Where flexible nonmetallic hose is permitted for use in piping systems by this section, it must meet SAE J-1942. Flexible nonmetallic hose may be used in lube oil and fuel oil systems, for the purpose of flexibility only, flexible hose installed in lengths of not more than 760 millimeters (30 inches). Hose end fittings must comply with SAE J-1475. MI observed two fuel lines with fittings that were not the type required by this regulation, and were of a length over 30 inches. 46 CFR 182.720(e)(1)

At each initial and subsequent inspection for certification the owner or managing operator shall be prepared to test and make available for inspection all items in the ship's outfit which are required to be carried by the regulations in this subchapter, as necessary to determine that they are fit for the service intended. MI observed that the dive ladder on the vessel was wasted through in one section. 46 CFR 176.816 16c

Except as otherwise allowed by this subpart, a vessel must comply with the structural design requirements for fiber reinforced plastic vessels. MI observed area of fiberglass damage on aft dive platform. 46 CFR 177.300(c)

Remote fuel shutoff stations must be marked in clearly legible letters at least 25 millimeters (1 inch) high indicating purpose of the valve and direction of operation. MI observed that the remote fuel shut off valves markings were not visible in the normal operating condition for the vessel. 46 CFR 185.608 16c

On a vessel of at least 7.9 meters (26 feet) in length, a visual and audible alarm must be provided at the operating station to indicate a high water level in normally unmanned spaces. MI observed that the high level visual alarms at the operating station did not indicate which bilge pump is operating. 46 CFR 182.530(a) 16c

The owner or managing operator of a vessel shall ensure that the vessel complies with the laws and regulations applicable to the vessel and that the vessel is otherwise satisfactory for the intended service. The initial inspection may include an inspection of the following items: Certificates and operating manuals. MI observed that the NOAA Beacon registration form for the vessel's EPIRB had expired. 46 CFR 176.402(c)(3)

An adult life jacket must be provided for each person carried on board a vessel. MI observed two missing lifejackets. Capacity is limited to 22 persons onboard until lifejackets are replaced and verified by the CG. 46 CFR 180.71(a)

Vessel must undergo an annual inspection as specified in paragraph (b)(1) of this section. Vessel must undergo an annual inspection within 3 months before or after each anniversary date. Vessels anniversary date was 14FEB202024, and vessel is past 3 months from said date. Vessel shall not operate with passengers until an annual inspection has been completed. 46CFR176.500(b) - 701C

Any vessel of at least five net tons which engages in fisheries on the navigable water of the United States or in the EEZ or coastwise trade must have a certificate of documentation. Vessel did not have COD onboard. 46 CFR 67.7

The minimum number of portable fire extinguishers required on each vessel shall be as determined by the Officer in charge, marine inspections, in accordance with Table 181.30-1(a) and other provisions of this sub part. Fire extinguisher located at operating station was not charged. 46 CFR 181.30-1(a)

Except as otherwise provided in this section, all vessels shall carry pyrotechnic distress signals as follows: 6 hand red flares distress signals, and 6 hand orange smoke distress signals; or, 12 hand combination flare and smoke distress signals. Vessel had 6 hand orange smoke distress signals, and 4 hand red flare distress signals. 46 CFR 180.68(a)

Each inflatable liferaft, inflatable buoyant apparatus, life float, and buoyant apparatus on the vessel on March 11, 1996, may be used to meet the requirements of this part for these survival craft as long as the survival craft is continued in use on the vessel, and is in good and serviceable condition. Life float was deteriorated and not serviceable for it's intended route. **Vessel reduced to Lakes, Bays & Sounds route.** 46 CFR 180.15(d)

The master of the vessel shall ensure that: (a) Each EPIRB, other than an EPIRB in an inflatable liferaft, must be tested monthly, using the integrated test circuit and output indicator, to determine that it is operative; (b) The EPIRB's battery is replaced after it is used, or before the date required by FCC regulations in 47 CFR part 80, whichever comes sooner; and (c) The EPIRB test required by paragraph (a) shall be logged or otherwise documented, as applicable. EPIRB battery expired in February 2023, but EPIRB checks were completed for March, April, May and June of 2023 **Vessel is reduced to Lakes, Bays & Sounds route.** 46 CFR 185.728

The master and crew of a vessel will be familiar with the content of and have mounted at the operating station, emergency instructions containing the actions to be taken in the event of fire, heavy weather, or man overboard conditions. Vessel did not have emergency instructions posted onboard. 46 CFR 185.510(a)

If fire is in machinery spaces, shut off fuel supply and ventilation and activate fixed extinguishing system if installed. A vessel on which a pre-engineered fixed gas fire extinguishing system is installed must have the following equipment at the operating station: A means to reset devices used to automatically shut down ventilation systems and engines. Captain did not know how to activate fixed system or how to reset/override engine at the operating station. 46 CFR 185.512(a)(3)(iv) 46 CFR 181.420(b)(3)

For fixed-gas fire extinguishing systems, the inspections and tests required by Table 176.810(b) of this section, in addition to the tests required by 46 CFR 147.60 and 147.65. The owner or managing operator must provide satisfactory evidence of the required servicing to the marine inspector. Vessel did not have annual servicing reports for the installed fixed fire suppression system. Provide report. 46 CFR 176.810(b)(2)

This part is intended to provide a minimum standard of regulations for electrical installations and equipment that will result in a vessel that is reasonably safe from fire caused by and/or originating in electrical equipment, and reasonably safe from electrical shock of personnel. Discovered dead end wire under the main operating station. 46 CFR 183.01-5(a)

It is further intended that all machinery be installed and maintained in such a manner as to afford adequate protection against fire, explosion, machinery failure and personnel injury. Discovered excessive shaft seal leak while the vessel was moored and underway. 46 CFR 182.01-5(a)

It is further intended that all machinery be installed and maintained in such a manner as to afford adequate protection against fire, explosion, machinery failure and personnel injury. Discovered exhaust leak on the main diesel engine. 46 CFR 182.01-5(a)

Flexible hose designed for use with hose clamps may be installed with two clamps, at both ends of the hose. Fuel filter hose for the main diesel engine was not double clamped. 46 CFR 182.720(e)(v)(B)

A marine employer whose vessel is involved in a casualty or incident that is, or is likely to become, a serious marine incident as defined in § 4.03–2 of subchapter A of this chapter shall comply with the requirements of § 4.06 in subchapter A of this chapter...The marine employer must have a sufficient number of alcohol testing devices readily accessible on board the vessel to determine the presence of alcohol in the system of each individual who was directly involved in the SMI. Vessel did not have alcohol test strips onboard. 46 CFR 185.212 46 CFR 4.06-15(a)(1)

A vessel must carry either a first-aid kit that meets the requirements in 46 CFR 199.175(b)(10) or a kit with equivalent contents and instructions...Each first-aid kit must meet the requirements in ISO 18813:2006(E) paragraph 4.12 (incorporated by reference, see § 199.05). (i) A first-aid kit may be considered acceptable if it meets all of the requirements of ISO 18813:2006(E) paragraph 4.12, except that it does not contain the burn preparations. It must be clearly marked on the first-aid kit that it does not include the burn preparations. Vessel's analgesic medications were expired. 46 CFR 184.710 46 CFR 199.175(b)(10)

Your vessel must undergo an annual inspection within the 3 months before or after each anniversary date. The vessel has a COI anniversary date of 14FEB. The vessel was required to have an annual inspection no later than 14MAY23, and the vessel has not had an annual inspection for this year. 46 CFR 176.500(b)(1)

Any vessel of at least five net tons which engages in the fisheries on the navigable waters of the United States or in the Exclusive Economic Zone, or coastwise trade, unless exempt under § 67.9(c), must have a Certificate of Documentation bearing a valid endorsement appropriate for the activity in which engaged. The original COD was not found onboard. 46 CFR 67.7

As appropriate for the intended voyage, a vessel must carry adequate and up-to-date: Charts of large enough scale to make safe navigation possible. No navigation charts were found onboard. 46 CFR 184.420

Each item of survival craft equipment must be of good quality, and efficient for the purpose it is intended to serve. The life float was color was found deteriorated and does not meet the Q specification for color. 46 CFR 180.175

Each portable fire extinguisher on a vessel must be of an approved type. The minimum number of portable fire extinguishers required on a vessel must be acceptable to the cognizant Officer in Charge, Marine Inspection, but must not be fewer than the minimum number required by Table 181.500(b) and other provisions of this section. One 40 BC portable fire extinguisher was found without a charge. 46 CFR 181.500

Repairs or alterations to the hull, machinery, or equipment that affect the safety of the vessel must not be made without the approval of the cognizant OCMI, except during an emergency. When repairs are made during an emergency, the owner, managing operator, or master shall notify the OCMI as soon as practicable after such repairs or alternations are made. Repairs or alterations that affect the safety of the vessel include, but are not limited to: replacement, repair, or refastening of deck or hull planking, plating, and structural members; repair of plate or frame cracks; damage repair or replacement, other than replacement in kind, of electrical wiring, fuel lines, tanks, boilers and other pressure vessels, and steering, propulsion and power supply systems; alterations affecting stability; and repair or alteration of lifesaving, fire detecting, or fire extinguishing equipment. Identified the steering packing leaking during an operational test of the steering gear. 46 CFR 176.700

A hatch exposed to the weather must be watertight. MI found the flush deck hatch to the laz space is leaking water and is not watertight. 46 CFR 171.124

Fuses must be of the cartridge type only and be listed by Underwriters Laboratories or another independent laboratory recognized by the Commandant. The conductors for the battery charger are missing overcurrent protection. 46 CFR 183.380

Repairs or alterations to the hull, machinery, or equipment that affect the safety of the vessel must be made without the approval of the cognizant OCMI, except during an emergency. The owner or managing operator shall submit drawings, sketches, or details of any proposed alterations to the cognizant [name withheld] alterations must be approved by the OCMI before work is started. Vessel was found to be outfitted with electric submersible bilge pumps that were installed with no submission of drawings or proposal to local OCMI for approval/acceptance. MI reviewed local vessel file and found no documentation for the approval/installation of new system. Vessel also has an installed bilge system piping and valves that appears to be from initial construction of the vessel and is not being used after. Vessel owner has the option of meeting regulatory compliance for installed electric submersible bilge pumps with the submission and approval of electrical plans/diagrams to the Marine Safety Center or prove proper operation of the original bilge system that was installed at initial construction. 46 CFR 176.700

A submersible electric bilge pump may be used as a power bilge pump required by Table 182.520(a) only on a vessel of not more than 19.8 meters (65 feet) in length carrying not more than 49 passengers provided that: A positive shutoff valve is installed at the hull penetration. The bilge system does not have positive shutoff valves installed at the hull penetrations for each individual bilge line going overboard. Install positive shutoff valves for each overboard bilge discharge line. 46 CFR 182.520(e)(7)

Remote fuel shutoff stations shall be marked in at least 1 inch letters indicating purpose of the valve and direction of operation. Markings were not of appropriate height and contained no directional information. 46 CFR 185.30-20

Repairs or alterations to the hull, machinery, or equipment that affect the safety of the vessel must not be made without the approval of the cognizant [name withheld] rails located on the stern of vessel had severe corrosion and holes where they mount to vessel. Provide plan proposal for repair or replacement. 46 CFR 176.700

A hatch exposed to the weather must be watertight. MI found drain in aft hatch to have no piping and no indication of where the drain led. With current configuration any water taken on during normal operations would fill aft steering compartment creating potential flooding. 46 CFR 179.360(a)

Placards containing instructions for the donning and use of the life jackets aboard the vessel must be posted in conspicuous places that are regularly accessible and visible to the crew and passengers. MI found two different types of life jackets on board. Both types of donning instructions are required to be on board the vessel. 46 CFR 185.516(a)

Each vessel must be equipped with at least two operable portable battery lights. Vessel had 01 operable portable light. 46 CFR 183.430

A vessel must carry either a first-aid kit approved under approval series 160.041 or a kit with equivalent contents and instructions. Vessel had expired aspirin within first-aid kit. 46 CFRR 184.710

At least one ring life buoy must be fitting with a lifeline of at least 18.2 meters (60 feet) in length. MI found lifeline to be approximately 30 feet. 46 CFR 180.70(c)(2)

A vessel not required to have a power driven fire pump must have at least three 9.5 liter (2.5 gallon) buckets, with an attached lanyard satisfactory to the cognizant OCMI, placed do as to be easily available during an emergency. The words "FIRE BUCKET" must be stenciled in a contrasting color on each bucket. Vessel had 02 fire buckets. 46 CFR 181.610

Each vessel that operates on the high seas...must have on board a FCC Type Accepted Category 1, 406 MHz EPIRB, installed to automatically float free and activate. EPIRB was found to be expired and did not match NOAA registration. 46 CFR 180.64

On 10MAY20 while underway, approximately 7 miles from Clearwater Pass, the vessel experienced a loss of propulsion. The vessel subsequently replaced the fuel filter an dwas able to return to port under its own power. Prior to carrying passengers, conduct sea trials in the presence of an attending marine inspector. 46 CFR 176.840

Each boat that operates on the high seas must have on board a FCC Type Accepted Category 1, 406 MHz EPIRB, installed to automatically float free and activate. The metal, spring loaded plate inside the EPIRB housing that pushes the EPIRB out of the housing when the hydrostatic release is cut was broken and no longer serving it's intended purpose. Vessel is limited to Lakes, Bays and Sounds route. Repair/replace prior to operating on a limited coastwise route. 46 CFR 180.64

Each survival craft on a vessel must be in good working order and ready for immediate use before the vessel leaves port and at all times when the vessel is underway. The 12 person life float was no longer in serviceable condition. Vessel is limited to Lakes, Bays and Sounds route. Repair/replace prior to operating on a limited coastwise route. 46 CFR 185.700

The floating waterlight must be attached around the body of the life float or buoyant apparatus by a 10mm (3/8 inch) lanyard, resistant to deterioration from ultraviolet light, and at least 5.5 meters (18 feet) in length. The waterlight lanyard is well short of 18 feet. 46 CFR 180.175(f)(4)

If the life float or buoyant apparatus does not have a painter attachment fitting, a means for attaching the painter must be provided by a wire or line that encircles the body of the device. The painter is attached to the grab lines and not to the painter attachment fitting. Vessel is limited to Lakes, Bays and Sounds route. Repair/replace prior to operating on a limited coastwise route. 46 CFR 180.137(d)

All vessels must have navigation lights that are in compliance with the applicable sections of the International and Inland Navigation Rules. The forward all around white light is inoperable. Repair/replace prior to nighttime or low visibility operations. 46 CFR 183.420

The EPIRB test required by 46 CFR 185.728(a) shall be logged or otherwise documented, as applicable. There is no records of logging the monthly EPIRB test. MI witnessed test by operator during the inspection and vessel representative will now start a log. 46 CFR 185.728(c)

Rails or equivalent protection must be installed near the periphery of all decks of a vessel accessible to passengers or crew. One of the forward port hand rail stanchions is broken.

A vessel not required to have a power driven fire pump must have at least three 2.5 gallon buckets with an attached lanyard satisfactory to the cognizant OCMI. The fire buckets on board were missing the lanyards and were 5 gallon buckets. Prior to getting underway the operator drilled holes half way up the buckets to ensure they did not fill all the way up and attached the lanyards. 46 CFR 181.610

A vessel on which a pre-engineered fixed gas fire extinguishing system is installed must have the following equipment at the operating station: a light to indicate discharge and an audible alarm that sounds upon discharge. The light a audible alarm were inoperable. MI witnessed sat. operational test of the system. 46 CFR 181.420(b)

All cable and wire must be installed with metal supports spaced not more than 24 inches apart, and in such a manner as to avoid chafing and other damage. The wiring below deck in the engine room and behind the main console was not properly secured. 46 CFR 183.340(b)(4)

Where a flexible fill pipe section is necessary, the metallic sections of the fill pipe must be joined by a conductor for protection against generation of a static charge when filling with fuel. Both port and starboard fuel tanks were missing a bonding wire on the fill line. 46 CFR 182.445(g)
