All exposed metal parts of electrical machiers by equipment which were not intended to be "live" bet are liable to become "live" under fault conditions, shall be earthed (grounded) and all electrical apparates shall be so constructed and so installed that danger of injury in ordinary handling shall not exsist. PSCOs observed metal handdles on main switchboard, multiple hanging wall outlets throughout the ship not properly installed, and multiple exposed electical hazards from removed wall outlets. 60SOLAS CH II Reg. 27(a)(i)(l) Code 40bc

Where "A" Class divisions are pierced for the passage of electric cables, pipes, trunks, ducts, etc. for girders, beams or other structures, arrangements shall be made to ensure that the fire resistance is not impaired. PSCO observed two open pipe penetrations in the deck between the engine room and A/C room that did not maintain the fire integrity of the boundary. 60SOLAS Chapter II Reg. 38(a) 16bc

Within the accommodation spaces, all enclosed bulkheads, other than those required to be of "A" Class divisions, shall be constructed of "B" Class divisions of incombustible materials, which may, however, be faced with combustible materials in accordance with Regulation 48 of this Chapter. PSCOs observed 05 doors within the accommodation space that did not maintain the fire integrity of the boundary due to the doors not extending all the way to the deck. 60SOLAS Chapter II Reg. 39(a)(i) 16bc

The side scuttles, together with their glasses, if fitted, and deadlights, shall be of substantial and approved construction. PSCOs observed 07 windows at the side shell incapable of being effectively closed and secured weathertight due to installation of window air conditioners. ICLL Annex I Reg23(3) 16bc

Sanitary accommodation shall comply with the following requirements; cold fresh water and hot fresh water available in all wash spaces. PSCOs observed that there was no hot water available on board. PWSA 46 USC 70002 ILO-147 p.37/21(c) 16bc

The international shore connection required by paragraph (d) of Regulation 64 and paragraph (d)of Regulation 65 of this Chapter to be installed in the ship shall be in accordance with the following specification and the appended sketch. PSCOs observed significant deterioration of the gasket material. 60SOLAS Chapter II Reg. 56(h) 10c

The company and the ship shall comply with the requirements of the International Safety Management Code. For the purpose of this regulation, the requirements of the Code shall be treated as mandatory. The company should establish procedures to ensure that the ship is maintained in conformity with the provisions of the relevant rules and regulations and with any additional requirements which may be established by the company. In meeting these requirements, the company should ensure that any non-conformity is reported, with its possible cause, if known. The nature of the below deficiencies provides objective evidence of a serious failure of the implementation of the ISM Code. An external ISM audit report, satisfactory to the Coast Guard, must be submitted prior to clearance of this deficiency and departure. 74 SOLAS (20) IX/3.1 ISM Code Part A/10.1 Code 30bc

The construction and the means for securing the weathertightness of cargo and other hatchways in positions 1 and 2 shall be at least equivalent to the requirements of regulations 15 and 16 of this annex. During the deck walk PSCOs identified multiple areas of excessive corrosion and wastage on cargo hatch covers, compromising their structural strength and weathertight integrity. Additionally, PSCOs observed 6 cargo hatch covers with missing or wasted gaskets. A total of 7 Gasket pieces were noted missing on the Starboard side and 5 were noted missing on the port side. Some Cargo hatches were open and PSCOs could not inspect gaskets on them. ICLL 66 Reg. 14(1) Code 30bc

Where air pipes to ballast and other tanks extend above the freeboard or superstructure decks, the exposed parts of the pipes shall be of substantial construction...PSCO observed excessive corrosion to multiple tank ventilation pipes and tank sounding pipes on both port and starboard sides of vessel’s bulkhead deck, permitting water intrusion, thus compromising the weathertight integrity of these structures. ICLL 66 Reg. 20 Code 30bc

Such certificate shall be accepted unless there are clear grounds for believing that the condition of the ship or of its equipment does not correspond substantially with the particulars of any of the certificate or that the ship and its equipment are not in compliance with the provisions of regulation 11(a) and (b). The vessel’s annual CSSCC survey was conducted on 16SEPT2023, and a UWILD was also conducted on 12SEPT2023 with no mention of material wastage. PSCOs found clear grounds to believe that vessel’s structural conditions are unsafe due to the amount of wastage, excessive corrosion, deck penetrations and ballast tanks holes rendering Cargo Ship Safety Construction Certificate invalid. 74 SOLAS (20) I/19(b) Code 30bc

The annual survey shall include a general inspection of the structure, machinery and equipment referred to in paragraph (b)(i), to ensure that they have been maintained in accordance with regulation 11(a) and that they remain satisfactory for the service for which the ship is intended. Due to the excessive amount of corrosion, wastage, and unauthorized repairs observed by PSCO’s, the vessel’s seaworthiness is in question. Request a survey with ultrasonic shots to ensure the vessel’s structure, ballast tanks, and bulkhead deck are within permissible wastage specifications. 74 SOLAS (20) I/10(b)(iv) Code 30bc

Maintenance of conditions after survey (a) The condition of the ship and its equipment shall be maintained to conform with the provisions of the present regulations to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or persons on board. PSCOs discovered unauthorized epoxy repairs in air pipes and in the cargo hold aft access. These repairs were not documented in ship’s maintenance logs. 74 SOLAS (20) I/11(a) Code 17bc

AIS shall be operated taking into account the guidelines adopted by the Organization. Ships fitted with AIS shall maintain AIS in operation at all times except where international agreements, rules or standards provide for the protection of navigational information. PSCOs observed the ship’s AIS equipment was non-operational. The ship’s Captain advised that the antenna broke 10 days prior to USCG attendance. 74 SOLAS (20) V/19.2.4.7

...There shall be permanently exhibited for the guidance of the ship's officers general arrangement plans showing clearly for each deck the...detection systems...Plans and booklets shall be kept up-to-date, any alterations being recorded there on as soon as practicable. Fire Control Plan missing 02 heat detectors in the engine room and 01 heat detector in the steering gear room. 60 SOLAS Ch. II/ Reg. 70. 50ac.

All lifebuoys...at least two of the lifebuoys provided with self-igniting lights...shall also be provided with an efficient self-activating smoke signal...and shall be capable of quick release from the navigation bridge. PSCO's observed both port and starboard bridge lifebuoys smoke and light were expired. SOLAS 60 Ch. III/ 21(g) 16ac

No Change shall be made in the structural arrangements, machinery, equipments, etc. covered by the survey without the sanction of the Administration. There is a significant exhaust leak in the emergency fire pump. SOLAS 60 II-2/11

In any passenger ship, and, as far as practicable in any cargo ship there shall be permanently exhibited for the guidance of the ships officers general arrangement plans showing clearly for each deck... plans and booklets shall be kept up-to-date any alterations being recorded there on as soon as practicable. Vessels fire control plan indicates 02 means of escape from forward space housing ship emergency fire pump. The hatch identified as the primary means of escape is blocked by cargo and cannot be opened. 60 SOLAS CH II/reg 70

All hatchways in positions 1 and 2 shall be fitted with hatch covers of steel or other equivalent material... such covers shall be watertight and fitted with gaskets and clamping devices. Several clamping devices are missing, broken, or blocked by chain securing cargo. ICLL ANNEX I/Reg 16(1)

All cargos shall be loaded, stowed, and secured throughout the voyage in accordance with the cargo securing manual approved by the administration. Vessel has vechiles and cargo loaded in areas of open deck both forward and aft of the cargo hatch covers in these areas. There are vechiles stowed on plywood that is resting on top of other cargo. Vessel's cargo securing manual provides no guidance for these arrangements. 74 SOLAS (14) VI/5.6

Fire extinguishing appliances shall be kept in good order and ready for immediate use. PSCO's observed that the emergency fire pump was unable to be started until it had been disassembled and sprayed with an aerosol starting spray, taking approximately 10 minutes for an initial start. Once started, the prime mover for the pump had an exhaust leak which filled the below deck space with hazardous atmosphere. 60 SOLAS CH.2/Reg 66

11104 - All the life-saving appliances shall be kept in working order and available for immediate use before the ship leaves port and at all times during the voyage. PSCO's observed the following: 1. Required rescue boat with engine unable to operate at idle RPM's, dry-rotted wooden oar, and missing required equipment from list (no searchlight, no hoses for de-watering pump.) - 60 SOLAS CH. 3/Reg 4(c)

11112 - Suitable arrangements shall also be made for embarkation. Embarkation ladders for port and starboard life rafts attached to ship with dry-rotted rope and no shackles. - 60 SOLAS CH.3/Reg 19(b)

11117 - Lifebuoys shall always be capable of being rapidly cast loose and shall not be permanently secured in any way. Lifebuoy line was directly tied to its bracket handle. - 60 SOLAS CH.3/ Reg 21(h)

01315 - The Oil Record Book Part 1 shall be completed on each occasion whenever any of the machinery space operations in 17.2 takes place on a ship. PSCO observed incomplete entries to ORB in regards to the disposal of sludge on 14DEC18. Also the ORB has a gap of entries from 14DEC18 to 16MAR19. During which time sludge capacity increased 0.80 m3 indicating the vessel remained in operation. - MARPOL Annex I/17.2

Every fuel oil suction pipe from…daily service tanks shall be fitted with a cock or valve capable of being closed from the outside of the space. Quick closing valve for the generator fuel tank in the steering gear space was wire tied open and unable to be closed remotely. Chief Engineer stated that while underway they tied the valve open to prevent closure. 60 SOLAS CH. 2/Reg 69(c)

The bunker delivery note shall be kept onboard the ship in such a place as to be readily accessible for inspection. The Chief Engineer was unable to produce bunker delivery notes for transfers conducted after September 2018. Instead, a statement of fact was provided for the most recent transfer conducted 31MAR19, which did not contain the required information for sulfur content and fuel quality onboard the vessel. MARPOL Annex VI/ 18.6

The entry for each discharge or incineration shall include date and time, position of the ship, category of the garbage and the estimated amount discharged or incinerated. When compared to the receipts of discharge, the entries into the Garbage Record Book from January to March 2019 were for incorrect days on numerous occasions. They were also approximately 33% less than what the reception facility verified was offloaded. While in Haiti in January 2019, the GRB recorded 6.7m3 offloaded to the shore facility, the receipt recorded 10m3. MARPOL Annex V/10.3.2

A vessel owner or operator required to have a response plan shall conduct exercises as necessary….qualified individual notification exercises, which must be conducted quarterly. Vessel could not provide documentation that QI notifications were being completed quarterly. 33CFR155.1060(a)(i)

MARPOL (2017) Annex I/17.1 - 1710 - Everyship of 400GT and above shall be provided with an oil record book. The ORB shall be in the form specified in Appendix III to the Annex. Chief Engineer did not properly record oil transfers in accordance with the instructions in the ORB.

ORB is being improperly filled out with incorrect codes and numbers for OWS test and removal of sludge and oily water. Incorrect units of measurement being used (gallons). The exact position of the rudder, if power operated, shall be indicated at the principal steering position. rudder Angle Indicator, as seen from Nav. Bridge, was 10 degrees different than steering gear room. 60 SOLAS Ch.2/Reg. 29(a)(iv) 25bc

All ships 150 gross tons and upwards shall be fitted with a bridge navigational watch alarm system. Vessel is not fitted with BNWAS as indicated on equipment certificate. 74 SOLAS(14Cons.) Ch. V/ Reg. 19.2.2.3 25bc

Except as provided in regulation 14.2, such covers shall be weathertight and fitted with gaskets and clamping devices.
