Except as provided in paragraph (b) of this section, the weather deck on a flush deck vessel must be watertight and have no obstruction to overboard drainage. The aft drainage freeing ports were found blocked by bundled electrical conductors and debris. Clear the freeing ports to permit drainage aft. Rectify prior to issuance of the COI, Code 705. 46 CFR 178.410

Paragraphs (c) through (g) of this section apply to each vessel that does not demonstrate compliance in accordance with § 178.310(c) of this chapter. Each vessel must have permanent loading marks placed on each side of the vessel forward and aft to indicate the maximum allowable trim and amidships to indicate the maximum allowable draft. A loading mark required by paragraph (c)(2) of this section must be a horizontal line of at least 205 millimeters (8 inches) in length and 25 millimeters (1 inch) in height, with its upper edge passing through the point of maximum draft. The loading mark must be painted in a contrasting color to the side shell paint. The loading mark was not found permanently installed on each side of the vessel as per the valid stability letter which is based on a deadweight survey. The deficiency will be rectified upon receiving a new stability letter, Code 705. 46 CFR 185.602

Gauges to indicate engine revolutions per minute (RPM), jacket water discharge temperature, and lubricating oil pressure must be provided for all propulsion engines installed in the vessel. The gauges must be readily visible at the operating station. The new outboard engines do not have a lube oil gauge or jacket water temp gauge at the operating station. Provide gauges as per regulations or request special consideration for an equivalent level of safety provided by the manufacturer alarm and safe mode shut down. 46 CFR 182.410(b)

An emergency switch must be provided in the normally ungrounded main supply conductor from a battery. The switch must be accessible and located as close to the battery as practicable. Disconnect means must be provided on the supply side of and adjacent to all fuses for the purpose of de-energizing the fuses for inspection and maintenance purposes. The operator removed the previously installed battery switch. A battery switch shall be installed on the supply side of the primary overcurrent protection. Rectify prior to issuance of the COI, Code 705. 46 CFR 183.380(I)

Fuses must be of the cartridge type only and be listed by Underwriters Laboratories or another independent laboratory recognized by the Commandant. A blade 30 amp fuse was found installed at the positive battery terminal as the primary branch protection. The batteries are wired in parallel and are labeled for 800 CCA each. The blade fuse is not UL listed for marine use and the AIC rating is not high enough to interrupt the 1600 CCA in the event of a dead short to ground fault condition. Rectify prior to the issuance of the COI, Code 705. 46 CFR 183.380(l)

Fuses must be of the cartridge type only and be listed by Underwriters Laboratories or another independent laboratory recognized by the Commandant. Replace blade fuses in the 12V distribution under the console with UL listed cartridge type fuses. Rectify prior to the issuance of the COI, Code 705. 46 CFR 183.380(l)

The construction and arrangement of a vessel must allow the safe operation of the vessel in accordance with the terms of its Certificate of Inspection giving consideration to provisions for a seaworthy hull, protection against fire, means of escape in case of a sudden unexpected casualty, guards and rails in hazardous places, ventilation of enclosed spaces, and necessary facilities for passengers and crew. The marine inspector witnessed the cross deck in between the operator's console and port side passenger seating distort when dynamic forces were applied to the vessel underway in seas less than 2 feet. The main deck presents a hazard to passengers and the vessel's structure. Provide a repair proposal and make satisfactory repairs to the vessel with a marine inspector in attendance. Rectify the deficiency no later than March 12, 2023. 46 CFR 177.100

Alterations to the hull, machinery, or equipment that affect the safety of the vessel must not be made without approval. A new stability test must be conducted to the satisfaction of MSC and Sector St. [name withheld] due the weight change from the repower. Stability test procedures shall be submitted to MSC two weeks prior to the test. Passenger count reduced to 25 until stability test is approved. 46 CFR 176.700(a)

Make permanent repairs to all identified areas on hull found during hull inspection. 46 CFR 176.610

Remove rub rail on front and stbd side to blue chalk line and make repairs to deck to hull joint and areas under bow overhang. Remove old fiberglass and inspect wood for decay and replace if necessary.

Starboard hull high water alarm when tested was inoperative. Make repairs or replace and show proper operation. 46 CFR 182.530

Provide ammonia inhalants, iodine swabs, and eyewash for First Aid Kit. 46 CFR 160.041

Provide your consortium contract with employees listed, or a "Letter of Understanding" from/between owner/operators. POC uses other captains that work for other companies. They are all in a consortium, but no way of tracking test results. Explained to POC the Letter of Understanding between companies, and that sounds like what he will do.

Provide a FCC Safety Certificate for vessel. POC stated that he never had one. To operate on a LC route, he must have certificate on board.

Prior to Limited Coastwise operation, repair/replace EPIRB antenna. Antenna was broken in several areas and held together with duct-tape. IAW FCC inspector, the EPIRB will not transmit the proper signal.

Provide a copy a Marine Operators [name withheld] for POC. POC claims he has applied for a new one.

Prior to the carriage of passengers, provide a work vest with a safety line for member during person OVBD drills.

Label amount and size of life jacket stowage areas. POC had jacket only signs up, but not size and amount.
