13104 - Each self-propelled vessel must be provided with a power-driven pump, or pumps connected to the bilge main as required. The bilge pump in the forepeak tank was inoperable.

02199 - At each inspection for certification and at every other vessel inspection all observed unsafe practices, fire hazards, and other hazardous situations must be corrected and all required guards and protective devices must be in satisfactory condition. There is a hot water spigot leaking in the engine room. 46 CFR 115.830(a)

A vessel of more than 19.8 meters (65 feet) in length must carry a minimum of three life buoys of not less than 610 millimeters (24 inches) in diameter and be approved in accordance with § 160.050 in subchapter Q of this chapter. 03 of the life rings on board had grab lines which were dry rotted and fraying.

Electric installations on vessels must ensure protection of passengers, crew, other persons, and the vessel from electrical hazards. The starboard generator had ships power wiring pulled from the terminal stuffing box.

Battery installation shall be in accordance with IEEE. Unarmored cables shall not be bent to a radius of less than six times the cables diameter. The battery bank cables were bent in a sharp degree at the box.

A power-driven fire pump shall be installed with a minimum capacity of 50 gallons per minute at a pressure of not less than 60 psi. Vessels fire pumps was inoperable. 46CFR181.10-1 "Old T"

Piping, including valves, pipe fittings and flanges, conveying vapor, gas, or liquid, the temperature of which exceeds 65.5 °C (150 °F), must be insulated where necessary to prevent injuries. A section of lagging on the starboard generator was found to be loose/missing. 46 CFR 116.970

Each lighting fixture globe, lens, or diffuser must have a guard or be made of high strength material. Multiple Light fixtures in the galley, engine room and tank room were missing guards or globes. 46 CFR 120.410(a)

Each lighting fixture and lampholder must be fixed. A fixture must not be supported by the screw shell of a lampholder. Light fixture in the Tank room was found to not be mounted. 46 CFR 120.410(c)(2)

Each individual bilge suction shall be fitted with a suitable bilge strainer having an open area of not less than three times at of the suction pipe. In addition a mud box or basket strainer shall be fitted in an accessible position between the bilge suction manifold and the pump. Bilge suction pipe in the Engine Room was missing the strainer. 46 CFR 56.50-50(g)

Each space accessible to passengers or used by the crew on a regular basis, must have at least two means of escape. Escape hatch from Engine room was found blocked by a table and chairs.

Electrical equipment on a vessel must be installed and maintained to protect passengers, crew, other persons, and the vessel from electrical hazards, including fire, caused by or originating in electrical equipment, and electrical shock. Electrical box for an exterior light on upper deck aft found missing cover with cut/exposed wires.

46 CFR 182.01-5(a), "Old-T; L" - The intent of this part is to insure all machinery be installed and maintained in such a manner as to afford adequate protection against fire, explosion, machinery failure and personnel injury. Vessel had oil leak from hose on port main diesel engine and another oil leak near the turbo on the starboard main diesel engine.

46 CFR 183.10-5(g), "Old-T; L" - For alternating-current generators a means for measuring frequency shall be provided. Vessel's port generator hertz gauge was not working.

46 CFR 176.25-50(a), "Old-T; L" - At each initial and subsequent inspection for certification, reinspection, and at every other vessel inspection the marine inspector shall require that all observed unsafe hazardous situations be corrected. The marine inspector observed what appeared to be oil on the cables coming out of the switchboard. Vessel is to investigate and correct any hazardous condition that may exist.

46 CFR 122.516(a), "Subchapter K" - Placards containing instructions for the donning and use of the life-jackets aboard the vessel must be posted in conspicuous places that are regularly accessible and visible to the crew and passengers. Vessel did not have life-jacket donning placards posted in an accessible or visible manner.

46 CFR 176.25-50(a), "Old-T; L" - At each initial and subsequent inspection for certification, reinspection, and at every other vessel inspection the marine inspector shall require that all observed unsafe hazardous situations be corrected. Vessel's alarm panel had a ground fault error that could not be cleared.

Propulsion machinery must be suitable in type and design for propulsion requirements of the hull in which it is installed and capable of operating at constant marine load under such requirements without exceeding its designed limitations. Internal portion of vessel's PORT tailshaft severed, rendering PORT M/E inoperable. Replace in kind. Demonstrate proper operability and installation to satisfaction of attending MI. 46 CFR 119.200

Propulsion machinery must be suitable in type and design for propulsion requirements of the hull in which it is installed and capable of operating at constant marine load. Vessel's STBD M/E inoperable. Repair as original and complete successful power trials to satisfaction of attending MI. 46 CFR 119.200(a)

All electrical equipment installations shall be to the satisfaction of the Officer in Charge, Marine Inspection [and must be installed and maintained to protect passengers and crew from electrical hazards, including fire, and to prevent electrical ignition of flammable vapors]. Prime-mover for starboard generator is leaking oil into the generator housing, creating a risk of fire while generator is operating. 46 CFR 183-01-15(a) - Old T 46 CFR 120.200

The bilges and other spaces may be examined to see that there is no excessive accumulation of oil that might create a fire hazard. Excessive oil observed in the engine room bilge beneath starboard generator and forward engine room bilge amidship. 46 CFR 115.830

The position of the rudder, if power operated, must be shown at the principle steering station. Rudder angle indicator was inoperable during steering system test at the principle steering station. 46 CFR 113.40-5

Each ring life buoy must be marked with Type II retroreflective material approved in accordance with accordance with § 164.018 in subchapter Q and in an arrangement specified by IMO Resolution A.658(16). All ring life buoys onboard are missing retroreflective material.

Vessel must conduct MOB and fire drills.

Vessel was boarded for a possible overload condition last night 18/19 Aug by Station New York, NYPD, and NY Health Department. No overload condition was found however the vessel has major fire, electrical hazards to include improper wiring, oil on the engine block and manifold, 13" of oil mixture in the engine room bilge. Vessel must have a full inspection by Sector New York inspection office prior to operating with passengers, must show full compliance with all applicable regulations.

Vessel has appeared to operate with crew members that are not enrolled or compliant with DAPI. Vessel must show compliance with all regulations.

Vessel has sewage leaks and unsanitary conditions, must complete sanitary inspection by state and USCG.

Vessel has made unauthorized modifications to several area's to include security/vault area, must provide all drawings, electrical one line diagram and materials used list for approval.

Vessel has many large speakers throughout the vessel which are not included in the stability inspection, must show compliance with stability calculations that have been approved.

The vessel has serious deficiencies to portions of the firefighting equipment and its capabilities, electrical hazards to the crew and passengers, machinery equipment improperly maintained, bilges filled with oily water, modifications and alterations which added significant weight after approved stability test, inoperable security equipment, and unsanitary conditions; which caused insufficiency of operational proficiency and unfamiliarity of essential operational procedures by the master and crew. All this combined puts the vessel in an unsafe condition, lives at risk, and is a danger to the port of New York. The [name withheld] is a SPV-TL, therefore not required a Safety Management System (SMS) per regulation. Sector NY has found the following deficiencies to be objective evidence that a serious substandard condition has not been pro-actively managed by the vessel's owner/operator.

Vessel must submit to Marine Safety Center (MSC) and Sector New York for approval all drawings, electrical load analysis, material list and manufacturer information sheets, for all modifications/alterations to the vessel since its last approval.

Vessel arrangements are not as original due to new operations and modifications so a new general arrangement drawing, fire control plan, and safety equipment drawing shall be submitted to USCG for approval.

Vessel operator shall be prepared to test the steering systems of the vessel. Vessel must have USCG Marine Inspector witness safe operation of vessel propulsion and maneuverability prior to getting underway with passengers.

A vessel must carry adequate and up-to-date charts of large enough scale to make safe navigation possible. Vessel operator must purchase an updated marine chart and retain on board the vessel.

MW01: Provide drug testing results for selected crew members.

MW02: Post EAP Placard.

MW03: Repair Ground Detection meter.

MW04: Provide FCC Station Authorization and Bridge to Bridge Radio-telephony Certificates.

Appropriately affix the PA speaker portside aft at passenger access deck (deck 3).

Store lifejackets in lockers accordingly, as per amount and type on placard.

Affix appropriate placard for children lifejackets storing location.

Secure excess portable fire extinguishers.

Provide up-to-date navigation publications and charts for all operational areas.

Provide cover protecting breakers at MD#3 breaker panel in way to engine room, and label breakers.
