Alterations and repairs to inspected vessels must be done under the direction of the USCG OCMI. The operator made undocumented alterations to the vessel which are not documented in the approved stability information carried onboard the vessel. The undocumented changes occurred throughout the vessel's service history and without the direction of the USCG OCMI.
The vessel was originally built with two ONAN 12 Kw generators installed in the engine compartment. Both generators and associated piping were removed at an unknown date and stability was not recalculated. The vessel was originally built with a water sprinkler fire protection system. All sprinkler components were removed at an unknown date and stability was not recalculated. This vessel is 75 feet in length and built in 1986. The original stability letter indicates a simplified stability test was performed which should not have been accepted. Discussions took place between the owner and OCMI in 2011 when the stability passenger weights changed and the original stability test was deemed a mistake, however, the COTP did not require a new stability test. The undocumented alterations were unknown when the 2011 COTP decision was provided as per email documentation that was preserved in the vessel hard file. The original simplified stability proof test results are no longer valid due to the undocumented alterations found throughout the vessel's service history and incorrect documentation/approval of a simplified stability test for a vessel over 65 feet in length as per 46 CFR 171.020. The vessel shall comply with stability regulations found in 46 CFR 178.
Updated the "Action" to Code 17 on December 11, 2024 due to the operator failing to meet the extended due date.

Vessels of more than 65 ft in length as well as a vessel with more than 1 deck above the bulkhead deck exclusive of a pilot house must have either permanent draft marks or a loading mark.
The vessel is more than 65 feet and has two passenger decks. Draft marks or a loading mark are not indicated on the hull. Provide draft marks or a loading mark once a new stability letter is issued indicating its placement location on the hull.

A pre-engineered fixed gas fire extinguishing system must: Be capable of manual actuation from outside the space in addition to automatic actuation by a heat detector and automatically shut down all power ventilation systems and all engines that draw intake air from within the protected space.
The pre-engineered FireBoy system had its safety pin installed when inspected by the MI; the pin prevents manual activation from outside of the space. The pin was removed and the system was tested. The test revealed that the mechanical ventilation and engine will not shut down if the FireBoy is deployed.
