Marine employers must establish programs for the chemical testing for dangerous drugs on a random basis of crewmembers on inspected vessels who:(1) Occupy a position, or perform the duties and functions of a position, required by the vessel's Certificate of Inspection...Marine employers will randomly select a sufficient number of covered crewmembers for testing during each calendar year to equal an annual rate not less than the minimum annual percentage rate for random drug testing determined by the Commandant. Vessel does not maintain current DAPI list. Last random chemical test was performed in March 2024. Update DAPI crew list and perform random chemical test. 46 CFR 16.230 (a-g)

All crew spaces are to be constructed and arranged in a manner suitable to the purpose for which they are intended and so that they can be kept in a clean, workable, and sanitary condition. Observed broken glass on mirrors on 2nd deck dance floor. 46 CFR 72.20-15

The general construction of the vessel shall be such as to minimize fire hazards insofar as is reasonable and practicable. Observed missing overhead panels on the 3rd deck, located forward on the starboard side. 46 CFR 72.03-5

At each annual inspection, the inspector must ensure that the following tests and inspections of fire detection and extinguishing equipment have been conducted. Vsl did not have all fire extinguishers on board and galley fire suppression system was under maintenance. Provide maintenance servicing report attesting to all fire extinguishers and fire suppression system serviced and in working condition.

All doors shall be capable of operation from either side by 1 person. The forward door leading to the anchor does not latch. Make repairs to the satisfaction of the attending marine inspector.

Before the vessel leaves port and at all times during the voyage, each lifesaving appliance must be in working order and ready for immediate use. Various lifebouy markings and retro tape were deteriorated. Ensure all lifebouys are ready for immediate use in accordance with 46 CFR 199.70(a).

Each vessel must carry a lifejacket for each person on board, and in addition a number of lifejackets suitable for children equal to at least 10 percent of the total number of passengers on board. Vessel was missing 15 children lifejackets. Reduce the number of children carried until lifejackets are replaced.

The annual inspection shall include an inspection of the structure, boilers, and other pressure vessels, machinery and equipment. Noticed damaged to the following areas: 1. Rub rail and lower handrail on transom near the port quarter were damaged 2. Bow handrail near anchor winch was damaged Submit repair proposal to the local OCMI for approval. Prior to credit drydock.

At least three reinspections shall be made on each vessel within one year. These reinspections will be made at approximately equal intervals between annual inspection. Vessel has canceled the third quarter reinspection and requires a new COI inspection to carry passengers. 46 CFR 71.30-1

Licenses for ship stations in the maritime services will normally be issued for a term of ten years from the date of original issuance, or renewal. Vessel FCC license certificate was expired. 47 CFR 80.25(a)

Each vessel must have posters or signs displayed in the vicinity of each survival craft and the survival craft's launching controls. Vessel did not have posters or signs illustrating how to deploy liferafts onboard. 46 CFR 199.90

Nonmetallic expansion joints must conform to the standards listed in table 2 to 56.60-1. Nonmetallic expansion joints may be used within their specified pressure and temperature rating in vital and nonvital machinery sea connections inboard of the skin valve. Raw water system expansion joint on the #3 SSDG has reach the end of its service life. 46 CFR 56.35-10

Reverse-power and reverse-current trips. Each generator arranged for parallel operation must have reverse-power or reverse-current trips. Reverse power relay on #3 SSDG inop. 46 CFR 111.12-11

Each inflatable life saving appliance must be serviced within 12 months of each subsequent servicing. 4(50 person) life rafts are a month past their servicing date. Vessel pax count will be reduced by 200 until servicing is complete.

Before the vessel leaves port and at all times during the voyage, each lifesaving appliance must be in working order and ready for immediate use. The port bridge wing ring buoy grab lines are damaged and in need of replacement.

Deck wiring or schematic plans of power systems and lighting systems must be approve. Vessel had temporary power leads wired into a distribution panel for DJ equipment in the accommodation space on the 3rd deck stbd side aft. Remove.

Each generator must be protected by a Circuit Breaker meeting the requirements of Subpart 11.12.

Bilge system deemed inoperable during inspection. System shall be capable of pumping from and draining water from required spaces. Demonstate proper operation per the above from multiple spaces prior to acceptance of current arrangement. 46 CFR 71.25-35(a), 46 CFR 56.50-50(a)

Fire Station #4 & Fire Station #2 did not have their hose nor spanner wrench on station during the exam. Outfit each of the respective fire stations as required.

Vessel's sprinkler system flow indicator alarms (zone M-2 main deck casino stbd 7 high limit room stbd, zone 2-2 second deck stbd side main casino, and main deck port zone m-1) did not operate as designed plus one had an allen wrench shoved into it to trick the system; the vessel is restricted from operating with passengers until system is working and verified by a CGMI.

Vessel has two CO2 bottles used for soda dispersement in the bars which is not mounted and could cause a safety hazard, must properly mount CO2 bottles when in use and storage.

Two fire stations (upper deck fwd & 2nd deck IWO anchor station) that were missing the required spanner wrenches; must provide one spanner wrench as per regulations.

VESSEL SHALL OFFLOAD ALL EFFECTED HAZARDOUS MATERIAL WASTE TO A CERTIFIED FACILITY. VESSEL SHALL CLEAN & GAS-FREE ALL EFFECTED TANKS/PIPING. PRIOR TO CLEARING DEFICIENCY, CG MI SHALL CONDUCT VISUAL INSPECTION OF EFFECTED TANKS/PIPING. VESSEL SHALL ISOLATE EFFECTED TANKL/PIPING AND NOT PERMITTED TO CONTINUE OPERATIONS OF EFFECTED TANK/PIPING UNTIL CG CONDUCTS VISUAL INSPECTION.

WHILE CONDUCTING A STEERING TEST, THE #1 STEERING PUMP MOTOR CAUGHT FIRE MAKING THE PUMP INOPERABLE. MI CONDUCTED NUMEROUS SATISFACTORY STEERING TESTS ON THE #2 EMERGENCY STEERING PUMP. VESSEL IS PERMITTED A ONE TIME [name withheld] TO OPERATE IN THE VICINITY OF THE STATUE OF LIBERTY ONLY, WITH A TUG ASSIST. VESSEL OPERATOR IS REQUIRED TO SUBMIT A SATISFACTROY TUG ASSIST PLAN THROUGH SECNY VTS. FOR PASSENGER OPERATIONS BEYOND 04/22/2023, VESSEL MUST SUBMIT SATISFACTORY REPAIR PLANS, CONDUCT SATISFACTORY REPAIRS, CONDUCT A SATISFACTORY OPERATIONAL TEST, AND CONDUCT A SATISFACTORY MAN OVERBOARD DRILL FOR CG REVIEW/APPROVAL.

A receptacle outlet must not have any exposed live parts with the plug opening uncovered, outlet in way of the #6 fire extinguisher is broken and needs to be replaced. 46CFR111.79-1

No flammable or combustible liquids may be stowed in any accommodation, control, or service space (other than a paint locker). Nothing in this subpart shall be construed as limiting the inspector from making inspections as necessary to be assured of the safety of the vessel. Remove the wastes oil and the containers from under ladder port side in the storeroom off of crew lounge. 46CFR71.25.50 46CFR147.45

Doors leading from engine room are not properly closing or latching, doors and are not self-closing and remain open. Demonstrate that the doors can close properly. Doors, other than those which are normally locked, such as from staterooms, fan rooms, lockers, etc., shall be of the self-closing. (Cleared) 46CFR72.05-25(b)(9)(i)

Prior to movement demonstrate proper operation of sprinkler system and demonstrate in the presence of an attending Marine Inspector that various heads and zones are not clogged, and water flows freely through the pipe through the heads. In addition, demonstrate that alarms and that the system operates as designed. 46CFR76.01-2 NFPA 13 CH25

Vessel has a Type III Marine Sanitation Device which is considered certified provided sole use is storage of sewage and flush water. Marine Inspector discover oil water in toilet in the “Marine Operations Managers Head” port side IWO frame 74-77 engine room deck. Thus, making the MSD tank not certified. The complete sewage system must be freed of all oil traces, prior to going back in operation. All oily water, contaminated water, to include sewage, must be properly contained on board the vessel. If the containment to include holding tanks for sewage and waste oil are exceeded, the vessel must coordinate the off load with USCG 33CFR159.12a

In general, at least three re-inspections shall be made on each vessel within one year. These re-inspections will be made at approximately equal intervals between annual inspections. Vessel operator has not requested or made vessel available for re-inspection, last inspection was completed 14NOV2022. Operator shall make vessel available to USCG Marine Inspector prior to operating with passengers. You must submit your application CG–3752 for the inspection at least 30 days in advance

An individual may not be engaged or employed, including self employment, on a vessel in a position as master, operator, or person in charge for which a credential is required by law or regulation unless all crewmembers covered by this regulation are subject to the random testing requirements of this section. Provide up to date list of persons enrolled in random chemical testing program. 46 CFR 16.230(k)

Where extinguishing systems or equipment are not required, but are installed, the system or equipment and its installation must meet the requirements of this part. Fire control panel was displaying a trouble alarm. Provide servicing report attesting to a satisfactory working detection system. 46 CFR 76.01-5(a)

The lifejackets stowage position must be marked with the words "LIFEJACKETS" or "CHILD LIFEJACKETS" as appropriate. Starboard bow sundeck lifejacket stowage locker was not labeled. 46 CFR 199.70(b)(2)(iii)

The intent of the annual inspections to insure that the vessel and other equipment is in satisfactory condition and fit for the service for which it is intended: (a)On the Sundeck, the bar is in needed of repair as there are sharp areas, nail sticking out and broken glass. Before the bar can be used the bar needs to be serviced/repaired prior to use. (b)Found 2 half tables that can easily fall over. Ensure the half tables are secured to the bulkheads as they inherently top heavy and easily fall over.

At each annual inspection, the inspector shall test automatic fire dampers to determine that they are in an operable condition. The fire dampers on main deck pantry is blocked by dishes/glasses, clear the area to make access to dampeners and demonstrate the operation of the dampers.

Remove the top row of boxes stored in the passageway leading to the CO2 station, so in the event of a fire the sprinkler system will reach behind the boxes/shelves, as there shall be 18” of clearance between the top of storage and ceiling sprinklers. (NFPA 13)

Before the vessel leaves port each lifesaving appliance must be ready for immediate use: (a) The ring buoy line, for the aft port side iwo e-gen, is being used to tie the door open. Properly mount life ring and make for immediate use. (b)Remove and replace the 02 un-serviceable life ring buoys identified on the 2nd deck bow and 2nd deck aft. (c)Replace ring buoy light line on 2nd deck to be between 3-6feet in length, UV resistant and be attached around the body of the life ring.

In engine room store rooms/ offices, remove the flammables from the rooms. As no flammable or combustible liquids may be stowed in any accommodation, control, or service space (other than a paint locker).

All piping, valves, and fittings of ferrous materials shall be protected inside and outside against corrosion. Currently installed piping unions used in the fixed CO2 system are not galvanized to protect against corrosion and shall be replaced as identified and reported by SEA SAFETY technician in their inspection certificate dated 18APR2022.

Each carbon dioxide extinguishing system altered after July 9, 2013, must have an approved odorizing unit to produce the scent of wintergreen. “Altered” means modified or refurbished beyond the maintenance required by the manufacturer's design, installation, operation and maintenance manual. Consequently from above deficiency number 09, when the pipe unions in the fixed CO2 system are replaced this would be considered an alteration beyond the regular maintenance required by manufacturer. Thus warranting the installation of an approved odorizing unit as required by 46 CFR 76.15-60.

Correct the identified cracked or stuck grounding prong electrical outlets to minimize electrical hazards.

The intent of the annual inspections to insure that the vessel, and other equipment is in satisfactory condition and fit for the service for which it is intended. Presently and over the past several inspections the vessels elevators have been taken out of service due to various failures. Due to theses failures, before all the elevators onboard the vessel can be used to carry any person (crew or passenger), provide proof from an Elevator Inspection Contractor licensed by the state of New Jersey or New York that the elevators meet ASME A17.1-2019: Safety Code for Elevators and Escalators.

Remove SSI lock combinations from ship's log.

Provide records for security equipment maintenance.

Provide list of crew members enrolled in DAPI.

Post EAP information for crew.

Replace dry rotted plug on bridge wing port side ring buoy.

Provide documentation for weekly lifesaving inspections.

Provide documentation for general alarm tests.

Demonstrate proper operation of flanking rudder angle indicator.

Conduct fire drill.

Replace emergency lighting on sun deck, port side, aft that is burned out.

Provide invoice from exterminator for rodent control.

Portable fire extinguishers must be numerically labeled to correspond with their numeric location on the fire control plan.

Tighten railing corner at the turn of the stairway from the 3rd deck to the sun deck.

Repair inop flood lights for liferafts at the second deck.

Sprinklers that are pushed up into the ceiling on the 3rd deck must be repaired to allow for proper diffuser functionality.

Provide elevator servicing certificate.

46 CFR 199.190(g) Liferaft annual servicing overdue.

33 CFR 64.11 (r) the (steering gear) equipment is maintained in operable condition. Follow-up control (primary means of steering) is inoperable from the main conning position on the navigation bridge. Vessel is required to make permanent repairs and conduct sea trials under the observation of a Coast Guaard Marine Inspectorprior prior to passenger service.

46 CFR 199.180(c) Drills - general. (1) Drills must, as far as practicable, be conducted as if there were an actual emergency. (2) Every crewmember must participate in at least one abandon-ship drill and one fire drill every month. The drills of the crew must take place within 24 hours of the vessel leaving a port if more than 25 percent of the crew have not participated in abandon-ship and fire drills on board that particular vessel in the previous month. NO DRILLS HAVE BEEN CONDUCTED. PRIOR TO PAX, VESSEL MUST CONDUCT MOB, FIRE AND SECURITY DRILLS WITH CREW.

§ 104.410 Submission and approval (c) The Commanding Officer, Marine Safety Center (MSC), will examine each submission for compliance with this part, and either - (1) Approve it and specify any conditions of approval, returning to the submitter a letter stating its acceptance and any conditions; VESSEL OWNER COULD NOT PROVIDE PROOF OF ASP ACCEPTANCE LETTER. LETTER MUST BE KEPT ON BOARD FOR INSPECTOR REVIEW.

78.33-5 Accidents to machinery. (a) In the event of an accident to machinery tending to render the further use of the item unsafe until repairs are made, or if by ordinary wear such items become unsafe, a report shall be made immediately to the Officer in Charge, Marine Inspection, or if at sea, immediately upon arrival at port. #1 MDE outboard crankcase cover leaking oil. Repair immediately (deficiency carried over from COI inspection).

Each liferaft must be arranged to permit it to drop directly into the water from the deck on which it is stowed. Aft liferafts on the port and starboard sides of the deck are impeded from dropping directly into the water by the passenger railing. Remove railing that would impede liferaft from direct drop overboard without compromising passenger safety and the intent of the railing to prevent MOB situations.

Lifebouys on vessel with light must be self-igniting. Replace/repair light on port side bridge wing of vessel.

Replace burned out bulbs for e-lighting between second and third deck.

Fire boundaries around area of safe refuge must be a class 'A' boundary. Replace plastic window separating accomodation space and area of safe refuge with proper class 'A' window IAW fire control plan.

Ventilation system was spot checked and several areas were dirty and filters were clogged. Clean out ventilation areas as discussed.

Pressure gauging on topping off tank gauge is not working and needs to be replace.

A vessel that has automatically or remotely controlled or monitored vital systems addressed by part 46 CFR 62 must be subjected to tests and inspections to evaluate the operation and reliability of controls, alarms, safety features, and interlocks. The vessel has no test or inspection procedures (Periodic Safety Test Procedure) ***Provide copy by 15 December 2018***

Vessels # 3 ship service generator is not operational, once repairs have been made and then prior to carrying passengers, the vessel must go through a survey such as to insure that the necessary repairs or renewals have been effectively made. *** After repairs, before carrying passengers***

Pipe, tubing, pipe joining fittings, and piping system components shall meet material and standard requirements of subpart 56.60 and shall meet the certification requirements of part 50 of this sub-chapter. The vessel has a pinhole leak its its jacket water pipe for the No. 2 SSDG. Prove proper repairs to the attending USCG Marine Inspector.

Fire pumps shall be fitted with a pressure gauge on the discharge side of the fire pump. Pressure gauge is inconsistent and unable to read. Demonstrate proper operation of pressure gauge for fire pump.

Sufficient illumination must be provided by the emergency lighting source under emergency conditions to provide safe egress. Emergency lighting in stairway from engine room flickers. Demonstrate proper operation of emergency lighting.

All water tight doors (WTD) shall be kept closed during navigation except when necessary for working on the vessel, and in such cases they shall always be ready to be immediately closed. Replace missing cotter pin in WTD leading into engine room.

For all types of stairways, sufficient handrails shall be fitted. Tighten handrail leading from the hurricane deck to the O-3 deck forward.

The frame or support of each fire extinguisher must be welded or otherwise permanently attached to a bulkhead or deck. Fire bracket on O-1 deck, starboard quarter, is broken. Replace broken fire bracket.

The inspector shall examine the tank tons and bilges in the machinery spaces to see that there is no accumulation of oil which might create a fire hazard. Oil was identified in void space between engine room and lazarette. Remove oil in bilge.

A survey, either general or partial, according to the circumstances, shall be made every time an accident occurs or a defect is discovered which affects the safety of the vessel or the efficacy or completeness of its lifesaving appliances, fire-fighting or other equipment, or whenever any important repairs or renewals are made. Vessel reported that a damper shut on the #2 generator, causing the generator to overheat and produce sparks and smoke. Prior to carrying passengers, vessel shall clean and/or replace exhaust piping and make available for inspection by a Coast Guard Marine Inspector.

A survey, eith general or partial, according to the circumstances, shall be made every time an accident occurs or a defect is discovered. The Captain of the Port is allowing this vessel to board passengers at the pier, stay pier-side while the passengers are on board the vessel for an event on the evening of 06May2018. In the event that the ship's service generator malfunctions and the ship's emergency generator takes the loas, all passengers shall be disembarked, and the Coast Guard shall be notified. The previous 02 CG-835V's are still in effect.

SSDG#3 is not operational and being repaired. Make repairs and perform operational test prior to being placed back in service.

Vessel has missed the 2nd and 3rd re-inspections (quarterlies). Prior to carrying passengers must have a credit COI.

Vessel did n ot have the proper number of crew to conduct drills.

Bar on second deck has a drain problem causing flooding of grey water on 1st deck & enlisted dining room which is an un-sanitary condition, must clean and repair pipe.

Vessel has lighting and block heater for emergency generator on same circuit. These should be on separate circuits.

Steering alarms for loss of power, oveload, and low lube oil for both steering pumps not producing audible alarm. #2 Steering pump loss of power alarm not illuminating.

Several panelboarsd do not have directory inside. Bridge deck panelboard on stbd side not able to be latched properly.

CO2 room is missing SFP insulation on bulkhead in separate areas that need to be replaced.

230V ground detection system is not working on MSB in engine room. Make repairs and demonstrate proper operation.

Repair blower fan ducting in the CO2 room. Currently ducitng is not properly attached and blowing dust and lint all over strutural fire protection insulation.

Fuel transfer pump / dirty oil shutdown shutdown switches currently inside the e gen space. Shutdowns need to be relocated outside space.

Potable water connection valve in galley needs cap abd lock to prevetn tampering.

Panelboard in engine room ajacent to stbd MDE is unable to be opened due to installation of handrail. handrail to be modified to ensure safety and allow for access.

Two doors do not have noncombustible thresholds installed: stbd door wheelhouse and 3rd deck store room.

3rd deck storeroom latch missing

Grab line on port bridge wings broken. All lifesaving shall be in full operational condition prior to operating.

Repair missing door handle in forward most space on the main deck leading to the Forecastle. Door is an emergency exit leading out to safe refuge area.

Mark vessel life rings with vessel name.

Repair deck flooring in way of the 3rd deck bar. Several tiles are loose and coming up, crew has fabricated a make shift cover out of cardboard.

Repair/replace electrical outlet and switch on 2nd deck pillar nearest the dance floor.

Ensure all sprinkler heads free and clear of drop ceiling panels throughout the vessel.

Remove oil in bilge in way of the elevator. Elevator hydraulic system appears to have leaked at one time and oil has work its way into the bilge.

Remove all flammable materials under the stern ladder in way of the rescue boat. Crew has stored cans of gas and diesel fuel.

Provide means of escape from galley alcohol refer, presently the door has a dead bolt and no panic release from inside if locked in.

Provide a cover for the electrical junction box in the overhead of the beer cooler walk-in.

Prove operation of air pressure vessel relief valves.

Conduct abandon ship drill.

Prove operation of #3 ships service generator buss tie breaker.

Provide pollution placards, and oil transfer proceedures.

Prove operation of chiller circuit ground detection lights on main power panel.

Make engine room water tight door alarm system function properly.

Mount main deck general alarm bell in location pointed out by inspector, and lable properly.

Renew stern light element.

Prove operation of fire screen door #1.

COMPLETE STORAGE AND LABELING FOR PFD STOWAGE.
