determined by the marine inspector to not be in serviceable condition must be repaired or replaced. MI observed unserviceable retroreflective tape on 02 port side life floats. MI observed all life floats missing vessel name stenciling. 46 CFR 176.808 (b)

A pre-engineered fixed gas fire extinguishing system must automatically shut down all power ventilation systems and all engines that draw intake air from within the protected space. MI observed operator unable to test nor provide proof that pre-engineered fixed gas fire extinguishing system in engine room was operational. 46 CFR 181.420(a)(3)

A vessel's hull must not carry current as a conductor. MI observed steering gear in lazarette to have damaged and inoperational ground wire. 46CFR183.370(a)

For each marine casualty required to be reported by § 185.202, the owner, agent, master, or person in charge of the vessel shall determine whether there is any evidence of alcohol or drug use by individuals directly involved in the casualty. MI observed expired alcohol test strips onboard the vessel and none available on the pier. 46 CFR 185.210 (a)

Gauges to indicate engine revolutions per minute (RPM), jacket water discharge temperature, and lubricating oil pressure must be provided for all propulsion engines installed in the vessel. The gauges must be readily visible at the operating station. MI observed RPM gauge for port side engine installation inoperable. 46 CFR 182.410(B)

As appropriate for the intended voyage, all vessels must carry adequate and up-to-date charts, Coast Pilot [name withheld], Tide Tables. MI observed no backup charts for electronic charts on vessel. 46 CFR 185.20-35 NVIC 01-16

An EAP training program must be conducted for the employer's crewmembers and supervisory personnel. The training program must include documentation of training given to crewmembers and the employer's supervisory personnel. Supervisory personnel must receive at least 60 minutes of training. MI observed master has not completed 60 minutes of training. 46 CFR 16.401 (b)

A vessel must be fitted with a Federal Communications Commission (FCC) type accepted general marine radar system for surface navigation with a radar screen mounted at the primary operating station if the vessel has an oceans route. MI observed non-operational radar on bridge. 46 CFR 184.404

46 CFR 182.455(b)(4) The shutoff valve at the tank must be manually operable from outside the compartment in which the valve is located. MI observed that the valves were not completely closing when operated by remote shutoff.

47 CFR 80.905(a)(2) Vessels operated beyond the 20 nautical mile limitation specified in paragraph (a)(1) of this section, but not more than 100 nautical miles from the nearest land, must be equipped with a MF-DSC frequency transmitter meeting the requirements of § 80.1101(c)(3) and capable of transmitting J3E emission and a receiver capable of reception of J3E emission within the band 1710 to 2850 kHz. Vessel was not able to test radio. CODE 705: Vessel is restricted to operating operated solely within 20 nautical miles of land until proper operation of radio can be provided.

46 CFR 180.71(a) An adult life jacket must be provided for each person carried on board a vessel. MI observed 06 life jackets that were not serviceable. CODE 705: Vessel is restricted to carrying 39 people that would require an adult size life jacket. O/O provided proof of 05 new adult sized life jackets. UPDATED CODE 705: Vessel is restricted to carrying 44 people that would require an adult size life jacket.

46 CFR 180.71(b) A number of child size life jackets equal to at least 10% of the number of persons permitted on board must be provided. MI observed 01 child size life jackets that were not serviceable. CODE 705: Vessel is restricted to carrying 04 passengers that would require a child size life jacket.

46 CFR 180.70(d)(1) Each floating waterlight must be approved in accordance with § 161.010 in subchapter Q of this chapter, or other standard specified by the Commandant, including, but not limited to, approval series 160.110. MI observed that the floating water light did not have batteries required by the light manufacturer. 705: Vessel is restricted to daytime operations.

46 CFR 180.70 The light must be a floating waterlight approved under approval series 161.010 or other standard specified by the Commandant. MI observed that 04 life float lights did not have batteries required by the light manufacturer. CODE 705: Vessel is restricted to daytime operations.

46 CFR 185.510(a) The master and crew of a vessel will be familiar with the content of and have mounted at the operating station, emergency instructions containing the actions to be taken in the event of fire, heavy weather, or man overboard conditions. MI observed that vessel did not have emergency instructions posted or on board. CODE 705: Rectify deficiency in 05 days.

A vessel that is exposed to salt water more than three months in any 12 month period since the last examination must undergo a drydock examination and an internal structural exam at least once every two years. Vessel was due for drydock examination on 31OCT23 and has yet to receive a drydock exam. 46 CFR 176.600(c)(1)

The gauges must be readily visible at the operating station. The RPM gauges for the new engine installation were found inoperable. Replace in kind. 46 CFR 182.410(B)

At least one ring life buoy must be fitted with a lifeline. If more than one ring life buoy is carried, at least one must not have a lifeline attached. Each lifeline on a ring life buoy must: Be buoyant; Be of at least 18.3 meters (60 feet) in length; Have a diameter of at least 7.9 millimeters ( 5/16 inch). The lifeline found onboard was less than 40 feet in length. 46 CFR 180.70

Electrical equipment on a vessel must be installed and maintained to: Protect passengers, crew, other persons, and the vessel from electrical hazards, including fire, caused by or originating in electrical equipment, and electrical shock. The operator installed the engine starting conductor in the bilge and the conductor is not supported. The installation creates an electrical shock hazard to personnel. Remove the conductor from the bilge and support IAW the regulations. 46 CFR 183.05-50(a)

Provision must be made for closing all supply duct cowls or scoops and exhaust duct discharge openings for a space protected by a fixed gas extinguishing system. All closure devices must be readily available and mounted in the vicinity of the vent. The engine room hatch does not have adequate material to close the hatch to the engine room and seal off the space for use of the fire suppression system. 46 CFR 182.465

Vessel shall be sufficiently maneuverable, arranged, and equipped to allow the crew to recover a helpless person from the water. In addition, the arrangement shall prevent the risk of the crew falling overboard during recovery operations. MI observed the crew member struggling to keep the rescue platform secured into the brackets located on the port quarter of the vessel. The rescue platform base is made of plastic with holes drilled into it. The current design of the platform is substantially effected by wave action. Drill was conducted in 1 to 1.5 foot seas. The rescue platform forward mounting bracket became unattached during the drill. 46 CFR 180.210(a)(1)

All vessels must have navigation lights that are in compliance with the applicable sections of the International and Inland Navigation Rules. Mast head light, stbd running light, and stern light found to be unmounted. Vessel operation restricted to daytime and clear visibility only. 46 CFR 183.420

The Master shall conduct drills and give instructions as necessary to ensure that all crew members are familiar with their duties. Master and crew were not familiar with emergency procedures or vessel rescue equipment. Complete crew training prior to operation with passengers. 46 CFR 185.25-10

As appropriate for the intended voyage, all vessels must carry adequate and up-to-date charts, Coast Pilot [name withheld], Tide Tables. Publications on vessel were outdated; update publications as required. 46 CFR 185.20-35

Instructions for the operation of the fixed fire extinguishing system must be posted at the control station. Post instructions for activation at pull station in pilot house. 46 CFR 181.20-15

Replacement shall be made of expired distress signals; all distress signals are expired. Replace as required. 46 CFR 180.35(b)

Before getting underway, master shall ensure safety announcements are made. Master of vessel was unaware of safety orientation requirements as listed in regulation. 46 CFR 185.25-1(d)

Each ring buoy shall be of an approved type; replace worn retro-reflective material on life ring buoy. 46 CFR 180.30-1

A life jacket shall be provided for each person on board; replace one non-serviceable adult life jacket and provide light. Provide light for one child life jacket. 46 CFR 180.25-5

The color of the life float must be primarily vivid reddish orange. All life floats are faded and do not meet color standard. Apply life float manufacturers recommended product to meet color requirement. 46 CFR 180.05-1

SHUTOFF VALVES, INSTALLED SO AS TO CLOSE AGAINST THE FUEL FLOW, SHALL BE FITTED IN THE FUEL SUPPLY LINES, ONE AT THE TANK CONNECTION AND ONE AT THE ENGINE END OF THE FUEL LINE TO STOP FUEL FLOW WHEN SERVICING ACCESSORIES. THE SHUTOFF VALVE AT THE TANK SHALL BE OPERABLE FROM OUTSIDE THE TANK COMPARTMENT, PREFERABLY FROM AN ACCESSIBLE POSITION ON THE WEATHER DECK. MARINE INSPECTOR IDENTIFIED BOTH EMERGENCY FUEL SHUTOFFS FOR PORT AND STARBOARD FUEL TANKS HAD BEEN DISASSEMBLED RENDERING SYSTEM INOPERABLE. INSTALL BOTH EMERGENCY FUEL SHUTOFF ON PORT AND STARBOARD TANKS IN ACCORDANCE WITH ABOVE CITE. 46 CFR 182.20-40(b)(3)

A SUITABLE MARINE TYPE STRAINER SHALL BE FITTED IN THE FUEL SUPPLY LINE IN THE ENGINE COMPARTMENT. NO SPECIAL FUEL STRAINER OTHER THAN THOSE RECOMMENDED OR FURNISHED BY THE ENGINE MANUFACTUREE WILL BE REQUIRED. DRIP PANS FITTED WITH FLAME SCREENS MAY BE REQUIRED UNDER FUEL STRAINERS OTHER THAN THOSE MOUNTED ON THE ENGINE. MARINE INSPECTOR IDENTIFIED THE STARBOARD RACOR FUEL FILTER MISSING FLAME IMPINGEMENT BOWL. INSTALL FLAME IMPINGEMENT BOWL. 46 CFR 182.20-40(b)(5)

IT SHALL BE THE DUTY OF THE MASTER OF ANY VESSEL TO ASSURE THAT ALL EXPOSED HATCHES ARE PROPERLY SECURED BEFORE GETTING UNDERWAY FOR A VOYAGE ON OTHER THAN PROTECTED WATERS. MARINE INSPECTOR INDENTIFIED AFT STEERING HATCH LOCKING DEVICE WAS INOPERABLE NOT ALLOWING THE HATCH TO BE SECURED. REPAIR OR REPLACE HATCH AND PROVE PROPER OPERATION. 46 CFR 185.20-15

A LOOP OF TUBING OR SHORT LENGTH OF FLEXIBLE HOSE SHALL BE INSTALLED IN THE FUEL SUPPLY LINE AT OR NEAR THE ENGINES. SUCH FLEXIBLE HOSE SHALL BE PROVIDED WITH SUITABLE CONNECTION FITTINGS AND SHALL HAVE A HIGH RESISTANCE TO SALT WATER, PETROLEUM OILS, HEAT AND VIBRATION. MARINE INSPECTOR IDENTIFIED FUEL SUPPLY LINE TO STARBOARD MAIN DIESEL ENGINE LOCATED INBOARD SIDE FORWARD AT ENGINE MOUNT HAD CHAFED THROUGH OUTER COVERING DUE TO VIBRATION. REPLACE FUEL LINE INDENTIFIED ABOVE AND PROVIDE PROPER SUPPORT BRACKETS. 46 CFR 182.20-40(b)(4)

NO FLAMMABLE OR COMBUSTIBLE LIQUIDS MAY BE STOWED IN ANY ACCOMMODATION, CONTROL, OR SERVICE SPACE (OTHER THAN A PAINT LOCKER). MARINE INSPECTOR IDENTIFIED A FIVE GALLON TANK FULL OF GASOLINE STORED IN THE BILGE LOCATED BEHIND THE STARBOARD MAIN DIESEL ENGINE. REMOVE FIVE GALLON GASOLINE CAN FROM THE ENGINE ROOM. 46 CFR 175.45(b)

BATTERIES SHALL BE SO LOCATED THAT THE GAS GENERATED IN CHARGING WILL BE EASILY DISSIPATED BY NATURAL OR INDUCED VENTILATION. BATTERIES SHOULD NOT BE LOCATED IN THE SAME COMPARTMENT WITH GASOLINE TANK OR ENGINE, BUT WHERE LOCATION ELSEWHERE IS IMPRACTICABLE, THEY SHALL BE EFFECTIVELY SCREENED BY A CAGE OR SIMILAR STRUCTURE TO MINIMIZE THE DANGER OF ACCIDENTAL SPARK THROUGH DROPPING A METAL OBJECT ACROSS TERMINALS. MARINE INSPECTOR INDENTIFIED BATTERY BANK LOCATED IN THE ENGINE ROOM AFT BULKHEAD WITH PROTECTIVE COVER MISSING EXPOSING ALL BATTERY TERMINALS. REPLACE BATTERY COVER. 46 CFR 183.02-20(a)

SUITABLE COVERS, GUARDS, OR RAILS SHALL BE INSTALLED IN WAY OF ALL EXPOSED AND HAZARDOUS PLACES SUCH AS GEARS, MACHINERY, ETC. MARINE INSPECTOR INDENTIFIED BOTH PORT AND STARBOARD ENGINES WERE MISSING GUARDS COVERING EXPOSED ACCESSORY DRIVES ON FRONT OF BOTH ENGINES.INSTALL PROTECTIVE GUARDS ON EXPOSED ACCESSORY DRIVES ON BOTH PORT AND STABOARD ENGINES. 46 CFR 177.35-15(a)

THE CERTIFICATE OF INSPECTION (COI) SHALL, IN GENERAL, BE FRAMED UNDER GLASS OR OTHER TRANSPARENT MATERIAL AND POSTED IN A CONSPICUOUS PLACE. WHEN THE FRAMING OF THE CERTIFICATE WOULD BE IMPRACTICABLE, THE COI SHALL BE KEPT ON BOARD TO BE SHOWN ON DEMAND.
