The owner or operator must conduct all tests as required by the OCMI, and make the vessel available for all specific inspections and drills required by subpart H of this part. In addition, the OCMI may require the vessel to get underway. Vessel was unable to get underway to test operation of the main propulsion machinery or man overboard and fire drills during annual inspection due to starboard engine inoperability. Conduct drills in presence of MI.

Vessels operated beyond the 20 nautical mile limitation specified in paragraph (a)(1) of this section, but not more than 100 nautical miles from the nearest land, must be equipped with a MF-DSC frequency transmitter. Vessel does not have an operable SSB or SAT phone onboard. Vessel route restricted to within 20NM of land until required radio equipment is onboard.

Each door, hatch, or scuttle, used as a means of escape, must be capable of being opened by one person, from either side. Forward escape hatch was unable to be opened from the outside. Replace escape hatch.

A visual indicator must be provided at the operating station to indicate when any automatic bilge pump is operating. Vessel is not equipped with a bilge pump visual indicator. Install visual indicator.

All vessels must have navigation lights that are in compliance with the applicable sections of the International and Inland Navigation Rules. Vessel's anchor light is inop. Replace anchor light.

Each life jacket, immersion suit, and ring life buoy must be marked in clearly legible block capital letters with the vessel's name. Vessel's name on lifering and lifefloat paddle is faded. Write vessel's name on life r ring and paddle.

A hatch exposed to the weather must be watertight. Engine room hatch cover seal is deteriorated. Replace and/or repair seal.

A hatch exposed to the weather must be watertight. Port and starboard fuel shutoff valves are located on aft weatherdeck in a sealed bowl enclosure. Both enclosures are allowing deck water in which is seeping into the engine room.

A vessel must be provided with bilge pumps in accordance with Table 182.520(a). A second power pump is an acceptable alternative to a hand pump if it is supplied by a source of power independent of the first power bilge pump. Individual power pumps used for separate spaces are to be controlled from a central control point and must have a light or other visual means at the control point to indicate operation. Bilge pumping arrangements failed to actuate on initial and multiple subsequent attempts, bilge piping was found disconnected to lazarette and suction in engine room was clogged with debris.

A hatch exposed to the weather must be watertight. The latching mechanism seal of the watertight hatch to the lazarette allows passage of water.

On a vessel of at least 7.9 meters (26 feet) in length, a visual and audible alarm must be provided at the operating station to indicate a high water level in each normally unmanned space. High level alarm panel not connected, high level alarms not providing audible or visual signals to bridge.

A vessel is inspected for compliance with the standards required by this subchapter. Machinery, equipment, materials, and arrangements not covered by standards in this subchapter may be inspected in accordance with standards acceptable to the cognizant OCMI as good marine practice. Port side tail shaft bolts are not tightened completely.

Abandon ship and man overboard drills and training shall be logged or otherwise documented for review by the Coast Guard upon request. Records of drills provided to Coast Guard were minimal and non descriptive. No drill records were available for significant time periods.

Electrical equipment on a vessel must be installed and maintained to protect passengers, crew, other persons, and the vessel from electrical hazards, including fire, caused by or originating in electrical equipment, and electrical shock. There are unterminated wires in the forward compartment, as well as disconnected grounding cables for the anode in lazarette.

The number of penetrations in a watertight bulkhead must be minimized. A penetration in a watertight bulkhead must be as high and as far inboard in the bulkhead as practicable, and made watertight. There is a pinhole opening in the watertight bulkhead between the engine room and the lazarette.

A pre-engineered fixed gas fire extinguishing system must have a means to reset devices used to automatically shut down ventilation systems and engines as required by paragraph (a)(3) of this section. Main engines could not actuate despite Fireboy override enabled. After troubleshooting discovered fireboy override connection was disconnected.

A bilge pipe in a vessel of not more than 19.8 meters (65 feet) in length must be not less than 25 millimeters (1 inch) nominal pipe size. A bilge pipe in a vessel of more than 19.8 meters (65 feet) in length must be not less than 40 millimeters (1.5 inches) nominal pipe size. A bilge suction must be fitted with a suitable strainer having an open area not less than three times the area of the bilge pipe. Engine room bilge suction filled with debris and missing strainer.

Vessels subject to part III of title III of the Communications Act that operate in the waters described in § 80.901 must, at a minimum, be equipped as follows: (1) Vessels operated solely within 20 nautical miles of land must be equipped with a VHF–DSC radiotelephone installation meeting the requirements of § 80.1101(c)(2), except that a VHF radiotelephone installation without DSC capability is permitted until one year after the Coast Guard notifies the Commission that shore-based sea area A1 coverage is established. Vessels in this category must not operate more than 20 nautical miles from land. Vessel’s VHF Radio is not equipped with MMSI or GPS positioning to meet DSC signaling requirements. 47 CFR 80.905(a)(1)

A vessel with installed toilet facilities must have a marine sanitation device that complies with 33 CFR part 159. No person may operate any vessel equipped with installed toilet facilities unless it is equipped with: An operable Type II or III device that has a label on it under § 159.16 or that is certified under § 159.12 or § 159.12a; or An operable Type I device that has a label on it under § 159.16 or that is certified under § 159.12, if the vessel is 19.7 meters (65 feet) or less in length. Vessels toilets are not connected to marine sanitation device.

A vessel is inspected for compliance with the standards required by this subchapter. Machinery, equipment, materials, and arrangements not covered by standards in this subchapter may be inspected in accordance with standards acceptable to the cognizant OCMI as good marine practice. Vessel has a detached, too short, unused shifter cable in engine space that is planned for removal.

Exhaust gas must not leak from the piping or any connections. The piping must be properly supported by noncombustible hangers or blocks. Port side wet exhaust is leaking minimal water and exhaust support structure on starboard side has deteriorated significantly.

A suitable metal marine type strainer, meeting the requirements of the engine manufacturer, must be fitted in the fuel supply line in the engine compartment. Starboard Racor filter is in extremely poor condition, as well as couplings leading to both starboard and port RACOR filters.

Shutoff valves, installed so as to close against the fuel flow, must be fitted in the fuel supply lines, one at the tank connection and one at the engine end of the fuel line to stop fuel flow when servicing accessories. The shutoff valve at the tank must be manually operable from outside the compartment in which the valve is located, preferably from an accessible position on the weather deck. If the handle to the shutoff valve at the tank is located inside the machinery space, it must be located so that the operator does not have to reach more than 300 millimeters (12 inches) into the machinery space and the valve handle must be shielded from flames by the same material the hull is constructed of, or some noncombustible material. Electric solenoid valves must not be used, unless used in addition to the manual valve. Port and Starboard fuel lines are corroded around the fuel shut offs.

The owner or managing operator of a vessel shall ensure that the vessel complies with the laws and regulations applicable to the vessel and that the vessel is otherwise satisfactory for the intended service. Life Float mounting brackets are cracked at the base and allowing water intrusion into deck house.

For a life float—Approved under approval series 160.027 or other standard specified by the Commandant. Forward 15-person life float has broken line attachments. Aft 15-person life float has broken attachments, separation, deterioration and discoloration of cover.

Shutoff valves, installed so as to close against the fuel flow, must be fitted in the fuel supply lines, one at the tank connection and one at the engine end of the fuel line to stop fuel flow when servicing accessories. The shutoff valve at the tank must be manually operable from outside the compartment in which the valve is located, preferably from an accessible position on the weather deck. If the handle to the shutoff valve at the tank is located inside the machinery space, it must be located so that the operator does not have to reach more than 300 millimeters (12 inches) into the machinery space and the valve handle must be shielded from flames by the same material the hull is constructed of, or some noncombustible material. Electric solenoid valves must not be used, unless used in addition to the manual valve. Port fuel shutoff valve coming from main deck is connected via a reach rod and is showing signs of breaking. Replace reach rod.

The lights prescribed in these Rules (Subpart C) shall have an intensity as specified in Annex I to these Rules (33 CFR part 84), so as to be visible at the following minimum ranges: (b) In a vessel of 12 meters or more in length: (i) A masthead light, 5 miles; except that where the length of the vesell is lass than 20 meters, 3 miles; (ii) A sidelight, 2 miles; (iii) A sternlight, 2 miles. Navigation light covers for the following lights found worn to the point where visibility is reduced: port sidelight, masthead, and stern. Replace covers for lights.

A vessel must carry either a first-aid kit that meets the requirements in 46 CFR 199.175(b)(10) or a kit with equivalent contents and instructions. For equivalent kits, the contents must be stowed in a suitable, watertight container that is marked “First-Aid Kit”. A first-aid kit must be easily visible and readily available to the crew. Vessel's first-aid kit contained multiple expired items. Discard expired items and provide a first-aid kit where all items are in serviceable condition.

A vessel must comply with the applicable requirements for any radio and Electronic Position Indicating Radiobeacon (EPIRB) installations, including the requirements for a station license and installation certificates to be issued by the Federal Communications Commission, as set forth in 47 CFR part 80. NOAA EPIRB registration paperwork was not available for inspection. Provide copy of current NOAA EPIRB registration.

Exhaust gas must not leak from the piping or any connections. The piping must be properly supported by noncombustible hangers or blocks. Where flexibility is necessary, a section of flexible metallic hose may be used. Nonmetallic hose may be used for wet exhaust systems provided it is especially adapted to resist the action of oil, acid, and heat, has a wall thickness sufficient to prevent collapsing or panting, and is double clamped where practicable. Port engine exhaust has slow leak near muffler and supports in engine room are wasted. STBD engine exhaust has extensive salt build-up in several locations indicating a leak is present. Repair both exhausts to ensure no leakage and properly supported.

Each lighting fixture globe, lens, or diffuser must have a guard or be made of high strength material, except in an accommodation space, radio room, galley, or similar space where it is not subject to damage. Several lights through engine room, heads, and sewage void did not have proper guards. Ensure all lights on vessel have proper guards.

At each inspection for certification and at every other vessel inspection, quarters, toilet and washing spaces, galleys, serving pantries, lockers, and similar spaces may be examined to determine that they are serviceable and in a sanitary condition. Sewage void had multiple hoses connected to the sewage system that were no longer sufficiently connected with clamps. Ensure all sewage system connections are secure.

Each window, port hole, and its means of attachment to the hull or deck house, must be capable of withstanding the maximum load from wave and wind conditions expected due to its location on the vessel and the authorized route of the vessel. 3 of vessels port light covers are missing fasteners to provide proper weather-tight closure. Provide means to properly close covers.

Electrical equipment on a vessel must be installed and maintained to: (b) Protect passengers, crew, other persons, and the vessel from electrical hazards, including fire, cause by or originating in electrical equipment, and electrical shock. FWD Bulkhead in engine room electrical junction box has exposed dead-end wires. Properly cap or remove unused or existing wires.

At each inspection for certification and at every other vessel inspection all observed unsafe practices, fire hazards, and other hazardous situations must be corrected and all required guards and protective devices must be in satisfactory condition. FWD accommodation space closets contained flammable liquids, including solvents and paints. Remove all hazardous flammable liquids from vessel.

For a vessel described by 46 CFR175.110(c), the training program in paragraph (a) of this section must address firefighting proficiency and must include all items referenced in this part. Provide required training and log into vessels training/drills logs. Federal Register/V.86 No. 245 46 CFR 185.420.

Except as otherwise provided in this section, rails or equivalent protection must be installed near the periphery of all decks of a vessel accessible to passengers or crew. Equivalent protection may include lifelines, wire rope, chains, and bulwarks, which provide strength and support equivalent to fixed rails. Deck rails must include a top rail with the minimum height required by this section, and lower courses or equivalent protection as required by this section. Vessel's rails have excessively loose wire rail courses. Tighten wire cable rail courses around entirety of vessel.

At each initial and subsequent inspection for certification of a vessel, the owner or managing operator shall be prepared to conduct tests and have the vessel ready for inspections of machinery, fuel, and piping systems, including the following: (g) Operational test of all overboard discharge and intake valves and watertight bulkhead pipe penetration valves. Marine Sanitation Device overboard discharge valve has vice grips installed in lieu of a valve handle. Unable to provide visual confirmation of open closed status. Provide proper valve handle to OVBD discharge valve.

Housing around stbd fuel shutoff on main deck was disconnected from the deck and allowing water ingress into the engine room.

At each initial and subsequent inspection for certification of a vessel, the owner or managing operator shall be prepared to conduct tests and have the vessel ready for inspections of machinery, fuel, and piping systems, including the following: (h) Operational test of the means provided for pumping bilges. Pumping of fore-peak bilge space inoperable.

Adult lift jackets must be provided for each person onboard a vessel. Vessel had 21 condemned kapok pfd's. Restricted to carrying 26 adult passengers for hire.

Vessel must carry first aid kit approved under 160.041. First aid kit expired. Replace to satisfaction of MI.

At each inspection, bilges must be free from excessive oil in the bilges. Excessive oil under port main diesel engine. Determine cause of leak and clean oil from bilge.

Vapor barriers must be provided in machinery spaces. Forward engine room bulkhead not vapor tight. Seal to satisfaction of marine inspector.

Electrical equipment installed must minimize accidental contact with electrical hazards. Dead end wires in sewage compartment. Remove or properly terminate.

Each electrical connection must be spliced IAW 46 CFR 183.340. Macerator pump wiring incorrectly spliced. Repair to satisfaction of MI.

VHF Radio capable of DSC must have MMSI and Lat/Long input. MMSI and Lat/Long missing. 47CFR80

The float free link required by 180.130(a)(1) must be: Secured to the painter at one end and to the vessel on the other end. The life float lines need to be re-rigged so that all 4 life floats each connect to the painter.

Each survival craft must be secured to the vessel by a painted with a float free link. The lines that connect the life floats to the painter and the lines that connect the lights to the life floats are deteriorated and need to be replaced.

Each vessel that operates on the high seas must have on board an FCC Type Accepted Category 1, 406 MHz EPIRB, installed to automatically float free and activate. The EPIRB needs to be installed so that it can float free and activate.

Each life float must be fitted with a lifeline, pendants, a painter, and a light. The lights attached to two of the Life Floats have expired batteries that need to be replaced.

Each ring life buoy on a vessel must be readily accessible and slower in a way that it can be rapidly cast loose. The mount for the ring buoy’s light is loose and needs to be repaired/tightened.

A suitable metal type strainer, meeting the requirements of the engine manufacturer, must be fitted in the fuel supply line in the engine compartment. Strainers must be leak free. There is a leak on the supply connection to the fuel filter that needs to be repaired.

46 CFR 182.05-1(a) Propulsion machinery shall be suitable in type and design for propulsion requirements of the hull in which it is installed and capable of operating at constant marine load under such requirements without exceeding its designed limitations. The shaft seal packing on the port engine is leaking water and needs to be repaired.

All vessels must have navigation lights that are in compliance with the International and Inland Navigation Rules. The vessel's stern light is inoperable. The vessel is currently restricted to operating in daylight hours only. During periods of reduced visibility, the vessel is prohibited from operating. 46CFR183.420

Repairs or alterations to the machinery or equipment that affect the safety of the vessel without approval of the cognizant [name withheld] vessel repower, new engines and reduction gears are 600 pounds lighter requiring a new simplified stability test. Vessel required to maintain 300 pounds in bilge beneath port engine and 300 pounds in bilge beneath starboard engine and reduce maximum allowable passengers by 10 passengers until satisfactory simplified stability Test completion is witnessed by an attending qualified Marine Inspector.46 CFR 176.700 (a)

A propulsion engine control system, including pilothouse control must be designed so that a loss of power to the control systems does not result in an increase in shaft speed. Engine was repowered and power to ECM was not disconnected to prove increase in shaft speed does not happen when power is lost.46 CFR 184.620 (c)

Repairs or alterations to the machinery or equipment that affect the safety of the vessel without approval of the cognizant OCMI. Vessel propulsion machinery has been replaced. Stability test, machinery test, and sea trials must be completed prior to the carriage of passengers. 46 CFR 176.700 (c).

Rails on vessels engaged in excursion trips must be at least 39 1/2 inches high. Rail courses or equivalent must have bulwarks, chain link fencing or wire mesh with openings of not more than 4 inches or bar slats, rail courses or an equivalent spaced at intervals not more than 4 inches. Rails are not 39 1/2 inches and are gapped greater than 4 inches. Vessel is engaged in whale watching excursions.46 CFR 177.900

All machinery must be installed and maintained in such a manner as to afford adequate protection against fire, explosion, machinery failure, and personnel injury. Fuel filter outboard fittings have fuel soaked tape on them. Remove tape and repair leak. 46 CFR 182.01-5

All machinery shall be installed and maintained in such a manner as to afford adequate protection against fire, explosion, machinery failure and personnel injury. Port Engine outboard exhaust non-metalic hose is crushed. 46 CFR 182.01-5

An adult life jacket must be provided for each person carried on board a vessel. Three adult lifejackets were condemned and in need of replacement.46 CFR 180.71

Each item of survival craft equipment must be of good quality. 3 of 4 life lights were cracked and not servicable.
