When operating on a body of water where the discharge of treated or untreated sewage is prohibited by the EPA under 40 CFR 140.3 or 140.4, the operator must secure each type I, II, or III marine sanitation device (MSD) in a manner which prevents discharge of treated or untreated sewage. Acceptable methods of securing the device include: 1) closing the seacock and removing the handle, 2) padlocking the seacock in a closed position, or 3) using a non-releasable wire-tie to hold the seacock in the closed position. The valve on the line from the MSD to overboard was not properly secured.

The owner, managing operator, or a qualified servicing facility as appropriate shall conduct the following inspections and tests: for portable fire extinguishers, the inspections, maintenance, and hydrostatic pressure tests required by Chapter 4 of NFPA 10, with the frequency specified in NFPA 10. The last visible hydrostatic test date stamped or otherwise marked on the 15 lb CO2 portable extinguisher in the engine room is February 2013. NFPA 10 requires hydrostatic testing of portable CO2 extinguishers at 5 year intervals.

Vital systems: mechanically propelled ‘S’ vessels which carry more than 49 passengers shall comply with the provisions of Subchapter F of this chapter. Nonmetallic flexible hose must be in accordance with SAE J1942. Nonmetallic flexible hose may be used in vital fresh and salt water systems in lengths not exceeding 30 inches. There is a 4-5 foot section of flexible hose in the fire main supply piping in the engine room. The hose is connected via double hose clamps.

They shall be so constructed that, if subjected to the standard fire test, they would be capable of preventing the passage of smoke and flame for 1 hour. In addition, they shall be so insulated with approved structural insulation. The engine room was missing insulation on the overhead in numerous areas. 46 CFR 177.10-5 "Old T" 46 CFR 72.05-10(c)(1)
