Lifeboats together with the emergency boat required by sub-paragraph (b)(iii) of Regulation 35 of this chapter shall be served by wire rope falls, together with winches of an approved type in which in the case of an emergency boat shall be capable of quick recovery of those boats. The vessel's rescue boat is incapable of being retrieved in a timely manner due to insufficient electrical power to the rescue boat davit winches and associated equipment. PSCO observed the crew manually hand crank the boat from the embarkation deck to the cradle, which took the crew over an hour to complete. 74 SOLAS III/36 30 abc

The structure, machinery and equipment of a cargo ship shall be subject to the following surveys and inspections: an annual survey within 3 months before or after each anniversary date of the Cargo Ship Safety Construction Certificate. The certificate onboard does not have an annual survey endorsement within 3 months before or after the anniversary of the certificate. 74 SOLAS (20) I/10 (a) (iv) Code 17abc

An Administration nominating surveyors or recognizing organizations to conduct inspections and surveys if requested by the appropriate authorities of a port state. A cargo ship shall be subject to a minimum of two inspections of the outside of the ship’s bottom during any five-year period. The interval shall not exceed 36 months in any case. There have been no inspections of the outside of the ship’s bottom in over 36 months. 74 SOLAS (20) I/10 (a) (v) 40abc

After any survey of the ship under Article 14 has been completed, no change shall be made in the structure, equipment, arrangements, material or scantlings covered by the survey, without the sanction of the Administration. PSCO observed broken pipe penetration connections on the vessel’s main deck; these connections house four electrical cable runs into the cargo hold on the starboard side, and two cable runs on the port side adjacent to the cargo hatch coamings. USCG wants to confirm 100 percent load test once vessel leaves drydock.

All electrical apparatus shall be so constructed and so installed that danger of injury in ordinary handling shall not exist. PSCO observed numerous hazardous electrical conditions including multiple dead end wires within; the vessel’s fuel oil purifier flat, along the length of the starboard side cargo hatch coaming, and outboard of the vessel’s starboard rudder post within the steering gear space. 1974 SOLAS II-1/27(a)(i)(1) 17abc

Each operation described in paragraph 2 of this regulation shall be fully recorded without delay in the Oil Record Book (ORB) Part I, so that all entries in the book appropriate to that operation are completed. Each completed operation shall be signed by the officer or officers in charge of the operations concerned and each completed page shall be signed by the master of ship. The vessel’s IOPP indicated that the capacity of the vessel’s bilge water tank was 35.5 cubic meters. PSCO observed an entry in the vessel's ORB from 16AUG2021 recording 19.1 cubic meters was retained in the vessel’s bilge water tank. PSCO observed that the tank exceeded its capacity of 35.5, and Chief Engineer confirmed the tank was at capacity on 16AUG2021. MARPOL Annex I reg 17.4 Code 17abc

Due to the #1 and #2 diesel generators being inoperable, the crew is utilizing a non-class approved containerized generator installed on top of a cargo hatch that does not meet the provisions of SOLAS 74 II-1 and II-2. 1974 SOLAS (2020) I/11(a) code 17abc

Oil filtering equipment referred to in paragraph 1 of this regulation shall be of a design approved by the Administration and shall be such as will ensure that any oily mixture discharged into the sea after passing through the system has an oil content not exceeding 15 parts per million. In considering the design of such equipment, the Administration shall have regard to the specification recommended by the Organization. Vessel’s crew was unable to test the vessel’s oily water separator due to the vessel’s bilge water tank exceeding its capacity. MARPOL Annex I Reg. 14.6 Code 17abc 22DEC21: Code change from 17 to 40 to allow vessel to transit to dry dock. Class has issued a COC not allowing the use of OWS prior to drydock.

A ship shall be subjected to a periodic inspection within 3 months either way of each annual anniversary date of the International Load Line Certificate. The certificate onboard does not have an annual survey endorsement within 3 months before or after the anniversary of the certificate. ICLL Article 14(1)(c) Code 17abc

Manufacturer supplied instructions for the installed Type II Marine Sanitation Device (MSD) shall list the type and quantity of chemicals that are required to operate the MSD. Chemical additive for the MSD is not provided onboard the vessel for proper operation in accordance with manufacturer instructions.33 CFR 159.57 17abc 22DEC21: Changed code from 17 to 40 to allow transit to drydock. Class has issued authorization to allow use of ballast tanks for sewage holding until vessels drydock.

Any Type III MSD is considered certified if it is used solely for the storage of sewage and flushwater at ambient air pressure and temperature. In addition to using the installed Type III sewage holding tank, the #6 and #7 centerline ballast tanks are also being used as sewage holding tanks without authorization by the Administration or RO. 33CFR159.12a 17abc 22DEC21: Changed code from 17 to 40 to allow transit to drydock. Class has issued authorization to allow use of ballast tanks for sewage holding until vessels drydock.

The company and the ship shall comply with the requirements of the International Safety Management (ISM) Code. The company should establish procedures to ensure that the ship is maintained in conformity with the provisions of the relevant rules and regulations and with any additional requirements which may be established by the company. 1. Crew failed to adhere to established company procedures for the maintenance of critical equipment. A review of the vessel's operational maintenance routine (OMR) revealed inconsistencies between maintenance performed and the vessel's July 2021 "Engine Checklist" submitted to the company. Inconstancies amount to the number one and number two diesel generators being overdue 3,312 hours and 3,617 hours respectively. Condition of the generators indicate failure of crew to maintain generators in accordance with ORM. 2. Vessel SMS states that the vessel’s superintendent should make annual inspections. Ship board records show the vessel’s superintendent has not conducted an inspection since March 2019.Safety management audit is required to be carried out by RO before ship is released from detention. 1974 SOLAS (2020) IX/3.1 ISM Code A/10.1 code 30abc 21DEC21: Code was changed from 30AC to 40AC to allow vessel to sail to drydock prior to required audit.

In all new and existing ships, fire-extinguishing appliances shall be kept in good order and available for immediate use at all times during the voyage. 02 portable fire extinguishers found to be unservicable.

Access doors to machinery spaces fitted in position 1 or 2 shall be equivalent strength to the uninspired bulkhead and weathertight. PSCO observed on 17SEP2018 that the emergency exit door on the starboard side weather deck for the machinery space, holed and wasted at lower gasket. Vessels crew conducted repairs but class attendance is required. 66ICLL (88) I/17 17ac

Every ship of 400 GT and above shall record each discharge operation in the ships garbage record book and signed for on the date date of discharge. PSCO observed the vessels garbage record book did not have any records of discharges since 10Aug 2018. However, an interview of the crew revealed the vessel discharges food overboard and had not recorded such discharges.

If a wrong entry has been recorded in the Oil Record Book (ORB), it should immediately be struck through with a single line in such a way that the entry is nstill visible. The wrong entry should be signed and dated. A review of the vessles ORB revealed the use of correction liquid in numerous locations. The use of the fluid made the incorrect entries illegible.

Electrical wiring shall be supported in such a manner as to avoid chafing or other injury. PSCO observed overhead lighting fixture in Port Side steering room in disrepair. Fixture is missing cover and internal wiring is exposed and hanging down. Crew members accessing steering room risk exposure to the hanging wires since the room is approximately one meter in height.

PSCO observed excessive exhaust leakage from prime mover connected to emergency fire pump.

Vessel is experiencing problems with its controllable pitch from the vessesl remote station. Pitch can be controled in the engine room until repairs can be made.
