A vessel on a limited coastwise route must carry six hand red flare distress signals and six hand orange smoke signals. The vessel is missing 4 red flare distress signals. Obtain the missing flares.

Electrical equipment must be installed to protect from electrical hazards. There are 4 dead end wires under the operating station. Properly remove or cover the wires.

Whenever damage or deterioration to hull plating or structural members that may affect the seaworthiness of a vessel is discovered or suspected, the cognizant OCMI may conduct an internal structural examination in any affected space including fuel tanks, and may require the vessel to be dry docked or taken out of service to assess the extent of the damage, and to effect permanent repairs. Crossbeam cracked and lifted from deck while underway. Captain terminated trip and returned to Port. Vessel may not conduct repairs until Marine Inspector attends the vessel and assesses the damage. Repairs will require a repair proposal and approval by competent Marine Inspector. Provide rigging report and associated pictures of the damage and mast. Vessel may not operate until it's seaworthiness is found satisfactory by attending Marine Inspector and a sea trial is conducted under sail.

A life preserver must be of such construction, material and workmanship that it can perform its intended function in all weathers and at all temperatures which may be expected in the normal usage of the life preserver. Replace retro-reflective wasted material in 22 adult sized life jackets. 46 CFR 160.001-02(a).

Each ring life buoy with a floating waterlight must have a lanyard of at least 910 millimeters (3 feet) in length, but not more than 1,830 millimeters (6 feet), securing the waterlight around the body of the ring life buoy. Waterlight lanyard was found deteriorated. 46 CFR 180.70(d)(2).

Lifering grab line shall shall be 3/8-inch diameter polyethylene, polypropylene, or other suitable buoyant type synthetic material having a minimum breaking strength of 1,350 pounds. The lifering grab line was found deteriorated, and vessel name faded. 46 cfr 160-050.3.

Deck rails must be designed and constructed to withstand a point load of 200 lbs applied at any point in any direction. Starboard side forward stanchion was found loose and leaking water into the collision bulkhead. 46 cfr 177.900 (B).

The master and crew of a vessel will be familiar with the content of and have mounted at the operating station, emergency instructions containing the actions to be taken in the event of fire, heavy weather, or man overboard conditions. Emergency instructions shall be updated with the current safety systems available on board the vessel, and crew shall be familiarized with those instructions. 46 cfr 185.510.

An Employee Assistance Program (EAP) training program must be conducted for the employer's crewmembers and supervisory personnel. The training program must include at least the following elements: a. the effects and consequences of drug and alcohol use on personal health, safety, and work environment; b. the manifestations and behavioral cues that may indicate drug and alcohol use and abuse; c. and documentation of training given to crewmembers and the employer's supervisory personnel. Supervisory personnel must receive at least 60 minutes of training. Crew indicated not having received EAP training in the past 2 yrs. Provide evidence of all crew and captains having received the EAP training for the satisfactions of the USCG Marine Inspector. 46 cfr 16.401(b).

Each window, port hole, and its means of attachment to the hull or deck house, must be capable of withstanding the maximum load from wave and wind conditions expected due to its location on the vessel and the authorized route of the vessel. Both port and starboard orward superstructure glass windows were found fractured and shall be replaced. 46 CFR 177.1020.

The owner or managing operator shall submit drawings, sketches, or written specifications describing the details of any proposed alterations to the cognizant [name withheld] alterations must be approved by the OCMI before work is started. The OCMI may require an inspection and testing whenever a repair or alteration is undertaken. Vessel conducted a modification of the mast support, and mast step from the original approved design, without submitting a proposal for USCG approval of such modifications, and prior conducting the modifications. Proposal and other documents was requested by phone 27NOV2024 to vessel owner and at 28NOV2024 at 1945 hrs no proposal was received. Submit for approval the following. 1. A proposal with list of materials; and process or procedures to conduct modifications. 2. Rigging survey from a 3rd party contracted rigger attesting that the modification is safe according with rigging industry standards, and deemed safe. 3. A sea trial shall be conducted by an attending USCG Marine Inspector, with the main sail and jib fully hoisted prior carrying passengers.

Every vessel subject to Part III of Title III of the Communications Act must have a detailed inspection of the radio installation by an FCC-licensed technician in accordance with § 80.59 once every five years. The FCC-licensed technician must use the latest FCC Information Bulletin, How to Conduct an Inspection of a Small Passenger Vessel. If the ship passes the inspection, the technician will issue a Communications Act Safety Radiotelephony Certificate. Communications Act Radiotelephony Certificates may be obtained from the Commission's National Call Center—(888) 225–5322—or from its forms contractor. Vessel permit was expired. Have technician complete required maintenance and acquire new certificate. 47CFR80.903 Code 17C.

An adult life jacket must be provided for each person carried on board a vessel. (b) In addition, a number of child size life jackets equal to at least 10% of the number of persons permitted on board must be provided, or such greater number as necessary to provide a life jacket for each person being carried that is smaller than the lower size limit of the adult life jackets provided to meet this section Vessel was missing 02 adult life jackets. In addition 07 adult life jackets and 01 child were removed from service. Vessel passenger account is reduced by 09 adults and 01 child until additional life jackets are on board and meet the requirements of this subchapter to the satisfaction of the marine inspector. 46 CFR 180.71, Code 705C.

Each life jacket must be marked with Type I retroreflective 46 CFR 185.604 material approved in 46 CFR 164.018 or other standard specified by the Commandant. The arrangement of the retroreflective material applied after March 11, 1996, must be as specified by IMO Resolution A.658(16) (incorporated by reference; see 46 CFR 175.600). Replace retro reflective tape on the identified 16 adult life jackets. 46CFR185.604, Code 16C.

At each inspection for certification and at every other vessel inspection all observed unsafe practices, fire hazards, and other hazardous situations must be corrected and all required guards and protective devices must be in satisfactory condition. Dead-end wires were identified underneath the compartment, below the mast step. Properly connect wire back in service, or if not in use, then shall be either eliminated or placed inside of an electrical junction box, protected of making contact. 46 CFR 176.830 (a), Code 16C.

A portable hand bilge pump must be: Capable of pumping water, but not necessarily simultaneously, from all watertight compartments; and provided with suitable suction hose capable of reaching the bilge of each watertight compartment and discharging overboard. Replace inoperable portable hand operated bilge pump. 46 CFR 182.520, Code 16C.

Deck rails must be designed and constructed to withstand a point load of 91 kilograms (200 pounds) applied at any point in any direction, and a uniform load of 74 kilograms per meter (50 pounds per foot) applied to the top rail in any direction. The point and uniform loads do not need to be applied simultaneously. Port side midship deck rail cracked weld at deck. 46 CFR 177.900 (c), Code 16C.

The marine employer must have a sufficient number of alcohol testing devices readily accessible on board the vessel to determine the presence of alcohol in the system of each individual who was directly involved in the SMI. Alcohol swabs were found expired in January 2024. Provide a suitable alcohol testing device. 46 CFR 4.06-15 (a) (1)., Code 16C.

A vessel must carry one floating waterlight, unless it is limited to day time operations. Battery is was found expired dated 06/2021. Replace battery with an approved type required by manufacturer. 46CFR180.70(d), Code 16.

A sailing vessel underway shall exhibit (1) sidelights; (2) a stern light; and a vessel proceeding under sail when also being propelled by machinery shall exhibit forward where it can best be seen a conical shape, apex downwards. Vessel was found to have a single light with dual lens (green-red) configuration, located forward mid-ship, instead of being installed on either outer sides of each port and starboard hulls, in accordance with NAVRULES Rule 25. Vessel does not have an approved Alternate Compliance for not meeting the requirements of navigations lights as required by 33 CFR 81 and 33 CFR 89. 33 CFR 83.25. Nav Rules COMDTINST M1 672.2D. Deficiency to be corrected during next dry dock NLT 31OCT2023.

A Marine Radio Operator Permit is required to operate a HF VHF Marine Radio on board vessels that are carrying more than 6 passenger for hire in the open sea or any tidewater area of the United States. Vessel was being operated with two MMLS licensed mariners and with both not having an FCC Marine Radio Operator Permit. 47 CFR 80.151

Vessels on a Limited Coastwise route must carry six hand red flare distress signals, and six orange smoke distress signals in accordance with approval number 160.021. Vessel was carrying six orange smoke flares only, and none of the required red flares. 46 CFR 180.68

Vessels operating in the high seas must have on board a FCC Cat 1, 406MHz EPIRB installed to automatically float free and activate. Vessel was found to have the installed hydrostatic release passed after the manufacturing date of 03/2020. Vessel captain stated that it was purchased a lower price by vendor knowing its shelf life was already expired (2 yrs prior installation).46 CFR 180.64

Owner, managing operator or a qualified servicing facility as applicable shall conduct for portable fire extinguishers the inspections, maintenance procedures and hydrostatic pressure tests required by NFPA 10, Chapter 4 (every 12 yrs). Two portable fire extinguishers on board showed manufacturing date in YR2010 and without having proof for being hydrostatic tested in 13yrs, also found to be corroded at its base.46 CFR 176.810(b)(1) & NFPA 10, Chapter 4, 8.3.1

EPIRBS must be tested monthly, using the integrated test circuit and output indicator to determine that is operative and testing shall be logged or otherwise documented, as applicable. Epirb was not tested in the months of Sept/Oct/Nov/Dec of 2022; and Jan2023.46 CFR 185.728 (a) (c) 47 CFR part 80.

The master and crew of a vessel will be familiar with the content of and have mounted at the operating station emergency instructions containing the actions to be taken in the event of fire, heavy weather, or man overboard conditions, in accordance with the recommended format in 46 CFR 185.512. Vessel was found not having displayed the emergency instructions posted.46 CFR 185.510 46 CFR 185.512

Before getting underway on a voyage or as soon as practicable thereafter, the master of a vessel shall ensure that a suitable public announcement are made informing the passengers of the following: 1. location of emergency exits; 2. lifejackets stowage location; 3. demonstration of proper use and adjustment of lifejackets, 4. location of the instruction placards for lifejackets. Safety orientation is not meeting the above requirements. 46 CFR 185.506

The USCG OCMI may require that a vessel and its equipment undergo additional testing or inspection deemed reasonable and necessary to determine that the vessel and its equipment are suitable for the service in which they are to be employed. Forward netting has wastage and showing signs to be worn, with an unacceptable temporary repair. Replace port and starboard forward netting with new netting materials. 46 CFR 176.840

All vessels must have navigations lights that are in compliance with the applicable Int. and Inland Navigation Rules. Prove proper operation of the mast light.46 CFR 183.420

A hatch exposed to the weather must be weathertight and have securing devices. Port and starboard forward hatches rubber gaskets are wasted and does not have means to keep the door closed.46 CFR 171.124

A hatch exposed to the weather must be weathertight and have securing devices. Portside stern steering gear hatch cover frame is broken and needs repairs; including that both port and starboard stern hatches are lacking of means to keep hatch closed. 46 CFR 171.124

The lights and shapes specified in the Int. and Inland Navigations Rules, all lights and shapes must be in compliance with Annex I. The day shapes found on board the vessel were broken and not useful.33 CFR 83.20

The marine employer must have sufficient number of alcohol testing devices readily accessible on board the vessel to determine the presence of alcohol in the system of each individual who has was directly involved in a serious marine incident. All alcohol testing swabs were found to be expired dated DEC2022.46 CFR 4.06-15

Marine employers must ensure that serious marine casualties are reported to the USCG. Two licensed MMLD mariners on board failed to respond correctly the required testing times (in hours) for alcohol and drugs, including how many days are required to submit a CG2692B form. Training must be facilitated and demonstrate proficiency to the satisfaction of an attending USCG Marine Inspector.46 CFR 4.06-3 46 CFR 4.06-6

VHF Radio shall be connected to a GPS receiver or have a VHF DSC Radio with integral GPS. VHF radio is not displaying GPS coordinates, make sure radio is connected to a GPS receiver or display GPS coordinates,47 CFR Part 80

The design, materials, and construction of masts, posts, yards, booms, bowsprits, and standing rigging on a sailing vessel must be suitable for the intended service. The mast step was found to have signs of fractures, coordinate and conduct the mast unstepping for more verification by an attending USCG Marine Inspector; and proceed to repair as in kind (original) approved plans any damages found by a subject matter expert rigger and wood-fiber glass repair technician.46 CFR 177.330

The design, materials, and construction of masts, posts, yards, booms, bowsprits, and standing rigging on a sailing vessel must be suitable for the intended service. Conduct all repairs as recommended by the Subject Matter Expert contracted rigger, according with the recommendation made by him in the most recent rigging survey dated 30JAN2023. Repairs must be reported once are completed to the USCG Marine Inspector.46 CFR 177.330, deficiency to be corrected by SEPT2023 Dry Dock

When utilizing portable fuel tanks, the arrangement must be in compliance with ABYC H-25. Provide quick disconnect fittings at the fuel tank for the fuel lines.

The VHF radio was not properly or permanently mounted at the operating station. Permanently mount the VHF radio at the operating station.

Every compartment with through hull fittings on a vessel over 26ft in length shall be fitted with a high water alarm. Repair/replace high inoperable high water alarm in the starboard mid/space.

Each should maintain updated charts which include the areas in which they operate. Replace outdated charts or provide proof of updates to current standards.

Vessel's that are required to carry an EPIRB are required to conduct monthly testing and record the results. Provide records of EPIRB testing.

Vessel's current PMP was not being followed as established. Update and implement an effective Sail & Rigging Preventive Maintenance Plan in accordance with NVIC 02-16. 46 CFR 176.540.

Last sail and rigging survey was dated in YR2019, provide a current 3rd party rigging survey to assess condition of sail and rigging components. 46CFR 176.540

A main sail hook in the Harken Travel Car that secures the sail to the guide attached to the mast was found broken, preventing the main sail to be deployed. Vessel is restricted to oparate without deploying the main sail. 46 CFR 176.540

Each EPIRB must be tested monthly and the test shall be logged or otherwise documented. EPIRB was found to to be tested or logged in a monthly basis as required.

Vessel was found without having on board Tide Tables. Obtain current tide tables and place them on board. 46CFR185.20-35.

The drill entry shall include the following information: 1. Date of drill and training 2. General description of the drill scenario and training topics. Provide a drills and training log as required above.

Properly repair broken wood coaming in the stern portside hatch and return to original condition.

A VHF Radio must have the MMSI number entered to properly operate The DSC Emergency Call system. Properly enter the MMSI number in the VHF Radio 46CFR80.

A total of 2 child size life jackets were found not serviceable. Vessel is limited to carry not more than 3 children and provide two serviceable child size life jacket.

The mast and rigging on a sailing vessel must be suitable for the intended service. Several issues were identified in rigging survey conducted on 10FEB2021 that require further inspection. Vessel issued prior to departure until: - Vessel preps the areas with fractures and cracks, as referenced in rigging report, for inspection. - Third party contracted survey assess the condition of the wood in the cross beam, base of the mast, and areas surrounding the chain plates. Areas in question referenced in rigging report. - Marine inspectors assess the extent of the damage.

An adult life jacket must be provided for each person carried on board a vessel. An additional seven (07) life jackets are required. Passenger count is reduced to 38 until the deficiency is cleared.

A vessel must have adequate and updated Coast Guard light list and U.S. Coast Pilot publications. The two publications onboard were outdated.

Each floating water light on the ring buoy must be attached to the lanyard with a corrosion-resistant clip. The life buoy does not have a corrosion-resistant clip.

A vessel is required to carry six (6) red hand flare and six (6) orange smoke distress signals or twelve (12) red hand flares. The vessel was missing four (04) distress signals.

Emergency broadcast instructions and information specific to the vessel must be posted next to the radiotelephone instillations. The instructions were not posted.

Make available a Rigging Preventative Maintenance Program that provides a level of detail commensurate with Appendix (2) to Enclosure (1) of NVIC 02-16.

05 Lifejackets were found in unserviceable condition. Vessel limited to carrying 40 Passengers and 03 crew. No more than 43 people on board.

PROVIDE APPROPRIATE SIZED BILGE PIPING STRAINERS.
