18299 - The marine employer shall ensure that all individuals engaged or employed on board a vessel are fully indoctrinated in the requirements of this subpart, and that appropriate vessel personnel are trained as necessary in the practical applications of these requirements. The vessel owner could not provide proof of enrollment in drug testing consortium for the Master or Deckhand. 46 CFR 4.06-1(e)

01305 - The owner, charterer, master or managing operator shall instruct each crew member, upon first being employed and prior to getting underway for the first time on a particular vessel and at least once every three months, as to the duties that the crew member is expected to perform in an emergency. The vessel owner was unable to provide proof of man overboard or fire drills. 46 CFR 185.420(a)

11117 - Each ring life buoy must be marked with Type II retroreflective material approved in accordance with 46 CFR 164.018. The life ring needs retro-reflective material. 46 CFR 185.604(i)

04108 - The master and crew of a vessel will be familiar with the content of and have mounted at the operating station, emergency instructions containing the actions to be taken in the event of fire, heavy weather, or man overboard conditions. The vessel did not have the correct emergency instructions posted. 46 CFR 185.510(a)

11118 - Each child size life jacket must be stowed in a location that is appropriately marked and separated from adult life jackets so the child size life jackets are not mistaken for adult life jackets. The children's life jackets were stowed with the adult life jackets. 46 CFR 180.78(a)(5)

Except as noted in paragraph (c) of this section, stations in the maritime service must be licensed by the FCC either individually or by fleet. Vessel did not have current FCC License. Need new Station license.

Drug testing programs required by this part must be conducted in accordance with 49 CFR part 40, Procedures for Transportation Workplace Testing Programs. This subpart summarizes the responsibilities of credentialed mariners, marine employers, MRO, SAP and other chemical testing service providers in 49 CFR part 40. The regulations in 49 CFR part 40 should be consulted to determine the specific procedures which must be established and utilized. Drug testing programs required by this part must use only drug testing laboratories certified by the Department of Health and Human Services (DHHS). Vessel does not have documentation of current drug testing.

A vessel on a lakes, bays, and sounds, or rivers route must carry: (1) Three hand red flare distress signals approved in accordance with § 160.021 in subchapter Q of this chapter, or other standard specified by the Commandant; and (2) Three hand orange smoke distress signals approved in accordance with § 160.037 in subchapter Q of this chapter, or other standard specified by the Commandant. Vessel was missing 03 flares.

Each child size life jacket must be stowed in a location that is marked and separated from adult life jackets so the child size life jackets are not mistaken for adult. Life jacket locations were not properly marked.

Each floating waterlight must be approved in accordance with subchapter Q of this chapter. Vessel's lifefloat and ring buoy waterlight batteries were expired and not of manufacturer's recommended type. 46 CFR 180.70(d)(1)

Each survival craft must be secured to the vessel by a painter with a float-free link. Lifefloat's painter is not attached to float-free link in a way that will allow lifefloat to float free. 46 CFR 180.130(a)(1)

A vessel must comply with the applicable requirements for a station license and installation certificates issued by the FCC. Vessel's callsign printed on station license and Safety Radio Telephony Certificate did not match. 46 CFR 184.502 47 CFR 80

A marine employer whose vessel is involved in a casualty or serious marine incident shall comply with the requirements of part 4.06 in subchapter A of this chapter. Vessel's deckhand was not enrolled in applicable random drug testing consortium. Vessel is limited to operating with no more than 24 passengers onboard with a single operator only until deckhand enrolled in consortium. 46 CFR 185.212 46 CFR 4.06
