A vessel must carry one floating waterlight. Each floating waterlight must have a lanyard of at least 3 feet in length, but not more than 6 feet, securing the waterlight around the body of the ring life buoy and must be attached to the lanyard with a corrosion-resistant clip. The clip must have a strength of at least 50 pounds, and allow the waterlight to be quickly disconnected from the ring life buoy. The waterlight was not attached around the body of the buoy and did not have a corrosion resistant clip. Attach waterlight appropriately to the satisfaction of the attending Marine Inspector. 46CFR180.70 46CFR180.30-1 Old T

A vessel must comply with the applicable requirements for any radio and installation certificates to be issued by the Federal Communications Commission, as set forth in 47 CFR part 80. The FCC Radiotelephony Certificate is expired. Acquire valid FCC certificate to the satisfaction of the attending Marine Inspector. 46CFR184.502

All cable and wire must be installed with metal supports spaced not more than 24 inches apart. The wire runs in the forward starboard compartment are not supported. Install wire supports to the satisfaction of the attending Marine Inspector. 46CFR183.340(b)(4)

Electrical equipment on a vessel must be installed and maintained to protect passengers, crew, other persons, and the vessel from electrical hazards, including fire, caused by or originating in electrical equipment, and electrical shock. There are dead end wires in the forward starboard compartment and on the port side Fireboy. Remove or secure wires to the satisfaction of the attending Marine Inspector. 46CFR183.200(b)

Annual inspection. Your vessel must undergo an annual inspection within the 3 months before or after each anniversary date. You must contact the cognizant OCMI to schedule an inspection at a time and place which he or she approves. No written application is required. Vessel has not conducted their required annual inspection. Complete required annual inspection to the satisfaction of the attending marine inspector. 46 CFR 176.500 (b)(1)(i)

Fuses must be of the cartridge type only and be listed by Underwriters Laboratories or another independent laboratory recognized by the Commandant. Engine ECU MIDI fuse is not UL approved. Replace with approved UL fuse of the same amperage to the satisfaction of the attending marine inspector. 46 CFR 183.330

The cognizant OCMI may require that a vessel and its equipment undergo any additional test or inspection deemed reasonable and necessary to determine that the vessel and its equipment are suitable for the service in which they are to be employed. Vessel main mast compression post has been repaired along with the main transverse truss frame scarf joint and other identified structural issues. A third party rigger is required to conduct final underway tuning of the standing rigging. In addition, the third party rigger is required to provide a copy of the survey report for the above to the attending Marine Inspector. Finally, vessel must get underway with the attending Marine Inspectors to evaluate the repairs structural strength prior to carrying passengers. 46 CFR 176.840

The cognizant OCMI may require that a vessel and its equipment undergo any additional test or inspection deemed reasonable and necessary to determine that the vessel and its equipment are suitable for the service in which they are to be employed. Vessel main mast compression post experienced an event doubting its structural strength and the surrounding structures. A third party survey is required to be conducted in the presence of the attending Marine Inspector to determine that the main mast compression post and surround structures are suitable for the service in which they are to be employed. In addition, the third party survey is required to provide a copy of the survey report for the above to the attending Marine Inspector. Vessel is not permitted to carry passengers until the survey is conducted and the results known. 46 CFR 176.840

Once the vessel's main mast compression post and surround structures condition is determined, submit a repair proposal for approval to the attending Marine Inspector. Once the repair proposal is approved by the attending Marine Inspector, complete the repairs to the satisfaction of the attending Marine Inspector. 46 CFR 176.700(a)

A visual indicator must be provided at the operating station to indicate when any automatic bilge pump is operating. Starboard hull automatic bilge pump visual indicators not illuminating. Repair and prove proper operation to the satisfaction of the attending Marine Inspector by July 17, 2024. In the interim, a crew member must make visual inspection of the stbd hull spaces every half-hour. The visual inspection start and end time must be documented in the vessels official log book. 46 CFR 182.530(c)

A vessel must comply with the applicable requirements for any radio and Electronic Position Indicating Radiobeacon (EPIRB) installations, including the requirements for a station license and installation certificates to be issued by the Federal Communications Commission, as set forth in 47 CFR part 80. Vessel missing Communications Act Safety Radiotelephony Certificate. Provide required certificate to the satisfaction of the attending Marine Inspector. 46 CFR 184.502

This part is intended to provide a minimum standard of regulations for electrical installations and equipment that will result in a vessel that is reasonably safe from fire caused by and/or originating in electrical equipment, and reasonably safe from electrical shock of personnel. Several dead end cables observed. Properly terminate cable ends or remove cable in its entirety to the satisfaction of the attending Marine Inspector. 46 CFR 183..01-5

The intent of this part is to insure the main propulsion machinery that installed on each vessel is suitable for the vessel and its operation and that the auxiliary machinery is suitable for the purpose intended. It is further in­ tended that all machinery be installed and maintained in such a manner as to afford adequate protection against fire, explosion, machinery failure and personnel injury. The port and stbd exhaust hoses are wearing due to chaffing. Install chaffing gear to the satisfaction of the attending Marine Inspector. 46 CFR 182.01-5

Drug testing programs required by this part must be conducted in accordance with 49 CFR part 40, Procedures for Transportation Workplace Testing Programs. This subpart summarizes the responsibilities of credentialed mariners, marine employers, MRO, SAP and other chemical testing service providers in 49 CFR part 40. The regulations in 49 CFR part 40 should be consulted to determine the specific procedures which must be established and utilized. The three owners are DERS and in the random test selection pool. Provide documentation from the company's consortium that when one DER is selected for random testing the notification will be sent to one of the other DER(s) to ensure the test notification is truly random and unannounced to the satisfaction of the attending Marine Inspector. 46 CFR 113(a)

A leak was discovered on the port engine exhaust where the piping goes through the hull. Utilizing fast cure, water curable FM 5200 for a temporary repair to the satisfaction of marine inspector. Vessel permitted to operate its two scheduled charters on Friday and Saturday. Once the size of the repair has been determined,submit a repair proposal for approval to the attending Marine Inspector. Once the repair proposal is approved by the attending Marine Inspector, complete the repairs to the satisfaction of the attending Marine Inspector. 46 CFR 176.700(a)

Every vessel must be fitted with a suitable magnetic compass designed for marine use, compass must be illuminated or restricted to daytime operation. Provide light for the compass. Compass light was found to be in operable. Replace light. 46 CFR 184.402

Provision must be made for closing all supply duct cowls or scoops and exhaust duct discharge openings for a space protected by a fixed gas extinguishing system. All closure devices must be readily available and mounted in the vicinity of the vent. Ventilation closing was not actuated during operation of the fixed fire fighting system. Repair ventilation closing to the satisfaction of the marine inspector. 46 CFR 182.465(h)

Each ship transporting more that six passengers for hire equipped with a radiotelephone station must carry a radio operator who: holds a marine radio operator permit or higher class license. The master on board did not provide a valid radio operator permit. Provide a proof of valid radio operator permit. 46 CFR 185.604(i)

Each ring life buoy must be marked with Type II retroreflective material approved in accordance with 46 CFR 164.018. Two life ring buoys on board vessel are missing Type II retroreflective material. Life ring buoy retroreflective material is worn. Add/replace retroreflective type material on ring buoy. 46 CFR 185.604(i)

A ship, except a ship of less than 26 feet in length, must have a placard of at least 5 by 8 inches, made of durable material fixed in a conspicuous place in each machinery space, or at the bilge and ballast pump control station, stating the following: Discharge of Oil ProhibitedThe Federal Water Pollution Control Act prohibits the discharge of oil or oily waste into or upon the navigable waters of the United States, or the waters of the contiguous zone, or which may affect natural resources belonging to, appertaining to, or under the exclusive management authority of the United States, if such discharge causes a film or discoloration of the surface of the water or causes a sludge or emulsion beneath the surface of the water. Violators are subject to substantial civil penalties and/or criminal sanctions including fines and imprisonment. Vessel did not have required placard in all machinery and fuel tank spaces. Add Oil pollution placard to the starboard engine room, and both fuel tank spaces. 33 CFR 155.450(a)

Firefighting drills and training shall be logged or otherwise documented for review by the Coast Guard upon request. The drill entry shall include the following information: Date of the drill and training; and general description of the drill scenario and training topics. Vessel unable to provide logs for fire fighting drills and training. Provide log for the recording of drills and training. 46 CFR 185.524(d)

The employer shall provide an Employee Assistance Program for all crew members that includes both education and training on the effects and consequences of drug and alcohol use. Vessel's crew members have not received training. Provide satisfactory evidence of training in accordance with the Employee Assistance Program. 46 CFR 16.401

All vessels shall be provided with a satisfactory arrangement for draining any watertight compartment other then small buoyancy compartments, heat resistivity as that afforded by the hull may be approved. Installed electric submersible bilge pumps are not UL 1113 certified. Provide electric submersible bilge pumps that are UL 1113 certified. 46 CFR 182.52(e)(1)

The Designated employer representative (DER) is an employee authorized by the employer to take immediate action(s) to remove employees from safety-sensitive duties, or cause employees to be removed from these covered duties, and to make required decisions in testing and evaluation processes. The DER also receives test results and other communications for the employer, consistent with the requirements of this part. One of the vessel's captains was listed as the vessel's DER. Designate another person which is not a member of the vessel's crew as the DER or allow for third party to coordinate DER's testing. 49 CFR 40.3

A pre-engineered fixed gas fire extinguishing system must be installed in accordance with the manufacturer's instructions. Fireboy control boxes were installed inside engine space. Move control boxes outside of the engine space. 46 CFR 181.420(a)(4)

Each vessel that operates on the high seas, or that operates beyond three miles from the coastline of the Great Lakes, must have on board a FCC Type Accepted Category 1, 406 MHz EPIRB, installed to automatically float free and activate. Vessel's EPIRB was not arranged to float free. Place EPIRB in a location that will allow it to float free. Vessel's route will be limited to Lake, Bays, and Sounds until EPIRB is mounted in float free arrangement. 46 CFR 180.64

The installation of fuel lines, including pipe, tube, and hose, must comply with the requirements of this paragraph. Fuel filter and strainer bowls must be highly resistant to shattering due to mechanical impact and resistant to failure due to thermal shock. Fuel filters fitted with bowls of other than steel construction must be approved by the Commandant and be protected from mechanical damage. Approval of bowls of other than steel construction will specify if a flame shield is required. Installed RACOR fuel filter assembly is the incorrect model and is not approved for marine application by the manufacturer. Replace with the approved RACOR marine fuel filter assembly marine metal bowl to the satisfaction of the attending MI. 182.455(b)(6)

Sail rigging and components are to be maintained in accordance with good marine practice as outlined in USCG NVIC 02-16. The attending Marine Inspectors observed the port side spreaders where under light tension and lower spreader moved forward and aft with about six to ten inches of articulation, the pins on starboard side of mast walked out fully pressing cotter pins on retaining faces. Operator shall schedule a third party rigging survey, to include an aloft rigging inspection, and provide the survey report to be reviewed by the attending USCG Marine Inspector. 46 CFR 176.800 (a)

Fuses must be of the cartridge type only and be listed by Underwriters Laboratories or another independent laboratory recognized by the Commandant. Starboard side new house battery bank has an in-line blade type fuse installed. Replace with an approved cartridge type fuse to the satisfaction of the attending MI. 46 CFR 183.380(l)

As appropriate for the intended voyage, all vessels must carry adequate and up-to-date- charts; sailing direction; coast pilot; light lists; notice to mariners; tide tables. Vessel chart out of date, coast pilot, light list, notice to mariners, and tide tables not on board the vessel. Provide new chart and publication. 46 CFR 185.20-35 [old T]

A portable or temporary electric cord or cable must be constructed and used in compliance with the requirements of § 111.60-13 in subchapter J of this chapter for a flexible electric cord or cable. Portable electric cord installed on inverter in main cabin aft starboard cabinet. Remove and install permanent wiring. 46 CFR 183.340(r)

A vessel must carry either a first-aid kit approved under approval series 160.041 or a kit with equivalent contents and instructions. The vessel’s first-aid kit is lacking aspirin and eyewash. Provide aspirin and eyewash for the first-aid kit on aboard the vessel. 46 CFR 184.710

Remote fuel shutoff valves stations shall be marked in at least 1-inch letters indicating purpose of the valve and the valve direction of operation. Labeling of remote fuel shutoff valves worn. Renew labeling. 46 CFR 185.30-25 [old T]

The exhaust pipe cooling water system shall be in accordance with the following provisions: water for cooling the exhaust pipe, other than a vertical exhaust, shall be injected into the exhaust system as near to the engine manifold as practicable. The water shall pass through the entire length of the exhaust pipe. The water-jacketed hose for wet exhaust on starboard engine wasted. Renew hose. 46 CFR 182.15-15(4) [old T]

All vessel except non-self-propelled vessels shall be provided with suitable steering apparatus. Port rudder post support blocks delaminated. Repair. 46 CFR 182.30-1 [old T]

Wiring sizes for lighting and power shall be in accordance with Table 183.05-45(a). Main circuit panel jumper wire has exposed conductor. Replace jumper wire with the correct current-carrying capacity. 46 CFR 183.05-45(a) [old T]

Ignition wiring as supplied or recommended by engine manufactures is generally acceptable. Engine starting battery cable is welding cable. Remove and replace with UL marine or UL boat cable of appropriate size specified by the engine manufacturer. 46 CFR 183.05-40 [old T]

Battery chargers must have an ammeter connected in the charging circuit. House batteries charger is a new installation without an ammeter. Install ammeter. 46 CFR 183.350 (f)

Equipment and arrangements not covered by standards in this subchapter may be inspected in accordance with standards acceptable to the cognizant OCMI as good marine practice. Starboard aft crossbeam bolt backed off. Tighten bolts on aft crossbeam. 46 CFR 176.800 (a)

A marine employer whose vessel is involved in a casualty or incident that is, or is likely to become, a serious marine incident as defined in § 4.03-2 of subchapter A of this chapter shall comply with the requirements of § 4.06 in subchapter A of this chapter. Alcohol test strips expired. Replace alcohol test strips. 46 CFR 185.212

The Coast Guard will issue a medical certificate to a mariner meeting the medical and physical standards for merchant mariners. Master unable to provide medical certificate. 46 CFR 10.301(a)

Oceans, coastwise, limited coastwise, and Great Lakes routes. A vessel on an oceans, coastwise, limited coastwise, or Great Lakes route must carry - Six hand red flare distress signals approved in accordance with § 160.021 in subchapter Q of this chapter, or other standard specified by the Commandant, including, but not limited to, approval series 160.121; and six hand orange smoke distress signals approved in accordance with § 160.037 in subchapter Q of this chapter, or other standard specified by the Commandant. Vessel only had three orange smoke distress and four red hand flares. Vessel restricted to operate only in Lakes bays and sounds. 46 CFR 180.68(a)

Each vessel must be marked as required by part 67, subpart I, of this chapter. Paragraphs (c) through (g) of this section apply to each vessel that does not demonstrate compliance in accordance with § 178.310(c) of this chapter. Each vessel must - Have permanent draft marks at each end of the vessel; or Have permanent loading marks placed on each side of the vessel forward and aft to indicate the maximum allowable trim and amidships to indicate the maximum allowable draft. A loading mark required by paragraph (c)(2) of this section must be a horizontal line of at least 205 millimeters (8 inches) in length and 25 millimeters (1 inch) in height, with its upper edge passing through the point of maximum draft. The loading mark must be painted in a contrasting color to the sideshell paint. 46 CFR 185.602

The EPIRB test required by paragraph (a) shall be logged or otherwise documented, as applicable. Vessel missing logs of monthly EPIRB test. Master conducted monthly check as part of inspection and logged action. 46 CFR 185.728 (c)

A vessel must be provided with satisfactory arrangement for draining any watertight compartment. Vessel was unable to demonstrate operation of the port side center electric bilge pump. Vessel shall not operate in commercial service until the proper operation of the port side center electric bilge pump is proven to the attending USCG Marine Inspector. 46CFR182.500(a)

Each vessel that operates on the high seas, or that operates beyond three miles from the coastline of the Great Lakes, must have on board an FCC Type Accepted Category 1, 406 MHz EPIRB, installed to automatically float free and activate. The vessels hydrostatic release mechanism is expired an shall be replaced. Vessel is prohibited from in operating in commercial service until hydrostatic release mechanism is replaced. 46CFR180.64

Electrical equipment on a vessel must be installed and maintained to minimize accidental personnel contact with energized parts. Loose exposed electrical conductors found in engine behind circuit breaker panel and on starboard side of control station. Properly terminate and secure loose conductors.46CFR183.200(c)

A visual and audible alarm must be provided at the operating station to indicate a high water level in each of the following normally unmanned spaces. The vessel does not have installed high-level alarms. The vessel has visual indicators for the installed bilge pumps when operating in automatic mode, however the visual indicator for the port side center is inoperable. Install high level audible and visual alarms in spaces required by 46CFR182.430 and repair or replace the visual indicator for the port side center bilge pump. 46CFR182.530

All electrical equipment and circuits must be clearly marked and identified. Remove out of service battery charger and associated unused electrical equipment from stbd fwd compartment.

Waterlights should be serviceable and batteries replaced annually if not marked with an expiration date. Waterlight was inoperable. Provide serviceable waterlight. 46 CFR 185.726(e)

The owner shall be prepared to conduct tests and have the vessel ready for inspection of the following: On a sailing vessel all spars, standing rigging, running rigging, blocks, fittings, and sails. Operator stated they do monthly checks aloft and periodic inspections from a third party rigger, but last in depth survey was from June 2019. Operator shall develop a written PMP to include maintenance intervals and schedule a 3rd party rigging survey IAW their verbal PMP. Vessel shall provide rigging report, their updated inventory list and written PMP to the satisfaction of the attending Marine Inspector. 46 CFR 176.802 (a)(3)

A pre-engineered fixed gas fire extinguishing system must automatically shut down all power ventilation systems and all engines that draw intake air from within the protected space. The starboard engine failed to shutdown automatically during test of pre-engineered FireBoy system. 46CFR181.420(a)(3)

Each vessel must have the following: Marine charts of the area to be transited published by the National Ocean Service, U.S. Army Corps of Engineers, or a river authority that are currently corrected. Vessel did not have log of chart corrections and claimed to update charts annually. Establish method of ensuring charts are up-to-date in accordance with applicable weekly Notices to Mariners published by the National Geospatial-Intelligence Agency. 33 CFR 164.33(a)(1)(ii)

Vessels operated solely within 20 nautical miles of land must be equipped with a VHF-DSC radiotelephone installation meeting the requirements of § 80.1101(c)(2). VHF radio missing LAT/LONG for DSC operation. 47 CFR 80.905(2)

Except for engine exhausts, each inlet or discharge pipe that penetrates the hull below a line drawn parallel to and at least 150 millimeters (6 inches) above the deepest load waterline must have means to prevent water from entering the vessel if the pipe fractures or otherwise fails. The vessel previously had a service generator in the port forward compartment. The generator has been removed and there is now piping in the port forward compartment that was previously supplying sea water to the generator that is now a down flooding point. Remove piping. 46CFR179.350(c)

Connections must be made to battery terminals with permanent type connectors. Both batteries utilized to start the main engines have temporary wingnuts connecting the leads to the battery terminals. Permanent connections shall be installed. 46CFR183.350(d)

A vessel of at least 7.9 meters (26 feet) in length must be provided with individual bilge lines and bilge suctions for each watertight compartment. The forward compartment on the starboard side does not have an installed bilge pump as required. Install bilge pump. 46CFR182.510(a)

Each disposable hydrostatic release unit must be marked with an expiration date of two years after the date on which the unit is installed; EPIRB hydrostatic release was expired. Replace hydrostatic release. 46 CFR 185.740 (b)

The height of top rails required by paragraph (a) of this section must be as follows: (1) Rails on passenger decks of a ferry or a vessel engaged in excursion trips, including but not limited to sightseeing trips, dinner and party cruises, and overnight cruises, must be at least 1,000 millimeters (39.5 inches) high; Aft railing was less than 39.5 inches high. Increase height of aft rail. 46 CFR 177.900 (d)(1).

Each life jacket must be marked with Type I retroreflective material approved in 46 CFR 164.018 or other standard specified by the Commandant. The arrangement of the retroreflective material applied after March 11, 1996, must be as specified by IMO Resolution A.658(16) (incorporated by reference; see 46 CFR 175.600); The lifejackets onboard the vessel did not have retro reflective material iaw IMO resolution A.658(16). Add more retro reflective material to lifejackets.

A vessel must carry one floating waterlight, unless it is limited to daytime operation, in which case no floating waterlight is required 46 CFR 180.70; Vessel's ring lifebuoy waterlight battery was expired. Replace batery.

Machinery and fuel tank spaces must be separated from accommodation spaces by boundaries that prevent the passage of vapors; vessel port engine box was not airtight. Make compartmetn airtight. 177.405 (c)

Vessels constructed of wood must, in addition to paragraph (a), provide bilge level alarms in all watertight compartments except small buoyancy chambers; bilge level alarm was missing in starboard fwd compartment. Add bilge level alarm in that compartment. 46 CFR 182.530

A review of the PMP and conversations with crew members indicated that inexperienced crew members have been conducting monthly PMP rigging inspections aloft. Essential standing rigging components concealed by the furling drum were never visually inspected by owner/operator, contradicting the PMP. Provide a third party rigging survey to include a rigging survey aloft prior to using auxiliary sails with passengers onboard.

Modifications were made to the standing rigging and sail area without notifying the [name withheld]/Starboard lower shrouds, backstays, and intermediate shrouds all found to be smaller wire diameter than listed on the MSC approved sail plan. Operator reduced sail area without notifying [name withheld] plans and calculations for approval of the modified rigging system or comply with the MSC 2002 approved sail plan or submit stability calculations to operate without aux sails rigging. Operator elected to operate without aux sails until MSC approval. Aux sails not permitted while carrying passengers.

EPIRB battery is expired. Replace EPIRB battery. 46 CFR 180.64

Provide an up to date navigational chart for operating area with a scale of appropriate size so chart can be used for navigation. 46 CFR 184.420

Provide copy of preventative maintenance rigging plan IAW NVIC 02-16.
