Whenever a vessel is deprived of the service of a member of its complement, and the master or person in charge is unable to find appropriate credentialed personnel to man the vessel a report of sailing short must be filed with the OCMI having cognizance for inspection in the area in which the vessel is operating, or the OCMI within whose jurisdiction the voyage is completed. Vessel master/rep made sailing short notification for the position of Captain and Mate between Jacksonville, FL and Las Mareas, Puerto Rico. The current Master and Mate have near-coastal endorsements and not oceans endorsements as required for the vessels intended route and service. Should you be able to not meet the minimum manning requirements as specified by law for the intended voyage, than arrangements must be made to fill the positions with the adequate crew by next port of call in Las Mareas, Puerto Rico.

This subpart (non-tank vessel response plan requirements) applies to each self-propelled vessel that carries oil of any kind as fuel for main propulsion, operates on the navigable waters of the United States, and is 400 gross tons or more as measured under the Convention measurement system (i.e. ITC tonnage). The subject vessel is 472 GT ITC but is not covered under a non-tank VRP approved by the Coast Guard. The Company must submit a VRP that includes the BALTIMORE as a covered vessel to the Coast Guard for review and approval. UPDATE 9/30/22: extended due date to 10/31/22, based on proof of submission of revised VRP, adding the Baltimore, to the VRP desk.

The owner and managing operator must ensure that the towing vessel is in compliance with this subchapter and other applicable laws and regulations at all times. Per the 2013 Vessel General Permit (VGP), if your vessel is greater than 300 gross tons, the VGP applies (gross tonnage is ITC for applicability purposes). The subject vessel is 472 GT IT, but at time of attendance there are no records indicating compliance with the 2013 VGP (eNOI, annual reports, etc.)

Each towing vessel certificated under the provisions of this subchapter must be in full compliance with the terms of the COI. The owner and managing operator must ensure that the towing vessel is in compliance with this subchapter and other applicable laws and regulations at all times. The TSMS must include elements...(c): policies must be in place that cover the owner or managing operator's approach to ensuring vessel compliance, including policies on maintenance and survey...(d): procedures and documentation must be in place to ensure that each towing vessel complies with the operational requirements of this subchapter. The vessel's current COI, issued by Sector St. Petersburg, with an expiry date of 6/13/26, lists a dry dock (DD) and internal structural exam (ISE) due date of 6/13/22. As of 9/1/2022, there is no documentary evidence that the Sub M DD&ISE has been completed to the satisfaction of the TPO, nor that an extension was granted by the CG to the Sub M DD and/or ISE due dates listed on the COI. This means the Subchapter M DD and ISE as listed on the COI is now 75+ days overdue, during which time the vessel has continued to operate. Taking into account that the company has reportedly made arrangements for the dry dock to be carried out at a dry dock facility in Tampa, FL, on 9/11/2022, the availability of which has subsequently been delayed until 9/30/2022 (due to reported on-going work with the vessel currently occupying the dry dock), the vessel is permitted to continue operations until no later than 9/30/2022, provided the following conditions are met: -The Sub M ISE must be carried out by the TPO (to the greatest extent possible prior to dry dock) and documentary evidence of this provided to the OCMI. -The master of the vessel must provide a written statement attesting to the continued materiel fitness for service on an Oceans route until 9/30/2022. -A Coast Guard Marine Inspector must attend the vessel at its next port of call, reported to be Baltimore on or about 9/2/2022, to confirm the condition of the vessel is suitable for continued service until 9/30/22. -Any further extension to the ILLC,beyond the previously extended date of 9/13/2022, must be authorized by the USCG Flag State Control (CVC-4) division. Additionally, within 30 days' time, the TSMS company is required to investigate this instance of non-compliance with Subchapter M, following the procedures in its TSMS, and provide a corrective action report, including detailing the actions to prevent recurrence, to the satisfaction of the TPO (ABS) and the local OCMI. 705 a/c 46 CFR 136.200 (b) 46 CFR 137.120 46 CFR 138.220 (c,d)
