Drug testing programs required by this part must be conducted in accordance with 49 CFR part 40, Procedures for Transportation Workplace Testing Programs. This subpart summarizes the responsibilities of credentialed mariners, marine employers, MRO, SAP and other chemical testing service providers in 49 CFR part 40. The regulations in 49 CFR part 40 should be consulted to determine the specific procedures which must be established and utilized. Sea Eagle Diving Adventure Corporation drug testing program is not in compliance with Title 49, CFR Part 40 based on the company Drug and Alcohol Program audit on December 8, 2025. No marine employer may engage or employ any individual to serve as a crew member unless the individual passes a chemical test for dangerous drugs for that employer. Breeze Hawaii dive masters and snorkel guides serve as crew members in a safety sensitive position that directly affect the safe operation of the vessel without a negative pre-employment test and enrollment in a random drug testing program as described by 46 CFR 16.230. (1) Ensure Breeze Hawaii dive or snorkel employees do not serve in a safety sensitive position as a crew member; or (2) Provide Breeze Hawaii employees pre-employment drug test and provide results from a qualified Medical Review Officer (MRO) to the attending marine inspector; and (3) Enroll Breeze Hawaii employees in a chemical testing program that meets the requirements of 46 CFR 16.230 and provide objective evidence of enrollment to the satisfaction of the attending marine inspector by December 15, 2025. 46 CFR 16.210(a)

Electrical equipment and installations must be suitable for the roll, pitch, and vibration of the vessel underway. Terminal board on bridge is unsupported and susceptible to ship's motions. Properly mount terminal board to the satisfaction of attending marine inspector. 46 CFR 183.310 (a)

Machinery, equipment, materials, and arrangements not covered by standards in this sub chapter may be inspected in accordance with standards acceptable to the cognizant OCMI as good marine practice. Bilge piping in head as broken away at thru-hull connection. Replace thru-hull connection on piping to the satisfaction of attending marine inspector. 46 CFR 176.800

Whenever damage or deterioration to hull plating or structural members that may affect the seaworthiness of a vessel is discovered or suspected, the cognizant OCMI may conduct an internal structural examination in any affected space including fuel tanks, and may require the vessel to be dry docked or taken out of service to assess the extent of the damage, and to effect permanent repairs. Exposed wood on the port crossbeam observed to be wet and rotting. Submit temporary repair proposal for review. Once approved, complete the repairs to the satisfaction of attending marine inspector. 46 CFR 176.600 (d)

Portable fire extinguishers must be located so that they are clearly visible and readily accessible from the space being protected. The installation and location must be to the satisfaction of the Officer in Charge, Marine Inspection. The portable fire extinguishers stored inside the forward storage space signage indicating their location is not legible. Replace signage to the satisfaction of attending marine inspector. 46 CFR 181.520

All vessels shall be provided with bilge pumps in accordance with Table 182.25-10(a). Fixed hand pumps in the port midship compartment, starboard forward compartment, and starboard midship compartment were inoperable. Repair. Prove satisfactory operation in the presence of the attending marine inspector. 46 CFR 182.25-10 (Old T)

Rails or equivalent protection shall be installed near the periphery of all weather decks accessible to passengers and crew. Port bow rail mount deck material has rotted and does not provide protection for passengers. Submit repair proposal for review and approval by attending marine inspector. Once approved, complete repairs to satisfaction of attending marine inspector. 46 CFR 177.35-1 (Old T)

Machinery, equipment, materials, and arrangements not covered by standards in this sub chapter may be inspected in accordance with standards acceptable to the cognizant OCMI as good marine practice. Fuel hose for both outboards not double hose clamped when fitting has enough room for two clamps. Add extra hose clamp on fuel hose for both outboards to satisfaction of attending marine inspector. 46 CFR 176.800

Fuses must be of the cartridge type only and be listed by Underwriters Laboratories or another independent laboratory recognized by the commandant. Blade type fuses and holder installed, replace with UL approved cartridge type fuses and holder to satisfaction of attending marine inspector. 46 CFR 183.380 (l)

Battery chargers must have an ammeter connected in the charging circuit. Ammeter not installed. Install an ammeter in charging circuit or replace with battery charger with ammeter built in or remove to the satisfaction of the attending marine inspector. 46 CFR 183.350 (f)

A portable or temporary electrical cord must be constructed and used in compliance with the requirements of 46 CFR 111.60-13. Prove existing flexible extension cable used for battery charging is: 1) UL62 approved; 2) 18 AWG; 3) outlet is GFCI; 4) connection is made to reduce tension as described in 46 CFR 111.60-13(f) to the satisfaction of the attending marine inspector. 46 CFR 183.340 (r)

The masthead light, or the all-round light described in Rule 23(d)(§ 83.23(d) of this chapter), of a power-driven vessel of less than 12 meters in length shall be carried at least one meter higher than the sidelights. The aft center all-around white light is lower than one meter than the sidelights. Raise to meet the regulation to the satisfaction of the attending marine inspector. 33 CFR 84.02(d)

Each life jacket kept in a stowage container must be readily available. Life jacket stowage areas had other items stowed in them. Remove additional stored items in life jacket storage areas to the satisfaction of the attending marine inspector. 46 CFR 180.78(a)(2)

A vessel is inspected for compliance with the standards required by this sub chapter. Machinery, equipment, materials, and arrangements not covered by standards in this sub chapter may be inspected in accordance with standards acceptable to the cognizant OCMI as good marine practice. There are five wires connected to the stbd battery terminal negative and the standard is a maximum of four connections. Remove one wire connection from the battery negative terminal and use an alternate means of connecting it to the negative battery terminal to the satisfaction of the attending marine inspector. 46 CFR 176.800(a)

Each number required by § 173.15 must:(1) Be painted on or permanently attached to each side of the forward half of the vessel except as allowed by paragraph (b) or required by paragraph (c) of this section;(2) Be in plain vertical block characters of not less than 3 inches in height;(3) Contrast with the color of the background and be distinctly visible and legible;(4) Have spaces or hyphens that are equal to the width of a letter other than “I” or a number other than “1” between the letter and number groupings (Example: DC 5678 EF or DC-5678-EF); and(5) Read from left to right. Affix HA numbers to the each side of the bow to the satisfaction of the attending marine inspector. 33 CFR 173.15(a)

A vessel of more than 7.9 meters (26 feet) in length, but not more than 19.8 meters (65 feet), must carry a minimum of one life buoy of not less than 610 millimeters (24 inches) in diameter. Life buoy not in a serviceable condition. Provide an approved life buoy to the satisfaction of the attending marine inspector. 46 CFR 180.70(a)(2)

Gages to indicate engine cooling water discharge temperature and lubricating oil pressure shall be provided for all propulsion engines and located so as to be in view of the operator. STBD gage not working and port gage not visible. 46CFR182.15-5(b)

Connections to batteries must be made with permanent type connectors. The battery lugs had terminals held in place with wing nuts. Replace wing nuts with permanent type connectors. 46 CFR 183.350(d)

Each ring buoy must be marked with with the vessel's name. The provided ring buoy was not properly marked. Properly mark the ring buoy. 46 CFR 185.604(b)

All vessels must have operable navigation lights in accordance with the Navigation Rules. The vessel’s stern, mast, and starboard navigation lights are extinguished. 46 CFR 183.420

An EAP training program must be conducted for the employer's crewmembers and supervisor personnel. The training program must include at least the following elements: the effects and consequences of drug and alcohol use on personal health, safety, and work environment; the manifestations and behavioral cues that may indicate drug and alcohol use and abuse; and documentation of training given to crewmembers and the employer's supervisory personnel. Supervisory personnel must receive at least 60 minutes of training. EAP supervisor did not provide documentation of training. 46 CFR 16.401(b)

A vessel must carry either a first-aid kit approved under approval series 160.041 or a kit with equivalent contents and instructions. For equivalent kits, the contents must be stowed in a suitable, watertight container that is marked “First-Aid Kit”. A first-aid kit must be easily visible and readily available to the crew. The first-aid kit is expired. Replace expired medication. 46 CFR 184.710

As appropriate for the intended voyage, a vessel must carry adequate and up-to-date: U.S. Coast Pilot [name withheld] List, tide tables, current tables, and charts of large enough scale to make safe navigation possible. Vessel requires current U.S. Coast Pilot [name withheld] List, tide tables, current tables, and up to date charts. 46 CFR 184.420(a)(1)-(5)

A valid certificate of number for that vessel issued by the issuing authority in the State in which the vessel is principally operated is required. State registration was not on board. 33 CFR 173.21(a)(1)

Vessel must be provided with satisfactory arrangement for draining any watertight compartment. Vessel was unable to demonstrate operation of the starboard bilge pump. Prove proper operation of the starboard bilge pump. 46 CFR 182.500(a)

A visual and audible alarm must be provided at the operating station to indicate a high water level in each of the following normally unmanned spaces. All bilge alarms not labeled. Label all bilge alarms. 46 CFR 182.530(a)

A port light must have an inside, hinged dead cover. Vessels dead covers missing closing devices in several compartments. Prove satisfactory operation. 46 CFR 179.350 3/13/2020 - reissued from worklist item as 30 day CG-835

Vent pipes terminating on the hull exterior must be installed or equipped to prevent the accidental contamination of the fuel by water under normal operating conditions. Vessels current fuel tank vent is exposed angled up allowing rain/ sea spray into vent. 46 CFR 182.450 (d)

The discharge ends of fuel tank vent pipes must be fitted with removable flame screens, corrosion resistant 30x30 mesh. One flame screen was painted over, the other was not secured. Provide adequate vent fitting. 46 CFR 182.450 (e)

Vessels sewage vent is flex hose stuck through a hole drilled in the side of the vessel. Provide permanent, adequate venting arrangements. 46 CFR 176.800(a)

A vessel must be provided with bilge pumps in accordance with table 182.520(a). Electric submersible pump overboard valves need to be removed and holes plugged. 46 CFR 182.520

Deck rails must be designed and constructed to withstand a point load of 200 pounds applied at any point in any direction. Reinforce port forward handrail to ensure 200 lb load. 46 CFR 177.900 (b)

The owner or operator shall make a vessel available for drydock examinations. Due to concerns with COVID-19, vessel was unable to complete the last 07 CG-835s issued on 13MAR2020 following drydock. Vessel rep elected to take prior to passenger CG-835 until COVID-19 concerns have passed and vessel is able to complete 07 remaining open CG-835s.

A visual indicator must be provided at the operating station to indicate when any automatic bilge pump is operating. Visual indicator is not provided at the operating station. Provide an indicator of activation of automatic bilge pump or remove automatic bilge pumps and maintain your fixed and portable hand pumps.

Battery chargers must have an ammeter connected in the charging circuit. Battery charger does not have an ammeter. Provide a battery charger with an ammeter.

A vessel not required to have a power driven fire pump must have at least three 2 1/2 gallon buckets, with an attached lanyard satisfactory to the cognizant OCMI, placed so as to be easily available during an emergency. Vessel's fire buckets were 2 gallons and not 2 1/2. Provide 2 1/2 gallon buckets.

When the operator on duty and in charge of transmitting systems, or performing service, maintenance or inspection functions, the license or permit document, or a photocopy thereof, or a copy of the application and PPC(s) received by the FCC, must be posted or in the operator's personal possession, and available for inspection. Operator could not provide Marine Radio Operators Permit. Provide Marine Radio Operators Permit.

One ship station license will be granted for operation of all maritime services transmitting equipment on board a vessel. Vessel's ship station license is expired. Provide proof of valid station license.

Vessel is not meeting the requirements of 46 CFR 16. Recommend a full DAPI Audit to be conducted

Based off 05JULY19 DAPI Audit, company drug and alcohol program is not in compliance with 46 CFR 16.210 and 40.25(Pre Employment testing), 46 CFR 16.401 (EAP Requirements), and 46 CFR 16.500(MIS Submission). Company has 30 Days to be found in compliance by attending Marine Inspector.
