The company and the ship shall comply w/ the requirement of the ISM Code. The company should establish procedures to ensure that the ship is maintained in conformity w/ the provisions of the relevant rules and regulations. The technical and operational nature of deficiencies 02,03,04,05,06, and 07 provide objective evidence of a serious failure of the implementation of the ISM Code. 74SOLAS(20) IX/3 ISM 10.1

Hydraulic power-operated steering gear shall be provided w/ the following: A fixed storage tank having sufficient capacity to recharge at least one power actuating system including the reservoir. PSCO observed tank leaking, with only 1/4 of the required oil inside. 74SOLAS(01) II-1/29.12.3

Hydraulic power operated steering gear shall be provided w/ the following: Arrangement to maintain the cleanliness of the hydraulic fluid. PSCO observed hydraulic leaks on both #1 & #2 steering gear systems. Including #3 and #4 gear rams. 74SOLAS(01) II-1/29-12.2

The company and the ship shall comply w/ the requirements of the ISM Code. The Company should establish procedures, plans and instructions, including checklists as appropriate, for key shipboard operations concerning the safety of personnel. PSCO observed lock-out/tag-out procedures not being followed as per Company SMS procedures. #1 diesel generator was not tagged out in accordance with SMS as breaker was not tagged out in the open position and not tagged out in the open position and start air valve was not tagged out in closed position. Also #2 boiler water circ. pump was not tagged out properly as the breaker was not secured in the open position. 74SOLAS(20) IX/3 ISM 7

Indicators shall be provided for all sliding doors and for hinged doors in watertight bulkheads. PSCO observed indicators for the port watertight door from E/R to cargo tunnel not operational. Observed indicators for both port and starboard water tight doors from E/R to cargo tunnel found not operational on the bridge. 74SOLAS(01) II-1/23-1.2

Watertight trunks shall be of the same strength as watertight bulkheads at corresponding levels. The means used for making them watertight, and the arrangements adopted for closing openings in them, shall be to the satisfaction of the Administration. PSCO Observed watertight rolling door to aft engine room inoperable as designed, open, capable of only being closed with hand pump. No flag/classification society documentation could be provided allowing this type of operation. 74SOLAS(04) II-1/19.1

In a ship in which oil fuel is used, the arrangements for the storage, distribution and utilization of the oil fuel shall be such as to ensure the safety of the ship and persons onboard. PSCO Observed significant Fuel oil leaks on transfer pump following F/O bunkering, Non-approved oil catch pans in purifier space, and oil leaks with oil soaked lagging on A/E #3. 74SOLAS(97) II-2/15.2

No person may cause a vessel to enter into or get underway on the navigable waters of the United States unless no more than 12 hours before entering or getting underway, the following equipment has been tested:Primary and secondary steering gear. The test procedure includes a visual inspection of the steering gear and its connecting linkage. PSCO observed significant hydraulic oil leaks on both steering gear systems as well as insignificant oil in reserve tank during inspection after vessel was moored. Condition was not identified on vessel checklist prior to port entry. 33 CFR 164.25 (a)

Before the ship leaves port and at all times during the voyage, all life-saving appliances shall be in working order and ready for immediate use. Crew was unable to raise lifeboat on port side from embarkation back to cradle via hydraulic or manual means. 74SOLAS(97)III/19.2 60ac

1420 The condition of the ship and its equipment shall be maintained to confrom with the provisions of the present regulations to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or persons on board. Excessive fuel oil leaks were observed thrughout the engine room. The standing pools of oil caused by these leaks pose a potential fire hazard. (17A/C)

The vessel's heavy fuel oil purifier system, heavy fuel oil pump, and shaft seal lubricating system were found to be leaking oil. (17 A/C) 74 SOLAS (97 CONS. ED.) II-2/15.2

0950 All electrical apparatus shall be so constructed and so installed as not to cause injury when handled or touched in the normal manner. Multiple lighting appliances on the vessel were found with exposed wiring and missing covers. (17 A/C) 74 SOLAS (97 CONS. ED.) II-1/45.1.3

0730- Fire Fighting systems and appliances shall be kept in good working order and readily available for immediate use. Multiple hoses were found with several leaks. The vessels SMS plan mandates that all damaged and suspect hoses are to be immediately replaced. 17(c)

The shipboard incinerator failed to start during examination, even after several attempts. Vessel rectified deficiency on the spot. 10(c)

Steering Gear Hydraulic storage tank has cracks around the weld of the vent. SOLAS 74/78 as ammended CHAPT I-11. Prior to next US port after sailing foreign to the satisfaction of class/RO/RSO.

It has been reported that the vessel has experienced a temporary loss of propulsion. Provide class report concerning repairs and attesting to satisfactory operation of propulsion prior to departure.

Vessel lost control/propulsion of MDE. Provide class report to the attestation safe operation of the main diesel engine.
