NEPTUNE'S CAR

Raido transmitting and receiving installations or radiotelephones are required on certain vessels carrying passengers. Details of the application of this requirement as well as the details of the installation shall be set forth in the regulations of the Federal Communications Commission (47 CFR Chapter 1). Vessel operating with expired FCC Radio Safety Certificate. 46 CFR 184.502

The design, materials, and construction of masts, posts, yards, booms, bowsprits, and standing rigging on a sailing vessel must be suitable for the intended service. Vessel is restricted from sailing with passengers until all Nitronic 50 [name withheld] is replaced, mill test certificates are provided, matched to the newly installed rod rigging and incorporated into Preventative Maintenance Plan. Verification shall be accomplished by attending marine inspector. -46 CFR 177.330, 701C

The cognizant OCMI may require that a vessel and its equipment undergo any additional test or inspection deemed reasonable and necessary to determine that the vessel and its equipment are suitable for the service in which they are to be employed. Full NDT shall be conducted on both the carbon fiber mast while it is un-stepped and while the chainplates are pulled, prior to carrying passengers. Format of NDT report shall be pre-approved by OCMI to ensure the document captures all required data to document lifecycle of carbon fiber mast and chain plates. -46 CFR 176.840, 701C

The cognizant OCMI may require that a vessel and its equipment undergo any additional test or inspection deemed reasonable and necessary to determine that the vessel and its equipment are suitable for the service in which they are to be employed. Multiple submissions of Preventative Maintenance Plan provided to OCMI from owner/operator were without quality control review and has resulted in OCMI requiring preventative maintenance plan to be submitted to marine consultant, rig surveyor, naval architect, or professional engineer for professional drafting, review and submission to OCMI to ensure compliance with NVIC 02-16. -46 CFR 176.840, 701C

A visual and audible alarm must be provided at the operating station to indicate a high water level in each of the following normally unmanned spaces: A machinery space bilge. Bilge high level alarm in machinery space was non operational.

VESSEL IS REQUIRED TO CONDUCT A THIRD-PARTY RIGGING SURVEY TO THE SATISFACTION OF THE [name withheld] PASSENGERS. LIFE FLOATS MUST NOT BE STOWED IN TIERS MORE THAN 4 FEET HIGH. WHEN STOWED IN TIERS, MUST BE KEPT APART BY SPACERS. OPERATOR TO SEPARATE LIFE FLOATS BY SPACERS. CITE: 46CFR180.137(f)

Vessel must carry and up-to-date charts of large enough scale to make safe navigation possible as appropriate for the intended voyage. The vessel has up to date electronic charts but there is not an up to date back up per NVIC 01-16. Required to provide a back up; 90 days to rectify deficiency since the operating season ends next week. 46 CFR 184.420

All escape hatches and other emergency exits used as means of escape must be marked on both sides in clearly legible letters at least 50 millimeters (2 inches) high: “EMERGENCY EXIT, KEEP CLEAR”, unless such markings are deemed unnecessary by the cognizant [name withheld] that the emergency escape that leads from below to the main deck is not labeled on the main deck side. Required to label so passengers are aware that it is an emergency escape and nothing is placed on top of it. 46 CFR 185.606

Each connection to a conductor or terminal part of a conductor must be made within an enclosure and have either: A pressure type connector on each conductor or a solder lug on each conductor. Each pressure type wire connector and lug must meet UL 486A (incorporated by reference; see 46 CFR 175.600) or other standard specified by the Commandant. The use of twist-on type wire nuts is permitted under the following conditions: The connections must be made within an enclosure and the insulated cap of the connector must be secured to prevent loosening due to vibration. Noticed two sections of dead end wires with the ends taped. Operator stated that lights were supposed to be placed there. Required to place dead end wires in a junction box or install the lights. 46 CFR 183.340 (g-i)

Each ring life buoy must be marked in clearly legible block capital letters with the vessel's name. The lettering on the ring life buoy was falling off. Required to label ring buoy prior to carrying passengers. 46 CFR 185.604

The current station authorization for a station other than a public coast station, or a clearly legible copy, must be posted at the principal control point of each station. The licensee of a station on board a ship subject to Part II or III or Title III of the Communications Act or the Safety Convention must retain the most recently expired ship station license in the station records until the first Commission inspection after the expiration date. Operator was unable to locate station license during the inspection. 47 CFR 80.405

Vessel does not have current FCC Safety R-T Certificate. 47 CFR 80.903

Flexible hose runs must be protected from mechanical damage. One of the fuel hoses in engine room was damaged due to contact with engine mount. 46 CFR 182.20-40(b)(2)

Portable fire extinguishers must be located so that they are clearly visible and readily accessible from the space being protected. The operating station fire extinguisher was located away from required location due to broken mounting bracket. 46 CFR 181.30-10(b)

(a) As appropriate for the intended voyage, a vessel must carry adequate and up-to-date: (1) Charts of large enough scale to make safe navigation possible; (2) U.S. Coast Pilot or similar publication; (3) Coast Guard Light List. No light list or coast pilot on board. Paper charts outdated, 2013. 46 CFR 184.420(a)

Each floating waterlight installed after March 11, 1997, on a vessel carrying only one ring buoy, must be attached to the lanyard with a corrosion-resistant clip. Waterlight secured to ring life buoy with line and knot. 46 CFR 180.70(d)(3)

Portable watertight containers for distress flares and smoke signals shall be of a bright color, and containers shall be clearly marked in legible contrasting letters at least 12.7 millimeters (0.5 inches) high: “DISTRESS SIGNALS”. Improperly marked distress signal container. 46 CFR 185.614

Painter must be stowed in such a way that it runs out freely when the life float or buoyant apparatus floats away from a sinking vessel. Life float painter not correctly attached or stowed in a way permitting it to run out freely. 46 CFR 180.175(f)(3)(iv)

During test of automatic engine shutdown of pre-engineered fixed gas fire extinguishing system the engine did not shutdown. It must automatically shutdown all engines that draw intake air from the protected space.

Vessel did not have designation letters described in NVIC 01-91 for senior deckhands as required by COI and 46CFR15.515(a).

Vessel could not provide log or documentation for crew training with firefighting, abandon ship, man overboard and emergency instructions.

. Primary electric submersible electric bilge pump was not operational.

Dead ended wires were found hanging from the overhead in the space just forward of the steering gear compartment.

An approx. 1' X 2' soft spot was found on the port side main deck 4' aft of the mast.

The floating water lights on the life floats and ring life buoy were not operational.

Forward spinnaker adjustment cam cleat guide needs replacing.

Inboard end of block on spinnaker pole requires cotter pin.

Chaffing gear on heater exhaust manifold needs replacing and exhaust manifold securely fastened.

Reroute radar rigging to not rub on heater fuel line and electrical cable.

Fireboy was found outside the engine space, not allowing proper release.

Arrangement of lifefloat was not connected properly. Lifefloats not attached to the vessel, lights were not attached to the lifefloats, and the lifefloats were not attached to eachother.

Missing FCC SSC

Stern Light was not mounted properly.

Found medicine expired (Asprin).

The vessel's manual bilge pump is inoperable.

Provide one red hand flare missing from flare kit IAW 46 CFR 180.68.

Provide donning placard for PFD, 46 CFR 185.516.

Reinstall mast head light properly and ensure operational IAW 46 CFR 183.420.

Properly affix HIN number inside vessel IAW 46 CFR 67.121.

Properly marke Emergency Exit IAW 46 CFR 177.500

Due to a collision significant damage has been noted, 3ft hole in the port bow, collision bulkhead is sheared off the hole, cracks in the deck forward of the mast , crack found in the transverse frame aft of the collision bulkhead. Make repair proposal and repair the vessel to operationing condition to satisfacation of local OCMI prior to operations IAW 46CFR176.700.

Provide means to lock overboard discharge y-valve. Valve is normally closed and vessel routinely utilized local pump out station.

Provide FCC station license.

Provide proper operation of high bilge level alarm. Vsl permitted to continue passenger operations due to shallow design of bilge and keel/hull design.

Four interior light covers were missing.

Lifering was cracked/holed and was missing proper markings.

Two lifefloats missing paddles and proper markings.

PRIOR TO OPERATING WITH PASSENGERS AFTER 17 SEPTEMBER 1999, CONDUCT STABILITY TEST AND PROVIDE STABILITY LETTER.

PROVIDE SATISFACTORY COVERING ON LIGHT RECEPTICAL OVER RACK, STARBOARD SIDE.

PROPERLY LABEL FORWARD HATCH AS EMERGENCY EXIT / ESCAPE.

PROVIDE CURRENT TRAINING LOGBOOK, INCLUDING PARTICIPANTS AND GENERAL DESCRIPTION OF TRAINING.

SEAL OPENING THROUGH MAIN DECK IN WAY OF ELECTRICAL JUNCTION ABOVE ENGINE COMPARTMENT, PORT SIDE.
