Each vessel that operates on the high seas...must have on board a FCC Type Accepted Category 1, 406 MHz EPIRB, installed to automatically float free and activate. Vessel route is restricted to no more than 3 nm from coastline until EPIRB is replaced with properly operating unit. 46CFR180.64; 705c

For fixed-gas fire extinguishing systems, the inspections and tests required by Table 176.810(b) of this section, in addition to the tests required by 46 CFR 147.60 and 147.65. The owner or managing operator must provide satisfactory evidence of the required servicing to the marine inspector. Fireboy service records must be provided. 46CFR176.810(b)(2)

A vessel must comply with the applicable requirements for any radio...as set forth in 47 CFR part 80. The provisions of Part III of Title III of the Communication Act require US vessels which transport more than six passengers for hire while being navigated on any tidewater, to carry a radiotelephone installation. Every vessel subject to Part III of Title III of the Communications Act must have a detailed inspection of the radio installation by an FCC-licensed technician once every five years. Vessel's Safety Radiotelephony Certificate was not on board. 46CFR184.502 - 47CFR80.903 - 47CFR80.901; 16c

All vessels shall be provided with a satisfactory arrangement for draining any watertight compartment other than small buoyancy compartments, under all practical conditions. MI observed that all 04 bilge suction points were not able to be tested, provide evidence of proper operation of all bilge suction points. 46 CFR 182.25-1

46 CFR 183.115 (c) New installations of electrical equipment and material, and the repair or replacement of wire and cable, on an existing vessel, which are completed to the satisfaction of the cognizant Officer in Charge, Marine Inspection (OCMI) on or after March 11, 1996, must comply with this part. Vessel shall provide MSC approval of updated electrical drawing.

46 CFR 183.115 (c) New installations of electrical equipment and material, and the repair or replacement of wire and cable, on an existing vessel, which are completed to the satisfaction of the cognizant Officer in Charge, Marine Inspection (OCMI) on or after March 11, 1996, must comply with this part. MI observed multiple items that were not configured IAW approved drawings. Enact repairs to the satisfaction attending USCG Marine Inspector.

Electrical equipment on a vessel must be installed and maintained to: (a) Provide services necessary for safety under normal and emergency conditions; (b) Protect passengers, crew, other persons, and the vessel from electrical hazards, including fire, caused by or originating in electrical equipment, and electrical shock; (c) Minimize accidental personnel contact with energized parts; and (d) Prevent electrical ignition of flammable vapors. The operator installed a battery charger for the port and starboard main engine starting batteries without Coast Guard plan approval. The inspector found the OEM 12 AWG conductor taped to a 14 AWG conductor with a 30 amp inline UL listed cartridge fuse installed as overcurrent protection. The 14 AWG conductor was hot to the touch. The conductor was not connected to the fuse holder and easily detached when handled. The smaller conductor and loose connection to the fuse holder created resistance and heat on the 14 AWG conductor which provides a potential for a fire in the engine room. The installation is considered a new installation based on the battery charger manufacture date and the operator stated it was installed within the past 10 years. 46 CFR 183.200 Code 705-Rectify by May 16, 2023

Except where all or part of the emergency instructions are deemed unnecessary by the OCMI, the emergency check off list shall contain not less than the applicable portions of the "Recommended Emergency Check Off List", 185.25-5. The vessel's emergency instructions require the crew to close ventilation if the fire is in the machinery space. MI found three engine room ventilation dampers inoperable due to broken button snaps used to attach them to the ventilation opening on deck. 46 CFR 185.25-1 Code 705-Prior to May 16, 2023

Shutoff valves, installed so as to close against the fuel flow, shall be fitted in the fuel supply lines, one at the tank connection and one at the engine end of the fuel line to stop fuel flow when servicing accessories. The shutoff valve at the tank shall be operable from outside the tank compartment preferably from an accessible position on the weather deck. The starboard fuel shutoff valve spun 360 degrees when tested by the crew. The MI is unable to determine if the ball valve is open or closed when the crew test the valve. 46 CFR 182.20-40 (b)(2) Code 705- Prior to May 16, 2023

Conductors must be protected in accordance with their current carrying capacities. If the allowable current carrying capacity does not correspond to a standard device size, the next larger overcurrent device may be used provided it does not exceed 150 percent of the conductor current carrying capacity. Each circuit breaker must meet UL 489 (incorporated by reference; see 46 CFR 175.600) or other standard specified by the Commandant, and be of the manually reset type designed for: (1) Inverse time delay; (2) Instantaneous short circuit protection; and (3) Switching duty if the breaker is used as a switch. MI found a 100 amp MRCB breaker installed on a 8 AWG conductor as the primary branch protection. MRCB breakers are not UL 489 breakers and are not approved for commercial vessel use. An 8 AWG conductor current carrying capacity @ 75 deg in the engine room is 65 amps. Although 100 amps is within the 150% of the current carrying capacity, breaker ratings can be found much lower to the 65 amp current carrying capacity of the conductor. The installation was found to be a new electrical installation and not existing. 46 CFR 183.380 14DEC23: MI observed that electrical system is not configured IAW approved electrical plans. Vessel shall Submit electrical plans/drawings of current configuration to [email withheld] for approval.

New installations of electrical equipment and material, and the repair or replacement of wire and cable, on an existing vessel, which are completed to the satisfaction of the cognizant Officer in Charge, Marine Inspection (OCMI) on or after March 11, 1996, must comply with this part. Replacement of existing equipment, not including wire or cable, installed on the vessel prior to March 11, 1996 need not comply with the regulations in this part. New battery chargers were found installed on the port and starboard main engine starting batteries. No USCG approved plans exist for this installation. Submit electrical plans for the battery charger installation to [email withheld] 46 CFR 183.115(c)

S. The power fire pump shall be self priming and of such size as to discharge an effective stream from a hose connected to the highest outlet. MI observed the power fire pump's ability to provide adequate pressure was not suitable for it's intended purpose. 46 CFR 181.10-1

S and L. All vessels shall be provided with bilge pumps in accordance with table 182.25-10(a)..."S" vessels carrying more than 49 passengers, 65 or more feet, shall have 1 fixed power pump and 1 portable hand pump. MI observed the bilge power pump's ability to properly de-water a space was inadequate due to operational condition. 46 CFR 185.25-10(a)

Each vessel must meet the applicable requirements in sub-chapter S of this chapter...Each hatch exposed to the weather must be watertight. MI observed two hatches on the aft deck were not capable of being secured "watertight" due loose hardware on the backside of each hatch. 46 CFR 177.13-1 46 CFR 171.124(a)

All vessels shall be provided with a satisfactory arrangement for draining any watertight compartment other than small buoyancy compartments, under all practical conditions. Lazarette space did not drain properly. Ensure proper drainage of all watertight compartments. 46CFR182.25-1(a)"Old T"

Each vessel that operates on the high seas must have on board a FCC Type Accepted Category 1, 406 MHz EPIRB, installed to automatically float free and activate. EPIRB was installed under the canopy behind the operating station, rendering it to not be float free. 46CFR180.64

A positive shutoff valve on a submersible electric bilge pump is to be installed at the hull penetration. The shutoff valve for the submersible electric bilge in the lazarette was seized open. 46CFR182.520(e)(7)

All machinery and equipment must be installed and maintained in such a manner as to afford adequate protection from causing fire, explosion, machinery failure, and personnel injury. The starboard fuel shutoff valves is severely rusted and brittle. The attending Marine Inspector did successfully test the valve and while it is currently operational, it needs to be replaced to avoid potential failure of the handle. 46CFR182.100

As appropriate for the intended voyage, a vessel must carry adequate and up-to-date charts of large enough scale to make safe navigation possible. No paper charts were onboard. 46CFR184.420

Section 151.57 (Garbage Management Plans) applies to a manned oceangoing ship of 40 feet or more in length that is documented under the laws of the United States and that is engaged in commerce. The master or person in charge of a ship to which this section applies shall ensure that the ship is not operated unless a garbage management plan meeting paragraph (b) of this section is on the ship and that each person handling garbage follows the plan. Vessel did not have a garbage management plan. 33CFR151.51(d)(1) 33CFR151.57(a)

Rails or equivalent protection shall be installed near the periphery of all weather decks accessible to passenger and crew. The second and third stanchion on the port side handrail had cracks rendering it unsafe for passengers and crew. Conduct temporary repairs on cracks. Replace all repaired railing at next credit dry dock. 46 CFR 177.35-1(a) "Old T"

Seating accommodations for passengers are required to be provided. 15 seats throughout the vessel were cracked or broken and not capable of safely supporting a person. Replace in kind. Passenger count reduced to 104 until seats are replaced. 46 CFR 177.30-1(a) "Old T"

A vessel on which a pre-engineered fixed gas fire extinguishing system is installed must have an audible alarm that sounds upon discharge. The audible alarm at the operating station did not sound during the test of the pre-engineered system. Repair according to manufacturer's recommendation. 46CFR181.420(b)(2)

Flexible hose designed for use with hose clamps may be installed with two clamps, at both ends of the hose. The flexible hose installed on the port side main engine wet exhaust piping was missing a clamp. Replace. 46CFR182.720(e)(3)(v)(B)

All piping, valves and fittings for the fire main shall be in accordance with good marine practice and suitable for the purpose intended. The fire main included a small section of flexible piping that was missing a double clamp on one side. Replace the double clamps. 46CFR181.15-5

Light and power conductors for interior wiring shall be insulated in accordance with Table 183.05-45(e). Dead end wires were found on board in the under deck steering compartment. Remove unused wires. 46CFR183.05-45(e)

All cable and wire must be installed with metal supports spaced not more than 24 inches apart. Metal supports in the steering gear were loose and no longer supporting the cable and wire runs. Repair. 46CFR183.340(b)(2)

A seat must be constructed to minimize the possibility of injury and avoid trapping occupants. Two seats on board were either missing or in bad repair. A seat forward was missing completely while a seat in the aft section was loose and not capable of safely supporting a person. Repair as original. 46CFR177.820(b)

An EAP training program must be conducted for the employer's crewmembers. Employees have not received EAP training. Provide proof of training for all crewmembers. 46CFR16.401(b)

A durable placard must be posted next to all radiotelephone installations with the emergency broadcast instructions and information, specific to the individual vessel. The placard was missing from the operating station and also missing the vessel's call sign. 46CFR184.506

Each EAP education program must include at least the following elements: display and distribution of informational material; community service hot-line number for crewmember assistance, and employer's policy on drug and alcohol use in the workplace. Display company policy, hot-line number, or employer's policy. 46CFR16.401(a)

Penetrations and openings in watertight bulkheads must have means to make them watertight. There is a pipe going through the watertight bulkhead in the forward engine room that is no longer in use and not capped. Cap the pipe to ensure watertight integrity. 46CFR171.114(a)(2)

A vessel must comply with the applicable requirements for any radio including the requirements for a station license. The FCC station license on board is expired. Provide an new, valid FCC radio license. 46CFR184.502
