BEAUPORT

[Exhaust piping] must be gas tight throughout its length. A medium-sized leak of exhaust gas was found in the lazarette coming from the starboard engine's exhaust piping, leaking exhaust gas into the space. Additionally, the lazarette access hatch is inside the passenger accommodation space and is not fitted with a gas-tight seal. 46 CFR 182.15-20 (Old T)

As appropriate for the intended voyage, a vessel must carry adequate and up-to-date: Charts of large enough scale to make safe navigation possible. Electronic chart installed on board could not be confirmed compliant with RTCM 10900 standards. Paper charts on board were older than 6 months and therefore out of date. 46 CFR 121.420(a)(1)

An adult life jacket must be provided for each person carried on board a vessel. Sixty (60) life jackets were found to have deteriorated buoyant foam (45 from 2nd deck, 15 from 3rd deck). Vessel may not operate with more than 364 total passengers on board. 46 CFR 117.71(a)

Each nozzle must be of a type approved in accordance with approval series 162.027. Fire nozzle on 2nd deck fire hose was not capable of producing a water spray pattern. 46 CFR 118.320(c)(1)

Penetrations and openings in watertight bulkheads must have means to make them watertight. Plastic discharge piping from aft kitchenette attached to the starboard hull had a small opening allowing daylight through. 46 CFR 171.114(a)(2)

On a vessel of more than 19.8 meters (65 feet) in length, the public address system must be a fixed installation and be audible during normal operating conditions throughout the accommodation spaces and all other spaces normally manned by crew members. Both speakers on 3rd deck passenger deck were not operational. 46 CFR 121.610(b)

An adult life jacket must be provided for each person carried on board a vessel. 127 adult life jackets were found in a damaged condition and removed from service. Replace life jackets removed from the vessel. Vessel is limited to a total maximum of 343 persons on board until appropriate number of life jackets are on board.

A door in a bulkhead required to be A-60 Class must be capable of meeting the requirements of an A-15 Class bulkhead. The door handles on the deck 03 stairtower doors were loose and not forming a fire boundary. Tighten/replace to the satisfaction of the Coast Guard.

Waste receptacles must be constructed of noncombustible materials with no openings in the sides or bottom. Waste receptacles on the vessel are plastic combustible types. Replace waste receptacles with noncombustible ones.

Each distribution panel or switchboard must be totally enclosed. The engine room port distribution panel had a missing punch out circular plate on the side of the panel box. Replace missing punch out plate.

An adult life jacket must be provided for each person carried on board a vessel. MI observed 06 life jackets with failed inner foam material. Total Persons Allowed On Board is reduced to 464 until replacement lifejackets are onboard.

The construction and arrangement of a vessel must allow the safe operation of the vessel in accordance with the terms of its Certificate of Inspection giving consideration to provisions for a seaworthy hull. MI observed wastage in the aft support gussets on both rudderposts as well as on the 1st transverse frame, starboard side, aft of the forward bulkhead in way of the chine to inboard longitudinal frame. Operator to submit plan to repair prior to next credit hull inspection.

Electrical equipment on a vessel must be installed and maintained to: Minimize accidental personnel contact with energized parts. MI observed 04 openings inside distribution panel in galley and exposed wire ends in an overhead light in the galley.

At least one ring life buoy must be fitted with a lifeline. If more than one ring life buoy is carried, at least one must not have a lifeline attached. MI observed that the lifeline on 02 ringbuoys were deteriorated and breaking when flexed.

Each vessel must be equipped with at least two operable portable battery lights. One of these lights must be located at the operating station and the other at the access to the propulsion machinery space. MI observed the portable light at the operating station had very weak batteries and there was no portable light outside the propulsion machinery space.

The construction and arrangement of a vessel must allow the safe operation of the vessel in accordance with the terms of its Certificate of Inspection giving consideration to provisions for a seaworthy hull. Superstructure bulkhead bottom, at the aft port door-sill, found wasted through and open to the weather. Crop and renew to good steel, to the satisfaction of the attending Marine Inspector.

The alcohol testing of each individual must be conducted within 2 hours of when the SMI occurs. Alcohol testing equipment was was expired. Obtain approved testing equipment and keep onboard at all times.

Each distribution panel must be protected from falling debris and dripping/splashing water. The front cover hardware on the pilothouse was broken allowing foreign object and water ingress. Repair/replace junction box as necessary to keep debris/water out.

A vessel to which this subchapter applies may not be operated without having on board a valid U.S. Coast Guard Certificate of Inspection. Vessel operated without a valid COI.

No marine employer shall engage or employ any individual to serve as a crewmember unless the individual passes a chemical test for dangerous drugs for that employer. The company has been enrolled in a non DOT drug testing program where results are not reviewed by a Medical Review Officer. Company must conduct pre-employment DOT drug testing for all employees who hold a safety sensitive position on the vessel.

The selection of crewmembers for random drug testing shall be made by a scientifically valid method, with each covered crewmember having an equal chance of being tested each time selections are made. Company is currently not using a scientifically valid method in selecting employees for random drug testing. Company shall use an approved method for selecting crewmembers for random drug testing.

The employer shall provide an Employee Assistance Program (EAP) for all crewmembers. Specifically, an EAP training program must be conducted for the employer’s crewmembers and supervisory personnel. Supervisory personnel must receive at least 60 minutes of training. Company currently does not conduct EAP training with crewmembers or supervisors. Company shall complete at least 60 minutes of EAP training with supervisors and general training for all other crewmembers.

Drug testing programs required by this part must be conducted in accordance with 49 CFR part 40, Procedures for Transportation Workplace Testing Programs. The company is not compliant with, specifically but not limited to part 16.201. **Must bring drug testing program into full compliance prior to carrying passengers**

Decks of the ‘‘A’’ Class shall be so insulated with approved structural insulation, deck covering that the average temperatures on the unexposed side would not rise more than 250 °F. above the original temperature, nor would the temperature at any one point, including any joint, rise more than 325 °F. above the original temperature, within the time listed below: Class A–60, 60 minutes. If the pipe passes through an A-60 division, approved structural insulation should be applied to the pipe on the insulated side of the division for a distance of at least 300 mm (12 inches). The A-60 deck fire boundary located on the overhead within the engine room is missing A-60 insulation in two locations where pipe penetrations are located.

The Certificate of Inspection (COI) must be posted under glass or other suitable transparent material, such that all pages are visible, in a conspicuous place on the vessel where observation by passengers is likely. Vessel has expired temporary COI posted in restricted pilot house on the navigation bridge.

Charts and nautical publications. (a) As appropriate for the intended voyage, a vessel must carry adequate and up-to-date: (1) Charts of large enough scale to make safe navigation possible; vessel has on board out dated paper charts (2009) & outdated electronic charts.

Each hydrostatic release unit, other than a disposable unit, must be serviced within 12 months of its manufacture and within 12 months of each subsequent subsequent servicing. Each disposable hydrostatic release unit must be marked in clearly legible letters with an expiration date of two years after the date on which the unit is installed. EPIRB hydrostatic release unit is expired.

A vessel must carry either a first-aid kit approved under approval series 160.041 or equivalent contents. First Aid Kit contents are expired.

All microprocessor or computer based systems must meet the requirements of part 62 in subchapter F. Vessel operators could not provide Design Test Verification Procedures or any USCG review of installation.

Protect passengers, crew, and the vessel from electrical hazards, including fire, caused by or in electrical equipment, and electrical shock. The outside light on 3rd deck is not hardwired to the electrical system

A vessel must comply with the applicable requirements as set forth in 47 CFR 80. FCC Safety Radio Certificate not on board vessel.

Amp meter does not work. Provide working amp meter for generator distribution panel. 46 CFR 183.10-5(g)

Battery charger does not have an amp meter. Provide in line amp meter on battery charger. 46 CFR 183.05-20(f)

Sewage discharge valve is not secured. Provide a method of securing overboard discharge.

Life jacket donning placards are illegible on deck 2 forward, port & starboard. Provide legible life jacket donning placards.

Life ring located on deck 3 is worn and the light is incorrectly spliced together. Replace lines and properly connect light to life ring.

Life ring located on deck 2 has incorrect name on it. Provide life ring with correct name.

Call sign is incorrect on Bridge-to-Bridge and Safety Certificates. Provide certificates with correct call sign. 47 CFR 80.13

Emergency lighting inoperable in deck 2 stairwell and is missing in deck 2 pantry and port quarter main deck (outside female bathroom). Provide working emergency lighting.

Hatch located on port bow deck is missing a securing device. Provide securing device for hatch. 46 CFR 171.124

Fuel vent is missing flame screen. Install 30x30 mesh flame screen. 46 CFR 182.20-35(d)

Life ring located on deck 1 line is worn. Replace line.

03 carbonation cylinders located on deck 2 in galley are not properly secured. Secure cylinders.
