The construction and means for securing the weathertightness of cargo and other hatchways in positions 1 and 2 shall be at least equivalent to the requirements of regulations 15 and 16 of this annex. PSCO observed a hole (1") in hatch cover #2. ICLL Annex I/reg 14.1

Whenever there is a hazardous condition either on board a vessel or caused by a vessel or its operation, the owner, agent, master, operator, or person in charge must immediately notify the nearest Coast Guard Sector Office or Group Office, and in addition submit any report required by 46CFR4.05-10. Vessel did not report to the nearest Coast Guard unit when it was found that the Controllable Pitch Propeller was non-operational during transit outbound Sector Miami. The vessel failed to notify USCG until 12 hours later. 33CFR160.216(a)

PSCO observed keyholes opening keyhole opening in the emergency escape door in the engine room 74SOLAS(97) II-2/47.1

Before the ship leaves port and at all times during the voyage, all life-saving appliances shall be in working order and ready for immediate use... During operational testing of the rescue boat, the shave on the rescue boat davit was found to be seized and could not move. 74SOLAS(97Cons.)III/19.2

An embarkation ladder complying with the requirements of regulation 48.7. PSCO's observes rope rot on the port side of embarkation ladder at the shackle connection. 74 SOLAS (1997 CONS.) III/11.7

Where risk from overspeeding of machinery exists, means shall be provided to ensure that the safe speed is not exceeded. Vessel's main engine overspeed trip alarm is not operational. 74 SOLAS (04) 11-1/27.1

The means of control of any such fixed gas fire-extinguishing system shall be readily accessible and simple to operate... Crew was unable to produce the keys necessary to unlock aft CO2 storage room in a timely manner.

THE MEANS OF CONTROL OF ANY FIXED GAS FIRE EXTINGUISHING SYSTEM SHALL BE READILY ACCESSIBLE… CREW COULD NOT IMMEDIATELY ACCES CONTROLS FOR EMERGENCY GENERATOR CO2 BOTTLES DUE TO THE CLOSEST DEVICES ON THE HATCH BEING PAINTED SHUT. 74 SOLAS (04 CONS) CH. II-2/REG 5.1.7

"A" class divisions shall be constructed as to be capable of preventing the passage of smoke and flame. PSCO's observed a penetration for wires through an "A" class boundary, allowing for the passage of smoke and flame through the bulkhead between the steering gear room and emergency pump room. 74 SOLAS (1997 Cons.) II-2/3.3.3

The International Load Line Certificate shall not be delivered to the ship until the officer or surveyor...has certified the markes are correctly and permanently indicated on the sides of the ship. The load lines on the certificate are not correctly marked on the ship. ICLL 66, Reg. 9

Fire extinguishers shall be periodically examined and subjected to such tests as the administration may require. Foam medium for the required foam applicators onboard vessel have not had the required lab analysis after being put into service for 5 years. Last analysis was May 2017. 74 SOLAS (1997 Cons.) II-2. 6.5 (MSC1/CIRC1432 para. 7.11)

The operator of each self propelled vessel over 12 meters or more in length shall carry onboard a copy of these rules. The vessel does not have a copy of the rules onboard. 33CFR83.01(g)

Each production device must be legibly marked in accordance with paragraph (b) of this section. The MSD on vessel is not marked with the required information. 33CFR159.55(a)

03-0940-To discharge ballast water into the waters of the United States, the master, owner, operator, agent or person in charge of the vesselsubject to 151.2025 of this subpart must either meets the ballast water dicharge standard in151.2030(a), use an AMS as described in 151.2025(a)(3), or Ballas with water from a U.S public water system according to the schedule in paragraph (b) of this section. Subject vessel of keel laid date 1989 and ballast water capacity of 1599 cubic meter is past its compliance date per the implementation schedule in 33 CFR 151.2035(b). Vessel's current ballast water management method is exchange and discharge, which is not authorized. Vessel has no BWTS installed. Vessel is not authorized to discharge untreated ballast into U.S waters. This deficiency will not be cleared until CG examiners receive documentation that the vessel has installed a BWTS, has decided to use public water from U.S public water systems, or has updated its ballast water management plan to state that the vessel's ballast water management method in U.S waters is NO DISCHARGE. 33 CFR 151.2035 15 C

05-1499 The machinery boilers and other pressure vessels, associated pipin systems and fittings shall be of a design and construction adequate for the service for which they are intended and shall be so installed and protected as to reduce to a minimum any danger to persons on board, due regard being paid to moving parts, hot surfaces, and other hazards. PSCO observed deteriorated boiler framing and insufficient boiler exhaust lagging. 74 SOLAS(04) II-1/26.1 50C

06-0199-Vessels operating within 03 nautical miles of the U.S must conduct routine visual inspections, once per week or voyage and document in official logbook or other documentation. Inspections are not being recorded as required under section 4.1.1.1 in 2013 VGP.

CODE 1286 A mechanical means of closing each drain and scupper in an enclosed deck area required by this section. PSCO observed 03 non-mechanical wooden plugs being used as a means of closing drains and scuppers. 33CFR155.310(a)3 40c

08-1440-All bilge pipes in machinery paces, including spaces in which oil settling tanks or oil pumping units are situated, shall be of steel or other suitable material. PSCO observed bilge suction arrangement from aft bilge well was made of flex hose material.
