All machinery and equipment must be installed and maintained in such a manner as to afford adequate protection from causing fire, explosion, machinery failure, and personal injury. The independent fuel tank for the main propulsion engine was observed to be leaking gasoline due to the tank’s deteriorated material condition.

The owner, charterer, master or managing operator shall instruct each crew member, upon first being employed and prior to getting underway for the first time on a particular vessel and at least once every three months, as to the duties that the crew member is expected to perform in an emergency including, but not limited to, the emergency instructions listed on the emergency instruction placard required by 185.510 of this part. Crew training shall be logged or otherwise documented for review by the Coast Guard upon request. Deckhand on duty was employed in this position for approximately two years. Deckhand was unfamiliar with emergency duties posted on emergency instruction placard. Crew training logs or documentation were not available for review by the Coast Guard. 46 CFR 185.420 (a)(c)

Except as allowed by paragraphs (b) and (c) of this section, before getting underway on a voyage or as soon as practicable thereafter, the master of a vessel shall ensure that suitable public announcements are made informing all passengers of the following: (1) The location of emergency exits , survival craft embarkation areas, and ring life buoys; (2) The stowage location of life jackets; (3) Either: (i) The proper method of donning and adjusting life jackets of the type(s) carried on the vessel including a demonstration of the proper donning if a life jacket. (4) The location of the instruction placard for life jackets and other life saving devcices; (5) That all passengers will be required to don life jackets when possible hazardous conditions exist, as directed by the master. The deckhand stated that the passenger safety orientation only communicated the location of the life jackets to passengers and no other information or instruction was provided. 46 CFR 185.506

The master shall conduct sufficient drills and give sufficient instructions to make sure that all crew members are familiar with their duties during emergencies that necessitate abandoning ship or the recovery of persons in the water that have fallen overboard. Drill logbook showed a man overboard drill was conducted on 29 May 2019; however, the crewmember stated no drill was conducted. The only other drills logged were in 2015. Deckhand was unable to demonstrate or describe duties required for emergencies in accordance with this regulation. 46 CFR 185.520

The master shall conduct sufficient fire drills to make sure that each crewmember is familiar with his or her duties in case of a fire. The deckhand was unable to demonstrate the activation and use of a portable fire extinguisher when requested to demonstrate a response to a simulated onboard fire by the attending Coast Guard Marine Inspector. 46 CFR 185.524 (a)

Portable fire extinguishers must be located so that they are clearly visible and readily accessible from the space being protected. The installation and location must be to the satisfaction of the Officer in Charge, Marine Inspection. A B-II portable fire extinguisher cylinder was observed wasted and not mounted in an approved bracket. 46 CFR 181.520

Each floating water light must be approved in accordance with 161.010 in Subchapter Q of this chapter, or other standard approved by the Commandant. The installed water light contained an unapproved battery, therefore negating its Coast Guard approval for its use as designed. 46 CFR 180.70 (d)(1)

All vessels must have navigation lights that are incompliance with the applicable sections of the International and Inland Navigation Rules. The starboard running light was observed to be obscured by paint. 46 CFR 183.420

A vessel must carry either a first-aid kit approved under approval series 160.041 or a kit with equivalent contents and instructions. The first aid kit was missing items required by 160.041. 46 CFR 185.710

Electrical equipment on a vessel must be installed and maintained to: (a) Provide services necessary for safety under normal and emergency conditions; (b) Protect passengers, crew, other persons, and the vessel from electrical hazards, including fire, caused by or originating in electrical equipment, and electrical shock Electrical cabling and wiring in way of operating station observed to have dead end and exposed electrical wiring, incorrect connectors, and no identifiable circuit information. 46 CFR 183.340

Electrical equipment on a vessel must be installed and maintained to: (a) Provide services necessary for safety under normal and emergency conditions; (b) Protect passengers, crew, other persons, and the vessel from electrical hazards, including fire, caused by or originating in electrical equipment, and electrical shock. Each lighting fixture globe, lens, or diffuser must have a guard or be made of high strength material, except in an accommodation space, radio room, galley, or similar space where it is not subject to damage. Exterior glass bulb lights on top of overhead were missing protective guards. Light fixtures were also observed cracked with exposed wiring. 46 CFR 183.300 & 183.410

The Certificate of Inspection must be posted under glass or other suitable transparent material, such that all pages are visible, in a conspicuous place on the vessel where observation by passengers is likely. U.S. Coast Guard inspector found that the displayed Certificate of Inspection was only of the second page of the presently issued two page Certificate of Inspection. 46 CFR 176.302

When in accordance with 178.210 of this chapter, The Stability Letter must be posted under glass or other suitable transparent material, such that all pages are visible, at the operating station of the vessel. Stability Letter was not posted on vessel. 46 CFR 176.306

Each vessel must be equipped with at least two operable portable battery lights. Only one portable light was on the vessel. Operator placed a second portable battery light onboard vessel. 46 CFR 183.430
