Shutoff valves, installed so as to close against the fuel flow, must be fitted in the fuel supply lines, one at the tank connection and one at the engine end of the fuel line to stop fuel flow when servicing accessories. The shutoff valve at the tank must be manually operable from outside the compartment in which the valve is located. The port fuel shutoff valve does not turn 90 degrees for full closure when activated remotely. 46 CFR 119.455(b)(3)

A-Class bulkheads… must be so insulated with approved structural insulation, so that, if subjected to the standard fire test for the applicable time period, the average temperature on the unexposed side does not rise more than 250 °F above the original temperature, nor does the temperature at any one point rise more than 325 °F above the original temperature… Penetrations must be designed or insulated to withstand the same temperature rise limits as the boundary penetrated. The A-60 Class bulkhead forward in the lazarette is missing sections of non-combustible insulation starboard of the CO2 bottles and inadequate foam is used to seal penetrations on both sides of same bulkhead and overhead aft of access ladder. 46 CFR 116.415(a)(2)

Nonconducting mats or grating must be provided on the deck in front of each switchboard. The nonconductive mat is missing. 46 CFR 120.330(g)

Each ring life buoy on a vessel must, if on a vessel on an oceans or coastwise route, be orange in color. Two ring life buoys are excessively faded. 46 CFR 117.70(b)(5)

Each life jacket must be marked with Type I retroreflective material approved in accordance with § 164.018 in subchapter Q of this chapter. Ten child lifejackets had retroreflective material that was worn and partially painted over. 46 CFR 122.604(h)

For a vessel described by 46 CFR 175.110(c), the training program in paragraph (a) of this section must address firefighting proficiency and must include (1) Training in the use and location of firefighting equipment and general firefighting knowledge, including: (i) Location of firefighting appliances and emergency escape routes; (ii) Types and sources of ignition; (iii) Flammable materials, fire hazards and spread of fire; (iv) The need for constant vigilance; (v) Actions to be taken on board; (vi) Fire and smoke detection and automatic systems on board; and (vii) Classification of fire and applicable extinguishing agents. Required training was not logged. 46 CFR 122.420

Secured to the vessel by a painter with a float-free link permanently attached to the vessel except that a float-free link is not required if the vessel operates only on waters not as deep as the length of the painter. Painter on 2 of 4 IBA’s were found not connected to the weak link and would have prevented release in an emergency. 46 CFR 117.130

At each inspection for certification and at every other vessel inspection all observed unsafe practices, fire hazards, and other hazardous situations must be corrected and all required guards and protective devices must be in satisfactory condition. Both outboard heating piping lines in the lazarette were holed in several locations allowing the potential for excess water accumulation in this space. 46 CFR 115.830

Piping used in a vital system must meet 56.50 in subchapter F of this chapter. Lazarette bilge suction piping found with two sections of the piping joined with a 5” portion of non metallic material. Replace existing section of piping with material in accordance with the regulations. 46 CFR 119.710

A vessel that is exposed to salt water more than three months in any 12 month period since the last examination must undergo a drydock examination and an internal structural at least once every two years. The vessel has not completed a drydock examination within the last two years. Conduct satisfactory drydock examination prior to the carriage of passengers. 46 CFR 176.600(c)(1)

The name of the vessel must be marked or painted in clearly legible letters on each life float paddle. Paddles for vessel's life floats did not have names. Label paddles properly to the satisfaction of the MI.

For a vessel described by 46 CFR 114.100(e), the training program in paragraph (a) of this section must address firefighting proficiency. MI observed limited details in vessel's drill logs. Crew training program must address the listed firefighting proficiencies to improve crewmember training and proficiency, including egress training for each member on board.

At each initial and subsequent inspection for certification of a vessel, the owner shall be prepared to conduct tests and have the vessel ready for inspections of the hull structure and its appurtenances. Temporary patch observed in overhead of storage void. Outer side of patch is on starboard main weatherdeck and there is a weld seam visible. Patch inside void is 10 ft forward of access ladder a few inches from sideshell. Remove patch during next drydock and make available for MI inspection.

A vessel owner or operator may use an Alternative Security Program as approved under § 101.120 of this subchapter if: (a) The Alternative Security Program is appropriate to that class of vessel. Vessel’s security plan was found to be missing key elements needed in a vessel security plan and was deemed not appropriate for the class of the vessel. Vessel must update and renew their security plan to the satisfaction of the attending Marine Inspector, vessel will be restricted to less than 150 passengers until this deficiency is resolved. 33 CFR 104.140(a)

Vessels described by 46 CFR 114.110(e) must have an interconnected fire detection system in compliance with 46 CFR 181.450 installed in all enclosed areas where passengers and crew have routine access, including accommodation spaces and machinery spaces. Vessel was found to not have an interconnected fire detection system on board. Vessel must have interconnected fire detection system in the machinery space, main deck accommodation space, and the pilot house and to the satisfaction of the attending Marine Inspector, vessel will be restricted to Limited Coastwise routes until this is resolved. 46 CFR 114.110(e) 46 CFR 118.400(d)

Each portable fire extinguisher on a vessel must be of a type approved by the Commandant. The minimum number of portable fire extinguishers required on a vessel must be acceptable to the cognizant OCMI, but must be not less than the minimum number required by Table 118.500(a) of this section and other provisions of this section. There were multiple extinguishers found on the vessel that did not meet the requirements of Table 188.500(a) of the regulation. Vessel must review the requirements of table 118.500(a) and update and correct all portable fire extinguishers to the standard and the satisfaction of the attending Marine Inspector. 46 CFR 114.110(e) 46 CFR 118.500(a)

Each ring life buoy on a vessel must: (1) Be approved in accordance with § 160.050 in subchapter Q of this chapter, or other standard specified by the Commandant, including, but not limited to, approval series 160.150; (2) Be readily accessible; (3) Be stowed in a way that it can be rapidly cast loose; (4) Not be permanently secured in any way; and (5) If on a vessel on an oceans or coastwise route, be orange in color. Vessels port side lifebuoy was found worn where the orange coloring was degrading. Repair or replace the lifebuoy to the satisfaction of the attending Marine inspector. 46 CFR 117.70(b)(5)

Each rescue boat and ring life buoy must be marked with Type II retroreflective material approved in accordance with § 164.018 in subchapter Q of this chapter, or other standard specified by the Commandant. The arrangement of the retroreflective material applied after March 11, 1996, must be as specified by IMO Resolution A.658(16). The vessels reflective material on the lifebuoys was found degraded and not up to the specifications of type II retroreflective material. Vessel must replace the reflective material on the lifebuoys to the satisfaction of the attending Marine Inspector. 46 CFR 122.604(i)

Spanner wrenches must be provided for each fire hydrant required by this regulation. Existing vessels must comply with this requirement by January 18, 2017. Port side fire station is missing a spanner wrench. Vessel must replace the missing spanner wrench to the satisfaction of the Marine Inspector. 46 CFR 118.310(e)

The master of the vessel shall ensure that: (c) The EPIRB test is required by paragraph (a) shall be logged or otherwise documented, as applicable. Vessel logbook was found with multiple missing EPIRB tests along with other important entries. Vessel Master and crew were educated on the importance of logging the critical information as well as when they need to be logging the information. 46 CFR 122.728(c)

At each initial and subsequent inspection for certification of a vessel, the owner or managing operator shall be prepared to conduct tests and have the vessel ready for inspections of the hull structure and its appurtenances. Cracked and missing welds were noted in the forepeak and fore most storage room. Locations were marked appropriately within the space and need repaired. 46 CFR 115.802(a)

At each initial and subsequent inspection for certification of a vessel, the owner or managing operator shall be prepared to conduct tests and have the vessel ready for inspections of the hull structure and its appurtenances. Two pieces of longitudinal framing were missing in the STBD side overhead in the forepeak. 46 CFR 115.802(a)

At each initial and subsequent inspection for certification, the owner or managing operator shall be prepared to conduct tests and have the vessel ready for inspection of its fire protection equipment, including the following: Inspection of fixed gas fire extinguishing system to check for excessive corrosion and general condition. CO2 cylinders have a large amount of corrosion on the bottom as the steel cylinders are mounted on an aluminum tray. Operator states that cylinders have not been weighed or moved in over two years. 46 CFR 115.810(a)(1)

At each initial and subsequent inspection for certification, the owner or managing operator shall be prepared to conduct tests and have the vessel ready for inspection of its fire protection equipment, including the following: For fixed gas fire extinguishing systems, the inspections and tests required by Table 115.810(b). During inspection, operator could not show inspector’s report documenting tests completed IAW requirements in table referenced. 46 CFR 115.810(b)(2)

At each initial and subsequent inspection for certification, the owner or managing operator shall be prepared to conduct tests and have the vessel ready for inspection of its fire protection equipment, including the following: Inspection and testing of smoke and fire detecting systems (including sensors and alarms) and fire confining appliances (such as fire screen doors and fire dampers). Operator could not show evidence of testing of detection system. 46 CFR 115.810(a)(7)

A device must be provided to automatically shut down power ventilation serving the protected space and engines that draw intake air from the protected space prior to release of the extinguishing agent into the space. Engine room has powered ventilation that is not on the pressure switch circuit and will not shut down upon activation of CO2 system. 46 CFR 118.410(b)(10)

A fire control plan (FCP) must be posted on the vessel in a location that is accessible and visible to all passengers. The plan must show escape routes, areas of refuge, embarkation stations, the location of fire protection/emergency equipment, compartment titles and hazard classification of accommodation and service spaces, and structural fire protection boundaries. Vessel has a Fire Control Plan that is not approved by OCMI and is not visible to all passengers. Additionally, several modifications to the vessel has been made since the current FCP was developed. Submit new plan for review by Marine Safety Center and approval by OCMI. 46 CFR 116.530

Fire load calculations must be submitted by the owner for review to the Marine Safety Center when: A space is designated as a low risk accommodation space by the owner; or the cognizant OCMI determines, based on the quantity of combustibles, that the fire load present in a high risk accommodations space may exceed 37.5 kg (7.5 pounds) of combustibles per square meter (square foot) of deck area. Vessel is using unapproved Fire Control Plan that was developed using fire load calculations that were done before extensive remodeling took place. Boundaries have been moved, flooring has been installed, and furniture has been installed; all of which raises concerns about fire load calculations. Submit calculations to Marine Safety Center for review and approval by OCMI. 46 CFR 116.427(a)

A-Class bulkheads or decks must be composed of steel or equivalent material, suitably stiffened and made intact with the main structure of the vessel, such as the shell, structural bulkheads, and decks. They must be so constructed that, if subjected to the standard fire test, they are capable of preventing the passage of smoke and flame for 1 hour. In addition, they must be so insulated with approved structural insulation, bulkhead panels, or deck covering so that, if subjected to the standard fire test for the applicable time period listed below, the average temperature on the unexposed side does not rise more than (250 °F) above the original temperature, nor does the temperature at any one point, including any joint, rise more than (325 °F) above the original temperature: A-60 Class – 60 minutes. Vessel does not have boundaries in lazarette that meet this requirement. Fire Control Plan lists this space a A-60 boundary. 46 CFR 116.415(a)(2)(i)

Penetrations in A-Class fire control boundaries for electrical cables, pipes, trunks, ducts, etc. must be constructed to prevent the passage of flame and smoke for one hour. In addition, the penetration must be designed or insulated so that it will withstand the same temperature rise limits as the boundary penetrated. A-60 boundary materials are missing in engine room in way of cable and piping penetrations leading out of engine room. 46 CFR 116.415(a)(2)(ii)

Sight-flow glasses may be used in lubricating-oil systems provided it has been demonstrated, to the satisfaction of the Commanding Officer, Marine Safety Center, that they can withstand exposure to a flame at a temperature of 927 °C (1700 °F) for one hour, without failure or appreciable leakage. Lube oil tank sight glass has been replaced with a flexible clear PVC tubing. Replace to original design to satisfaction of attending marine inspector. 46 CFR 56.50-80(h)

Electrical equipment on a vessel must be installed and maintained to: Prevent electrical ignition of flammable vapors. Vessel has installed in engine room a portable, temporary, clipped on, non-UL listed light, and utilizes an uncovered bulb in the engine room. 46 CFR 120.200(d)

At each inspection for certification and at every other vessel inspection the bilges and other spaces may be examined to see that there is no excessive accumulation of oil, trash, debris, or other matter that might create a fire hazard, clog bilge pumping systems, or block emergency escapes. Engine rooms were found with bilges containing excessive amounts of oil and temporary catches for oil. Determine the cause of oil accumulation and make repairs to satisfaction of OCMI. 46 CFR 115.830(b)

Tests must verify that automated vital systems are designed, constructed, and operate in accordance with all applicable requirements of part 62 of this subchapter. The tests must be based upon the failure analysis, if required by § 62.20-3(b) of this subchapter, functional performance requirements, and the Periodic Safety tests of § 61.40-6. Tests must be performed immediately after the installation of the automated equipment or before the issuance of the initial Certificate of Inspection. Vessel has installed electronic engine controls and does not have an approved set of Design Verification Test Procedures, Qualitative Failure Analysis, or Periodic Safety Test Procedures. 46 CFR 61.40-3

The OCMI may require an inspection and testing whenever a repair or alteration is undertaken. Vessel has installed a thru hull penetration in the bottom shell of the hull that attempts to make watertight by use of epoxy and composite material. Penetration is under fuel tank. Vessel to submit repair proposal that includes returning hull scantlings and watertight. Once approved, vessel to have properly installed equipment prior to next credit drydock. 46 CFR 115.700(d)

Electrical equipment used in the following locations must be dripproof: A machinery Space. Engine electronic control modules for port and starboard main engines have wire bundle drip shields that are not placed on connections properly. Additionally, it looks like excessive dust and debris may have entered wire bundle female connection. Clear of debris and properly install drip shields to satisfaction of attending marine inspector. 46 CFR 120.210(a)(1)

C'-Class bulkheads must be constructed to prevent the passage of smoke between adjacent areas. Penetrations in C'-Class boundaries for electrical cables, pipes, trunks, ducts, etc. must be constructed so as to preserve the smoke-tight integrity of the boundary. There three holes in the stairs leading to upper deck. Holes are in a C-Class boundary according to Fire Control Plan. 46 CFR 116.415(a)(2)(vi)

A vessel must carry either a first-aid kit approved under approval series 160.041 or a kit with equivalent contents and instructions. Eyewash and aspirin are expired and must be replaced. 46 CFR 121.710

Each vessel that operates on the high seas, or that operates beyond three miles from the coastline of the Great Lakes, must have on board an FCC Type Accepted Category 1, 406 MHz EPIRB, installed to automatically float free and activate. EPIRB battery and hydrostatic release were expired. 46 CFR 117.64

The number and identification of the items stowed inside, and their sizes, must be marked in clearly legible letters and numbers on each container for life jackets and immersion suits. Child life jacket storage container is labeled for 25 instead of the required 26 life jackets. 46 CFR 122.604

Portable fire extinguishers must be located so that they are clearly visible and readily accessible from the space being protected. The installation and location must be to the satisfaction of the cognizant [name withheld] fire extinguishers in the galley and operating station must be stored in suitable mounting bracket. 46 CFR 118.520

Carbon dioxide warning signs. Each entrance to a space storing carbon dioxide cylinders, a space protected by carbon dioxide systems, or any space into which carbon dioxide might migrate must be conspicuously marked as follows: (1) Spaces storing carbon dioxide - “CARBON DIOXIDE GAS CAN CAUSE INJURY OR DEATH. VENTILATE THE AREA BEFORE ENTERING. A HIGH CONCENTRATION CAN OCCUR IN THIS AREA AND CAN CAUSE SUFFOCATION.” (2)Spaces protected by carbon dioxide - “CARBON DIOXIDE GAS CAN CAUSE INJURY OR DEATH. WHEN ALARM OPERATES OR WINTERGREEN SCENT IS DETECTED, DO NOT ENTER UNTIL VENTILATED. LOCK OUT SYSTEM WHEN SERVICING.” Carbon dioxide warning signs are not posted. Verbiage from 46 CFR 122.612(i)(1) must be posted at entrance to lazarette and verbiage from 46 CFR 122.612(i)(2) must be posted at the entrance to the engine room. 46 CFR 122.612(i)(1)(2)

The arrangement of a vessel must allow the safe operation of the vessel giving consideration to protection against fire. Open and unsecured plastic bottle of hydraulic fluid is being used as overfill for steering system and placed on top of pilot house console. Remove overfill line and plastic bottle from the pilot house. 46 CFR 116.100(a)

Electrical equipment on a vessel must be installed and maintained to protect passengers and crew from electrical hazards originating in electrical equipment. Multiple dead end and unused wires are stowed behind pilot house console. Remove all unnecessary wires and dead end wires from space. 46 CFR 120.220(b)

The construction and arrangement of a vessel must allow for the safe operation of the vessel giving consideration to provisions for a seaworthy hull. Significant hole was made on the starboard bulkhead of the pilot house with insulation exposed to the weather. Ensure weather tight boundary in bulkhead.

Alterations to machinery or equipment that affect the safety of the vessel must not be made without the approval of the OCMI, except during an emergency. Alarms for the bow and stern thrusters are covered in duct tape, minimizing the operation and intent of the alarm. Remove tape from alarm. 46 CFR 115.700(a)

Nonmetallic piping materials, including nonmetallic flexible hose assemblies, must meet the requirements of § 56.60-25 in subchapter F of this chapter. Vessel has a length of piping from a thru-hull to the sewage raw water pump. Submit piping diagram repair proposal that meets 56.50-25 requirements for approval by OCMI. 46 CFR 119.720

Non-metallic flexible hose must be in accordance with SAE J1942. 46 CFR 56-60.25(b). Vessel had unauthorized tank truck hoses on both port and starboard engines. Replace with an approved hose. 46 CFR 119.720

Vessel has installed an air compressor/receiver in the engine room. Equipment is installed with undersized hardware that is under excessive strain. 46 CFR 115.830(a)

Nonferrous metallic piping materials are acceptable for use in the following: non-vital systems. Bilge pump piping under fuel tank uses a 12” section of flexible hose material to connect piping to strainer. 46 CFR 119.730(a)(1)

Sluice valves are not permitted in watertight bulkheads. Bilge piping leading to forepeak and through collision bulkhead is fitted with a sluice (gate) valve. 46 CFR 119.500(a)

At each initial and subsequent inspection for certification of a vessel, the owner or managing operator shall be prepared to conduct tests and have the vessel ready for inspections of…piping systems, including the following: Operational test of all overboard discharge and intake valves and watertight bulkhead pipe penetration valves. During testing of the fire pump/ bilge pump system, raw water intake valve was found stuck open. After several tries, operator was able to close valve. 46 CFR 115.804(g)

The fire pump must be capable of delivering a single hose stream from the highest hydrant, through the hose and nozzle required by § 118.320 of this part, at a pitot tube pressure of 345 kPa (50 psi). During testing of the fire pump, 50 psi could not be reached. Marine Inspector found that overboard discharge valve could not close all the way due to an improperly maintained/stuck ball valve and an installation to ball valve that has handle hitting the bulkhead before fully seated in the closed position. After several attempts, operator was able to close valve. Subsequently, fire pump pressure was able to reach the minimum 50 psi. 46 CFR 118.300(b)

Penetrations and openings in watertight bulkheads must have a means to make them watertight. Cable penetrations must be made watertight. 46 CFR 171.114(a)(2)

All cable and wire must be installed with metal supports spaced not more than 24 inches. The use of plastic tie wraps must be limited to bundling and not used as a means of support. Plastic ties and rope was observed in the engineroom in multiple places as a means of support of cable, wire and hoses. Properly support cable, wiring and hoses. 46 CFR 120.340(b)(4)

On a vessel on which the number of passengers permitted on upper decks is limited by stability criteria, as indicated by the vessel's stability letter, the maximum number of passengers allowed on an upper deck must be indicated by a durable marking of at least 1 inch numbers and letters at the entranceway to that deck. Upper deck restricted to 166 passengers as per stability letter not marked.

Each survival craft must be: stowed so that when the vessel sinks the survival craft floats free and, if inflatable, inflates automatically. Hydrostatic release was improperly connected on 01 IBA preventing its automatic release.

Each door, hatch, or scuttle, used as a means of escape, must be capable of being opened by one person, from either side. Emergency escape hatch in storage void seized from the inside.

Life floats must not be stowed in tiers more than 4 high. When stowed in tiers, the separate units must be kept apart by spacers. Life floats were not separated by spacers.

Vessel has an approx. 30" crack along weld at port side (amid ship) open passenger deck on previous welding insert. See narrative for details.

IAW 46 CFR 54.01-5(4) Class II; III Pressure vessels that have a net internal volume of less than 5 ft3 must be stamped with either the ASME "U" or "UM" symbol. The existing pressure vessel does not have a "U' stamp; shows signs of corrosion. Replace with approved pressure vessel.

Repair structural fire protection in engine room and tankroom where indicated.

Install guard over a/c - d/c converters atop batteries port and STBD sides. Exposed cable connections.
