The M/V T BIRD is restricted from carrying passengers for hire due to not having the required interconnected detection in accordance with 46CFR185.410. The vessels installed detection system was not interconnected. 46 CFR 181.405 Revised the 835 to prior to movement as the vessel is for sale and is no longer interested in coming into compliance with the current owner/operator.

Wastage discovered in 2 locations in lazarette. #1 forward port corner, 3 planks inboard of chine. (hole 1.5 ” deep, 2” diameter) structural integrity of plank and fasteners in area are in question. #2 port side shell planking, 3 pockets aft of forward bulkhead 2 planks above butt block (hole 1” deep surrounding wastage). Submit repair proposal for two wasted planks. 46 CFR 176.600. Revised the 835 to prior to movement as the vessel is for sale and is no longer interested in coming into compliance with the current owner/operator.

The frames on the port and starboard side of the vessel in the sewage tank space directly below the forward side of the sewage tanks showed decay along the frames to the point of soft wood allowing the awl to penetrate between the frame and the planks. Additionally the butt block on the port side was decayed adjacent to the frame on the port side. Submit repair proposal to make water tight. 46 CFR 176.600. Revised the 835 to prior to movement as the vessel is for sale and is no longer interested in coming into compliance with the current owner/operator.

Vessels shall be provided with suitable steering apparatus. Repair steering tie rod to steering arm connection. Witnessed extreme play during normal operation. Revised the 835 to prior to movement as the vessel is for sale and is no longer interested in coming into compliance with the current owner/operator.

Electrical equipment and circuits which are of any vital system to safety shall be applicable to subchapter J. Engine room lighting, emergency bilge pump and navigational equipment needs to be hard wired. (OLD) 46 CFR 183.01-10 Revised the 835 to prior to movement as the vessel is for sale and is no longer interested in coming into compliance with the current owner/operator.

Each life float must be fitted with a lifeline, pendants, two paddles, a painter, and a light. The painter line is no longer serviceable and requires replacement.46 CFR 180.175(d) Revised the 835 to prior to movement as the vessel is for sale and is no longer interested in coming into compliance with the current owner/operator.

Each ring life buoy must be approved in accordance with 160.050. Vessels forward ring buoy and grab line is no longer serviceable due to deterioration and requires replacement. 46 CFR 180.70(b) Revised the 835 to prior to movement as the vessel is for sale and is no longer interested in coming into compliance with the current owner/operator.

Master shall conduct sufficient drills to make sure all crew members are familiar with their duties. Abandon ship drills and man overboard drills haven’t been logged since September 2023. Master on vessel hasn’t conducted a drill with vessel. 46 CFR 185.520(a) Revised the 835 to prior to movement as the vessel is for sale and is no longer interested in coming into compliance with the current owner/operator.

Each vessel must have one floating water light with a corrosion resistant clip installed. Corrosion resistant clip has corrosion rendering it inoperable and requires replacement with correct clip. 46 CFR 180.70(b) Revised the 835 to prior to movement as the vessel is for sale and is no longer interested in coming into compliance with the current owner/operator.

The M/V T BIRD is restricted from carrying passengers for hire until it is proven the required interconnected detection is properly installed in the engine room. Shutoff valves installed so as to close against fuel flow. There is currently no way of knowing if ball valves are open or close. Re-install limiting brackets and label or install indicator. 46 CFR 182.455 (d) Revised the 835 to prior to movement as the vessel is for sale and is no longer interested in coming into compliance with the current owner/operator.

Connection to the sewage tank on the starboard side was disconnected, allowing the sewage tank to be open. Re install the piping to the sewage tank. 46 CFR 176.818 Revised the 835 to prior to movement as the vessel is for sale and is no longer interested in coming into compliance with the current owner/operator.

Through hull fittings and shutoff valves must be metallic. In the case of nonmetallic hulls, materials that will afford an equal degree of safety and heat resistivity as that afforded by the hull may be approved Shut off valves were not metallic and flanged fitting was not mechanically fastened to the hull. 46 CFR 182.720 Revised the 835 to prior to movement as the vessel is for sale and is no longer interested in coming into compliance with the current owner/operator.

Deck in the #2 void space is wasted and not watertight. Remove wasted deck material and replace, Submit repair proposal.46 CFR 176.600 Revised the 835 to prior to movement or passengers / cargo as applicable as the vessel is for sale and is no longer interested in coming into compliance with the current owner/operator.

A person may not employ or engage an individual in a position that requires an MMC unless they maintain a current medical certificate. Master did not have a medical certificate. 46 CFR 15.401(c) Revised the 835 to prior to movement or passengers / cargo as applicable as the vessel is for sale and is no longer interested in coming into compliance with the current owner/operator.

Each ship transporting more then 6 passengers for hire equipped with radiotelephone station, the radio operator must hold a marine operator permit. Vessel master did not have a valid MROP.46CFR176.830 Revised the 835 to prior to movement or passengers / cargo as applicable as the vessel is for sale and is no longer interested in coming into compliance with the current owner/operator.

The employer shall provide an Employee Assistance Program (EAP) for all crew members. Vessel did not have any education program elements on board the vessel. Revised the 835 to prior to movement or passengers / cargo as applicable as the vessel is for sale and is no longer interested in coming into compliance with the current owner/operator.

Vessel was found with exposed wires in the wheelhouse in three areas. Electrical dead-ended cables not properly terminated.46 CFR 183.340 Revised the 835 to prior to movement or passengers / cargo as applicable as the vessel is for sale and is no longer interested in coming into compliance with the current owner/operator.

Vessels galley exhaust was found with a layer of grease. To remain exempt from the requirement to have a grease extraction hood and fire suppression system, the vessel must clean the exhaust system monthly and maintain a log of that cleaning and follow all guidance in PFM 1-99 46 CFR 181.425

Vessel must carry adequate and up-to-date nautical charts. Vessel uses electronic charts and paper charts. Neither have most recent updates documented.46 CFR 184.420(a)

Portable fire extinguishers must be tested in accordance with NFPA chapter 4 (monthly). Portable fire extinguishers haven’t been inspected monthly since 2023.46 CFR 176.810 (b)(1) Revised the 835 to prior to movement as the vessel is for sale and is no longer interested in coming into compliance with the current owner/operator.

Each vessel that operated on the high seas must have an 406 MHz EPIRB on board. EPIRB on board requires registration.46 CFR 180.64 Revised the 835 to prior to movement as the vessel is for sale and is no longer interested in coming into compliance with the current owner/operator.

Each EPIRB must be tested monthly. EPIRB has no been tested monthly since 2023.46 CFR 185.728(a)

A vessel must carry either a first-aid kit approved under approval series 160.041 or a kit with equivalent con[1]tents. First aid kit was missing multiple items required under 160.041.46 CFR 184.710

Removed 12 Kapok life jackets from service. Passenger count is restricted to 39 adults and 8 children.46 CFR 180.71

Placards containing instruction for the donning and use of the life jackets aboard the vessel must be posted in conspicuous places. Vessel needs to produce donning instructions for all 3 styles of life jackets on board and post them. Vessel currently has one set of donning instructions posted.46 CFR 185.516(a)

Vessel must undergo an annual inspection within 3 months before or after each anniversary date. Vessel is out of compliance with annual inspection date.

Provide vessel with 03 fire buckets. Each bucket should be 2.5 gallons and labeled with the words "FIRE BUCKET"

Provide life ring buoy with water light. Lanyard attached to light shall be between 3 and 6 feet in length and have a corrosion resistant clip to attach and remove from the ring buoy.

Provide vessel with fully stocked first aid kit approved under 46 CFR 160.041

Provide vessel with valid FCC station license. 47 CFR 80

Remove excess fuel from raycor fuel strainer bowls.

Remove electrical hazard of RV style receptacle on forward bulkhead of bunk room.

Replace fire extinguisher discharge nozzle on port side fire extinguisher / foward bunk room.

Provide bunk room bilge valve with handle.

Provide all vital system hoses in engine room with double hose clamps.

Vessel is overdue for its COI renewal Inspection. Make the vessel available for COI renewal Inspection by USCG marine inspectors.

The pre-engineered fixed system (Kidde Fireboy) in the engine room must be capable of manual actuation from outside the space. The pull cable was rigged with the tip of the s-hook aligned with the hole in the manual actuator lever such that the s hook could slip out of the manual actuator lever without breaking the activation ampule if the manual pull cable were pulled. 46 CFR 181.420(a)(2)

Machinery shall be maintained so as to afford protection against fire. The air filters on the Ships Service Diesel Generator and 1 of the 2 propulsion diesel engines were soaked with oil. 46 CFR 182.10-5

The temporary repair to the hull in the forward section of the berthing space in the vicinity of the sonar mount and keel must be permanently repaired at next dry dock. The permanent repair must include an inspection of fasteners in the vicinity of the leaking seam. Until permanent repairs are affected, the crew must conduct and log hourly rounds documenting the condition of the bilge. Additionally, a statement signed by a licensed master must be emailed to [email withheld] once every 2 weeks attesting to the condition of the bilge (first statement due July 5th, 2022). The statement must contain an estimated rate of water ingress as well as an estimate of how often the bilge pump is running. If the bilge pump operates more than once an hour, an immediate notification to Sector San Diego must be made. 46 CFR 177.01-5(a)

The construction and arrangement of a vessel must allow the safe operation of the vessel in accordance with the terms of the certificate of Inspection giving consideration to the provisions for a seaworthy hull and protection against fire. Marine Inspector observed automatic bilge pump energizing/ dewatering the forward accommodation space bilge (transducer space) repeatedly approximately every 2 minutes. Evidence of water ingress at approx.. 5-10 gallons every 2 minutes. Owner operator to contract a diver and/or marine surveyor to assist in identifying source of water ingress and communicate findings. Owner must provide repair proposal to the cognizant OCMI for evaluation prior to affecting repair.

At each inspection for certification and at every other vessel inspection all observed unsafe practices, fire hazards, and other hazardous situations must be corrected. Marine Inspector observed excessive oil leaks/accumulation on generator set in way of the generator cooling fan vent. Excessive oil accumulation also noted on port MDE alternator. Identify source of leaks - repair and remove excessive oil accumulation throughout engine space and rotating machinery components.

Prove proper operation of bunkroom escape hatches.

Repair/treat rot on frame forward of port shaft seal.

Operator must make repairs listed above and conduct satisfactory sea trial prior to credit drydock.

Discovered half an inch crack at the elbow of the exhaust manifold from the starboard main engine. Must submit proposal to Sector SD OCMI and effect temporary repair until vessel is hauled out for dry-dock, then make permanent repair.

Discovered water ingress coming through vessel hull in between sonar mount and keel in forward section of berthing space. Must make temporary repair until next dry dock to the satisfaction of the CG Marine Inspector prior to carrying passengers.

The master conduct an inspection of space below deck accommodations prior to getting underway with passengers and shall ensure that hourly rounds are conducted while underway. Crew members shall ensure no further water ingress occurs in way of sonar mount/keel. All rounds shall be logged in vessel's log book. Any evidence of water ingress shall be reported to Sector San Diego immediately and vessel shall return to closest safe berthing.

Unauthorized use of extension cords. Must properly install electrical wiring in accommodation spaces.

Must properly provide adequate protection to all exposed wiring in accommodation spaces.

Provide painters of appropriate length to launch life floats.

Must install gasket on forward void space hatch to maintain watertight integrity.

Repair port side gray water line plumbing in fore-peak connection at deck.

Must fill holes in forward bulkhead in berthing accommodation space to maintain watertight integrity.

Must provide double hose clamps for port side fuel hose in engine space.

Must properly mount and ground sanitation water pump.

Must provide double hose clamps in line for saltwater vital system.

Properly install machinery guard on generator in machinery space.

Must provide double hose clamps for starboard main belt driven pump.

Repair oil leak on starboard main engine.

Install 30x30 fuel tank vent screens.

Provide proof of current enrollment for Third Party Administrator for Drug and Alcohol Program.

Must provide at least 12 distress flares

While underway or drifting at sea, every vessel shall at all times maintain a proper look-out by sight and hearing. The designated watchmen required by 46 CFR 185.410 cannot preform both roving patrolling and look-out watch simultaneously. Vessel has been instructed to operate with a look-out and watchman while conducting drift operations.

Vessel has been identified as having various A/C electrical modifications since initial certification. Sector San Diego does not have vessels electrical plans on file or current installations do not match what we have on file. Provide a one-line electrical drawing for all A/C switchboards and distribution panels. Include all circuit loads, conductor sizes, over current protection, and max panel ratings in amps.

Electrical equipment on a vessel must be installed and maintained to protect persons and the vessel from electrical hazards. Engine room distribution panel cables had missing insulation with exposed wiring.

Portable fire extinguishers must be readily accessible for the space being protected. 01 portable extinguisher in passenger berthing area was found discharged/empty. Recharge as required to satisfaction of CG Marine Inspector prior to carrying passengers.

Install life jacket instructions at muster station.

Clean fuel out of tank room bilge.

Replace fire main piping at pump to approved materials.

Replace defective smoke detectors in bunk room.

Replace bunk room escape hatch at next drydock no later than 22Jan2021.

Prove proper operation of bilge pumping system prior to carriage of passengers.

Install 2 hose clamps on port main engine cooling hose.

Replace starboard fuel tank at next drydock exam no later than 22Jan2021.

Install pressure gauge at fire main.

Crop and renew rotten frame in way of port side shaft seal at next drydock no later than 22Jan2021.

Attach/sister port side stringer as indicated.

Several life jackets were missing retro-reflective tape, Marine Inspector had retro-reflective tape applied to several life jackets, corrected on the spot.

Two check valves were stuck. Corrected on the spot. Manual manipulation freed the valve, allowed the system to operate correctly.

Discovered numerous power strips and extension chords daisy chained together. Corrected on the spot

Marine Inspector had several hose clamps installed on fuel tank vent hose, corrected on the spot.

During inspection, Marine Inspector noticed that the navigation lights were dim, upon inspection discovered that the bulbs used were a dual filiment trailer brake light, not an approved COLREGS/ABYC navigation light. Vessel replaced with appropriate lights while Marine Inspector was onboard, corrected on the spot.

Repair damage to hull caused by anchor.

Repair indicated areas of worm shoe.

Replace 4 broken keel bolts.

Repair hole in the forepeak deck.

Repair rot on frame joint at chine in the engine room on both port & stbs side aft.

Install cover on light fixture in engine room.

Provide vessel with serviceable ring lifebuoy.

Provide segregation scheme for child/adult size PFDs

Install operable bilge high level alarm in lazaratte

Install 2 hose clamps on pedro fitting for bunk room bilge suction.

Install bilge pickup strainer in engine room.

Ensure stern light arc of visibility is 135 degrees on centerline.
