Each vessel that operates on the high seas, or that operates beyond three miles from the coastline of the Great Lakes, must have on board a FCC Type Accepted Category 1, 406 MHz EPIRB, installed to automatically float free and activate. Vessel's EPIRB battery is expired. Vessel's route is restricted to lakes, bays and sounds until valid battery is installed. 46 CFR 180.64

An internal structural examination conducted in compliance with § 176.600 may be conducted while the vessel is afloat or out of the water and consists of a complete examination of the vessel's main strength members... The port side stanchion supporting the galley house structure exhibited a crack through the paint around the post where it is welded to the base plate. Remove paint from the area to allow inspection of base plate weld integrity. 46 CFR 176.610(b)

Machinery and fuel tank spaces must be separated from accommodation spaces by boundaries that prevent the passage of vapors. Throttle cable penetration from captain's quarters to engine room is not vapor tight. 46 CFR 177.405(c)

Each EAP education program must include at least the following elements: display and distribution of informational material; display and distribution of a community service hot-line telephone number for crewmember assistance, and display and distribution of the employer's policy regarding drug and alcohol use in the workplace. Employee assistance program hotline information was not displayed onboard. 46 CFR 16.401(a)

A vessel must carry either a first-aid kit that meets the requirements in 46 CFR 199.175(b)(10) or a kit with equivalent contents and instructions. Multiple items of the onboard first aid kit are expired. 46 CFR 184.710

Machinery, equipment, materials, and arrangements not covered by standards in this subchapter may be inspected in accordance with standards acceptable to the cognizant OCMI as good marine practice. The onboard Preventative Maintenance Plan was 1) missing updates to the Inventory of Rigging Components and 2) lacked recent documentation of examination and maintenance. 46 CFR 176.800(a)

Each life jacket carried on a vessel on oceans, coastwise, or Great Lakes route, must have a life jacket light approved in accordance with § 161.012 in subchapter Q of this chapter. MI observed 01 child lifejacket without light, operator installed with spare. 46 CFR 180.75(a)

Each survival craft must be: secured to the vessel by a painter with a float-free link permanently attached to the vessel. MI observed float free-link attached incorrectly, operator fixed and installed correctly. 46 CFR 180.130

A vessel that is exposed to salt water more than three months in any 12 month period since the last examination must undergo a drydock examination and an internal structural at least once every two years. The vessel has not completed a drydock examination within the last two years. Conduct satisfactory drydock examination prior to the carriage of passengers. 46 CFR 176.600(c)(1)

AT EACH INSPECTION FOR CERTIFICATION AND AT EVERY OTHER VESSEL INSPECTION ALL UNSAFE PRACTICES, FIRE HAZARDS, AND OTHER HAZARDOUS SITUATION MUST BE CORRECTED AND ALL REQUIRED GUARDS AND PROTETIVE DEVICES MUST BE IN SATISFACTORY ORDER. GALLY TABLE ELECTRICAL OUTLET COVER BROKEN WITH EXPOSED WIRES, REQUIRES REPLACEMENT.

EVERY VESSEL MUST HAVE DETAILED INSPECTION OF THE RADIO INSTALLATION BY AN FCC-LICENSEND TECHNICIAN EVERY FIVE YEARS. VESSEL'S CERTIFICATE HAS EXPIRED, AND DUE TO ROUTE EXCEEEDING 20 NM, REQUIRES A MF RADIO WHICH MUST BE VERIFIED ON THE CERTIFICATE. 47 CFR 80.903

VESSELS MUST SUBMIT PLANS TO THE COGNIZANT OCMI FOR THE INSTALLATION AND USE OF MONITORING DEVICE TO ENSURE THE WAKEFULNESS OF THE WATCHMEN. SUBMIT PLANS TO OCMI.

A weathertight door must be provided for each opening located in a deck house or companionway. Permanent watertight coamings must be provided as follows: a vessel on an exposed route, a watertight coaming with a height of at least 150mm (6 inches) must be provided. Vessels current coaming is not a permanent installation as required. To be rectified by the next dry-dock.

"Survival craft must be secured to the vessel by a painter." 46 CFR 180.130(a) Painter was not secured. Fixed on the spot during inspection.

"The design, and standing rigging on a sailing vessel must be suitable for the intended service." 46 CFR 177.330 Loose bolts, tighten for serviceability.

"All mattresses must comply with 16 CFR part 1632. 46 CFR 177.405 Currently installed mattresses are not fire rated. Resolve prior to carrying overnight passengers.

A vessel must carry either a first-aid kit approved under approval series 160.041. The eye cleaning solution was expired. 46 CFR 184.710

Adequate emergency lighting automatically actuated upon failure of the main lighting system shall be fitted along the line of escape in vessels having lounge areas below the main deck. Vessels not equipped with a single source emergency lighting system shall have individual storage battery powered automatically operated lights in strategic locations. These lights shall have an automatic battery charger, shall not be readily portable and shall have sufficient capacity for 6 hours of continuous operation. Vessel did not have emergency lighting. Install IAW 46 CFR 184.30-5. Vessel is restricted in their ability to carry overnight passengers until the deficiency is rectified.

All escape hatches and other emergency exits shall be marked on both sides using at least 1-inch letters: "Emergency Exit, Keep Clear". Vessel was missing labeling on the external portion of the forward most emergency exit. Label IAW 46 CFR 185.30-15.

46 CFR 176.25-5 - In sailing vessel's the Marine Inspector shall inspect all spars, standing rigging, running rigging, blocks, fittings and sails. Vessel's forward pin rail struts, both port and starboard side, are cracking. Replace or repair struts and prove proper operation to the attending Marine Inspector.

46 CFR 176.25-5 - Inspect all railings and bulwarks and their attachments to the hull structure. Railing adjacent to the vessel's starboard embarkation area is cracked. Replace or repair rail to the satisfaction of the attending Marine Inspector prior to next credit dry dock.

The selection of crew members for random drug testing shall be made by a scientifically valid method, such as a random number table or a computer-based random number generator that is matched with the crewmembers' social security numbers, payroll identification number or other identifying numbers. Vessel hasn't used a scientifically based method to conduct random selection of chemical testing. Establish an appropriate random selection process and notify the attending Marine Inspector.
