Each survival craft must be: Secured to the vessel by a painter with a float-free link permanently attached to the vessel except that a float-free link is not required if the vessel operates only on waters not as deep as the length of the painter. The inflatable buoyant apparatus was not secured to the vessel with a painter line.

Fuel lines must be accessible, protected from mechanical injury, and effectively secured against excessive movement and vibration by the use of soft nonferrous metal straps which have no sharp edges and are insulated to protect against corrosion. The fuel vent line on the vessel was ruptured.

Shutoff valves, installed so as to close against the fuel flow, must be fitted in the fuel supply lines, one at the tank connection and one at the engine end of the fuel line to stop fuel flow when servicing accessories. The shutoff valve at the tank must be manually operable from outside the compartment in which the valve is located, preferably from an accessible position on the weather deck. The fuel shut off valve for the auxiliary fuel tank did not close completely.

Vessels operated beyond the 20 nautical mile limitation specified in paragraph (a)(1) of this section, but not more than 100 nautical miles from the nearest land, must be equipped with a MF–DSC frequency transmitter meeting the requirements of § 80.1101(c)(3) and capable of transmitting J3E emission and a receiver capable of reception of J3E emission within the band 1710 to 2850 kHz, in addition to the VHF–DSC radiotelephone installation required by paragraph (a)(1) of this section. The VHF radio on board the vessel did not include the correct MMSI number. 46 CFR 80.905 (3)(i)

Where rigid nonmetallic material (plastic) is permitted for use in piping systems by this section, the following restrictions apply: Through hull fittings and shutoff valves must be metallic. In the case of nonmetallic hulls, materials that will afford an equal degree of safety and heat resistivity as that afforded by the hull may be approved. The vessel had a plastic through hull fitting on the starboard side.

As appropriate for the intended voyage, a vessel must carry adequate and up-to-date: U.S. Coast Pilot or similar publication; Coast Guard Light List. The vessel had an out-dated Light List and Coast Pilot on board.

All electrical equipment and circuits must be clearly marked and identified. The 24 Volt DC distribution panel in the operating station needs to be labeled.

Electrical equipment on a vessel must be installed and maintained to: Minimize accidental personnel contact with energized parts. The vessel had dead end wires in the operating station and battery void.

Each distribution panel or switchboard must be totally enclosed and of the dead front type. Dead front covers were missing on the 24 Volt DC and 120 Volt AC distribution panels in the operating station.

EAP traning program: An EAP training program must be conducted for the employer's crewmembers and supervisory personnel. The training program must include at least the following elements: the effects and consequences of drug and alcohol use on personal health, safety, and work environment; the manifestations and behavioral cues that may indicate drug and alcohol use and abuse; and documentation of training given to crewmembers and the employer's supervisory personnel. Supervisory personnel must receive at least 60 minutes of training. The Discovery Whale Watch company did not have a designated/trained EAP SUpervisor/Designated Employer Representative (DER), and was not providing employees with the requoired EAP education and training program. Provide proof of training for at least supervisory personnel and all crew.

A vessel must comply with the applicable requirements for any radio and Electronic Position Indicating Radiobeacon (EPIRB) installations, including the requirements for a station license and installation certificates to be issued by the Federal Communications Commission, as set forth in 47 CFR part 80. Each ship transporting more than six passengers for hire equipped with a radiotelephone station in accordance with Part III of Title III of the Communications Act must carry a radio operator who meets the following requirements: Where the station power does not exceed 250 watts carrier power or 1500 watts peak envelope power, the radio operator must hold a marine radio operator permit or higher class license. Vessel master to obtain Marine Radio Operator Permit (or higher) and provide documentation to the satisfaction of the Marine Inspector. 46 CFR 184.502 / 47 CFR 80.159(e)(1)

As appropriate for the intended voyage, a vessel must carry adequate and up-to-date: charts or large enough scale to make safe navigation possible. Vessel has outdated navigation charts.

Remote fuel shutoff stations must be marked in clearly legible letters at least 25 millimeters (1 inch) high indicating purpose of the valve and direction of operation. Vessel has missing labels for two fuel shutoff valves.

A vessel not required to have a power driven fire pump by 181.300 must have at least three 2.5 gallon buckets, with an attached lanyard placed so as to be easily available during an emergency. The words "FIRE BUCKET" must be stenciled in a contrasting color on each bucket. Vessel has missing fire buckets.

The discharge ends of vent pipes shall be fitted with removable flame screens or flame arresters. The flame screen shall consist of a single screen of corrosion resistant wire of at least 30x30 mesh. The flame screens or arresters shall be of such size and design as to prevent reduction in the net cross-sectional area of the vent pipe and permit cleaning or renewal of the flames screens or arrester elements. Vessel has one missing flame screen and one flame screen bigger than 30x30 mesh.

Ventilation of spaces containing diesel machinery. Provision must be made for closing all supply duct cowls or scoops and exhaust duct discharge openings for a space protected by a fixed gas extinguishing system. All closure devices must be readily available and mounted in the vicinity of the vent. Vessel has multiple vent closures that are inoperable.

Vessels shall be inspected for compliance with the standards required by this subchapter. For items not covered by standards in this subchapter, inspection shall be in accordance with standards acceptable to the Officer in Charge Marine Inspection as good marine practice. Vessel has light fixture on port side in engine room that is loosely fixed to the overhead.

Each survival craft must be secured to the vessel by a painter with a float free link. Vessel's IBA had an improperly rigged Bowsing Line.

A visual and audible high water level alarm must be provided for ach of the following unmanned spaces: shaft alley bilge. Vessel's high level water alarm for the lazarette did not work.

A hydrostatic release unit when used in a float free arrangement must be approved under 46 CFR 160.062 or 160.162. Vessels float free link did not have it's installation/expiry date marked on it.

An adult lifejacket must be carried for each person on board a vessel. Vessel has 30 adult kapok life jackets the need replacement. Reduced passenger count to 16 adults, 5 children, and 2 crew until life jackets are replaced.

The master of the vessel shall ensure each EPIRB must be tested monthly and logged. Vessel needs to update it's log book to relect the completion of drills and tests.

Both port and starboard props have clusted pitting located on the hub. Props need to be set the propeller shop to assess ability to grind and repair propellers. If unable to conduct repairs on the propellers both propellers will need to be replaced.

Fill 8 holes between engineroom and battery room with fire rated material.

Fuel fill pipes must terminate at the weather deck so as not to allow the overflow of liquid or vapors into the inside of the vessel. 46 CFR 182.20-30

Provide guards to the front of both main propulsion engines to protect from personnel injuries. 46 CFR 182.01-5

Two B-II fire extinguishers located outside in a box on the aft bulkhead were not mounted in brackets required by manufacturer. Both extinguishers were secured with a bungee cord to an eye screwed into the storage box.

The battery in the water light was not approved for use in the water light in accordance with manufacturer’s instructions. Part number was off by one number on Rayvac battery

Fuel and oil hoses contain unprotected non corrosion resistant fittings.

Examined forward bulkhead of Engine Room space and found bulkhead wire penetrations to be inadequately sealed to prevent water and/or vapor to exit from the space. Wire run was wrapped in a rubber gasket material and screwed to the bulkhead.
