The lights prescribed in these Rules shall have an intensity... so as to be visible at the following minimum ranges: In a vessel of 12 meters or more in length but not less 50 meters in length: a sternlight, 2 miles. The vessel's sternlight was inoperable. - 33 CFR 83.22(b)(ii)

A vessel on a lakes, bays, and sounds or rivers route must carry: three hand red flare distress signals, and three hand orange smoke distress signals. One of the following may be substituted for any of the hand orange smoke distress signals: a rocket parachute flare, a hand red flare distress signal, a floating orange smoke distress signal. Three of the vessel's distress signals are expired. 46 CFR 180.68(b)

As appropriate for the intended voyage, a vessel must carry adequate and up-to-date: Charts of large enough scale to make safe navigation possible. Vessel's crew was not able to verify up-to-date electronic charts. 46 CFR 184.420(a)(1)

Vessels operated solely within 20 nautical miles of land must be equipped with a VHF-DSC radiotelephone installation. Vessel operator could not verify that the DSC will be fully functional without a latitude and longitude DSC transmission. 47 CFR 80.905(a)(1)

Each ship transporting more than six passengers for hire equipped with a radiotelephone station in accordance with Part III of Title III of the Communications Act must carry a radio operator who meets the following requirements: Where the station power does not exceed 250 watts carrier power or 1500 watts peak envelope power, the radio operator must hold a marine radio operator permit or higher class license. Vessel's Master does not hold a valid marine operator permit. 47 CFR 80.159(e)

Radio transmitting and receiving installations or radiotelephones are required on certain vessels carrying passengers. Details...set forth in the regulations of the Federal Communications Commission (47 CFR Chapter 1). "...stations in the maritime service must be licensed by the FCC.." and "...will normally be issued for a term of ten years.." Vessel FCC station license and radiotelephony certificate where both expired. Provide documentation that both certificates have been updated to the satisfaction of U.S. Coast Guard.

Your vessel must undergo an annual inspection within 3 months before or after each anniversary date. The vessel has not requested an inspection more than 3 months after the anniversary date. Contact the local OCMI to schedule and complete the required inspection prior to the carriage of passengers. - 46 CFR 176.500(b)(1)

176.502: To maintain a valid Certificate of Inspection, you must complete your annual inspection within the periods specified in 176.500(b)(1) and your Certificate of Inspection must be endorsed. The current Certificate of Inspection is invalid due to the vessel not completing the required annual inspection. The vessel must complete an annual inspection prior to carrying passengers. Vessel must submit temporary repair proposal for approval to moving the vessel to a shipyard for repairs.

Subsequent inspections for certification. (a) An inspection for renewal of a Certificate of Inspection is conducted to determine if the vessel is in satisfactory condition, fit for the service intended, and complies with all applicable regulations. It normally includes inspection and testing of the structure, machinery, and equipment. The owner or operator must conduct all tests as required by the OCMI, and make the vessel available for all specific inspections and drills required by subpart H of this part. In addition, the OCMI may require the vessel to get underway. During exam it was found, (in the fuel tank room aft bilge pocket, center line, starboard side of bilge pocket), that the vessel has a seepage hole that has a constant flow of seawater entering the vessel. Prior to the carriage of passengers vessel must enter dry dock for an ISE and Dry dock Inspection to discover the extent of the damage and submit a repair proposal to the Coast Guard for approval prior to the commencement of any work.

(a) An inspection for renewal of a Certificate of Inspection is conducted to determine if the vessel is in satisfactory condition, fit for the service intended, and complies with all applicable regulations. It normally includes inspection and testing of the structure, machinery, and equipment. The owner or operator must conduct all tests as required by the OCMI, and make the vessel available for all specific inspections and drills required by subpart H of this part. In addition, the OCMI may require the vessel to get underway. During exam it was found, on the port aft section of vessel hull, that there is extensive damage to the skin of the vessel just above the water line to include structural failure due to extensive damage to the aft port corner of the vessel super structure. Prior to the carriage of passengers vessel must enter dry dock for an ISE and Dry dock Inspection to discover the extent of the damage and submit a repair proposal to the Coast Guard for approval prior to the commencement of any work.

Fill pipes and sounding pipes must be so arranged that overflow of liquid or vapor cannot escape to the inside of the vessel. During inspection it was discovered the vessel's fuel fill line was leaking into the fuel tank room, port side of tank, filling voids and bilge with fuel. Prior to the carriage of passengers vessel must enter dry dock for an ISE and Dry dock Inspection to discover the extent of the damage and submit a repair proposal to the Coast Guard for approval prior to the commencement of any work.

Electrical equipment and installations must be suitable for the roll, pitch, and vibration of the vessel underway. All equipment, including switches, fuses, lamp-holders, etc., must be suitable for the voltage and current utilized. Receptacle outlets of the type providing a grounded pole or a specific direct current polarity must be of a configuration that will not permit improper connection. All electrical equipment and circuits must be clearly marked and identified. Any cabinet, panel, box, or other enclosure containing more than one source of power must be fitted with a sign warning persons of this condition and identifying the circuits to be disconnected. During inspection it was found various equipment on upper deck was not marine grade equipment (i.e. power strips, bubble machine, fog machine, ect. as well as junction boxes on upper level that were not properly sealed with bare wires extruding from the enclosures. Also to include improper lighting fixture that was either melted or burnt from improper usage on the starboard side of the fuel tank.) Prior to the carriage of passengers vessel must enter dry dock for an ISE and Dry dock and COI Renewal Inspection's to discover the extent of the damage and submit a repair proposal to the Coast Guard for approval prior to the commencement of any work.

A SUBMERSIBLE ELECTRIC BILGE PUMP DISCHARGE LINE IS REQUIRED A POSITIVE SHUTOFF VALVE AT THE HULL PENETRATION. VESSEL FOR PEAK ELECTRIC BILGE PUMP DOES NOT HAVE A POSITIVE SHUTOFF VALVE INSTALLED.

PROPOSED REPAIRS OR ALTERATIONS SHALL BE APPROVED BY THE COGNIZANT OFFICER IN CHARGE MARINE INSPCTIONS. 1. VESSEL MADE FIBERGLASS REPAIRS TO THEIR PORT QUARTER HULL JUST ABOVE THE WATERLINE. VESSEL REPRESENTATIVE IS TO SUBMIT A PROPOSAL FOR REPAIRS ALREADY COMPLETED TO INCLUDE LAYUP SCHEDULE, RESIGN, SDS FOR RESGN, AND REPAIR PLAN. 2. VESSEL ALTERED THE HULL BY CUTTING OUT ACCESS HOLES AND INSTALLING ACCESS PLATES IN ORDER TO INSTALL SUPPORT PLATES UNDER THE DECK RAILING POSTS. VESSEL REPRESENTATIVE WAS INSTRUCTED TO PROVIDE A REPAIR PROPOSAL TO INCLUDE THE SIZE OF HOLE BEING CUT, LOCATION, AND MEANS OF SEALING THE HOLES ONCE FINISHED.

A PENETRATION IN A WATERTIGHT BULKHEAD MUST BE MADE WATERTIGHT. VESSEL HAS A THROUGH HULL FITTING MADE OF PVC THAT ALLOWS WATER TO DRAIN FROM THEIR MAIN DECK PORT SIDE STORAGE LOCKER OVERBOARD WHICH IS NOT WATERTIGHT. VESSEL REPRESENTATIVE INSTRUCTED TO PROVIDE A REPAIR PROPOSAL TO INSTALL A PROPER PENETRATION FOR THE DRAIN LINE.

PROPOSED REPAIRS OR ALTERATIONS SHALL BE APPROVED BY THE COGNIZANT OFFICER IN CHARGE MARINE INSPCTIONS. 1. PORT QUARTER HULL UNDER THE EXHAUST OUTLET HAS DAMAGED FIBERGLASS. VESSEL REPRESENTATIVE WILL PROVIDE A REPAIR PROPOSAL AND LAYUP SCHDULE PRIOR TO ENACTING REPAIRS. 2. PORT QUARTER HULL AT THE END OF THE EXHAUST OUTLET HAS DAMAGED FIBERGLASS. VESSEL REPRESENTATIVE WILL PROVIDE A REPAIR PROPOSAL AND LAYUP SCHEDULE PRIOR TO ENACTING REPAIRS.

DURING THE EXAMINATION ALL ACCESSIBLE PARTS OF THE VESSEL'S UNDERWATER BODY SHALL BE MADE AVAILABLE FOR EXAMINATION. 1. PORT HULL PLATING BELOW THE WATERLINE HAS MULTIPLE SOFT SPOTS THAT REQUIRE PAINT REMOVAL TO INSPECT FOR FIBERGLASS DAMAGE. AREAS MARKED IN ORANGE CRAYON. 2. STARBOARD HULL PLATING BELOW THE WATERLINE HAS MULTIPLE SOFT SPOTS THAT REQUIRE PAINT REMOVAL TO INSPECT FOR FIBERGLASS DAMAGE. AREAS MARKED IN ORANGE CRAYON. 3. PORT SIDE KEEL PLATING HAS FIBERGLASS PROTECTING MATERIAL MISSING. FIBERGLASS PROTECTIVE MATERIAL NEEDS TO BE REPLACED PRIOR TO BOTTOM PAINT BEING APPLIED. 4. STARBOARD SIDE KEEL PLATING HAS FIBERGLASS PROTECTING MATERIAL MISSING. FIBERGLASS PROTECTIVE MATERIAL NEEDS TO BE REPLACED PRIOR TO BOTTOM PAINT BEING APPLIED.

02199 - A vessel exposed to salt water more than three months in a twelve month period must undergo a drydock examination and internal structural examination at least once every two years. Vessel's last drydock examination was more than two years ago on 27 April 2016. 46 CFR 176.600(c)(1)

13104 - All vessels shall be provided with bilge pumps in accordance with table 182.25-10(a). Vessels installed bilge pump does not gain suction and or prime. 46 CFR 182.25-10(a)

13104 - Visual and audible alarm must be provided at the operating station to indicate high water level in the bilges. Alarm for the forepeak and engine room was not operable. 46 CFR 182.530

02101 - Each watertight door, an indicator must be installed in the pilothouse and at each other vessel operating station from which the door is not visible. The indicator must show whether the door is open or closed. Vessel’s watertight door located in the engine room indicator is inoperable. 46 CFR 170.270(e)

11118 - Life jackets must be marked with Type I retroreflective material approved in 46 CFR 164.018. Life jackets are marked with Type II retroreflective material. 46 CFR 185.604(h)

09233 - Suitable covers, guards or rails shall be installed in way of all exposed hazards. Anchor windlass is accessible to passengers on passenger deck. 46 CFR 177.35-15

07199 - Fuel shutoff valves shall be marked in at least 1-inch letters indicating the direction of operation. Fuel shutoff valves were not marked with the direction of operation. 46 CFR 185.30-20

02199 - The hailing port of the vessel must be marked on some clearly visible exterior part of the stern of the vessel. Hailing port is not marked. 46 CFR 185.30-1 46 CFR 67.123(a)

02116 - Openings in watertight bulkheads must have means to make them watertight. Vessel has two holes in the watertight bulkhead between the engine room and tank room. 46 CFR 177.13-1 46 CFR 171.114

02118 - Railings and bulwarks and their attachment to the hull structure shall be inspected. Discovered crack in FRP at the rail connection to the hull. 46 CFR 176.802(a)(4)

14402 - MSD must be marked with manufacture, name and model number, manufacture date, serial number, whether the device is certified for an inspected vessel, and Type. During internal structural examination (ISE), marine inspector noticed an overboard valve without a handle that does not indicate valve position and noticed a leak at the section where valve connects to & penetrates the hull. Upon further examination, marine inspector could not find identification for the type of MSD installed. 46 CFR 184.704 33 CFR 159.55

13199 - Exhaust piping shall be gas-tight throughout it's length. During internal structural examination (ISE), marine inspector noticed signs of possible leaks on PORT & STBD mufflers and AFT exhaust piping. Vessel representative shall get vessel underway to determine if signs of possible leaks are active and in need of repair. 46 CFR 182.20-20 46 CFR 182.15-20

Remove or repair dead end wires in machinery space & steering space. 46CFR183.200

Replace hose for main fire pump due to multiple pinholes in hose. 46CFR181.320

Permanently attach the hatch cover to the steering compartment with a line or chain.

Repair or replace the fire/bilge pump located on the stbd MDE.

Replace double hose clamps missing on both main diesel engines.

Install belt cover on starboard main diesel engine.

Replace all cable receptacles with watertight covers.

Add sign for the "Remote Emergency Fuel Shutoff Valve".

Make permanent repairs to the 3" gash in the Starboard Quarter, 2 feet above the waterline.

Replace the light covers in the forward stateromm and on the 2nd deck.

Renew the dry rotted fuel lines on the port and starboard MDE's prior to carrying passengers.

Add a gauge to the main fire pump.

Relocate Electrical breaker box in the STBD closet. LEGACY COMPONENT DESC: Distribution Panel Bus

Relocate A/C compressor unit in the STBD closet.

Replace raw water intake hose for the STBD and port engine. LEGACY COMPONENT DESC: Hose

PROVE PROPER OPERATION OF THE GENERATOR FREQUENCY METER LOCATED IN PILOT HOUSE.

PROVIDE CREW LADDER TO TOP OF PILOT HOUSE ALLOW EMERGENCY LAUNCHING OF VSLSLIFEFLOATS.

PROVIDE VALID COMPASS DEVIATION CARD.

ON ARRIVAL AND PRIOR TO CARRING ANY PASSENGERS, CONTACT MSO HOUSTON FOR INSPECTION AFTER ARRIVAL AT HOMEPORT.

PROVE OPERATION OF BOTH MAIN ENGINE OVERSPEED CONTROL DEVICES IAW ABS RULE 34.11.6, FOR MAIN ENGINES OF 300HP OR GREATER.

COMPLETE INSTALLATION AND PROVE PROPER OPERATION OF A/C SYSTEMS.
