For the purpose of this subpart, rooms containing “fire resistant furnishings” are considered to be those in which: Furniture such as chairs, sofas, and similar items are tested and meet the requirements in UL 1056 “Fire Test of Upholstered Furniture,” or meet the requirements in § 72.05-55 in subchapter H of this chapter. 46 CFR 116.115 states: when outfit items such as furnishings and mattresses are renewed, they must comply with the regulations in this part. 46 CFR 114.400 defines low risk service spaces as an accommodation space that contains only fire resistant furnishings and a fire load not greater than 3 pounds per square foot. New chairs were purchased for the dining spaces on board the vessel that are located in Category 5 (Low Risk Accommodation) spaces according to the space categorization plan. However these chairs do not meet the definition of "fire resistant furnishings" in subpart K or the guidance found in NVIC 9-97 (Ch. 1)page 37 which allows for the standard of CAL TB 133. The fire load calculations submitted to MSC account for the fire load of the chairs but do not address the approval of the chairs which is required to be submitted with the plan in accordance with PRG H2-14 page 2. 46 CFR 116.423(a)(1) 46 CFR 116.115(b) 46 CFR 114.400 46 CFR 116.427

At each initial and subsequent inspection for certification, the marine inspector may require that a fire drill, abandon ship drill, or man overboard drill be held under simulated emergency conditions to be specified by the inspector. A class bulkheads must be so insulated with approved structural insulation, bulkhead panels, or deck covering so that, if subjected to the standard fire test for the applicable time period listed. The structural fire protection insulation located in the overhead in the galley was replaced during this yard period, however the operator was unable to provide proof that the insulation meet A-15 standards. The only approval given was for 164.009 which is for noncombustible materials and not under 164.007 for structural insulation. 46 CFR 116.416(a)(2)(i)

Propulsion machinery must be suitable in type and design for propulsion requirements of the hull in which it is installed and capable of operating at constant marine load under such requirements without exceeding its designed limitations. The vessel's propulsion is currently set up for 8 speeds forward and 4 speeds astern utilizing a diesel electric system. The owner requested to not run the vessel to the 8 forward setting during seal trials due to the vessel not being operated on a normal basis in that manner. Owner to submit a plan to ensure that vessel is not operated past 7 and also prove safety operations at lower design speed. 46 CFR 119.200(a)
