The master, owner, operator, agent, or person in charge of any vessel equipped with ballast water tanks that operates in the waters of the United States must follow these practices: Maintain a ballast water management (BWM) plan that has been developed specifically for the vessel and that will allow those responsible for the plan's implementation to understand and follow the vessel's BWM strategy and comply with the requirements of this subpart. Vessel has had a drydock after 01JAN2016 and has not installed a Ballast Water Management System as required by 33 CFR 151.2035. Vessel Ballast Water Management Plan has provisions for a ballast water exchange, under normal conditions, that are no longer allowed by 33 CFR 151.2025 unless in an emergency. Vessel uses potable water in an effort to meet 33 CFR 151.2025(2), however, has not been receiving documentation from the Public Water System provider to show that water meets requirements of 40 CFR parts 141 and 143. Amend the Ballast Water Management Plan to meet these requirements for all future ballasting operations. Submit plan for schedule of cleaning of ballast tanks as per 33 CFR 151.2025(2)(i).
