For fixed-gas fire extinguishing systems, the inspections and tests required by Table 176.810(b) of this section, in addition to the tests required by 46 CFR 147.60 and 147.65. The owner or managing operator must provide satisfactory evidence of the required servicing to the marine inspector. If any of the equipment or records have not been properly maintained, a qualified servicing facility may be required to perform the required inspections, maintenance procedures, and hydrostatic pressure tests. Vessel did not conduct Annual Servicing for fixed gas CO2 System. Conduct Annual Servicing.

A vessel must comply with the applicable requirements for any radio and Electronic Position Indicating Radio beacon (EPIRB) installations, including the requirements for a station license and installation certificates to be issued by the Federal Communications Commission, as set forth in 47 CFR part 80. Attending MI found out that the vessel's FCC certs for Bridge to bridge and safety radiotelephony certificates were expired. Renew certificates. 46 cfr 183.502

Abandon ship and man overboard drills and training shall be logged or otherwise documented for review by the Coast Guard upon request. The drill entry shall include the following information:(1) Date of the drill and training; and(2) General description of the drill scenario and training topics... Attending Marine Inspector was informed that Captain left his logbook at the shop. Provide evidence that a logbook exists with drills conducted. 46 cfr 185.520

a vessel must carry adequate and up-to-date: Charts of large enough scale to make safe navigation possible.. Outdates maps found onboard. Update new Charts 46 CFR 184.420

A vessel on a lakes, bays, and sounds, or rivers route must carry: Three hand red flare distress signals approved in accordance with § 160.021 in subchapter Q of this chapter, or other standard specified by the Commandant; and Three hand orange smoke distress signals approved in accordance with § 160.037 in subchapter Q of this chapter, or other standard specified by the Commandant. Attending MI found expired flares. Outfit vessel with valid flares. 46 cfr 180.68

An ammeter that is readily visible shall be included in the battery charger circuit. Attending MI found no ammeter in the charging circuit. Outfit vessel with Ammeter. 46 cfr 183.05-20 OLD T

In systems and applications where flexible hoses are permitted to be clamped... Two clamps must be used on each end of the hose... Generator fuel lines found to be clamped with Zip ties and wet exhaust flex hose found to be single clamped. Outfit vessel with double clamping. 46 CFR 182.410

Provision Shall be made by means of plugs covers etc to prevent the admission of air into the space protected. Attending MI found wire run openings into the spaces where fixed CO2 is protecting. Seal wire runs approved insulation. 46 CFR 181.20-35 OLD T

A vessel that is exposed to salt water more than three months in any 12 month period since the last examination must undergo a drydock examination and an internal structural at least once every two years... Vessel lapsed required inspection dates 31MAR2024 (page two of COI). Make vessel ready for drydock and internal structures examination. Prior to carriage of passengers/cargo, vessel must receive credit drydock.

On a vessel of at least 7.9 meters (26 feet) in length, a visual and audible alarm must be provided at the operating station to indicate a high water level. Vessel did not have audible alarms in two of the four spaces required on the vessel. All alarms had operational visual alarms.

The master shall conduct drills and give instructions as necessary to ensure that all crew members are familiar with their duties. While conducting man Overboard Drill, crew was not able to properly communicate with the Master of the vessel, running over the "victim" due to poor visibility for the captain and poor communication by the crew. A device must be provided to automatically shut down power ventilation serving the protected space and engines that draw intake air from the protected space prior to release of the extinguishing agent into the space While testing the CO2 system,the device used to shut down the engines and ventilation was not functional.

On a vessel on which the number of passengers permitted on the upper decks is limited by stability criteria, as indicated by the vessel's stability letter, the maximum number of passengers allowed on the upper decks must be indicated by a durable marking of numbers and letters at least one inch in height at the entranceway to each such deck. placard not showing # of pax on top deck. On the vessels stability letter, 06 passengers are allowed on the second deck. There was no placard on the vessel stating the number of passengers allowed on the second deck.

Propulsion machinery must be suitable in type and design for propulsion requirements of the hull in which it is installed and capable of operating at constant marine load under such requirements without exceeding its designed limitations. Vessel needs to be repaired, and conduct sea trials in the presence of a marine inspector prior to carriage of passengers.

The vessel had several dead end wires in the generator space.

Rudder posts on port and starboard side had significant water ingress.

Vessel did not have a means of securing ventilation from outside the space.

Vessel did not have stability letter.

The vessel did not have emergency instructions.

Raw water line coming from through hull fitting in the generator room is rubbing against CO2 bottle. Vessel will add chafing gear to prevent damage to piping.

At each inspection for certification and at every other vessel inspection, the bilges and other spaces may be examined to see that there is no excessive accumulation of oil, trash, debris or other matter that might create a fire hazard. Excessive standing oil and coolant underneath both of the vessel's generators, as well as the Port and Starboard MDE's. Additionally, flammable chemicals/cleaners and carpeting are stored in the port E/R, representing an immediate fire hazard.

All fiber reinforced plastic vessels constructed with general purpose resins must be fitted with a smoke activated fire detection system of an approved type. None of the vessel's smoke detectors were functional, not all were approved under UL 217, and smoke detectors were not installed in all areas requiring them.

A vessel on a lakes, bays and sounds route must carry: three hand red flare distress signals; and three hand orange smoke distress signals. The vessel had only four flares onboard, and those were found to be expired.

Passenger accommodation spaces must be maintained to minimize safety hazards and to preserve sanitary conditions. Vessel has numerous sewage leaks that caused raw sewage to spray all over the generator space, and accumulate in the bilges of the generator space and forward passenger accommodation area.

A vessel must be provided with a satisfactory arrangements for draining any watertight compartment, under all practicable conditions. Due to excessive amounts of oily water and sewage in the bilge, inspectors were unable to test the operation of the bilge system.

A submersible electrical bilge pump may be used as a power bilge pump only on a vessel of not more than 19.8 meters in length carrying not more than 49 passengers, provided that: A positive shutoff valve is installed at the hull penetration. No positive shutoff valves were installed at the hull penetrations for the bilge system.

Flexible tube or hose may be used instead of fixed pipe for the discharge line of a submersible electric bilge pump provided the hose is of good quality, substantial construction, & suitable for the intended use. Bilge lines are not suitable for the intended use.

On a vessel of at least 7.9 meters in length, a visual and audible alarm must be provided at the operating station to indicate a high water level. Wiring for the bilge high level alarm system is corroded and no longer serviceable.

Annual Inspection: Your vessel must undergo an annual inspection within 3 months before or after each anniversary date. Vessel was actively operating after the 3-month period had expired.

At each initial and subsequent inspection for certification, the marine inspector shall examine and test electrical installations to the extent necessary to determine that they are in proper operating condition, safe electrical condition, and fit for the service for which they are intended. Numerous dead ended, disconnected and spliced wires were discovered throughout the vessel.

At each initial and subsequent inspection for certification, the marine inspector shall examine and test the auxiliary machinery to the extent necessary to determine that they in proper operating condition and fit for the service in which they are intended. Windings in the generator end must be inspected for oil buildup.

Chemical testing of personnel must be conducted as required by this subpart and in accordance with the procedures detailed in 49 CFR part 40. Vessel could not provide proof of enrollment in a DAPI program.

For portable fire extinguishers, the inspections, maintenance procedures and hydrostatic pressure tests required by Chapter 4 of NFPA 10 must be completed. 03 B-II extinguishers were found to be past their annual servicing date.

At each inspection for certification, and at every other vessel inspection, all observed unsafe practices, fire hazards and other hazardous situations must be corrected. Excessive unsecured gear, dunnage, parts and equipment created an egress and fire hazard.

It is intended that all machinery be installed and maintained in such a manner as to afford adequate protection against fire, explosion, machinery failure and personnel injury. The port side engine cooling water flex hose is not properly secured.

The construction and arrangement of a vessel must allow the safe operation of the vessel in accordance with the terms of its Certificate of Inspection giving consideration to provisions for necessary facilities for passengers and crew. Master stated that all flying bridge equipment was not used by the crew, and was found to be unserviceable. All equipment, to include throttle and navigation equipment and electronics should be disconnected or appropriately removed from service to prevent passenger interference from the flying bridge with vessel operations.

Port E/R air conditioner pump is wired using a non-permanent arrangement, and must be made using a permanent arrangement.

Passenger accommodation spaces must be maintained to minimize safety hazards and to preserve sanitary conditions. Floor supports for the bilge access hatch in port guest cabin are rotted, creating a hazardous condition.

Port and STBD main engine raw water sea strainer gaskets are wasted and no longer serviceable.

Due to COVID-19 and the unavailability of crew, coupled with the fact that this vessel had numerous detainable and prior to departure deficiencies, drills were not conducted during USCG attendance. Vessel must conduct fire and MOB drills prior to carriage of passengers.

Crew training shall be logged or otherwise documented for review by the Coast Guard upon request. The training entry shall include the following information: Date of training; and general description of the training topics. There were no logs or records of crew training onboard.

Abandon ship and man overboard drills and training shall be logged or otherwise documented for review by the Coast Guard upon request. The drill entry shall include the following information: Date of the drill and training; and general description of the drill scenario and training topics. No records or logs of abandon ship/man-overboard drills were onboard the vessel.

Firefighting drills and training shall be logged or otherwise documented for review by the Coast Guard upon request. The drill entry shall include the following information: Date of the drill and training; and general description of the drill scenario and training topics. No records or logs of firefighting drills were onboard the vessel.

All escape hatches and other emergency exits used as means of escape must bemarked on both sides in clearly legible letters at least 50 millimeters high: "EMERGENCY EXIT, KEEP CLEAR". Emergency exits onboard were not marked/labeled.

Before getting underway on a voyage or as soon as practicable thereafter, the Master of a vessel shall ensure that suitable public announcements are made informing passengers of safety information. Master expressed that overnight egress details were not being given in the safety orientation to overnight passengers. This must be added to the safety orientation.

The area of operation for each vessel and any necessary operational limits are determined by the [name withheld] are permitted to operate on the following protected route: BOSTON HARBOR AND ADJACENT WATERS: INSIDE A LINE DRAWN BETWEEN DEER ISLAND AND POINT ALLERTON, MA, UNDER REASONABLE OPERATING CONDITIONS.

A Stability letter is issued in accordance with the requirements of 170.120 of this chapter, it must be posted under glass or other suitable transparent material in the pilothouse. Stability letter not posted.

Every vessel subject to part III of Title III of the Communications Act must have a detailed inspection of the radio installation by an FCC-licensed technician in accordance with 80.59 once every five year. Operator could not produce valid FCC Safety Certificate.47 CFR 80.905

Licenses for ship stations in the maritime services will normally be issued for a term of ten years from the date of original issuance. Operator could not produce a valid FCC Station License.47 CFR 80.25

Fire protection equipment must be clearly and conspicuously marked. Fixed C02 fire system not marked at IAW: 46CFR185.612(a-g)

Remote fuel shutoff stations must be marked in clearly legible letters at least (1 inch) high indicating purpose of the valve and direction of operation. Remote fuel shutoff station marking is illegible to the space containing the generators.

A vessel is inspected for compliance with the standards acceptable to the OCMI as good marine practice. The detector located in the space containing the generators is not properly mounted.

(over 30 life jackets are stowed in portable bags on upper deck, but do not have an established location marked and designated for stowage. Most of the passengers are required to remain on the main deck, therefore, pfds should be in a designated location with the majority on the main deck.)

Vessel is overdue for annual exam. Exam was required to be conducted no more than 90 days after the anniversary date on the COI. The anniversary date is 15 Oct, so teh exam was required to be conducted no later than 15 Jan 2010.
