The condition of the ship and its equipment shall be maintained to conform with the provisions of the present regulations to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or persons on board. Port Newark Container Terminal gantry crane struck ship's main mast causing structural damage to the main mast, stiffeners, and attached railings affecting the following equipment and rendering inoperable: main mast navigational lights, 02 all around red lights, 02 all around white lights, morse signal light, fog horn (extra), and all around green flashing light.

74SOLAS(01) II-2/15.2: In a ship which oil fuel is used, the arrangements for storage, distribution, and utilization of the fuel shall be such as to ensure the safety of the ship and persons onboard. PSCO observed numerous fuel oil leaks from the main engine and generator #2. Additionally there were oily rags and pooled oil in the aft void below the main engine. PSCO also observed oil soaked lagging around a fuel oil pipe connecting to main engine.

74 SOLAS(14) IX/3.1 & ISM CODE 10.1: The company should establish procedures to ensure that the ship is maintained in accordance with the provisions of the relevant rules and regulations established by the company. The vessel was unable to provide PSCOs with checklists for engine room maintenance. Additionally, the vessel is not following procedures outlined in the safety and quality management manual which requires cleanliness of the engine and surroundings. Due to the objective evidence in the above deficiencies, the vessel is not in substantial compliance with relevant conventions. The Captain of the Port questions the adequacy and implementation of the vessel's Safety Management System under the International Safety Managemt (ISM) Code. An external audit conducted by the flag or recognized organization is recommended within 30 days to determine whether the ship is operating in accordance with the ISM Code.

The vessel has temporary repairs on the filters for the high and low sea chests. The repairs are required to be insected by the crew regularly and recorded in accordance with a class report issued 21OCT2020. The vessel could not provide PSCOs with inspection records.
