"You must keep records of negative and canceled drug test results and alcohol test results with a concentration of less than 0.02 for one year." Records were unavailable for Coast Guard inspection. 46 CFR 16.113 (a) 49 CFR 40.333 (a)(d)

"For a vessel described by 46 CFR 175.110(c), the training program in paragraph (a) of this section must address firefighting proficiency and must include, but need not be limited to emergency egress training for each member of the crew, to occur for all members of the crew at least monthly while such members are employed on board the vessels; and each time a crew member joins the crew of such vessel." Vessel did not have records of emergency egress training. 46 CFR 185.420(b)(3)

"The drill entry shall include the following information: date of the drill and training; and general description of the drill scenario and training topics." Vessel drill/training logs did not provide a general description of the scenario or training topics. 46 CFR 185.420 (d)(2)& 46 CFR 185.520 (f)(2)& 46 CFR 185.524 (d)(2)

"As appropriate for the intended voyage, a vessel must carry adequate and up-to-date:(2)U.S. Coast Pilot or similar publication;(3)Coast Guard Light List. Extracts from the publications listed above for the areas to be transited may be provided instead of the complete publication." Coast Pilot and Light list on board were not up-to-date. 46 CFR 184.420

A hatch exposed to the weather must be watertight. Marine Inspector observed fish hold hatch with missing gasket. Vessel to install gasket to satisfaction of Marine Inspector. 46 CFR 179.360(a)

The marine employer must have a sufficient number of alcohol testing devices readily accessible on board the vessel to determine the presence of alcohol in the system of each individual who was directly involved in the SMI. Vessel had expired alcohol testing strips. Vessel to acquire unexpired alcohol testing strips to satisfaction of Marine Inspector. 46 CFR 4.06-15(a)(1)

Repairs or alterations to the hull, machinery, or equipment that affect the safety of the vessel must not be made without the approval of the cognizant OCMI. Vessel operator reported ruptured port fuel tank. Vessel to submit plans for repair or replacement of fuel tank, as well as plans to repair portion of deck that must be cut out to access fuel tank. Plans must be approved, and all work inspected to the satisfaction of the attending Marine Inspector. 46 CFR 176.700 (a)

Each officer employed on any vessel subject to this subchapter must have his or her license or merchant mariner credential onboard and available for examination at all times when the vessel is operating. A person may not employ or engage an individual in a position required to hold an MMC unless that individual maintains a current medical certificate. Vessel owner and vessel master both had expired medical certificates. Vessel to provide documentation of valid/unexpired medical certificate for at least one person able to operate as vessel master, to the satisfaction of the Marine Inspector, prior to the carriage of passengers. 46 CFR 185.402 46 CFR 15.401 (c)

No marine employer shall engage or employ any individual to serve as a crewmember unless the individual passes a chemical test for dangerous drugs for that employer. An employer may waive a pre-employment test required for a job applicant if the individual provides satisfactory evidence that he or she has passed a chemical test for dangerous drugs, required by this part, within the previous six months with no subsequent positive drug tests during the remainder of the six-month period. Vessel owner inquired about a third potential operator, not currently employed on vessel, but holding valid a MMC and unexpired Medical Certificate, but could not provide documentation of negative pre-employment drug testing. Vessel to provide documentation of negative pre-employment drug testing, to the satisfaction of the Marine Inspector, prior to the carriage of passengers. 46 CFR 16.210

At each initial and subsequent inspection for certification, the owner or managing operator must be prepared to conduct tests and have the vessel ready for inspection of its fire protection equipment, including the following: Inspection of fixed gas fire extinguishing system. During operational test of engine room pre-engineered fire fighting system, starboard engine was not able to restart after activating override function. Vessel to repair, and conduct satisfactory test of system, to the satisfaction of the Marine Inspector. 46 CFR 176.810

Vapor barriers must be provided where insulation of any type is used in spaces where flammable and combustible liquids or vapors are present, such as machinery spaces and paint lockers. Vessel to seal bulkhead penetrations between engine room and battery space, to the satisfaction of the Marine Inspector. 46 CFR 177.405 (e)

In systems and applications where flexible hoses are permitted to be clamped: (1) Double hose clamping is required where practicable; (2) The clamps must be of a corrosion resistant metallic material. Vessel to clamp both ends of steering system hydraulic hose, to the satisfaction of the Marine Inspector. 46 CFR 182.410 (d)

A vessel must comply with the applicable requirements for any radio and Electronic Position Indicating Radiobeacon (EPIRB) installations, including the requirements for a station license and installation certificates to be issued by the Federal Communications Commission, as set forth in 47 CFR part 80. Every vessel subject to Part III of Title III of the Communications Act must have a detailed inspection of the radio installation by an FCC-licensed technician in accordance with § 80.59 once every five years. The FCC-licensed technician must use the latest FCC Information Bulletin, How to Conduct an Inspection of a Small Passenger Vessel. If the ship passes the inspection, the technician will issue a Communications Act Safety Radiotelephony Certificate. Communications Act Radiotelephony Certificates may be obtained from the Commission's National Call Center—(888) 225–5322—or from its forms contractor. Vessel has expired Communications Act Safety Radiotelephony Certificate. Vessel to acquire new Communications Act Safety Radiotelephony Certificate to the satisfaction of the marine inspector. 46 CFR 184.502 47 CFR 80.1061(f)

A vessel must carry either a first-aid kit that meets the requirements in 46 CFR 199.175(b)(10) or a kit with equivalent contents and instructions. For equivalent kits, the contents must be stowed in a suitable, watertight container that is marked “First-Aid Kit”. A first-aid kit must be easily visible and readily available to the crew. Vessel to replace expired aspirin in first aid kit. 46 CFR 184.710

An interconnected detection and alarm system must be installed such that the actuation of alarm in one area results in both audible and visual alarms in all areas required by 46 CFR 181.405(c) to be protected by the interconnected detection and alarm system. Interconnected fire alarm system was not operating correctly. Operator corrected during inspection. 46 CFR 181.450 (a)(2)

Each life float must be fitted with a lifeline, pendants, two paddles, a painter, and a light. Light on life float was not operating correctly. Operator corrected during inspection. 46 CFR 180.175 (d)

At each initial and subsequent inspection for certification of a vessel, the owner or managing operator shall be prepared to conduct tests and have the vessel ready for inspections of the hull structure and its appurtenances, including the following: Inspection of all interior spaces to ensure that they are adequately ventilated and drained, and that means of escape are adequate and properly maintained. While conducting underway portion of exam, discovered excessive water in lazarette. Operator to drain water, identify source of leak, and repiar to the satisfaction of the attending Marine Inspector. 46 CFR 176.802 (a)(7)

Vessel sustained damage to port side hull at the water line during earlier event. Operator to submit plans for repair, to include drawings, sketches, or written specifications describing the details of the proposed repair. Proposed repair must be approved by the OCMI, and inspected to the satisfaction of the attending Marine Inspector prior to movement of the vessel. 46 CFR 176.700 (a)

Whenever damage or deterioration to hull plating or structural members that may affect the seaworthiness of a vessel is discovered or suspected, the cognizant OCMI may conduct an internal structural examination in any affected space including fuel tanks, and may require the vessel to be drydocked or taken out of service to assess the extent of the damage, and to effect permanent repairs. Vessel sustained damage to port side hull at the water line during earlier event. Operator to haul out vessel prior to commencing any work. Operator is to remove all damaged unsafe wood until good wood is found, and to determine full extent of damage. Operator to submit plans for repair, to include wood moisture readings, drawings, sketches, or written specifications describing the details of the proposed repair. Proposed repair must be approved by the OCMI, and inspected at intervals to the satisfaction of the attending Marine Inspector. 46 CFR 176.600(d)

Each survival craft must be: Stowed so that when the vessel sinks the survival craft floats free and, if inflatable, inflates automatically. The painter line for the 3 life floats was not routed correctly to allow the life floats to float free in the event the vessel sinks.

Each vessel must carry one floating waterlight unless the vessel is limited to daytime operations. The floating waterlight attached to the starboard side ring buoy, was inoperable. Repair or renew waterlight.

Vessels operated beyond the 20 nautical mile limitation specified in paragraph, but not more than 100 nautical miles from the nearest land, must be equipped with a MF-DSC frequency transmitter meeting the requirements of §80.1101(c)(3) and capable of transmitting J3E emission and a receiver capable of reception of J3E emission within the band 1710 to 2850 kHz, in addition to the VHF-DSC radiotelephone installation required by paragraph (a)(1) of this section. The DSC function was not operable on the vessels VHF, and MF radios. Provide vessel with 01 VHF radio installation with functioning DSC, and 01 MF radio installation with functioning DSC.

The construction and arrangements of a vessel must allow the safe operation of the vessel in accordance with the terms of its certificate of inspection giving consideration to provisions for a seaworthy hull. The FRP covering the cold molded plywood on the vessels hull, had five areas where it had cracked and allowed water to soak the plywood. All areas shall be repaired to the satisfaction of the attending Coast Guard Marine Inspector.
