1. When operating a vessel on a body of water where the discharge of untreated sewage is prohibited, the operator must secure each Type III device in a manner which prevents discharge of sewage. Acceptable methods include - (1) closing each valve and removing the handle; (2) padlocking each valve in the closed position; (3) Using a non-releasable wire tie to hold each valve in the closed position. Vessel has type III MSD system and system was not secured to prevent discharge. 33 CFR 159.7 (c)

A suitable hull strainer must be installed in the circulating raw water intake line of an engine cooling water system. Vessel did not have a raw water hull strainer installed. Install strainer. 46 CFR 182.420(a)(2)

Repairs or alterations to the machinery, or equipment that affect the safety of the vessel must not be made without the approval of the cognizant OCMI, except during an emergency. When repairs are made during an emergency, the owner, managing operator, or master shall notify the OCMI as soon as practicable after such repairs or alternations are made. Repairs or alterations that affect the safety of the vessel include, but are not limited to: replacement or repair, propulsion and systems; alterations affecting stability. The owner or managing operator shall submit written specifications describing the details of any proposed alterations to the cognizant OCMI for approval before work is started. The OCMI may require an inspection and testing whenever a repair or alteration is undertaken. Vessel main diesel engine was removed to be replaced for a new engine, without notifying USCG Inspections Office. 1. Provide specifications of existing and new engine to be installed for approval; 2. complete and submit the document Guidance for Repowering Vessels Inspected under 46 CFR Subchapter T with both engines specifications; 3. Prove proper operation of main diesel engine during sea trials prior to departure carrying passengers. 46 CFR 176.700, Code 17C.

Repairs or alterations to equipment that affect the safety of the vessel must not be made without the approval of the OCMI, except during an emergency. Repairs or alterations that affect the safety of the vessel include electrical wiring. The owner or managing operator shall submit drawings, sketches, or details of any proposed alterations to the cognizant OCMI. A new wiring diagram or electrical systems schematic is required.

Machinery space boundaries. Boundaries that separate machinery spaces from accommodation spaces, service spaces, and control spaces must be lined with noncombustible panels or insulation approved in accordance with § 164.009 in subchapter Q of this chapter, or other standard specified by the Commandant. Found that the overhead area forward of the propulsion engine was missing the noncombustible panels.46 CFR 177.410(c )(4)

02107-The discharge ends of fuel tank vent pipes must be fitted with removable flame screens or flame arresters. The flame screens must consist of a single screen of corrosion resistant wire of at least 30 × 30 mesh. The flame screens or flame arresters must be of such size and design as to prevent reduction in the net cross sectional area of the vent pipe and permit cleaning or renewal of the flame screens or arrester elements. Both the port and starboard hull fuel tank vents flame screens were partially blocked by paint.46 CFR 182.450

09112-A vessel must carry either a first-aid kit that meets the requirements in 46 CFR 199.175(b)(10) or a kit with equivalent contents and instructions. For equivalent kits, the contents must be stowed in a suitable, watertight container that is marked “First-Aid Kit”. A first-aid kit must be easily visible and readily available to the crew.46 CFR 184.710

02108-Each connection to a conductor or terminal part of a conductor must be made within an enclosure and have either: A pressure type connector on each conductor; A solder lug on each conductor. Found in the forward cabin port side that two electrical terminal blocks had stranded wire connected directly without using pressure type terminal connectors.46 CFR 183.340(g)

02108-Electrical equipment on a vessel must be installed and maintained to: Provide services necessary for safety under normal and emergency conditions; Protect passengers, crew, other persons, and the vessel from electrical hazards, including fire, caused by or originating in electrical equipment, and electrical shock; Minimize accidental personnel contact with energized parts. Found the following: ( a) Forward cabin port side, the two electrical terminal blocks and pressure type electrical connectors are corroded. Also there was no cover installed to prevent items stored in this area from shorting out the connects. (b) Under the steering console, the clip type fuse panel and pressure type electrical connectors are corroded. (c) The propulsion engine battery selector switch connections are corroded.46 CFR 183.220

CG204-Where flexible nonmetallic hose is permitted for use in piping systems by this section, it must meet SAE J-1942 (incorporated by reference; see 46 CFR 175.600) or be specifically approved by the Commandant. The following restrictions apply: Flexible nonmetallic hose must be complete with factory-assembled end fittings requiring no further adjustment of the fittings on the hose, or field attachable type fittings may be used. Hose end fittings must comply with SAE J-1475. Found no marking that fuel lines meets SAE J 1942 or had be spliced, and did not have connections meeting SAE J 1945. For all supply and return lines to the port and starboard fuel tanks. 46 CFR 172.720(g)

CG204-Shutoff valves, installed so as to close against the fuel flow, shall be fitted in the supply line, at the tank connection. Found the handle for the shutoff valve located at the starboard fuel tank was loose and could not confirm the valve closed when the valve was operated by the remote pull.46 CFR 182.20-40(b)(3)

02105-Except as further modified in this section all single screw vessel in ocean and coastwise service shall be provided with an auxiliary steering arrangement located above the weather deck. Found the auxiliary steering arrangement would not operate, there was no means to quickly disconnect the hydraulic ram from the rudder assembly.46 CFR 182.30-5(a)

11117-All vessels shall be fitted with one ring buoy of not less than 24 inches in diameter. Found following deteriorated, the line around the outside was diameter deteriorated and the retro tape. 46 CFR 180.30.5(a)

03107-A hatch exposed to the weather must be watertight, have securing devices and be attached by hinges, captive chains or other devices or substantial strength to prevent its loss. Found that the port and starboard deck hatches located in way of the operating station not have captive devices to prevent their loss. 46 CFR 179.360

04110-Each vessel must be equipped with at least two operable portable battery lights. One of these lights must be located at the operating station and the other at the access to the propulsion machinery space. Found that one of the two required portable battery lights was not operational.46 CFR 183.43

10109-The lights and shapes specified in these Rules shall comply with the provisions of Annex I of these Rules (33 CFR part 84.13(c). Found: a. The fixture used as a stern light did not meet the requirements of having an unbroken light over an arc of the horizon of 135° and so fixed as to show the light 67.5° from right aft on each side of the vessel. b. The means of turning on all around light (anchor light)is not separate from the rest of the navigation lights.46 CFR 183.43

02108-All electrical equipment and circuits must be clearly marked and identified. The individual fuses for the fuse panel were not marked showing load being serviced. Located on forward end, under the steering console.46 CFR 183.200(d)

The marine employer must have a sufficient number of alcohol detecting testing devices readily accessible on board the vessel to determine the presence of alcohol in the system of each individual who was directly involved in the Serious Marine Casualty. Alcohol detecting swabs on board were found to be expired in YR2021, and lacking on an additional swab as one master and two deckhands are currently operating this vessel. Obtain an approve alcohol breathalyzer and/or current not expired alcohol swabs for all crew. 46CFR06-15

An Employee Assistance Program (EAP) must be conducted for the employer’s crewmembers and supervisory personnel. The training program must include at least the following elements: The effects and consequences of drug and alcohol use on personal health, safety, and work environment; the manifestations and behavioral cues that may indicate drug and alcohol use and abuse; and documentation of training given to crew members and employer’s supervisory personnel. Supervisory personnel must receive at least 60 minutes of training. Conduct an Employee Assistance Program training at all levels (master, deckhands and management supervisory level) and provide evidence of training.

For each marine casualty required to be reported by 46CFR185.202, the vessel owner, master, or person in charge of the vessel shall determine whether there is any evidence of alcohol or drugs use by the individuals directly involved in the casualty. The owner, master or person in charge of the vessel shall include in the written report, Form CG-2692. Vessel captain failed to answer the correct reporting procedures in accordance of the regulation in how much time a alcohol or drug testing must be conducted after a marine casualty. Vessel captain must be trained and demonstrate knowledge in what are the conditions of a reportable marine casualty and timeframe for drug and alcohol testing for the satisfaction of an attending USCG Marine Inspector. 46CFR185.210.

All vessels must carry adequate and up-to-date nautical charts. Vessel was found to have a nautical chart without evidence of being updated since 2007. Update nautical chart in accordance with all changes as provided in the publication called Noticed to Mariners. 46 CFR 185.20-35.

Prepare and post emergency check-up list in a conspicuous place accessible to crew and passengers. Emergency checkup list may follow the recommended format in accordance with 46 CFR 185.25-5. Vessel was found not having posted emergency instructions or checkup list. Provide emergency instructions and post it in a conspicuous place accessible for passengers and crew. 46CFR185.25-1 and 46CFR185.25-5.

A vessel on which a pre-engineered fixed gas fire system is installed must have a light to indicate discharge and an audible alarm that sounds upon discharge at the operating station. USCG Marine Inspector found that the visual light to indicate discharge was not operational. Replace the visual alarm and prove proper operation during testing of the system for the satisfaction of an attending USCG Marine Inspector. 46 CFR 181.420 (4)(b)(1).

A hatch exposed to the weather must be weathertight and have securing devices. The following were found not to be weathertight and missing securing devices: a. forward hatch in front of the accommodation space, which is forward of the operating station; and b. center window right of the operating station.

Compliance in all weathers. Rules concerning lights and shapes a vessel is required to have sidelights, means a green light on the starboard and a red light on the portside, a sternlight means a white light placed as nearly as practicable at the stern. Day shapes must have a ball, diamond, ball configuration. Vessel’s current navigation red and green lights lens was found faded by UV exposure, and sternlight inoperable. In addition, vessel did not have on board any dayshapes. Replace both red and green, and sternlight navigation lights with an approved type, and provide the day shapes. 33CFR83.20

As appropriate for the intended voyage, a vessel must carry adequate and up-to-date: Charts of large enough scale to make safe navigation possible; U.S. Coast Pilot or similar publication.

Requirements of the Federal Communications Commission. A vessel must comply with the applicable requirements for any radio and Electronic Position Indicating Radio beacon (EPIRB) installations, including the requirements for a station license and installation certificates to be issued by the Federal Communications Commission, as set forth in 47 CFR part 80. MMSI # Does not match up to certificate.

All fuel tanks must be electrically bonded to a common ground. STB Side fuel tank not grounded.

A hatch exposed to the weather must be watertight. Deck foaming has a 26” soft/water logged wood.

The marine inspector may require any part or all of the propeller shafting to be drawn for examination of the shafting and stern bearing of a vessel whenever the condition of the shafting and bearings are in question. Change clamps for shaft packing glans.

Pre- engineered fire extinguishing systems must have a means to reset device used to automatically shut down the engine. Engine override switch does not operate. Vessel is restricted from carrying passengers.

Each disposable hydrostatic release unit must be marked with an expiration date of two years after the date on which the unit Hydrostatic release for EPRIB is expired.

At each vessel inspection the bilges and other spaces may be examined to see that there is no excessive accumulation of oil, trash, debris, or other matter that might create a fire hazard or clog bilge pumping systems. Wiring in engine space is not secured and rests in the bilge.

All vessels must have navigation lights that are in compliance with the applicable sections of the International and Inland Navigation Rules. Railings block the visibility of port and starboard navigational lights. Navigational lights need to be in a location that does not prohibit the visibility and intensity of navigational lights.

The connection fittings on the non-metallic hoses for the oil cooler for the transmission are severely corroded and require replacement in accordance with regulations.

In systems where flexible hoses are permitted to be clamped, two clamps must be used at each end of the hose. Flexible hose on engine cooling line needs to be readjusted and double clamped onto the though hull valve.

As appropriate for the intended voyage, a vessel must carry adequate and up-to-date Coast Guard Light list and tide tables. Light list and tide tables for area of operation are out of date.

Prove proper operation of engine room pre-engineered fire fighting system. Install proper sytem, the bottle is fyrework and the override switch is fireboy.

properly install emergency steering.

Replace 7 lifejackets. Vessel is restricted to 20 passengers until sufficient amount of approved preservers are provided.

Install approved marine grade fuel strainer. 46 CFR 182.455.

Program MMSI number in VHF-DSC Radio.

Provide 160.041 approved first aid kit and remove all expired items from the vessel.
