Any vessel of at least five net tons which engages in the fisheries on the navigable waters of the United States or in the Exclusive Economic Zone, or coastwise trade, unless exempt under § 67.9(c), must have a Certificate of Documentation bearing a valid endorsement appropriate for the activity in which engaged. Vessels COD is expired. Provide renewed COD to Coast Guard. 46 CFR 67.7

03112 - Scuppers for the drainage of cockpit vessels shall be located to allow rapid clearing of water. MI found the scupper flap in a position that would stop drainage of the deck. Provide plan to the MI for the scupper flap to remain in the proper orientation. Provide plan within seven days and no operations further than 20 mile from shore. 46 CFR 178.420 (a)(1) 705c - 20 miles

09209 - All cable and wire must be installed with metal supports spaced not more than 24 inches apart. MI found wiring in the engine compartment not properly affixed to the bulkhead. Properly affix wires with approved hangers within seven days. 46 CFR 183.340 (b)(4) 705 c - 20 miles

05108 - The service of each ship station must at all times be under the ultimate control of the master. Master was not properly trained or licensed for radio communications found onboard vessel. Furnish the MI with proper licensing for onboard radio communications prior to operating beyond 20 miles from shore. 47 CFR 80.114(a) 705 c - 20 miles

Propulsion machinery must be suitable in type and design for propulsion requirements of the hull in which it is installed and capable of operating at constant marine load under such requirements without exceeding its designed limitations. Vessel lost propulsion following oil leak. Engine to be replaced in kind. 46 CFR 182.200(a)

A vessel must comply with the applicable requirements for any radio and Electronic Position Indicating Radiobeacon (EPIRB) installations, including the requirements for a station license and installation certificates to be issued by the Federal Communications Commission, as set forth in 47 CFR part 80. Vessels operated beyond the 20 nautical mile limitation specified in paragraph (a)(1) of this section, but not more than 100 nautical miles from the nearest land, must be equipped with a MF-DSC frequency transmitter meeting the requirements of § 80.1101(c)(3) and capable of transmitting J3E emission and a receiver capable of reception of J3E emission within the band 1710 to 2850 kHz, in addition to the VHF-DSC radiotelephone installation required by paragraph (a)(1) of this section. The MF or MF-DSC transmitter and receiver must be capable of operation on 2670 kHz. Vessel SSB radio has been removed. Vessel is limited to operation within 20 nautical miles of land. 46 CFR 184.502 47 CFR 80.905(a)(2)

An adult life jacket must be provided for each person carried on board a vessel. 01 adult life jacket was unserviceable. Passenger count is reduced to 09 until life jacket is replaced. 46 CFR 180.71(a)

A pre-engineered fixed gas fire extinguishing system must automatically shut down all engines that draw intake air from within the protected space. The starboard engine remained running while testing engine shutdowns for the pre-engineered fire extinguishing system. Make satisfactory repairs. 46 CFR 181.420(a)(3)

A life float must be approved under approval series 160.027. Each life float must have a platform designed to drop through the center of the float. The metal body for the platform on the second additional 12 person life float was broken at each end. 46 CFR 180.25(a) 46 CFR 160.027-3(a)

Each ring life buoy must be marked with Type II retroreflective material approved in accordance with 46 CFR 164.018. The retro-reflective tape on the ring buoy was degraded and shall be replaced.

Every vessel must be fitted with a suitable magnetic compass designed for marine use, to be mounted at the primary operating station. Vessel's magnetic compass is not mounted due to repairs. Replace. - 46CFR184.402(a)

The marine employer shall ensure that all persons directly involved in a serious marine incident are chemically tested for evidence of dangerous drugs and alcohol in accordance with the requirements of 46 CFR 4.06. Alcohol test strips provided by ASAP used for testing within 2 hours of a serious marine incident are expired. Replace. - 46CFR16.240

Each EAP education program must include the following elements: display and distribution of informational material; display and distribution of community service hot-line telephone number for crewmember assistance, and display and distribution of employer’s policy regarding drug and alcohol use in the workplace. Owner had no record of signed substance abuse policy for each employee as required by program. Provide record of signed policies for each employee to USCG. - 46CFR16.401(a)

An EAP training program must be conducted for the employer’s crewmembers and supervisory personnel. The training program must include at least the following elements: the effects and consequences of drug and alcohol use on personal health, safety, and work environment; the manifestations and behavioral cues that may indicate drug and alcohol use and abuse; and documentation of training given to crewmembers and the employer’s supervisory personnel. Supervisory personnel must receive at least 60 minutes of training. Owner had no record of training for crewmembers or supervisor. Provide record of training to USCG. - 46CFR16.401(b)

Cockpit deck of a cockpit vessel that operates on exposed waters must be at least 10 inches above the deepest load waterline iaw 46CFR178.420(b). Reduce passenger count to 10 passengers 2 crew.

Lifefloat Paddle missing, provide paddle, mark properly to the satisfaction of the attending marine inspector iaw 46CFR180.175(2).
