An International Load Line Certificate shall be isued to every ship which has been surveyed and marked in accordance with the present Convention. PSCO observed ILLC issued by RINA did not match Plimsoll markings currently showing BV.

74 SOLAS 01 II-2/41-2.4.7 The means of escape, including stairways and exits, shall be marked by lighting or photoluminescent strip indicators placed not mor than 300 mm above the deck at all points of the escape route, including angles and intersections. The marking must enable passengers to identify the routes of escape and readily identify the escape exits. Section of Low Location Lighting was not working on Deck 10 in way of cabins near the aft stairway stbd side.

74 SOLAS 20 II-2/14.1.1 Fire protection systems and fire-fighting systems and appliances shall be maintained ready for use. Section Valve 6-8 leaking from one of the cut off valves to the system.

74 SOLAS 81 Amend II-2/26.1 The minimum for integrity of all bulkheads and decks shall be as prescribed in tables 26.1 to 26.4. Combustible materials were found stored in a Category 10 electrical locker, changing the space categorization and use.

74 SOLAS 01 II-2/41-2.4.1 Hinged fire doors in stairway enclosures, main vertical zone bulkheads and galley boundaries which are normally kept open shall be self-closing and be capable of release from a central control station and form a position at the door. Fire doors 1-154 and dirty linen stores did not fully close after being opened from the fully open position.

74 SOLAS (81 amend) II-2/ 23.1 The hull, superstructures, structural bulkheads, decks, and deckhouses shall be constructed of steel or other equivalent material. For the purposes of applying the definition of steel or other equivalent material as given in regulation 3.7 the "applicable fire exposure" shall be according to the integrity and insulation standards given in the tables of regulations 26 and 27. Penetrations of the A0 boundaries were found in the radar mast and on the fire screen doorframes exiting the aft crew stairway on deck 10.

74 SOLAS (81 amend) II-2/ 36.1.1 An automatic sprinkler... of an approved type, complying with the provisions of regulation 12 and so installed and arranged as to protect such spaces. PSCO observed deck 7 port side arcade room had gaming equipment blocking sprinkler heads from full coverage in the areas being protected.

74 SOLAS (81 amend) II-2/ 30.2 The construction of all doors and door frames in "A" class divisions, with the means of securing them when closed, shall provide resistance to fire as well as to the passage of smoke anf flame, as fas as practicable, equivalent to that of the bulkheads in which the doors are situated. Such doors and doorframes shall be constructed of steel or other equivalent material. Fire screen door 1152 and multiple fire doors located on deck 3 did not close.

74 SOLAS (2001 amend) II-2/ 41-2.4.7 The means of escape, including stairways and exits, shall be marked by lighting or photoluminescent strip indicators places not more than 300mm above the deck at all points of the escape route, including angles and intersections. The marking must enable passengers to identify the routes of escape and readily identify the escape exits. Additionally, escape route signs and fire equipment location markings shall be of photoluminescent material or marked by lighting. Means of escape signage posted in passenger corridor (deck 7, starboard side) did not match the emergency escape plan and did not properly enable passengers to identify the best escape route.

Fire fighting systems and appliances shall be kept in good working order and readily available for immediate use. Fire doors 09034, 05001, and 07002 are not in proper working order - 74 SOLAS 2020 II-2/14.2.1.2 - 40c

All electrical apparatuses shall be so constructed and so installed as not to cause injury in the normal manner. PSCO observed an unauthorized electrical outlet installed in aft port casino storage closet; outlet was installed in such a manner that did not prevent electrical shock - 74 SOLAS 04 II-1/45 - 10c

Fire Fighting systems and appliances shall be kept in good working order and readily available for immediate use. Doors 6/188, 3/210, and 3/214 do not properly seal not maintaining the fire division - 74 SOLAS 2020 II-2/14.2.1.2 - 10c

Every ship of 12 meters or more shall display placards which notify the crew of the discharge requirements. Garbage placard was not present in vessels garbage room - MARPOL 2017 Annex 5 Reg 10.1.1 - 10c

Before the ship leaves port and at all times during the voyage, all life-saving appliances shall be in working order and ready for immediate use. During the abandon ship drill Lifeboat #4 engine was unable to start as per the requirements - 74 SOLAS 97 III/20 - 10c / 11101

Emergency lighting required by regulations II-1/42 and III/11.5, the means of escape including stairways and exits shall be marked, at all points of the escape route including angles and intersections, by lighting or photoluminescent strip indicators. Aft deck crew category 2 stairs on deck 8 leading from the galley did not have low location lighting on the landing with the doors either opened or closed - 74 SOLAS 01 II-2/41-2 - 10c - 07120

The company should establish procedures to ensure that the ship is maintained in conformity with the provisions of the relevant rules and regulations and with any additional requirements, which may be established by the company. In meeting these requirements the company should ensure that: procedures are established and maintained for identifying any training which may be required and conducted for all personnel concerned; inspections are held at appropriate intervals, any non-conformity is reported with its possible cause, if known, and appropriate corrective action is taken; procedures are established for the implementation of corrective action, including measures intended to prevent reoccurrence. Due to the objective evidence in the below deficiencies, the vessel is not in substantial compliance with relevant conventions, calling into question the adequacy and implementation of the vessel’s SMS under the ISM code. PSCOs collected objective evidence that the vessel was not identifying non-conformities following the inspection and reporting requirements of its SMS, the vessel was not taking steps to prevent the reoccurrence of non-conformities, and that the vessel was not properly maintaining the procedures for properly conducting crew training. An external audit conducted by the Flag is required within 30 days to determine whether the ship is operating in accordance with the ISM Code. Provide a copy of the completed audit report to USCG prior to departure from port - 74 SOLAS (2014 Cons) Ch IX/3.1 ISM Code Part A Reg 6.5, 10.1, 9.2 - 30abc

Every crewmember with assigned emergency duties shall be familiar with these duties before the voyage begins. PSCOs did not witness sufficient action by the crew to extinguish/ prevent the growth of a fire during the fire drill and did not satisfactorily witness the simulated abandonment of the vessel. Crew did not adequately perform the positions to which they were assigned to abandon the vessel - 74 SOLAS (2020 Cons.)III/19.2.1 - 30abc

Every crewmember with assigned emergency duties shall be familiar with these duties before the voyage begins. PSCOs were unable to adequately ascertain the proper answers from crew when conducting questioning regarding the stairway guides roles/ required knowledge per ships procedures and the crew roles during abandon ship. This, along with being unable to properly conduct fire and abandon ship drills, points to a breakdown in the vessels training and following ships procedures surrounding them 74 SOLAS (2020 Cons.)III/19.2.1 - 30abc

The angular position of the rudder shall, if the main steering gear is power-operated be indicated on the navigation bridge. The bridge rudder angle indicator showed a difference of five degrees from the rudder angle indicator on the steering gear - 74 SOLAS (2004 Cons.)II-1/29.11.1 - 17ac

Hoses specified in this chapter as “fire hoses” shall, together with any necessary fittings and tools, be kept ready for use in conspicuous positions near the water service hydrants or connections. Additionally, in interior locations in passenger ships carrying more than 36 passengers, fire hoses shall be connected to the hydrants at all times. 03 fire hoses were found disconnected from their associated hydrants - 74 SOLAS (1997 Cons.)II-2/4.7.1 - 17ac

Fire-fighting systems and appliances shall be kept in good working order and readily available for immediate use. Galley located on deck 7 deep fat fryer suppression system had installed caps rendering the system ineffective - 74 SOLAS (2020 Cons.)II-2/14.2.1.2 - 17ac

Any required fire detection system shall be capable of immediate operation at all times. 02 smoke detectors were discovered to be inoperable - 74 SOLAS (1997 Cons.) Ch. II-2/12.1.1 - 17ac

“A” class divisions shall be so constructed as to be capable of preventing the passage of smoke and flame. Fire doors throughout the ship were unable to fully close - 74 SOLAS (1997 Cons.)II-2/3.3.3 - 17ac

Fire doors shall have an approximately uniform rate of closure of no more than 40s and no less than 10s. Fire doors throughout the ship were witnessed to close between one and five seconds - 74 SOLAS (1997 Cons.)II-2/30.4.1 - 17ac

The main inlets and outlets of all ventilation systems shall be capable of being closed from outside of the spaces being ventilated. Fire damper located next to the portable power pack on the uppermost deck was inoperable - 74 SOLAS (1997 Cons.)II-2/32.1.1 - 16ac

Drills shall be conducted as realistically as possible. Drills were not conducted in a fashion to replicate a real scenario.

All lifesaving appliances shall be in working order and ready for immediate use. A crack in the hull was found on the starboard side of the #6 lifeboat.

Lifesaving appliances shall be fitted with retroreflective material to assist with detection. All rescue boats were found to not have proper tape on the hulls.

Means of escape shall be marked by lighting or photoluminescent strip indicators. The strips in the luggage handling room were blocked and not visible.

Means of escape marking must enable passengers to identify all routes of escape and readily identify escape exits. The rock bar on deck 10 has no way to identify means of escape.

Only lockers of non-combustible materials providing storage for safety equipment and open information counters may be located within the stairway enclosure boundries. Items of non-safety combustible materials were found to be stored under the crew stairway in zone 6 on deck 3.

Means of escape from control stations, accomodation spaces and service spaces. A glass door was foundto be impeding egress on Deck 9.

The capacity of generating sets identified or described in Regulation 41.1.1 shall be such that in the event of any one generating set being stopped it will still be possible to supply those services necessary to provide normal operational conditions of propulsion and safety. Minimum comfortable conditions of habitability shall also be ensured which include at least adequate services for cooking, heating, domestic refrigeration, mechanical ventilation, sanitary and fresh water. Vessel is provided with 4 diesel generators, 1 of which is not operational due to mechanical issues. The Chief Engineer and crew stated the remaining 3 diesel generators can only be run at approximately 50% load without the risk of overheating due to the age of the engines. During mooring operations and prior to utilizing the bow thruster, the crew must shed numerous and essential services from the switchboard to include mechanical ventilation. This shedding of the load is required to prevent the remaining diesel generators from overheating due to overloaded conditions. 74 SOLAS (1997) II-1/41.1.2 - 60 a c

In a ship in which oil fuel is used, the arrangements for the storage, distribution and utilization of the oil fuel shall be such as to ensure the safety of the ship and persons onboard. PSCO observed significant fuel oil leaks on the Number 1 Diesel Generator, Number 2 Diesel Generator, and Number 4 Diesel Generator. The leaks were apparent at the fuel oil leak tanks and were dripping at a rate of several drips per second. 74 SOLAS (1997) II-2/15.2 - 60 a c

All external high-pressure fuel delivery lines between the high- pressure fuel pumps and fuel injectors shall be protected with a jacketed piping system capable of containing fuel from a high- pressure line failure. A jacketed pipe incorporates an outer pipe into which the high-pressure fuel pipe is placed,forming a permanent assembly. The jacketed piping system shall include a means for collection of leakages and arrangements shall be provided for an alarm to be given of a fuel line failure. With the presence of significant leaks as described in deficiency number 01, there were no associated active alarms for Number 1, Number 2, or Number 4 Diesel Generator leak tanks. 74 SOLAS (1997) II-2-15.2.9 - 60 a c

All lifeboats shall be properly constructed and shall be of such form and proportions that they have ample stability in a seaway and sufficient freeboard when loaded with their full complement of persons and equipment. PSCO observed delaminated/damaged gel coat resulting in visible fiberglass fibers in way of the hull and/or keel on lifeboats 03, 05, and 06. 74 SOLAS (1997) III/41.1.1 - 17 a c

The lifeboat engine, transmission and engine accessories shall be enclosed in a fire-retardant casing or other suitable arrangements providing similar protection. Such arrangements shall also protect persons from coming into accidental contact with hot or moving parts and protect the engine from exposure to weather and sea. Adequate means shall be provided to reduce the engine noise. PSCO observed the insulation for the engine cover to be damaged and torn away from the cover on Number 2 Lifeboat. 74 SOLAS (1997) III/41.6.9 - 17 a c

Fire doors in main vertical zone bulkheads and stairway enclosures shall satisfy the following requirements: the doors shall be self-closing and shall have an approximate uniform rate of closure of no more than 40s and no less than 10s with the ship in upright position. Fire doors: 4/200, 3/208, access to waste treatment room, and door adjacent to sprinkler station 1/3 outside of the starboard steering gear room do not operate as intended. 74 SOLAS (1997) II-2/30.4.1 - 17 a c

Before the ship leaves port and at all times during the voyage, all life-saving appliances shall be in working order and ready for immediate use. Lifeboat #12 port engine is inoperable - 74 SOLAS (2020) III/20.2 - 30ac

Any required fire detection system shall be capable of immediate operation at all times. Smoke detector 403 ADD 41 on deck 10 and 306/114 on deck 9 are not operational - 74 SOLAS (1997) II-2/12.1.1 - 30ac

Each power-operated sliding water tight door shall have an approximately uniform rate of closure under power and in no case less than 20 s or more than 40 s with the ship in the upright position. Vessel’s crew were unable to meet closure timeframe requirements during the test on water tight doors #12 and #13 - 74 SOLAS(2004) II-1/15.7.3.2 - 30ac

In a ship in which oil fuel is used, the arrangements for the storage, distribution and utilization of the oil fuel shall be such as to ensure the safety of the ship and persons on board. No fuel oil leaks shall be situated where spillage or leakage therefore can constitute a hazard by falling on heated surfaces. Fuel oil leak found at storage tank from regulating valve soaking the lagging covering the valve, creating an extreme fire hazard - 74 SOLAS (1997) II-2/15.2.4 - 30ac

The main inlets and outlets of all ventilation systems shall be capable of being closed from outside of the spaces being ventilated. 09 fire dampers located on deck 9 and 01 located on deck 8 in the stack space are inoperable 74 SOLAS (1997) II-2/16.9 - 30ac

Fire-fighting systems and appliances shall be kept in good working order and readily available for immediate use. -The topping off pump for the sprinkler system protecting accommodation and public areas, lobbies, stores, workshops, mooring decks and cold rooms is unable to fill the pressure vessel automatically as the system is designed. -The sprinkler system protecting accommodation and public areas, lobbies, stores, workshops, mooring decks and cold rooms has two soft patches on the main discharge pipe at the pressure vessel. -The sprinkler system pump protecting the accommodation and public areas, lobbies, stores, workshops, mooring decks and cold rooms is out of service. -The mist fire suppression system protecting the Main Engines, Diesel Generators and the Purifier room is off and not in the automatic position. The Ultrafog fire suppression system fresh water supply tanks are below half full and not ready to supply sufficient water to the protected spaces 74 SOLAS(2020) II-2/14.2.1.2 - 30ac

The arrangements for the storage, distribution and utilization of oil used in pressure lubrication systems shall be such as to ensure the safety of the ship and persons onboard. A massive leak was observed on the hydraulic oil storage tanks for the power-operated sliding water tight doors in the engine room, hydraulic oil subsequently sprayed all over PSCOs and crew - 74 SOLAS(1997) II-2/15.3 - 30ac

The condition of the ship and its equipment shall be maintained to conform with the provisions of the present regulations to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or persons on board. There is a concrete patch located on the main cooling water line for the ship’s diesel generators - 74 SOLAS(2020) I/11(a) - 30ac

Maintenance, testing and inspections shall be carried out based on the guidelines developed by the Organization* and in a manner having due regard to ensuring the reliability of fire-fighting systems and appliances. The Ultrafog system is past its manufacture annual service requirement 74 SOLAS(2020) II-2/14.2.2.1 - 30ac

Fire-fighting systems and appliances shall be kept in good working order and readily available for immediate use. Gauges on the section valves of the fire suppression system for the ship’s diesel generators are inoperable - 74 SOLAS(2020) II-2/14.2.1.2 - 17ac

Means of escape, including stairwells and exits shall be marked by lighting or photoluminescent strip indicators. Installed low location photo luminescent strip is damaged and sections are missing in the port side corridor on deck 3 MVZ 6 in way of the linen store. Additionally, a vertical low location lighting strip on door #04030 located on deck 4 was inoperable - 74 SOLAS(1997) II-2/28.1.10 - 17ac

No person may operate any vessel equipped with installed toilet facilities unless it is equipped with an operable Type II or III device that has a label on it under §159.16 or that is certified under §159.12 or §159.12a. PSCO observed multiple sewage leaks coming from MSD Type II piping - 33 CFR 159.7(a)(1) - 17ac

During preparation and launching, the survival craft, its launching appliance, and the area of water into which it is to be launched shall be adequately illuminated by lighting supplied from the emergency source of electrical power. 02 Lighting arrangements for survival craft launching/recovery located starboard side by lifeboat #3 and above the deck line are extinguished - 74 SOLAS(1997) III/15.7 - 17ac

Power ventilation of machinery spaces shall be capable of being stopped from an easily accessible position outside the space being served. Ventilation duct serving damper #7/39/3 is inoperable.

Every crewmember with assigned emergency duties shall be familiar with these duties before the voyage begins. Fire team #3 responsible for conducting boundary cooling during COC Annual fire drill, were not familiar with assigned duties and locations onboard to conduct boundary cooling 74 SOLAS(2020) III/19.2.1 - 17ac

Fire Doors in main vertical sound bulkheads and stairway enclosures shall satisfy the following requirements: The Doors shall be self-closing and shall have an approximately uniform rate of closure of no more than 40 s and no less than 10 s. Fire doors 4/206, 3/216, 4/138, 5/162, 4/140, 5/121, 3/127, 2/176, 1/78 and 2/218 have a closer time of less than 10 seconds 74 SOLAS(1997) II-2/30.4.1 - 17ac

Stairways and exits giving access to the muster and embarkation stations shall be lighted. Such lighting shall be capable of being supplied from the emergency source of electrical power. Multiple exit lighting arrangements are extinguished; Locations include: 01 light on Deck 3 above door #03063, 02 lights on deck 8 in forward Yellow Elder Restaurant, 01 light on deck 8 MVZ 1 in galley forward starboard escape route, 01 light located on deck 9 Par-A-Dice Casino starboard side and 01 on deck 8 located aft port side escape from the Encore Lounge - 74 SOLAS(1997) III/11.5 - 17ac

Each passenger state room and crew cabin shall be equipped with entry doors that include peep holes or other means of visual identification. As per vessels approved plans, cabins number 03062, 03064, 6039, and 03060 are not outfitted with peep holes or other means of visual identification 46 USC 3507(a)(1)(b) - 17ac

Diesel generator #1 has constant high fuel oil temperature alarms and the maintenance of the generator is not up to date - 74 SOLAS(2020) I/11(a) - 17ac

Any Certificate required by the Convention must be kept available in its original form on board the ship on which the holder is serving. The officers onboard the vessel do not have their original Bahamian flag state endorsements STCW 78/95 Annex I/I/2.11 - 17bc

The owner of a vessel to which this section applies shall maintain on the vessel adequate, in-date supplies of anti-retroviral medications and other medication’s design to prevent sexually transmitted diseases after a sexual assault. Vessel is required to be outfitted with three sexual assault kits as per company procedures. No sexual assault kits are onboard - 46 USC 3507(d)(1) - 17ac

For determining the appropriate fire integrity standards to be applied to boundaries between adjacent spaces, such spaces are classified according to their fire risk as shown in categories (1) to (14). A flammable locker located in the plumber’s workshop on deck 3 exceeded flammable liquid quantities necessary for practical/daily use of the space 74 SOLAS(1997) II-2/26.2.2 - 17ac

All electrical apparatus shall be so constructed and so installed as not to cause injury when handled or touched in the normal manner. The microverter located in the electrical substation #03109 on deck 3 has exposed wires creating an electrical hazard. Additionally in the machinery space, 440v cables from the electro-chlorination panel found hanging with conductors visible; panel power light was illuminated - 74 SOLAS(2004) II-1/45.1.3 - 17ac

The construction of all doors and door frames in "A" class divisions, with the means of securing them closed, shall provide resistance to fire as well as the passage of smoke and flame. “A” Class fire doors #04001, #08083, #4036, and #04029 were incapable of latching 74 SOLAS(1997) II-2/30.2 - 17ac

"A" Class divisions are those divisions formed by bulkheads and decks which shall be so constructed as to be capable of preventing the passage of smoke and flame to the end of the one hour standard fire test. Multiple penetrations were discovered in the crew gym located on deck 4, penetrating through the deck of “A” Class divisions - 74 SOLAS(1997) II-2/3.3 - 17ac

Stairways and ladders shall be arranged to provide ready means of escape to the life boat and life raft embarkation deck from all passengers and crew spaces and from spaces in which the crew is normally employed. A Room-in-room configuration was identified in the pharmacy located in the hospital on deck 3. The primary escape route from the pharmacy lead to another accommodation space. No Audible alarm is installed to notify crew - 74 SOLAS(1997) II-2.28.1 - 17ac

Muster and embarkation stations shall be adequately illuminated by lighting supplied from the emergency source of electrical power. PSCO identified multiple locations along the starboard wide where emergency lighting at embarkation stations are non-operational - 74 SOLAS(1997)III/11.4 - 17ac

The condition of the ship and its equipment shall be maintained to conform with the provisions of the present regulations to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or persons on board. Hot water pipes in the engine room are leaking and missing lagging - 74 SOLAS(2020) I/11(a) - 16ac

The vessel has deviated from the approved space categorization plan in 02 locations; Hotel Office #03010 on deck 3, and Crew Office #03027 on deck 3. The approved vessel space categorization plan identifies both of these spaces as category 13 workshops however, they are being utilized as category 7 accommodation spaces of moderate risk - 74 SOLAS(1997) II-2/26.2.2 - 50ac

The company should establish procedures to ensure that the ship is maintained in conformity with the provisions of the relevant rules and regulations and with any additional requirements, which may be established by the company. In meeting these requirements, the company should ensure that: the inspections are held at appropriate intervals; any non-conformity is reported, with its possible cause, if known; appropriate corrective action is taken. Due to the objective evidence in the above deficiencies, the vessel is not in substantial compliance with relevant conventions, calling into question the adequacy and implementation of the vessel’s SMS under the ISM code. PSCOs collected objective evidence that the vessel was not identifying non-conformities and following the inspection and reporting requirements of its SMS. Upon shifting from main bridge control to starboard bridge wing contol, the port side reverse thrust/pitch was unresponsive and upon switching to emergency control, it remained unresponsive in reverse.

Ventilation ducts...pass through "A" class decks exceeding .075m2 shall be fitted with fire damper. PSCO observed inverter room on deck 11 with ventilation fan missing and no fire damper in ventilation trunk.

Damper operating position shall be readily accessible and be marked in red light reflecting colour. PSCO observed fire damper closure for gaylord in mini-galley deck 10 mislabeled and activation is in another space.

"A" class divisions are so constructed to be capable of preventing passage of smoke and flame. PSCO observed an open penetrationin the main vertical fire zone bulkhead between stairwell and casino cashier room.

Provision shall be made to facilitate cleaning, inspection and maintenance of main propulsion and auxiliary machinery. PSCO observed SSDG #4 overdue for general overhaul on prime mover. Fuel pumps on auxiliary engines for #1, #3, #4 generators are leaking diesel fuel internally.

The launching mechanism shall be so arranged that it may be actuated by one person from a position on the ships deck and except for secondary launching appliances for free-fall lifeboat, from a position withing the survival craft or rescue boat. During lowering of rescue boat #2, eyebold on brake release sheared preventing the manual release from the vessel.74SOLAS(97 cons) CH III, LSA 6.12.2

All openings shall be provided with permanently attached means of closing which shall be at least as effective for resisting fires as the divisions in which they are fitted. Automatic latching mechanism on starboard side mini-galley found inoperable.
