All passenger accommodations must be arranged and equipped to provide for the safety of the passengers in consideration of the route, modes of operation, and speed of the vessel. Deck rails must be designed and constructed to withstand a point load of 200 pounds applied at any point in any direction, and a uniform load of 50 pounds per foot applied to the top rail in any direction. Multiple cracks were found on the vessels bow structure, rails and canopy which could cause inherent danger for passengers onboard if failure to meet required load strength. 46 CFR 177.800(a) & 46 CFR 177.900(b)
