PSCO’s observed unapproved modifications to watertight door alarm sensors and the pumps and piping arrangements on the heavy fuel oil purifier system. The non-conformities and modifications were not reported to either class or Flag. Due to the objective evidence in the below deficiencies, the vessel is not in substantial compliance with relevant conventions, calling into question the adequacy and implementation of the vessel’s SMS under the ISM code. An external audit conducted by the Flag or RO is required within 30 days to determine whether the ship is operating in accordance with the ISM Code. 02101 - All watertight doors shall be kept closed during navigation except when necessarily opened for the working of the ship, and shall always be ready to be immediately closed. During the cargo tunnel examination, the PSCO observed 9 out the 9 water tight doors did not close properly. 4 watertight doors on the port side failed to close properly, 4 watertight doors on the starboard side failed to close. The watertight door leading from the engine room to the tunnel also failed to close properly. The safety management system should provide for specific measures aimed at promoting the reliability of such systems. PSCO observed gangway rigged at an angle that does not comply with shipboard SMS procedures and the gangway technical requirements. Also, the vessel's SMS states the gangway should be suitably rigged to compensate for the movement of the ship, however it was rigged in such a way preventing the rollers at the bottom from coming into contact with the pier rendering it ineffective and creating high stress areas on the gangway. 74 SOLAS (14)IX/3.1 ISM Code 10.3 40ac

74 SOLAS (14) IX/3.1 & ISM Code A 10.1: The company should establish procedures to ensure that the ship is maintained in accordance with the provisions of the relevant rules and regulations established by the company. PSCO’s requested maintenance checklist for the engine room and firefighting equipment. Ship’s crew provided completed “Algoma central corporation pre-inspection checklist” where the engine department had checked “yes” for engine room machinery clean and free of oil. They had also marked “yes” for steering gear save-all clean and free of oil, overall cleanliness of engine room acceptable, and no leaks in the purifier room. Completed “Algoma Ship Tech LTD Firehoses/Hydrants/Nozzles and attachments” maintenance logs were also notated as “Checked All SAT” weekly, over the last two months. Due to the objective evidence in the above deficiencies, the vessel is not in substantial compliance with relevant conventions. The Captain of the Port questions the adequacy and overall implementation of the vessel’s SMS under the ISM Code. An external audit conducted by the flag or RO is required to determine whether the ship is operating in accordance with the ISM Code. Provide a copy of the completed audit report to the USCG prior to departure from port.

ICLL (66) 12(1): All access openings in bulkheads at ends of enclosed superstructures shall be fitted so that the structure is weathertight when closed. The means for securing these doors shall be so arranged that they can be operated from both sides of the bulkhead. The weathertight door from the galley to the weather deck was missing the handle creating an opening in the door, making the condition non-weathertight.

74 SOLAS (14) I/11(a): The condition of the ship and its equipment shall be maintained to conform with the provisions of the present regulations. PSCO observed condensation leaking from the pipelines to the refrigerated stores. The condensation was pooled on the deck and unable to drain due to a plugged drain.

49 CFR 176.200(c): When cylinders of Class 2 (compressed gas) materials being transported by vessel, the cylinders must be dunnaged 10 cm off any metal deck. PSCO observed oxygen and acetylene tanks stored directly on metal deck of the vessel.

MARPOL I/15.1 Discharge into the sea of oil from ships shall be prohibited. While conducting bunker operations, vessel's sounding tube on Portside LSFO tank was giving false readings due to Heavy Fuel Oil build up in sounding tube. These readings were well below the actual levels in the tank, thus causing fuel oil to overfill the tank, discharge from the air vent, fill up the small containment and discharge approximately 15-20 liters into a U.S. navigable waterway.
