A vessel that is exposed to salt water more than three months in any 12 month period since the last examination must undergo a drydock examination at least once every two years. Vessel is overdue for credit hull exam (28FEB26). Vessel must be made available for exam and receive credit dry dock prior to carrying passengers for hire. 46CFR176.600 (c)(1)

A vessel must be operated in accordance with applicable laws and regulations in such a manner as to afford adequate precaution against hazards that might endanger the vessel and the persons to be transported. Deficiencies 3, 5-13, 15, 20-25 & 29-31 provide objective evidence that the vessel is substandard and not proactively managing technical and operational requirements. Vessel must complete a satisfactory COI re-inspection prior to any movement. 46 CFR 185.100

Provisions shall be made by means of plugs, covers, etc., to prevent the admission of air into the space protected. There were no provisions for securing the ventilation openings to the engine room, rendering the fixed firefighting system ineffective. 46 CFR 181.20-35(a) (OLD CFRs)

Shutoff valves, installed so as to close against the fuel flow, shall be fitted in the fuel supply lines. The shutoff valve at the tank shall be operable from outside the tank compartment. The emergency fuel shutoff valves are covered by PVC caps. The PVC caps were seized due to excessive deck paint, rendering the shutoff valves inaccessible. 46 CFR 182.20-40(b)(3) (OLD CFRs)

A pre-engineered fixed gas fire extinguishing system must…be installed in accordance with manufacturer's instructions. The installed Fireboy system was not securely mounted on its brackets, causing the bottle to shift and nearly slip out. Continued movement likely would have engaged the activation cable, triggering the system to activate. 46 CFR 181.420(a)(4)

A vessel not required to have a power-driven fire pump by 181.300 must have at least three 2.5 gallon buckets with an attached lanyard, placed so as to be easily available during an emergency. The words “FIRE BUCKET” must be stenciled in a contrasting color on each bucket. The onboard fire buckets were wasted, cracked, missing required markings, and were under capacity at only 2 gallons. 46 CFR 181.610

Firefighting, abandon ship, and man overboard drills and training shall be logged or otherwise documented for review by the coast guard upon request. The drill entry shall include the following information: date of the drill and training and a general description of the drill scenario and training topics. Vessel did not have a logbook and was not recording any required drills and training. 46 CFR 185.520(f) & 185.524(d)

Passenger egress drills must be logged or otherwise documented for review by the Coast Guard upon request. The drill entry must include the following information: (1) Date and time of the drill; and (2) Number of drill participants. Vessel did not have a logbook and was not recording any required passenger egress drills. 46 CFR 185.507

Each buoyant apparatus must have a life line securely attached around the outside, festooned in bights no longer than 3 ft., with a seine float in each bight, unless the line is of an inherently buoyant material and absorbs little or no water. The life line must be at least 10 mm (3/8 in.) diameter and have a breaking strength of at least 1215 lb. Pendants must be fitted approximately 18 in. apart around the outside of each buoyant apparatus. Each pendant must be at least 1/4 in. diameter, at least 12 ft. long, secured in the middle, and have a breaking strength of at least 540 lb. Each pendant must be made up in a hank, and the hank secured by not more than two turns of light twine. The Life Floats pendants were installed with incorrect cords and dimensions, were improperly spaced, and several were missing. 46 CFR 160.010-4

Each battery used in an item of lifesaving equipment, except inflatable survival craft equipment, must be replaced during the annual inspection if the expiration date of the battery has passed. The water light batteries on the lifefloats were expired in 2022 and of the incorrect type. 46 CFR 185.726(d)

The grab lines shall encircle the buoy and shall be held in place by beckets. The ring life buoy's grab lines were severed in multiple locations and did not encircle the buoy. 46 CFR 160.050-4(c)

Each life jacket carried on a vessel on oceans, coastwise, or Great Lakes route, must have a life jacket light approved in accordance with §161.012 in subchapter Q of this chapter. 18 life jacket lights were expired. Some lights were expired by one year, while the majority had surpassed their expiration date by two years. 46 CFR 180.75(a)

Electrical equipment on a vessel must be installed and maintained to protect passengers, crew, and the vessel from electrical hazards, including fire and electrical shock. The vessel had numerous wiring issues which posed a major hazard to passengers and crew. The hazards identified include: various exposed and dead end wiring throughout vessel and inappropriate wire connections to include wire nuts. 46 CFR 183.200(b)

Repairs or alterations to the hull, machinery, or equipment that affect the safety of the vessel must not be made without the approval of the cognizant OCMI, except during an emergency. The vessel made unapproved repairs to the starboard bow after an allision with a dock, preventing the attending marine inspector from evaluate the extent of the damage. 46 CFR 176.700(a)

Accessories, such as switches , fuses, and sockets, shall be standard National Electrical Code types for the loads to be carried. Power strips were found throughout the vessel allowing loads to extend beyond the outlets' designed capabilities. Several extension cords were found throughout vessel as a means of permanent installation. 46 CFR 183.05-35 (OLD CFRs)

The equipment required for life floats must meet the following specifications: Each paddle must be of at least 4 feet in length, lashed to the life float to which it belongs, and buoyant. Vessel’s paddles were not secured to their respective life floats and one was broken and requires replacement. 46 CFR 180.175(f)(2)

A vessel at anchor shall exhibit where it can best be seen: In the fore part, an all-round white light. The installed anchor light was obstructed by the radar dome and the approximate arc of visibility was 180 degrees. Vessel is restricted to daylight operations only. 33 CFR 83.30(a)(i)

Where a flexible fill pipe section is necessary…Such hose shall overlap metallic pipe ends at least 1.5 times the pipe diameter and shall be secured at each end by two clamps of corrosion resistant metal…When the flexible section is a nonconductor of electricity, the metallic sections of the filling pipe separated thereby shall be joined by a conductor for protection against static spark when filling. The flexible fuel fill pipes on the port and starboard sides were missing two clamps and bonding wire to prevent static spark.46 CFR 182.15-30(d) (OLD CFRs)

At each inspection for certification and at every other vessel inspection all observed unsafe practices, fire hazards, and other hazardous situations must be corrected and all required guards and protective devices must be in satisfactory condition. The onboard freezer located in the passenger accommodation area was improperly stowed on an overhead shelf and left unsecured, posing a potential hazard to both crew and passengers. 46 CFR 176.830

Bilge suction shall be fitted with suitable strainers. The installed bilge foots were missing required strainers. 46 CFR 182.25-5(b) (OLD CFRs)

Each child size life jacket must be stowed in a location that is appropriately marked and separated from adult life jackets so the child size life jackets are not mistaken for adult life jackets. The child size life jackets were not separated from the adult lifejackets. 46 CFR 180.78(a)(5)

Life floats must not be stowed in tiers more than 4 feet high. When stowed in tiers, the separate units must be kept apart by spacers. Spacers between lifefloats were missing. 46 CFR 180.137(f)

An individual may not be engaged or employed, including self-employment, on a vessel in a position as master, operator, or person in charge for which a credential is required by law or regulation unless all crewmembers covered by this section are subject to the random testing requirements of this section. Vessel was unable to prove compliance with any DAPI requirements, including master and crew enrollment in the vessel's DAPI program and a lack of company DAPI policy. 46 CFR 16.230(k)

Each EPIRB, other than an EPIRB in an inflatable liferaft , must be tested monthly, using the integrated test circuit and output indicator, to determine that it is operative. The EPIRB test required by paragraph (a) shall be logged or otherwise documented, as applicable. Vessel was unable to provide an EPIRB testing log. 46 CFR 185.728

As appropriate for the intended voyage, a vessel must carry adequate and up-to-date: U.S. Coast Pilot [name withheld] List, and Tide Tables. The publications onboard were outdated by 6 years and inland navigation rules was missing. 46 CFR 184.420(a)

The name of a vessel must be marked or painted in clearly legible letters and numbers: (2) On each life float and buoyant apparatus. Required markings were worn and illegible. 46 CFR 185.604(a)(2)

Spaces containing machinery shall be fitted with at least 2 ducts to furnish natural or mechanical supply and exhaust ventilation. One duct shall extend to a point at the bottom of the compartment. Engine room only has one general ventilation duct located at the top entrance of the compartment. 46 CFR 182.20-45(c) (OLD CFRs)

Each ship transporting more than six passengers for hire equipped with a radiotelephone station in accordance with Part III of Title III of the Communications Act must carry a radio operator. Operator did not have an FCC radio operator permit. 47 CFR 80.159(e)

Every vessel subject to Part III of Title III of the Communications Act must have a detailed inspection of the radio installation by an FCC-licensed technician in accordance with § 80.59 once every five years. Vessel did not have a valid safety radiotelephony certificate. 47 CFR 80.903

For a vessel described by 46 CFR 175.110(c), the training program in paragraph (a) of this section must address firefighting proficiency and must include, but need not be limited to...Emergency egress training for each member of the crew, to occur for all members of the crew— (i) At least monthly while such members are employed on board the vessels; and (ii) Each time a crew member joins the crew of such vessel. The vessel had no record of a training program or emergency egress training for crewmembers. 46 CFR 185.420(b)

The master and crew of a vessel will be familiar with the content of and have mounted at the operating station, emergency instructions containing the actions to be taken in the event of fire, heavy weather, or man overboard conditions. The vessel was missing emergency instructions as listed in 46 CFR 185.512. 46 CFR 185.510(a)

Lighting fixtures shall be contrasted in accordance with the requirements of UL Inc. Standard for Marine Type Electric Lighting Fixtures. An overhead light in the E/R was missing its light bulb, globe, and protective cover. 46 CFR 183.10-20(l) (OLD CFRs)

Propulsion machinery must be suitable in type and design for propulsion requirements of the hull in which it is installed and capable of operating at constant marine load under such requirements without exceeding its designed limitations. Vessel lost propulsion while underway with passengers on board. Prior to movement, proper operation of propulsion machinery must be verified by an attending USCG Marine Inspector.

Each vessel that relies on electricity to power the following loads must be arranged so that the loads can be energized from two sources of electricity. Generator is inoperable due to a seized alternator.

The construction and arrangement of a vessel must allow the safe operation of the vessel in accordance with the terms of its Certificate of Inspection giving consideration to provisions for a seaworthy hull, protection against fire, means of escape in case of a sudden unexpected casualty, guards and rails in hazardous places, ventilation of enclosed spaces, and necessary facilities for passengers and crew. Vessel's propeller is damaged. Repair/replace propeller and conduct a satisfactory sea trial prior to movement to the satisfaction of an attending USCG Marine Inspector. 46 CFR 177.100

In systems and applications where flexible hoses are permitted to be clamped: Double hose clamping is required where practicable. Inspector found raw water intake system with single hose clamping in engine room. 46CFR182.410(d)(1)

At each inspection for certification and at every other vessel inspection the bilges and other spaces may be examined to see that there is no excessive accumulation of oil, trash, debris, or other matter that might create a fire hazard, clog bilge pumping systems, or block emergency escapes. Inspector observed bilges with excessive accumulation of oil in engine room. 46 CFR 176.830(b)

WHERE FLEXIBLE FILL PIPE SECTION IS NECESARRY, SUITABLE FLEXIBLE TUBING OR HOSE HAVING HIGH RESISTANCE TO SALT WATER, PETROLEUM OILS, HEAT AND VIBRATION, MAY BE USED. SUCH HOSE MUST OVERLAP METALIIC PIPE ENDS AT THE LEAST 1 1/2" TIMES THE PIPE DIAMTER AND MUST BE SECURTED AT EACH END BY CLAMPS. MI OBSERVED FUEL FILL PIPE MISSING HOSE CLAMPS. 46 CFR 182.445(g)

EACH VESSEL THAT OPERATES ON THE HIGH SEAS MUST HAVE ONBOARD A FCC TYPE ACCEPTED CATEGORY 1, 406 MHz EPIRB, INSTALLED TO AUTOMATICALLY FLOAT FREE AND ACTIVATE. MI OBSERVED EPIRB REGISTRATION STICKER MISSING. 46 CFR 150.64

Each vessel that operates on the high seas, or that operates beyond three miles from the coastline of the great lakes, must have an onboard a FCC type accepted category I, 406 Mhz EPIRB, installed to automatically float free & activate. EPIRB hydrostatic release is expired.

Painter. The painter must be of at lease 30.5 meters (100) feet in length, but not less than 3 times the distance between the deck where the life float of buoyant apparatus it serves is stowed. Life float painter lines is not of required length.

All fiber reinforced plastic (FRP) vessels constructed with general purpose resin must be fitted with a smoke activation fire detection system in isolated spaces that contain an ignition source. No fire detection system in galley.

Each life jacket carried on a vessel on oceans route or coastwise route must have a lifejacket light.01 lifejacket missing light.

Master shall ensure that one or more placards meeting the requirements of this section are displayed in prominent locations. No garbage placard located on the vessel.

When operational a vessel on a body of water where the discharge of untreated sewage is prohibited by the EPA, the operator must secure each type II device in a manner which prevents discharge of sewage. Vessel does not have means to secure the discharge of sewage.

Each watertight bulkhead must be of sufficient strenght to be capable of remaining watertight with a head of water. To the top of the bulkhead, water ingress from laz to E/R.

An exposed hazard, such as gears or rotating machinery, must be properly protected by a cover guard or rail. No guard around generator belt.

All equipment, including switches, fuses, lamp holders etc. must be suitable for the voltage and current utilized. Vsl battery system is plugged into the power strip.

All cables and wire must be: protected from the weather. HF antenna cable is cracked.

A vessel must carry either a first-aid kit approved under approval series 160.041 or a kit with equivalent contents & instructions. Aspirin in kit is expired.

02 permanently installed extension cords were found on the vessel, provide dedicated receptacles and properly sized boat cable for electrical loads.

Remove electrical outlet installed in the stbd head/shower, outlet is an electrical safety hazard.

Main engine sea strainers acrylic cylinder was found cracked but not leaking, replace in-kind.

Permanently secure hose that was interfering with the closure of the port fuel shutoff valve.

Sector San Diego does not have vessels electrical plans on file or current installations do not match what we have on file. Provide a one-line electrical drawing for all A/C switchboards and distribution panels. Include all circuit loads, conductor sizes, and over current protection.

While underway or drifting at sea, every vessel shall at all times maintain a proper look-out by sight and hearing. The designated watchmen required by 46 CFR 185.410 cannot preform both roving patrolling and look-out watch simultaneously.

Vessel electrical panel shall be provided with a shore tie interlock to prevent simultaneous electrical loads from going to the panel.

All emergency lighting installed shall operate in accordance with regulations. Emergency lighting install in close vicinity to the emergency exit was not working.
