Each vessel certificated to operate on a limited coastwise route within three miles of land in warm water must: Have on board a FCC Type Accepted Category 1 406 MHz EPIRB, installed to automatically float free and activate, and not be required to carry survival craft. Hydrostatic release for EPIRB is expired. Replace with valid hydrostatic release for EPRIBs.

A vessel not required to have a power driven fire pump by 181.300 must have at least three 2 1/2 gallon buckets, with an attached lanyard satisfactory to the cognizant OCMI, placed so as to be easily available during an emergency. The words “FIRE BUCKET” must be stenciled in a contrasting color on each bucket.. The vessel had two fire buckets, only one was serviceable. Procure more fire buckets to have a total of 03 meeting the above regulation. 46 CFR 181.610

Except when in the judgment of the cognizant OCMI the operation of a vessel does not present one of the hazards listed, the emergency instruction placard should contain at least the applicable portions of the “Emergency Instructions” listed in § 185.512. Emergency instructions for rough weather were not posted. Post instructions to the satisfaction of the attending marine inspector. 46 CFR 185.510

Except for a storage battery used in a rescue boat, each battery without an expiration date indicated on it or for which the owner or managing operator does not have a record of the expiration date, used in an item of lifesaving equipment, must be replaced during the annual inspection. The waterlights battery was found with written 9/23, it was unknown if it was the expiry date or installed date. Replace with manufacturer approved battery for marine use to the satisfaction of the attending marine inspector. 46 CFR 185.726 (e)

The name of a vessel must be marked or painted in clearly legible letters and numbers: (2) On each life float and buoyant apparatus. The vessels’ name was no longer legible on the life float. Renew or replace label so the vessel’s name is legible to the satisfaction of the attending marine inspector. 46 CFR 185.604

Placards containing instructions for the donning and use of the life jackets aboard the vessel must be posted in conspicuous places that are regularly accessible and visible to the crew and passengers. The vessel has two different styles of life vest donning instructions. 15 adult life vests onboard do not have the appropriate donning instructions posted. Reduce passenger count to 26 adult. Provide correct donning instructions for all life vests carried by the vessel to the satisfaction of the attending marine inspector. 46CFR185.516(a)

A vessel must comply with the applicable requirements for any radio installations, including the requirements for a station license and installation certificates to be issued by the Federal Communications Commission, as set forth in 47 CFR part 80. The vessels MMSI number on the FCC certificate does not match the MMSI number for the radio. The owner needs to correct the radio station authorization certificate to match the installed radios MMSI number to the satisfaction of the attending marine inspector. 46 CFR 184.502

A vessel on a limited coastwise route must carry six hand red flare distress signals and six hand orange smoke signals. A red hand flare distress signal may be substituted for any of the hand orange smoke distress signals. Vessel missing one (1) oranges smoke distress signals. Provide 01 orange distress smoke signal or an approved substitution under this section by September 20, 2024. Vessel operations is restricted to Lakes, Bays, and Sounds until resolved to the satisfaction of the attending Marine Inspector. 46 CFR 180.68

A power-driven vessel of less than 12 meters in length may, in lieu of the lights prescribed in paragraph (a) of this Rule, exhibit an all-round white light and sidelights. Vessel exhibits an all-round white light and a white stern light, which is not permitted under Navigation Rule 23. Arrange vessels navigation lights to meet prescribed lights under this rule to the satisfaction of the attending Marine Inspector. 33 CFR 83.23(d)

At least one ring life buoy must be fitted with a lifeline. If more than one ring life buoy is carried, at least one must not have a lifeline attached. Each lifeline on a ring life buoy must be of at least 18.3 meters (60 feet) in length. Vessel ring life buoy lifeline was 54 feet. Provide a 60 foot lifeline for the ring life buoy to the satisfaction of the attending Marine Inspector. 46 CFR 180.70(c)(2)

Electrical equipment on a vessel must be installed and maintained to protect passengers, crew, other persons, and the vessel from electrical hazards, including fire, caused by or originating in electrical equipment, and electrical shock. There are two (2) dead end cables under the flying bridge operating station. Decommission the cables to the satisfaction of the attending Marine Inspector. 46 CFR 183.200(b)

A submersible electric bilge pump may be used as a power bilge pump required by Table 182.520(a) only on a vessel of not more than 19.8 meters (65 feet) in length carrying not more than 49 passengers, other than a ferry, provided that:(1) The pump is listed by an independent laboratory as meeting the requirements in UL 1113. The two electric bilge pumps were not UL listed. 1)Provide two UL listed submersible electric bilge pumps and prove operation in the presence of the marine inspector; or 2) Meet the bilge pump requirements in Table 182.520(a) to the satisfaction of the attending Marine Inspector. 46 CFR 182.520(e)(1)

EAP training program: An EAP training program must be conducted for the employer's crewmembers and supervisory personnel. The training program must include at least the following elements: the effects and consequences of drug and alcohol use on personal health, safety, and work environment; the manifestations and behavioral cues that may indicate drug and alcohol use and abuse; and documentation of training given to crewmembers and the employer's supervisory personnel. Supervisory personnel must receive at least 60 minutes of training. Crew members and supervisory personnel did not receive the above required training. Provide an attendance roster for the training described above signed/dated by company crew members, supervisory personnel, and DER to the satisfaction of the attending Marine Inspector. 46 CFR 16.401(b)

A vessel must comply with the applicable requirements for any radio and Electronic Position Indicating Radiobeacon (EPIRB) installations, including the requirements for a station license and installation certificates to be issued by the FCC, as set forth in 47 CFR part 80. Vessel call sign is incorrect on the Communications Act Safety Radiotelephony Certificate. Provide certificate with correct call sign to the satisfaction of the attending Marine Inspector. 46 CFR 184.502

Drug testing programs required by this part must be conducted in accordance with 49 CFR part 40, Procedures for Transportation Workplace Testing Programs. This subpart summarizes the responsibilities of credentialed mariners, marine employers, MRO, SAP and other chemical testing service providers in 49 CFR part 40. The regulations in 49 CFR part 40 should be consulted to determine the specific procedures which must be established and utilized. The owner is the DER and in the random test selection pool. Provide documentation from the company's consortium that when the DER is selected for random testing the notification will be sent to a disinterested third party to ensure the test notification is truly random and unannounced to the satisfaction of the attending Marine Inspector. 46 CFR 16.113(a)

An inspected vessel may be inspected in accordance with the standards acceptable to the cognizant OCMI as good marine practice. Vessel had no posted notifications that prohibited access to operating station by passengers. Affix a means to prohibit or restrict passenger access, to the satisfaction of the attending Marine Inspector. 46 CFR 176.800(a)

A vessel must comply with the applicable requirements for any radio and Electronic Position Indicating Radiobeacon (EPIRB) installations, including the requirements for a station license and installation certificates to be issued by the FCC, as set forth in 47 CFR part 80. The owner/operator is designated as EPIRB emergency contact. Amend the registration form emergency contacts to a individual that does not perform duties aboard the vessel, to the satisfaction to the attending Marine Inspector. 46 CFR 184.502

At each initial and subsequent inspection for certification of a vessel, the owner or managing operator shall be prepared to conduct tests and have the vessel ready for inspections of machinery, fuel, and piping systems, including the following: Operation of the main propulsion machinery both ahead and astern. Starboard outboard engine was not operational. Repair engine and demonstrate operation to attending Marine Inspector. 46 CFR 176.804

At each inspection the marine inspector may require that an abandon ship or man overboard drill be held under simulated emergency conditions specified by the inspector. Drills have not been conducted. Conduct drills to the satisfaction of the attending Marine Inspector prior to the carriage of passengers. 46CFR176.808(g)

At each initial and subsequent inspection for certification of a vessel, the owner or managing operator shall be prepared to conduct tests and have the vessel ready for inspections of machinery, fuel, and piping systems, including the following: Operation of the main propulsion machinery both ahead and astern. Port outboard engine was not operational. Repair engine and demonstrate operation to attending Marine Inspector. 46 CFR 176.804

A visual and audible alarm must be provided at the operating station to indicate a high water level in each of the following normally unmanned spaces. Stbd bilge alarm light is not operational. 46 CFR 182.530(a)

Portable and semi-portable extinguishers must be inspected and maintained in accordance with NFPA 10. Fire extinguisher on second deck has not been serviced in 2 years. Provide satisfactory evidence of the required servicing to the marine inspector. 46CFR176.810(b)(1)

A submersible electric bilge pump may be used as a power bilge pump required by Table 182.520(a) only on a vessel of not more than 19.8 meters (65 feet) in length carrying not more than 49 passengers, other than a ferry, provided that: The pump is permanently mounted. Bilge pump was held in place by weights. Permanently mount bilge pump. 46 CFR 182.520

The name of the vessel must be marked on some clearly visible exterior part of the port and starboard bow and the stern of the vessel. The hailing port of the vessel must be marked on some clearly visible exterior part of the stern of the vessel. The name of the vessel and hailing port were not marked on the vessel. Mark vessel with both name and hailing port. 46 CFR 67.123 (a)

The EPIRB's battery is replaced after it is used, or before the date required by FCC regulations in 47 CFR part 80, whichever comes sooner. The battery date on the sticker on the EPIRB was expired. Place new sticker on EPIRB. 46 CFR 185.728 (b)

Electrical equipment on a vessel must be installed and maintained to minimize accidental personnel contact with energized parts. Dead end wires found in behind operating console. Remove or properly terminate wires. 46CFR183.200(c)

Electrical equipment on a vessel must be installed and maintained to: Prevent electrical ignition of flammable vapors. Gasoline fuel lines and fuel filters are located in enclosed compartments containing electrical equipment. Provide proposal for review and approval by our office. Upon proposal approval the issue must be resolved prior to carrying passengers. This deficiency supersedes the previous deficiency 7 issued during this inspection. 46 CFR 183.200(d)

All vessels must have operable navigation lights in accordance with the Navigation Rules. The vessel’s mast navigation light is extinguished. 46 CFR 183.420

A Certificate of Documentation is required for the operation of a vessel in certain trades, serves as evidence of vessel nationality, and permits a vessel to be subject to preferred mortgages. A valid Certificate of Documentation was not present for inspection. Provide valid Certificate of Documentation. 46 CFR 67.1

A vessel must carry either a first-aid kit approved under approval series 160.041 or a kit with equivalent contents and instructions. For equivalent kits, the contents must be stowed in a suitable, watertight container that is marked “First-Aid Kit”. A first-aid kit must be easily visible and readily available to the crew. The first-aid kit is expired. Replace expired medication. 46 CFR 184.710

Remote fuel shutoff stations must be marked in clearly legible letters at least 25 millimeters (1 inch) high indicating purpose of the valve and direction of operation. Fuel shutoff valves not labeled. Label fuel shutoff valves. 46 CFR 185.608

A conductor of a control, interlock, or indicator circuit, such as a conductor for an instrument, pilot light, ground detector light, or potential transformer, must be protected by an overcurrent device. Vessel's high water alarms do not have overcurrent protection. Install fuse. 46 CFR 183.380(c)

Any time passengers are embarked on a passenger vessel, the vessel must have the crew complement required by the COI, whether the vessel is underway, at anchor, made fast to shore, or aground. However, the master may allow reduced crew for limited or special operating conditions subject to the approval of the OCMI. The vessel does not have written procedures, AED pads, or Medical grade oxygen as required by Work Instruction 31. Provide written procedures, AED pads, and medical grade oxygen. Vessel cannot reduce the COI manning under Work Instruction 31 until the requirements above are to the satisfaction of the attending MI. 46 CFR 15.515(b)

Electrical equipment in spaces containing machinery powered by, or fuel tanks for, gasoline or other fuels having a flash point of 43.3 °C (110 °F) or lower must be explosion-proof or ignition-protected, or be part of an intrinsically safe system. Explosion-proof equipment and intrinsically safe systems must meet the requirements of 46 CFR § 111.105 in subchapter J of this chapter. Gasoline fuel filters and fuel lines for machinery powered by gasoline are located in enclosed port and starboard compartments containing a battery and associated battery cables. Resolve by 1) meet the explosion-proof or ignition-protected, or be part of an intrinsically safe system meeting the requirements of 46 CFR § 111.105 in subchapter J; 2) relocate the fuel filters and fuel lines outside of the enclosed space containing the battery and associated battery cables; 3) permanently separate the fuel filters and fuel lines from the batteries and battery cables. The new compartment (if enclosed or partially enclosed) containing the filters and fuel lines must meet the requirements of 46 CFR § 182.460; or 4) Install a flammable vapor detection system meeting the requirements of 46 CFR § 182.480 46 CFR 183.530

A vessel must comply with the structural design requirements of one of the standards listed. Fractured weld in starboard side swim ladder. Repair in dry dock October 2022. 46 CFR 177.300

Except on a vessel limited to daytime operations, the compass must be illuminated. 46CFR 184.402(c)

Windows and other openings at the operating station must be of sufficient size and properly located to provide an adequate view for safe navigation in all operating conditions. Three windows at the main deck operating station do not provide adequate visibility for navigation. 46 CFR 177.1030 (a)

A vessel is inspected for compliance with the standards required by this subchapter. Machinery, equipment, materials, and arrangements not covered by standards in this subchapter may be inspected in accordance with standards acceptable to the cognizant OCMI as good marine practice. Vessel has through hull penetration not in operation. Provide means of permanent closure as near to the hull as practicable. 46 CFR 176.800 (a)

A submersible electric bilge pump may be used as a power bilge pump required by Table 182.520(a) only on a vessel of not more than 19.8 meters (65 feet) in length carrying not more than 49 passengers, other than a ferry, provided that the pump is listed by an independent laboratory as meeting the requirements in UL 1113 (incorporated by reference; see 46 CFR 175.600). Vessel’s bilge pumps are not UL rated. 46 CFR 182.520 (e)(1)

Marine employers shall establish programs for the chemical testing for dangerous drugs on a random basis of crewmembers on inspected vessels who occupy a position or perform the duties and functions of a position, required by the vessel's COI. Marine employers may form or otherwise use sponsoring organizations, or may use contractors to conduct the random chemical testing programs. Vessel's consortium enrollment paperwork does not contain all crew members and has people listed incorrectly as licensed or unlicensed personnel. 46 CFR 16.230(a)

The owner, managing operator, or a qualified servicing facility must conduct portable fire extinguisher inspections in accordance with NFPA 10. A tag issued by a qualified servicing organization may be accepted as evidence. Servicing tag on the portable extinguisher at the fly bridge operating station is expired. 46 CFR 176.810(b)

The Certificate of Inspection issued to a vessel describes the vessels minimum manning requirements and any equivalences accepted or authorized by the cognizant [name withheld] required deckhand enters the water during in water passenger activities in accordance with Sector Honolulu Work Instruction (WI) 31. WI 31 requires the vessel to carry medical oxygen. Vessel’s medical oxygen was empty. 46 CFR 176.103

Electrical equipment on a vessel must be installed and maintained to: protect passengers, crew and the vessel from electrical hazards. Dead end wires were observed in the following locations: under the lower operating station console; under the port bench IVO the water tank; lower port speaker wiring. Remove or properly terminate the dead end wires to the satisfaction of the Marine Inspector. 46CFR183.200(b)

Flexible hose installed in lengths of not more than 30 inches and subject to pressures of not more than 5 psi, may be installed with two clamps, at the ends of each hose. The port and starboard electric submersible bilge were found to be secured with a single hose clamp. Hose clamp added in the presence of the Marine Inspector. 46 CFR 182.720(e)(3)(v)

Connections must be made to battery terminals with permanent type connectors. The starboard starting battery had wing-nut type connectors. Wing nuts were replaced with permanent type connectors in the presence of the Marine Inspector. 46 CFR 183.350

Vessels operated solely within 20 nautical miles of land must be equipped with a VHF-DSC radiotelephone installation meeting the requirements of § 80.1101(c)(2). VHF radio missing MMSI and LAT/LONG for DSC operation on upper operating station VHF radio, and missing LAT/LONG for lower operating station VHF radio. 47 CFR 80.905

Each flare carried to meet this section must be stowed in one of the following: (1) a portable watertight container marked as required by 46 CFR 185.614, carried at the operating station. Vessels portable watertight container damaged and no longer watertight. 46 CFR 180.68 (e)

The name of the vessel must be marked on some clearly visible exterior part of the port and starboard bow and the stern of the vessel. No name on starboard bow. Must be at least 4 inches in height. 46 CFR 185.602(a) 46 CFR 67.123 (a)

A hatch exposed to the weather must be watertight. Gasket material for each of the vessel's port window deteriorated does not provide a watertight seal and allow ingress of water. 46 CFR 179.360

When operating a vessel on a body of water where the discharge of untreated sewage is prohibited, the operator must secure each Type III device in a manner which prevents discharge of sewage. Acceptable methods include - (1) closing each valve and removing the handle; (2) padlocking each valve in the closed position; (3) Using a non-releasable wire tie to hold each valve in the closed position. Vessel has type III MSD system and system was not secured to prevent discharge. 33 CFR 159.7 (c)

Vessel has 02 hatches on the main deck that are not watertight. Vessel is required to install Bilge High Level Alarms for the 02 compartments iaw 46 CFR 182.530 (a)(3). If you can demonstrate the hatches are watertight, then the bilge high level alarms will not be required.

Each vessel certificated to operate on a limited coastwise route within 3 miles of land must either: (3) Have onboard a FCC Type accepted Category 1 406MHz EPIRB installed to automatically float free and activate and not be required to carry survival craft; vessel EPIRB battery is expired. replace EPIRB or EPIRB Battery.

Secure disconnected electrical wiring.

Provide proof of EPIRB Registration.
